MEMORANDUM OF AGREEMENT <br /> TORRANCE AIRPORT STORM WATER INFILTRATION PROJECT <br /> STAKEHOLDER GROUP <br /> PRELIMINARY DESIGN WORK COST SHARING AGREEMENT <br /> This Memorandum of Agreement ("MOA") is made, entered into, as of the date of <br /> the last Party signature set forth ("Effective Date"), by and among the City of Torrance, a <br /> municipal corporation ("Torrance"); the City of Palos Verdes Estates, a municipal <br /> corporation ("Palos Verdes Estates"); the City of Rolling Hills, a municipal corporation <br /> ("Rolling Hills"), the City of Rolling Hills Estates, a municipal corporation ("Rolling Hills <br /> Estates"); the City of Rancho Palos Verdes, a municipal corporation ("Rancho Palos <br /> Verdes"); and the County of Los Angeles ( "County"), a political subdivision of the State <br /> of California; (each, individually a "Party," and collectively, "Parties"), with respect to the <br /> following: <br /> RECITALS <br /> c-) <br /> A. WHEREAS, the U.S. Environmental Protection Agency (USEPA) and the <br /> California Regional Water Quality Control Board, Los Angeles Region (Regional Board) <br /> have classified the Greater Los Angeles County Municipal Separate Storm Sewer <br /> System Permit (MS4) as a large MS4 pursuant to 40 CFR section 122.26(b)(4) and a <br /> major facility pursuant to 40 CFR section 122.2; and <br /> B. WHEREAS, the Regional Board adopted National Pollutant Discharge p• <br /> Elimination System Municipal Separate Storm Sewer System Permit Order No. R4- <br /> 2012-0175 as amended by State Water Board Order WQ 2015-0075 and Los Angeles <br /> Water Board Order R4-2012-0175-A01 (MS4 Permit); and <br /> C. WHEREAS, the MS4 Permit became effective on December 28, 2012, and <br /> requires that the LACFCD, the COUNTY, and 84 of the 88 cities (excluding Avalon, <br /> Long Beach, Palmdale, and Lancaster) within the County comply with the prescribed <br /> elements of the MS4 Permit; and <br /> D. WHEREAS, the Regional Water Quality Control Board, Los Angeles Region <br /> adopted an amendment to the Water Quality Control Plan for the Los Angeles Region <br /> incorporating a Total Maximum Daily Load ("TMDL") for Nutrients in Machado Lake, with <br /> an effective date of March 11, 2009; and <br /> E. WHEREAS, the Regional Water Quality Control Board, Los Angeles Region <br /> adopted an amendment to the Water Quality Control Plan for the Los Angeles Region <br /> incorporating a TMDL for Pesticides and PCBs in Machado Lake, with an effective date <br /> of March 20, 2012; and <br /> 00158762.docx -1- <br /> LA#4848-0897- <br /> 9810 v1 <br />
