City Council Minutes of December, 20, 2016 (page A-1) <br />BACKGROUND AND DISCUSSION: <br />California Health & Safety Code Section 4730 provides in part that "[t]he governing body <br />of a sanitation district is a board of directors of not less than three members. The <br />presiding officer of the governing body of each city, the whole or part of which is <br />included in the sanitation district, is a member of the board.... The governing body of <br />each city ... shall each select one of its members, other than its presiding officer, as an <br />alternate director to act as a member of the district board in place of the presiding officer <br />... during such person's absence, inability, or refusal to act." [emphasis added] <br />At the City Council Meeting on December 20, 2016, the Mayor appointed and the City <br />Council affirmed Councilwoman Brooks as the City's Director and Councilman Misetich <br />as the City's Alternate Director to the Boards of Sanitation District No. 5 and the South <br />Bay Sanitation District. This action is confirmed by the Minutes of that meeting <br />(Attachment A). We know that Council Member Brooks was willing to serve in this <br />capacity, but we have not spoken with the Mayor as to why he chose to make this <br />1 <br />
