FISCAL IMPACT: Funding to prepare the Engineer’s Report in the amount of $18,000 is included in the approved FY 2025-26 budget. The Engineer’s Report is required to be prepared each year regardless of whether the City elects to levy and collect assessments until the LLMD is dissolved. The total expenditures eligible for the LLMD are estimated at $2,121,281 for FY 2026-27, which are included in the FY 2026-27 Draft Budget. Of this amount, $381,126 would be funded from LLMD Fund from collected revenues, $32,304 from LLMD Fund Balance, $486,100 from the 1911 Act Fund, and $1,221,751 from General Fund, Gas Tax 1972 Act Landscape/Lighting, and Measure M. The May 19, 2026 Staff Report stated that the total eligible expenditures for the LLMD were estimated at $2,228,281. However, the correct total eligible expenditures are $2,121,281. Staff incorrectly included $111,500 from the Waste Reduction Fund as an eligible expenditure, even though this amount was not included in the budget analyzed in the Engineer’s Report. Staff also inadvertently omitted $4,500 for Median Utilities as an eligible expenditure. The purpose of forming the LLMD was to provide funding for the ongoing operation, maintenance, and servicing of landscaping, street trees, irrigation systems, hardscapes, sidewalks, streetlights, and traffic signals in City rights-of-way and dedicated easements. The LLMD is funded through assessments 2 on properties citywide. In accordance with 1972 Act requirements, each parcel is assessed an amount based on the relative benefit the parcel receives from the LLMD’s operations rather than the parcel’s assessed value (Attachment E). To ensure a fair and equitable sharing of LLMD costs, the City conducts an annual review of an Engineer’s Report wherein the current year’s expenses are reviewed, the ensuing year’s expenses are budgeted, and the assessment for each parcel in the ensuing fiscal year is set. In setting the annual assessment, the City Council will consider any proposed new improvements or any changes in existing improvements, any fund balances or shortages, and adjust the assessment accordingly. Payment of the assessment for each parcel is made in the same manner and at the same time payments are made for property taxes for each property. The LLMD annual levy ranged from $49.99 per parcel for single family residences (approximately 94% of properties Citywide) at inception on August 6, 1992 to $23.50 in FY 1997-98. Beginning in FY 1998-99, the annual levy was set to $20.38 per parcel for single-family residences, resulting in an annual revenue of approximately $333,000. On June 21, 2005, the City Council decided to fund streetlight and traffic signal operation and maintenance costs using a different fund, the 1911 Act Lighting and Maintenance District Fund (1911 Act Fund) rather than LLMD funds. Staff presumes that the City Council made this decision because of an adequate 1911 Act Fund balance for operation and maintenance of streetlights and traffic signals and the desire to reduce the overall tax burden on residents. Accordingly, the City Council reduced the LLMD assessment rates by $4.46 and annual levy was set to $15.92 per parcel for most of the single-family residences. The 1911 Act Fund continues to collect revenues and pay for costs associated with the installation, operation, and maintenance of streetlights and traffic signals. This annual revenue has been, and is projected to continue to be, sufficient to cover the typical annual expenses for installing, operating, and maintaining the City’s streetlights and traffic signals. On May 16, 2017, the City Council set the LLMD rate to zero, which means property owners were not assessed. The rate had been set to zero in each subsequent year until FY 2025-26, when a levy was reinstated (as discussed later in this report). This means that alternate funds were being used to pay costs that could otherwise have been funded through the LLMD. Moreover, by setting the assessment at zero rather than sunsetting the LLMD, it enabled the City Council to reconsider levying an assessment up to the rate at the time Proposition 218 (Prop 218) went into effect as discussed later in this report On June 6, 2023, during the City Council’s annual consideration of the LLMD, the City Council directed Staff to bring LLMD assessment options for the City Council’s consideration during the time that the FY 2024-25 Budget was being developed so that the City Council’s direction on assessments can be incorporated into budget calculations prior to finalizing the budget. 3 On April 16, 2024, Staff presented the City Council with LLMD assessment rate options for setting the FY 2024-25 assessment rates. At the conclusion of the meeting, the City Council directed staff to initiate proceedings and prepare an Engineer’s Report setting the LLMD rate to zero. On April 15, 2025, Staff presented the City Council with assessment rate options for setting the FY 2025-26 assessment rates. At the conclusion of the meeting, the City Council directed Staff to reinstate the assessment at rates ranging from $9.94 to $49.17 ($23.50 for most parcels); which were the rates in effect on July 1, 1997, i.e. the rates effective on the date of Prop 218. On May 19, 2026, the City Council adopted Resolution No. 2026-37 (Attachment C) initiating proceedings for the annual levy of assessments, ordering an Engineer’s Report, and setting a date for a public hearing to consider the levy in effect on July 1, 1997 which is exempt from the requirements of Proposition 218 because the initial assessment predates the effective date of Proposition 218. The City hired NBS Government Finance Group (NBS) to prepare an Engineer’s Report which includes a methodology for apportioning assessments based on relative benefit. The Engineer’s Report classifies areas within the City into various zones which, by reason of variations in the nature, location, and extent of the