Comparison Assessment of Fully Burdened Hourly Rates (page G-1) BACKGROUND: On April 20, 2021, the City Council adopted Resolution No. 2021-15 (Attachment E), which established a new Master Schedule of Fees based on a Citywide updated cost of service study. The Resolution also established a Total Cost Allocation Plan and a Fully Burdened Hourly Rates (FBHR) schedule. As a result, the City Council directed Staff to return annually with the Master Schedule of Fees to consider whether fees should be adjusted by the March CPI-U. The Master Schedule of Fees lists the fees charged to applicants for personal choice services, such as encroachments in the public right-of-way, building permits, planning entitlements, filming permits, and renting of City facilities. These fees are intended to recover the City’s costs associated with providing services related to those requests. The Master Schedule of Fees also includes the FBHR for City staff positions, allowing the City to recover the cost of staff time incurred in providing the services, including grant-related activities, as well as services associated with Trust Deposits for which a set fee is not listed in the Master Schedule of Fees. Since the adoption of the fees from the cost of service study in 2021, the City Council opted not to apply CPI-U adjustments, in order to provide economic relief to residents and businesses during a period of increasing inflation and broader economic uncertainty, as a strong fund balance placed the City in a solid financial position to maintain existing fees without the need for increases. Accordingly, the City Council approved Staff’s recommendation to hold fee levels steady from Fiscal Years 2022-23 and 2023-24. This is reflected in amendments to Resolution 2021-15 with Resolution No. 2022-24 (adopted on May 3, 2022) and Resolution No. 2023-17 (adopted on May 5, 2023). On May 7, 2024, the City Council adopted Resolution No. 2024-19 (Attachment C), amending Resolution No. 2021-15 to update various fees within the Master Schedule for fees, including Community Development related fees such as conditional use permits, coastal permits, grading plan reviews, and subdivision applications, Recreation and Parks 2 facility rental fees, as well as the FY 2024-25 Fully Burdened Hourly Rate (FBHR) schedule, within the Master Schedule of Fees. Any fee, charge, or rate included in Resolution No. 2021-15 that was not superseded by the amendment remained in effect. On June 18, 2024, the City Council adopted Resolution No. 2024 -37 (Attachment D) to adopt new fees for a new Antenna Development permit. Following several years of holding fees flat to provide economic relief to residents and businesses during periods of inflation and economic uncertainty, the City began re - evaluating its ability to continue subsidizing the cost of fee -related services through General Fund resources. Increasing operational costs and ongoing fiscal impacts associated with the landslide emergency contributed to the City’s broader financial challenges and consideration of future CPI-U adjustments to the Master Schedule of Fees. Accordingly, on June 3, 2025, the City Council adopted Reso lution No. 2025-35 (Attachment B) increasing the rates in the Master Schedule of Fees and the FBHR schedule based on the March 2025 CPI-U of 3.0% for FY 2025-26. The City Council approved the increase in fees and FBHR as part of the City’s financial sustainability efforts to reduce subsidies during a period of ongoing fiscal constraints. For the FBHR schedule, the City Council has historically approved adjustments based on the CPI -U, since these rates are used to calculate reimbursable costs of providing City services, including grant- related reimbursements. According to state law, City-imposed fees for services cannot exceed the estimated reasonable cost of providing the service. As such, the City annually reviews the Master Fee Schedule of Fees and associated FBHR schedule to evaluate whether adjustments are warranted to ensure fees remain reasonably aligned with the cost of providing services. As part of the annual process, this staff report provides the City Council with an overview of the proposed amendments to the Master Schedule of Fees and the associated FBHR schedule for FY 2026-27, including recommended CPI-U adjustments, revised rates, and updates based on operational and service delivery needs. The report also summarizes the methodology and rationale used to evaluate the proposed fee and FBHR adjustments to help ensure rates remain reasonably aligned with the estimated cost of providing services and staff time associated with those services. DISCUSSION: a. Proposed March 2026 CPI-U Increase On April 10, 2026, the U.S. Bureau of Labor Statistics (BLS) published the March 2026 CPI-U of 3.4%. To assess the impact on current fees after applying the March 2026 CPI- U, a comparison of the current fees to the inflation-adjusted fees was prepared by Staff (see Attachment F for the complete list). The table below provides a few sample fees included in the comparison. 