LIMITED LICENSE TO ENTER AGREEMENT <br /> THIS LIMITED LICENSE TO ENTER AGREEMENT ( Agreement") is made and <br /> entered into this 6th day of July, 2020 ( Effective Date") by and between on the one hand, Allen <br /> H Ginsburg & Charlotte A Ginsburg, husband and wife (the Ginsburgs" or `Owner") and on <br /> the other hand,the City of Rancho Palos Verdes, a California municipal corporation( City") City <br /> and Owner may be referred to, individually or collectively, as Party" or Parties." <br /> RECITALS <br /> A. The Ginsburgs are the owner of that certain real property commonly known as 5500 Palos <br /> Verdes Drive South in the City of Rancho Palos Verdes, County of Los Angeles(APN No <br /> 7572-019-005), legally described in Exhibit "A" attached hereto and incorporated herein <br /> by this reference ( Owner's Property") <br /> B. City is the owner of that certain real property commonly known as 5970 Palos Verdes <br /> Drive South in the City of Rancho Palos Verdes, County of Los Angeles (APN Nos 7572- <br /> 018-900 and 7572-019-900), legally described on Exhibit "B" attached hereto and <br /> incorporated herein by this reference ( City's Property") <br /> C. City's Property and Owner's Property are located in the Abalone Cove Reserve (the <br /> Reserve"),one of the ecological reserves within the Palos Verdes Nature Preserve located <br /> in the City and managed by the Palos Verdes Peninsula Land Conservancy ( PVPLC") <br /> D. In May 2015,the Ginsburgs performed unpermitted grading work that impacted the natural <br /> vegetation in certain areas of City's Property and Owner's Property in the Reserve <br /> E. On December 12, 2017, the Planning Commission adopted Resolution No 2017-45 and <br /> Resolution No 2017-46, attached hereto in Exhibit "C" and incorporated herein by this <br /> reference (collectively, ' Resolutions"), certifying a Mitigated Negative Declaration <br /> (MND) and approving an After-the-Fact (ATF) Major Grading Permit and Coastal <br /> Development Permit to regrade the areas of the Owner's Property and the City's Property <br /> where unpermitted grading occurred in the Reserve <br /> F. As part of the Conditions of Approval of Planning Commission Resolution No 2017-46, <br /> Condition No 41, required the Applicant to revegetate the City's impacted habitat and pay <br /> a mitigation fee in order to address the habitat loss caused by the unpermitted grading <br /> G. The Ginsburgs have deposited $76,525 into a Trust Deposit account with the City for the <br /> performance of the revegetation work to address habitat loss caused by the unpermitted <br /> grading <br /> H. The City has contracted PVPLC to perform the revegetation work, which shall consist of <br /> the installation of an irrigation system, planting of vegetation, and maintenance and <br /> monitoring in the areas of the City's Property that were impacted by the unpermitted <br /> grading work in the Reserve ( Habitat Restoration Project"or Project") <br /> 01203001h/633285 I Itt 1 <br />
