MEMORANDUM OF UNDERSTANDING <br /> BETWEEN PALOS VERDES PENINSULA UNIFIED SCHOOL DISTRICT, <br /> CITY OF RANCHO PALOS VERDES AND <br /> CITY OF ROLLING HILLS ESTATES <br /> FOR USE OF POOL FACILITIES <br /> THIS MEMORANDUM OF UNDERSTANDING (MOU) is made and entered into this 27th <br /> day of June, 2019 ("Effective Date"), by and between the Palos Verdes Peninsula Unified School <br /> District (hereinafter "School District"), a California public school district duly organized and existing <br /> under Chapter 1 of Division 3 of Title 2 of the Education Code of the State of California, as well as the <br /> City of Rolling Hills Estates and the City of Rancho Palos Verdes (hereinafter "Cities"), both municipal <br /> corporations (individually a"Party" and collectively"the Parties"). <br /> RECITALS <br /> WHEREAS, School District owns property located at 27118 Silver Spur Road, Rolling Hills <br /> Estates CA 90274-2300, known as Palos Verdes Peninsula High School ("School Site"); <br /> WHEREAS, a pool and related facilities ("Pool Facilities") are located at the School Site; <br /> WHEREAS, the Cities and their affiliates have had access to the Pool Facilities to offer City- <br /> sponsored summer swim programs, and the community at large, beyond School District teams or City <br /> related programs, have had some additional access to the Pool Facilities; <br /> WHEREAS, the current MOU between the Cities and the School District expired on January 31, <br /> 2019. <br /> WHEREAS, the Cities and the School District desire to implement a new MOU for the time <br /> period from June 1, 2019 through May 30, 2024. <br /> NOW, THEREFORE, the Parties hereto agree as follows: <br /> Section 1. A satellite map depiction of the Pool Facilities subject to this MOU is attached <br /> hereto as Attachment"A". <br /> Section 2. School District programs and students, and groups licensed by the School District <br /> to use the Pool Facilities shall have priority use of the Pool Facilities at all times. <br /> Section 3. Subject to Section 2 above, School District agrees that, to the greatest extent <br /> possible, it will make the Pool Facilities available for City-sponsored summer swim programs during the <br /> term of this MOU to a similar extent as it has in the past, as described in Attachment"B". <br /> Section 4. The cost to be charged to the Cities for the use of the pool facility will be $25.00 <br /> (twenty five) dollars per hour which is, to help defray District operational costs. This rate is half of the <br /> non-profit pool use rate in effect for any approved non-profit group, which is currently $50.00 (fifty <br /> dollars)per hour. <br /> 1 <br />