3 Table 1. Examples of Fees Increases based on March 2026 CPI-U Exceptions to CPI-U increases A few exceptions are identified to the proposed increases based on CPI-U calculations, as follows: • Under Code S-142 (Photocopy), the “Copy of existing electronic record burned to CD – Per CD” fee and the Per Page Fee Established by Government Code Section 81008 Retrieval of FPPC Filings five or more years old” fee is kept at $5. • The Abalone Cove Parking Fees are unchanged due to California Coastal Commission considerations. Similar to last year’s request, Staff seeks City Council affirmation to apply a 3.4% CPI-U increase for applicable fees in the FY 2026-27 Master Schedule of Fees. If approved, Staff estimate an increase in revenues of approximately $121,000 which will help support the City’s cost recovery efforts. Proposed Rate Changes (Public Works) As part of the review process, the Departments were asked to review the costs of providing services and compare those costs to the applicable current fees and identify any fees that should be adjusted to offset those cost differences. Although a formal new Fee Study was not performed by an outside consultant, similar to the one conducted prior to the 2021 Master Schedule of Fees, a number of Public Works fees were re-evaluated using the same general cost recovery methodology from the 2021 study. The fees were re-evaluated and recalculated to better align cost recovery with the actual level of staff and consultant effort required to provide the associated services. The proposed fees are based on estimated staff hours, proposed FY 2026-27 FBHR, and estimated consultant hours and rates associated with providing those services. The recalculations were intended to more accurately reflect the City’s estimated cost of delivering the services and to help ensure the fees remain reasonably aligned with the resources required to process and support those activities. The following recommendations are: • Dumpster Fee: Reduced from $68 to $41. Proposed Reformatting Staff reformatted the Master Schedule of Fees to improve readability, make the document more customer service friendly, and assist the public in more easily identifying the fees applicable to requested services. The reformatting was intended to create a clearer and more user-friendly format that allows residents, applicants, businesses, and other users to better navigate the document and understand applicable fees and requirements. The following changes were made: • Organized the Departments alphabetically • Ensured fees are clearly identified in the fees column, instead of in the description • Grouped fees by type within a Department’s fee schedule (i.e. “Inspection Fees” in Public Works or Building Safety) • Eliminated duplicate Geologic Review Fees listed in the Planning Division, as they are listed in the Building Safety Division • Moved the (National Pollutant Discharge Elimination System (LID) / Low Impact Development (LID) Fees from the Planning Division to the Building & Safety Division • Consolidated definitions that were repeated in the current Master Schedule of Fees • Other aesthetic changes to help readers locate the fees applicable to their request for services Staff seek City Council affirmation of the proposed reformatting of the FY 2026-27 Master Fee Schedule of Fees. 6 d. Proposed Adding Omitted Fees During a review of the current Master Schedule of Fees, Staff identified several fees that were not included in the schedule. Although these were previously authorized by the City Council, they were inadvertently omitted from the current schedule. The request to add these fees is only for clarity and transparency, as previous staff reports for authorizations of Resolutions that amended the schedule have stated that any fee, charge, or rate included in Resolution No. 2021-15 that was not superseded by the amendment remains in effect. Fully Burdened Hourly Rate (FBHR) The FBHR is an hourly rate set by the City for the fiscal year for City staff positions to track the costs of staff time in providing services. The rates were established as part of cost recovery study in 2021. 7 The FBHR schedule is primarily used to calculate charges associated with elective or applicant-driven services. The majority of FBHR usage is related to development and Public Works activities, including development-related permit reviews, inspections, plan checks, encroachment permits, consultant reimbursements, and other services requested by developers, businesses, utility companies, outside agencies, and residents. These rates are also used for grant reimbursements to recover staff time associated with grant-related activities. The FBHR includes salary, benefits, and indirect costs such as supplies, and technology required for a specific position and task. This schedule is used by Staff to calculate the amount owed to the City for services provided when a flat rate or per unit cost is not set in the Master Schedule of Fees and to invoice other agencies for reimbursement of a service. The FBHR is also used to establish the appropriate fee levels for various permits based on the full cost of providing these elective services. The FBHR schedules have been updated annually by the City Council since 2021, even when the set fees listed in the Master Schedule of