r <br /> IP <br /> • AMENDED AND RESTATED AGREEMENT BETWEEN <br /> THE CITY OF RANCHO PALOS VERDES AND THE <br /> PALOS VERDES PENINSULA LAND CONSERVANCY, A <br /> NON-PROFIT ORGANIZATION, TO JOINTLY OPERATE <br /> AND MAINTAIN A TRACT OF LAND KNOWN AS THE <br /> FORRESTAL NATURE PRESERVE AND TO CONDUCT <br /> ENVIRONMENTAL EDUCATION PROGRAMS, TOURS, <br /> AND EVENTS THAT WILL ENCOURAGE <br /> PARTICIPATION IN THE PASSIVE RECREATIONAL USE <br /> OF THE PRESERVE AS AN OPEN SPACE COASTAL <br /> NATURE PRESERVE AND AUTHORIZE THE USE OF <br /> PRIVATELY AND PUBLICLY RAISED FUNDS FOR THE <br /> UPGRADING AND ENHANCEMENT OF THE PRESERVE <br /> FOR USE BY THE PUBLIC AND TO ENHANCE AND <br /> PROTECT HABITAT AND SPECIES LOCATED <br /> THEREON. <br /> This Document is an Operating Agreement (hereinafter, "the Agreement") <br /> executed in the City of Rancho Palos Verdes (hereinafter"the City"), which is <br /> effective as of this 15th day of March , 2005, by and <br /> between the City and the Palos Verdes Peninsula Land Conservancy (hereinafter <br /> "PVPLC" or"the Conservancy"), a non-profit organization. This Agreement <br /> supercedes the prior agreement between the City and the Conservancy, which <br /> was entered into on June 5 , 2001. <br /> 1. DESCRIPTION OF THE PROPERTY <br /> The Preserve, (hereinafter"the Premises" or"the Preserve") is described <br /> in Exhibit "A," which is attached hereto and incorporated herein by this reference. <br /> The Preserve is located at the terminus of Forrestal Drive. <br /> 2. PURPOSE <br /> The purpose of the Agreement is to authorize the Conservancy, jointly <br /> with the City, to manage and maintain the Preserve subject to the following: <br /> A. The City has completed the Forrestal Management Plan <br /> (hereinafter " the Plan"). The Plan specifies a variety of <br /> management objectives and functions that are to be completed in <br /> the future. The Plan is hereby incorporated herein by this reference, <br /> and a copy is attached hereto as Exhibit "B". The goals and <br /> objectives defined in the Plan include four broad categories of <br /> activities that will be described as: 1) administration 2) public <br /> works/public safety; 2) habitat enhancement/vegetation <br /> management and 3) recreation management. <br /> 800905.4 <br />
