On April 19 the City Manager confirmed for the College that all expenses were <br />exclusively related to Measure P. The College will pay these expenses. We request <br />twenty minutes to make a payment presentation to the Council at a council meeting in <br />June. <br />Given comments made by Council members and the City Attorney in Council meetings, in <br />the press, and via email (attached) over the last year, the College requests that the City <br />submit a contract or a donor pledge agreement to Marymount. The City Attorney has <br />offered contradictory comments on the requirements of this payment and her newspaper <br />comments in December troubled the College. There can be no question about whether <br />this was a contractual obligation or a donation. There also can be no question that <br />Marymount ever wavered from its commitment: Payment will be made after one of these <br />documents is signed by the City and the College. <br />The contract or pledge agreement needs to include the following information: <br />In the case of a contract, how the determination was made that this was a <br />contractual agreement. <br />The date the Council accepted the donation or confirmed the contractual <br />agreement and the City Council meeting minutes that document this action. <br />A statement by the City Council that the College never withdrew its <br />commitment to pay Measure P election expenses. <br />A review by the City Attorney of Councilman Stern's actions (documents <br />attached) in early December and his comments in the press regarding the <br />College's commitment to pay Measure P election expenses. <br />A statement from the City that no city resources were used in the Measure P <br />political campaign, especially as it relates to Councilman Stern's actions <br />(documents attached) in March 2010.