Fees remained at 2021 set amounts. In prior years, existing FBHRs were generally adjusted annually by the March CPI-U. In this year’s proposed FBHR, Staff recalculated the rates for each job classification using FY 2026-27 salary and benefit data to more accurately reflect the City’s potential service delivery costs. Consistent with cost recovery best practices, classifications with multiple incumbents within the same job classification were assigned a standardized FBHR based on the average fully burdened cost for that classification, rather than establishing separate rates for individual employees in the same position. This approach promotes consistency, administrative efficiency, and equitable cost recovery practices while still maintaining classification-specific rates. The updated FBHR schedule also incorporates classifications that were added or modified as part of the City’s organizational and classification updates completed in recent years and that previously did not have established FBHRs. As a result of the updated methodology and current staffing structure, the majority of classifications experienced increases compared to prior years. Table 2 below provides examples of classifications with notable changes to the proposed FY 2026-27 FBHR schedule compared to the previously adopted FY 2025-26 rates. Table 2. Adjusting the FBHR schedule allows the City to improve cost recovery through fee revenues and reduces the reliance on general tax revenues paid by all residents to subsidize services provided to specific applicants or users. The proposed FY 2026-27 FBHR schedule reflects classification-based rates that were recalculated using current salary and benefit data and standardized, where applicable, across employees within the same classification to promote consistency and administrative efficiency. Staff seek City Council affirmation of the proposed FBHRs primarily charged for reimbursed services and elective services. ADDITIONAL INFORMATION: Effective Date If approved, the proposed fee changes will be part of the FY 2026 -27 Budget and will take effect on July 1, 2026. Public Notice On May 5 and 12, 2026, Staff published a public notice in the Daily Breeze. An explanation of the contents of this staff report and details on how to view the public hearing were provided. The draft Master Schedule of Fees was also made available to the public and can be viewed at https://www.rpvca.gov/1012/Taxes-and-Fees. This was posted on the City’s website on May 5. CONCLUSION: Given the City’s current financial condition, Staff recommends the City Council approve amending Resolution No. 2025-35, establishing an updated Master Schedule of Fees for FY 2026-27. This action will update the schedule and fees as proposed and affirm an increase to the FBHR schedule based on March 2026 CPI-U of 3.4%. If approved, the proposed fee adjustments are estimated to generate approximately $1 21,000 in additional revenue in FY 2026-27. This update also helps minimize the General Fund funds needed to subsidize expenses related to services provided in response to requests for personal choice services, such as encroachments in the public right-of-way, building permits, filming permits and renting of City facilities, by updating the rates to in relation to similar increases to the costs for the City to provide those services. All other terms of Resolution 2021-15 will remain in full force and effect. ALTERNATIVES: In addition to the Staff recommendation, the following alternative action s are available for the City Council’s consideration: 9 1. Do not increase the Master Schedule of Fees based on the March 2026 CPI-U. 2. Identify a different percentage increase to the Master Schedule of Fees. 3. Do not approve the proposed format of the Master Schedule of Fees. 4. Do not affirm the proposed FBHR schedule. 5. WHEREAS, the City of Rancho Palos Verdes (“City”) conducted an extensive analysis of its services, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, on April 21, 2021, based on that analysis of services, the City Council adopted Resolution 2021-15 approving a new Master Schedule of Fees for Fiscal Year 2021-22 and establishing a Total Cost Allocation Plan and Fully Burdened Hourly Rates for City services; and WHEREAS, on May 5, 2023, the City Council adopted Resolution 2023-17 adding certain new fees to the Council-adopted Master Schedule of fees and establishing an updated Fully Burdened Hourly Rates for City Services; and WHEREAS, on May 7, 2024, the City Council adopted Resolution 2024-19 adding certain new fees to the Council-adopted Master Schedule of fees and establishing an updated Fully Burdened Hourly Rates for City Services; and WHEREAS, on June 18, 2024, the City Council adopted Resolution 2024-37 adopting certain new fees; and WHEREAS, on June 3, 2025, the City Council adopted Resolution 2025-35 adjusting the Council-adopted Master Schedule of fees and establishing an updated Fully Burdened Hourly Rates for City Services; and WHEREAS, the City also desires to update and adjust the City’s Master Schedule of Fees and Charges and Fully Burdened Hourly Rates for Fiscal Year 2026-27; and WHEREAS, California Government Code Section 