4 1 <br /> • <br /> AGREEMENT BETWI N THE CITY OF RANCHO PALOS <br /> VERDES AND THE PALOS VERDES PENINSULA LAND <br /> CONSERVANCY, A NON-PROFIT ORGANIZATION,TO <br /> JOINTLY OPERATE AND MAINTAIN A TRACT OF LAND <br /> KNOWN AS THE FORRESTAL NATURE PRESERVE AND <br /> TO CONDUCT ENVIRONMENTAL EDUCATION <br /> PROGRAMS, TOURS, AND EVENTS THAT WILL <br /> ENCOURAGE PARTICIPATION IN THE PASSIVE <br /> RECREATIONAL USE OF THE PRESERVE AS AN OPEN <br /> SPACE COASTAL NATURE PRESERVE AND AUTHORIZE <br /> THE USE OF PRIVATELY AND PUBLICLY RAISED FUNDS <br /> FOR THE UPGRADING AND ENHANCEMENT OF THE <br /> PRESERVE FOR USE BY THE PUBLIC AND TO ENHANCE <br /> AND PROTECT HABITAT AND SPECIES LOCATED <br /> THEREON. <br /> This Document is an Operating Agreement (hereinafter, "the Agreement") <br /> executed in the City of Rancho Palos Verdes (hereinafter"the City"), which is effective <br /> as of this 5th day of June , 2001, by and between the City and <br /> the Palos Verdes Peninsula Land Conservancy(hereinafter"the Conservancy"), a non- <br /> profit organization. <br /> WHEREAS, the Conservancy submitted a written proposal to the City to <br /> manage, maintain and operate certain aspects of the Forrestal Nature Preserve <br /> (hereinafter"the Preserve"); and <br /> WHEREAS, the Conservancy was recommended to the City Council by City <br /> staff to jointly manage the Preserve with the City as an open space, coastal land resource <br /> and passive recreational park, and; <br /> WHEREAS, the Conservancy is a non-profit organization dedicated to the <br /> preservation and maintenance of open space for recreational, ecological and educational <br /> purposes and is qualified to conduct native habitat restoration and improvement, to <br /> manage passive recreational facilities, such as open space and trails, and to implement <br /> educational and interpretive programs at the Preserve; and <br /> WHEREAS, the Conservancy has requested that the City enter into a long-term <br /> joint operating agreement in order to raise public and private funds to upgrade and <br /> enhance and jointly maintain the Preserve for the City for the use, enjoyment and benefit <br /> of the general public; and <br /> WHEREAS, the Conservancy has the experience and capabilities to promote, <br /> finance, revegetate, maintain, and operate such environmental and recreational facilities <br /> for the benefit and enjoyment of the general public; <br /> 654461.4 <br />