proposed activities and improvements, receive differing degrees of benefit from the operation of the LLMD. DISCUSSION: Apportionment of Assessments The FY 2026-27 Engineer’s Report (Attachment B) classifies areas within the City into seven various zone diagrams which receive differing degrees of benefit from the operation of the Citywide LLMD. Depending on which zone a parcel is located within, the proposed annual assessment for a parcel with a single-family home ranges from $9.94 to $49.17, with most parcels (approximately 94% Citywide) receiving an annual assessment of $23.50. In all seven zones within the City, the proposed assessments for FY 2026-27 are the same as the assessments levied on July 1, 1997 and would total $381,126 in revenue. An increase above this amount to recover LLMD expenses would require the City Council to undertake the notice and protest procedures in compliance with Proposition 218. Proposition 218 process involves the following and should be completed in time to meet Los Angeles County’s August 10th deadline to be collected on the tax rolls, if approved: • Preparation of an Engineer’s Report • Mailed notice and ballot to each property owner 45 days before the public hearing • Public Hearing 4 Estimated Revenues and Expenditures The Engineer’s Report (Attachment B) provides a summary of the FY 2026-27 Citywide District’s estimated revenues and expenditures. Total estimated expenditures for the operation, maintenance, and servicing of median landscaping, street trees, street lighting, and traffic signals for FY 2026-27 are $2,121,281. The proposed assessment of $381,126 will fund a portion of eligible LLMD expenditures for FY 2026-27. In addition, as directed by the City Council on June 21, 2005, the 1911 Act Ad Valorem Property Tax fund balance will be used to pay for the cost of maintaining traffic signals and safety lighting. The budget for these maintenance costs for FY 2026-27 is estimated to be $486,100. Lastly, the 1972 Act fund balance of $32,304 and other City funds (Measure M, Gas Tax, and General Fund) in the amount of $1,221,751 will be used to cover the LLMD’s expenditures in excess of the revenue amount. ADDITIONAL INFORMATION: A notice of a Public Hearing was published in the Palos Verdes Peninsula News on June 4 and 10, 2026 (Attachment D), as well as posted at City Hall on June 4, 2026. To date, the City has received one written protest (Attachment F). If written protests are received after the publication of this staff report, they will be provided to the City Council as late correspondence. CONCLUSION: To levy assessments through the City’s LLMD, Staff recommend the City Council conduct a public hearing and adopt a resolution (Attachment A) ordering the assessments for FY 2026-27. ALTERNATIVES: In addition to the Staff recommendation, the following alternative actions are available for the City Council’s consideration: 1. Reduce or zero the LLMD assessment for FY 2026-27. 2. Direct staff to initiate Prop 218 notification and hearing process to increase the LLMD assessment for FY 2026-27 to recover more or all of the LLMD maintenance and operation costs. 3. Sunset the LLMD. 4. Take other action, as deemed appropriate. 5 Resolution No. 2026 ___ Page 1 of 3 RESOLUTION NO. 2026___ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES CONFIRMING THE ZONE DIAGRAMS AND ASSESSMENTS, ORDERING THE IMPROVEMENTS, AND ORDERING THE LEVY FOR THE CITYWIDE LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT FOR FISCAL YEAR 2026-27 WHEREAS, the City Council of the City of Rancho Palos Verdes (the "City Council") previously completed its proceedings in accordance with and pursuant to the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing with Section 22600) (the "Act") to establish the "Citywide Landscaping and Lighting Maintenance District" (the "District"); and WHEREAS, the City Council has retained NBS Government Finance Group (NBS) for the purpose of assisting with the annual levy of the District, and the preparation and filing of an Engineer's Report; and WHEREAS, the City Council has, by previous resolution, approved the Engineer's Report, and declared its intention to hold a Public Hearing concerning the levy and collection of assessments within the District; and WHEREAS, a Public Hearing has been held and concluded and notice thereof was duly given in accordance with Section 22626 of the Act; and WHEREAS, at the time and place specified in the Resolution of Intention the City Council conducted such hearing and considered all oral and written statements, protests, and communications made or filed by interested persons. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation and servicing of the landscaping, public lighting facilities, and appurtenant facilities, including repair, removal or replacement of all or part of any of the landscaping, public lighting facilities, or appurtenant facilities; providing for the life, growth, health and beauty of the landscaping, including cultivation, irrigation, trimming, spraying, fertilizing and treating for disease or injury; the removal of trimmings, rubbish, debris and other solid waste; and the cleaning, sandblasting, and painting of walls and other improvements to remove or cover graffiti. Servicing means the furnishing of water I for irrigation of the landscaping and the maintenance of any of the public lighting facilities or appurtenant facilities and the furnishing of electric current or energy, gas or other illuminating agent for the public lighting facilities, or for the lighting or operation of landscaping or appurtenant facilities; and, Section 5. Reference is made to the Engineer's Report on file in the Office of the City Clerk and open to public inspection for a full and detailed description of the improvements, the boundaries of the District and the zones therein, and the proposed assessments upon assessable lots and parcels of land within the District.