66000, et. seq. authorizes the City to adopt fees for municipal services, provided such fees do not exceed the cost to the City in providing the service; and A-1 3673580.2 045616 DRFT WHEREAS, on May 5 and 12, 2026, a public notice was published in the Daily Breeze describing the contents of this public hearing matter and details on how to view and participate in the public hearing; and WHEREAS, on May 19, 2026, the City Council conducted a duly noticed public hearing concerning the fees, charges and rates proposed to be adopted as the Master Schedule of Fees; and WHEREAS, the adoption of this Resolution amending Resolution 2025-35 approves and sets forth a procedure for determining fees, charges and rates for the purpose of meeting the operating expenses of City departments and is, therefore, exempt from the California Environmental Quality Act (Public Resources Code Sections 21080 et seq.) pursuant to Public Resources Code Section 21080(b)(8)(A); and WHEREAS, all requirements of California Government Code Sections 66016 and 66018 are hereby found to have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. The facts set forth in the Recitals of this Resolution are true and correct and are hereby incorporated by reference as though set forth in full. Section 2. The City Council hereby finds that none of the fees, charges and rates set forth in the Master Schedule of Fees attached hereto as Exhibit A and incorporated by reference, exceeds the cost to the City in providing the service to which such fee, charge or rate applies. The basis for the new fees, charges and adjusted hourly rates contained in the Master Schedule of Fees is set forth in the Fully Burdened Hourly Rates and attached hereto as Exhibit B. The Periodic Analysis of Fees, Charges and Rates was prepared in accordance with Section 9 of Resolution 2021 -15. Section 3. The City Council hereby approves and adopts the amended Master Schedule of Fees and Fully Burdened Hourly Rates for Fiscal Year 2026-27 as the fees, charges, and rates applicable to specified municipal services provided by the City of Rancho Palos Verdes. Any restatement in the Master Schedule of Fees and Fully Burdened Hourly Rates to the existing rates, charges, and amounts for previously imposed fees is for the purpose of administrative convenience and is not intended, and shall not be construed, as the imposition, extension, or increase of any such fee. Further, omission of a fee, charge or rate from the Master Schedule of Fees and Fully Burdened Hourly Rates approved by this Resolution does not repeal it even if the fee, charge or rate was included on a prior Master Schedule of Fees. Such fee, charge or rate remains in effect until expressly repealed or superseded. Section 4. WHEREAS, the City of Rancho Palos Verdes ("City") conducted an extensive analysis of its services, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, based on that analysis of services, the City Council adopted Resolution 2021-15 approving a new Master Schedule of Fees for Fiscal Year 2021-22 and establishing a Total Cost Allocation Plan and Fully Burdened Hourly Rates for City services; and 111 WHEREAS, the City Council adopted Resolution 2023-17 adding certain new fees to the Council-adopted Master Schedule of fees and establishing an updated Fully Burdened Hourly Rates for City Services; and WHEREAS, the City Council adopted Resolution 2024-19 adding certain new fees to the Council-adopted Master Schedule of fees and establishing an updated Fully Burdened Hourly Rates for City Services; and WHEREAS, the City Council adopted Resolution 2024-37 adopting certain new fees; and WHEREAS, the City also desires to update its Master Schedule of Fees and Charges and appropriately adjust the City's Fully Burdened Hourly Rates for Fiscal Year 2025-26; and WHEREAS, California Government Code Section 66000, et. seq. authorizes the City to adopt fees for municipal services, provided such fees do not exceed the cost to the City in providing the service; and WHEREAS, on May 12 and 19, 2025, a public notice was published in the Daily Breeze describing the contents of this public hearing matter and details on how to view and participate in the public hearing; and WHEREAS, on June 3, 2025, the City Council conducted a duly noticed public hearing concerning the fees, charges and rates proposed to be adopted; and 01203 0042/767138 1 B-1 WHEREAS, the adoption of this Resolution amending Resolutions 2021-15, 2024- 19 and 2024-37 approves and sets forth a procedure for determining fees, charges and rates for the purpose of meeting the operating expenses of City departments and is, therefore, exempt from the California Environmental Quality Act (Public Resources Code Sections 21080 et seq.) pursuant to Public Resources Code Section 21080(b)(8)(A); and WHEREAS, all requirements of California Government Code Sections 66016 and 66018 are hereby found to have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. The facts set forth in the Recitals of this Resolution are true and correct and are hereby incorporated by reference as though set forth in full. Section 2. The City Council hereby finds that none of the fees, charges and rates set forth in the Master Schedule of Fees attached hereto as Exhibit A and incorporated by reference, exceeds the cost to the City in providing the service to which such fee, charge or rate applies. The basis for the new fees, charges and adjusted hourly rates contained in the Master Schedule of Fees is set forth in the Fully Burdened Hourly Rates and attached hereto as Exhibit B. The Periodic Analysis of Fees, Charges and Rates was prepared in accordance with Section 9 of Resolution 2021-15. Section 3. The City Council hereby approves and adopts the amended Master Schedule of Fees and Fully Burdened Hourly Rates for Fiscal Year 2025-26 as the fees, charges, and rates applicable to specified municipal services provided by the City of Rancho Palos Verdes. Any restatement in the Master Schedule of Fees and Fully Burdened Hourly Rates to the existing rates, charges, and amounts for previously imposed fees is for the purpose of administrative convenience and is not intended, and shall not be construed, as the imposition, extension, or increase of any such fee. Further, omission of a fee, charge or rate from the Master Schedule of Fees and Fully Burdened Hourly Rates approved by this Resolution does not repeal it even if the fee, charge or rate was included on a prior Master Schedule of Fees. Such fee, charge or rate remains in effect until expressly repealed or superseded. Section 4. The provisions of Resolution Nos. 2021-15, 2024-19 and 2024-37 not consistent with or in conflict with this Resolution are hereby superseded by this Resolution; in all other respects, Resolution Nos. 2021-15 and 2024-37 shall remain in full force and effect. WHEREAS, the City of Rancho Palos Verdes ("City") conducted an extensive analysis of its services, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, based on that analysis of services, the City Council adopted Resolution 2021-15 approving a new Master Schedule of Fees for Fiscal Year 2021-22 and establishing a Total Cost Allocation Plan and Fully Burdened Hourly Rates for City services; and WHEREAS, the City Council adopted Resolution 2023-17, amending Resolution No. 2021-15, thereby adding certain new fees to the Council-adopted Master Schedule of fees and establishing an updated Fully Burdened Hourly Rates for City Services; and WHEREAS, the City now desires to update its Master Schedule of Fees and Charges and appropriately adjust the City's Fully Burdened Hourly Rates for Fiscal Year 2024-25 by amending Resolution No. 2023-17; and WHEREAS, California Government Code Section 66000, et. seq. authorizes the City to adopt fees for municipal services, provided such fees do not exceed the cost to the City in providing the service; and WHEREAS, on April 4 and 18, 2024, a public notice was published in the Peninsula News describing the contents of this public hearing matter and details on how to view and participate in the public hearing; and WHEREAS, on May 7, 2024, the City Council conducted a duly noticed public hearing concerning the fees, charges and rates proposed to be adopted; and WHEREAS, the adoption of this Resolution amending Resolutions 2021-15 and 2023-17 approves and sets forth a procedure for determining fees, charges and rates for the purpose of meeting the operating expenses of City departments and is, therefore, exempt from the California Environmental Quality Act (Public Resources, Code Sections 21080 et seq.) pursuant to Public Resources Code Section 21080(b)(8)(A); and 01203 0042/767138 1 C-1 WHEREAS, all requirements of California Government Code Sections 66016 and 66018 are hereby found to have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. The facts set forth in the Recitals of this Resolution are true and correct and are hereby incorporated by reference as though set forth in full. Section 2. The City Council hereby finds that none of the fees, charges and rates set forth in the Master Schedule of Fees attached hereto as Exhibit A and incorporated by reference, exceeds the cost to the City in providing the service to which such fee, charge or rate applies. The basis for the new fees, charges and adjusted hourly rates contained in the Master Schedule of Fees is set forth in the Fully Burdened Hourly Rates and attached hereto as Exhibit B. The Periodic Analysis of Fees, Charges and Rates was prepared in accordance with Section 9 of Resolution No. 2021-15. Section 3. The City Council hereby approves and adopts the amended Master Schedule of Fees and Fully Burdened Hourly Rates for Fiscal Year 2024-25 as the fees, charges, and rates applicable to specified municipal services provided by the City of Rancho Palos Verdes. Any restatement in the Master Schedule of Fees and Fully Burdened Hourly Rates to the existing rates, charges, and amounts for previously imposed fees is for the purpose of administrative convenience and is not intended, andIIshallnotbeconstrued, as the imposition, extension, or increase of any such fee. Further, omission of a fee, charge or rate from the Master Schedule of Fees and Fully Burdened Hourly Rates approved by this Resolution does not repeal it even if the fee, charge or rate was included on a prior Master Schedule of Fees. WHEREAS, the City of Rancho Palos Verdes ("City") conducted an extensive analysis of its services, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, based on that analysis of services, the City Council adopted Resolution 2021-15 approving a new Master Schedule of Fees for Fiscal Year 2021-22 and establishing a Total Cost Allocation Plan and Fully Burdened Hourly Rates for City services; and WHEREAS, the City Council adopted Resolution 2023-17, amending Resolution No. 2021-15, thereby adding certain new fees to the Council-adopted Master Schedule of fees and establishing an updated Fully Burdened Hourly Rates for City Services; and WHEREAS, the City now desires to update its Master Schedule of Fees and Charges and appropriately adjust the City's Fully Burdened Hourly Rates for Fiscal Year 2024-25 by amending Resolution No. 2023-17; and WHEREAS, California Government Code Section 66000, et. seq. authorizes the City to adopt fees for municipal services, provided such fees do not exceed the cost to the City in providing the service; and WHEREAS, on April 4 and 18, 2024, a public notice was published in the Peninsula News describing the contents of this public hearing matter and details on how to view and participate in the public hearing; and WHEREAS, after conducting a public hearing on May 7, 2024, the City adopted Resolution No. 2024-19 thereby adopting an updated Master Schedule of Fees and Charges for City services; and, WHEREAS, on June 4, 2024, Ordinance No. 682 was introduced by the City Council, which repealed §17.76.020 (Antennas) of Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code (RPVMC) and replaces it with Chapter 17.73 (Wireless Telecommunication Facilities on Private Property)to ensure that the City's Antenna Code D-1 provisions are consistent with state and federal telecommunications law, and that wireless communications are reasonably available while the scenic views, quality of life, character, and aesthetics of the City are protected; and WHEREAS, on June 18, 2024, a second reading of Ordinance No. 682 will be conducted as part of the City Council's regularly scheduled meeting establishing July 19, 2024 as effective date of Ordinance No. 682; and WHEREAS, Ordinance No. 682, if adopted, will establish a set of new permits associated with antenna development including a Conditional Wireless Facility Permit, an Administrative Wireless Facility Permit, an Eligible Facility Permit, and an Over the Air Reception Devices Permit; and WHEREAS, permit fees for the new Antenna Development Permits do not exist in the City's Master Schedule of Fees and Charges thus necessitating an amendment to the Master Schedule of Fees and Charges; and WHEREAS, on May 30, 2024 and June 13, 2024, notices of a public hearing describing the contents of this public hearing matter and details on how to view and participate in the public hearing to be held on June 18, 2024 was published in the Palos Verdes Peninsula News,; and WHEREAS, the proposed amendment to the Master Fee Schedule was made available to the public ten days prior to the City Council's,June 18, 2024 public hearing; and WHEREAS, on June 18, 2024, the City Council conducted a duly noticed public hearing for the proposed amendment of the City's Master Schedule of Fees and Charges; and, WHEREAS, the adoption of this Resolution amending Resolutions 2021-15, 2023- 17, and 2024-19 approves and sets forth a procedure for determining fees, charges and rates for the purpose of adding new Antenna Development Permit fees for a Conditional Wireless Facility Permit, an Administrative Wireless Facility Permit, an Eligible Facility Permit, and an Over-the-Air Reception Devices Permit, on private property, and is, therefore, exempt from the California Environmental Quality Act (Public Resources Code Sections 21080 et seq.) pursuant to Public Resources Code Section 21080(b)(8)(A); and WHEREAS, all requirements of California Government Code Sections 66016 and I 66018 are hereby found to have been satisfied. THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES RESOLVE AS FOLLOWS: WHEREAS, the City of Rancho Palos Verdes ("City") has conducted an extensive analysis of its services, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, the City retained an independent consultant, Revenue & Cost Specialists, LLC ("RCS"), to conduct said analysis of the City's services and related costs. RCS completed that certain Total Cost Allocation Plan and Service Cost Update (the "Fee Study") dated April 30, 2019, a copy of which was distributed to the City Council and is on file with the City Clerk. The Fee Study set forth a mechanism for ensuring that fees adopted by the City for services rendered do not exceed the reasonable estimated cost for providing the services for which the fees are charged; and WHEREAS, California Government Code Section 66000, et. seq. authorizes the City to adopt fees for municipal services, provided such fees do not exceed the cost to the City of providing the service; and WHEREAS, on April 20, 2021, the City Council conducted a duly noticed public hearing to consider the new fees proposed to be adopted; and WHEREAS, the adoption of this Resolution approves and sets forth a procedure for determining fees for the purpose of meeting the operating expenses of City departments and is, therefore, exempt from the California Environmental Quality Act (Public Resources Code Sections 21080 et seq.) pursuant to Public Resources Code Section 21080(b)( 8)(A); and WHEREAS, all requirements of California Government Code Sections 66016 and 66018 are hereby found to have been satisfied. E-1 NOW, THEREFORE, the City Council of the City of Rancho Palos Verdes does hereby resolve as follows: Section 1. The facts set forth in the Recitals of this Resolution are true and correct and are hereby incorporated by reference as though set forth in full. Section 2. The City Council hereby finds that none of the fees set forth in the Master Fee Schedule ("Master Fee Schedule") attached hereto as Exhibit 1 and incorporated by reference, exceeds the cost to the City of providing the service to which such fee applies. The basis for the fees and charges contained in the Master Fee Schedule is set forth in the Fee Study, which is incorporated herein by this reference and attached hereto as Exhibit 2. The City Council hereby establishes the total cost allocation plan and approves the cost of services analysis as contained in the City's Fee Study. Section 3. The City Council hereby approves and adopts the Master Fee Schedule as the master schedule of fees applicable to specified municipal services provided by the City of Rancho Palos Verdes. Any restatement in the Master Fee Schedule of existing rates and amounts for previously imposed fees is for the purpose of administrative convenience and is not intended, and shall not be construed, as the imposition, extension, or increase of any such fee. Section 4. Costs Reasonably Borne Defined. "Costs reasonably borne," as used and ordered to be applied in this Resolution, shall consist of the following elements: r A. All applicable direct costs including, but not limited to, salaries, wages, overtime, employee fringe benefits, services and supplies, maintenance and operation expenses, contracted services, special supplies, and any other direct expense incurred by the City. B. All applicable indirect costs including, but not restricted to, building maintenance and operations, equipment maintenance and operations, communications expenses, information technology costs, printing and reproduction, vehicle expenses, insurance and like expenses, when distributed, based on an accounted and documented rational proration system. C. Fixed asset recovery expenses, consisting of depreciation of fixed assets, and additional fixed asset expense recovery charges calculated on the current estimated cost of replacement, divided by the approximate life expectancy of the fixed asset were considered and adjusted accordingly by the City Council. D. Citywide support, expressed as a percentage, distributing and charging the expenses of the City Council, City Attorney, City Manager, City Clerk, and Finance and Information Technology Department, and all other staff and support service provided to the Resolution No. 2021-15 111 Page 2 of 6 E-2 I entire city organization. Support shall be prorated between tax-financed services and fee- financed services on the basis of said percentage so that each tax and fee and charge shall proportionately defray such support costs. E. Departmental support, expressed as a percentage, distributing and charging the cost of each department head and his or her supporting expenses. F. Debt service costs, if applicable, consisting of repayment of principal, payment of interest, and trustee fees and administrative expenses for all applicable bond, certificate, or securities issues or loans of whatever nature or kind. Any required coverage factors or required or established reserves beyond basic debt service costs also shall be considered, if applicable, as a cost if required by covenant within any securities ordinance, resolution, indenture or general law applicable to the City. Section 5. Fully Burdened Hourly Rates. "Fully Burdened Hourly Rates" attached hereto as Exhibit 2 shall be applied to all trust deposit charges or to fees that are to be collected for which a flat rate or per unit cost cannot be established due to the nature of the regulation, product, or service to be provided. Fully burdened hourly rates shall be consistent with the definition of "costs reasonably borne" as defined above and shall be applied as follows: Direct Hourly Salary (1) Services and Supplies (2) Direct Expenses Departmental Support (3) Fully Burdened Hourly Rate 1) Includes employee salary and benefits and is based on a 1,580 hour productive work year. 2) Proportionate share is based on total departmental services and supplies divided by productive work hours (1,580) times the ratio of the employee's salary and benefits to all department employees' salaries and benefits. 3) Proportionate share is based on the departmental overhead cost divided by productive work hours (1,580) times the ratio of the employee's salary and benefits to all department employees' salaries and benefits. Section 6. Separate Fee for Each Application. All fees set by this resolution are for each identified application that is being processed. Additional fees shall be required for each additional application or service that is requested or required. Where fees are indicated on a per-unit of measurement basis, the fee is for each identified unit or portion thereof within the indicated ranges of such units. Resolution No. 2021-15 Page 3 of 6E-3 Where additional fees need to be charged and collected for completed staff work, or where a refund of excess deposited monies is due, and where such charge or refund is ten dollars ($10.00) or less, a charge or refund need not be made, pursuant to California Government Code Sections 29373.1 and 29375.1 and amendments thereto, and because the cost to the City of processing a refund or collecting the charge will exceed the cost of the refund or charge. City staff has calculated it would cost the City $42.78 to process a refund (0.25 hours of staff time at the Fully Burdened Hourly Rate of $114.17 plus 0.16 hours of staff time at the Fully Burdened Hourly Rate of$89.01), and it would cost the City 37.67 to collect the charge (0.33 hours of staff time at the Fully Burdened Hourly rate of 114.17). Section 7. Trust Deposits. In addition to the fees and charges for an application, each applicant shall be responsible for the full cost of services provided on behalf of the City by outside consultants that have been retained by the City to render services specifically in connection with the processing of the application. Each applicant shall be required to pre-pay, in the form of a trust deposit with the City, the estimated amount of the cost of any such services to be provided in connection with the processing of the application. The trust deposit shall be remitted to the City prior to commencement of covered services. The staff member responsible for processing the application shall establish the initial amount of the trust deposit for a given application. The trust deposit required shall be sufficient to cover the estimated costs of the services to be provided plus the estimated cost of staff time, at the Fully Burdened Hourly Rate, for overseeing outside consultants and administering the trust deposit. Services routinely provided to the City by the City Attorney and other consultants that are included in the Fully Burdened Hourly Rates shall be exempt from this condition. However, the trust deposits shall include the costs of extraordinary services, including, but not limited to, geological reviews, preparation of environmental impact reports and other environmental documentation, and special services by the City Attorney that arise directly from the particular application and are not within the scope of services that are routinely provided to the City. In the event the trust deposit exceeds the actual costs incurred for a particular application, the City will refund the surplus. If, conversely, the actual costs will exceed the amount on deposit, the City shall notify the applicant in writing that additional funds are required to replenish the trust deposit. The applicant shall replenish the trust deposit within ten (10) days of receipt of notice from the City that additional funds are needed; the replenishment amount shall be based upon an estimate by City Staff of the cost of services that will be provided by the City during the next ninety (90) days. If an applicant fails to timely replenish a trust deposit, the City shall suspend all processing of the application until such time as the applicant remits the required additional funds. Section 8. The fees specified in the Master Fee Schedule shall become effective on July 1, 2021; provided, however, that those fees shall not be applicable to any application received by or deemed "complete" by the City prior to July 1, 2021, and such applications shall continue to be subject to the fee schedule in effect when the application was deemed complete. The City Council hereby directs staff to return annually with the Master Fee Schedule for the City Council to review and determine if the fee should be adjusted by the March urban consumer price index (CPI-U) for Los Angeles, Riverside, and Orange County. Based on the results of said annual review, the City Council shall revise such fees, charges and rates as warranted. Section 10. The City Council hereby directs staff to either internally or through a third party, to perform a thorough analysis of fees, charges and rates every five years from the date of this adopted resolution. Based on the results of said periodic review, the City Council shall consider revising such fees, charges and rates as warranted. Until a periodic analysis is completed, and after the fee adjustments detailed in Exhibit 1 are implemented, the City Council may review the fees, charges and rates as often as annually and, after conducting a duly noticed public hearing, may increase the portion of the fees, charges and rates directly related to employee salaries and benefits by the percentage increase in City salaries and benefits, as calculated by comparing the City's most recently adopted budget for City salaries and benefits, divided by the number of full-time employees budgeted for that year, to the adopted budget for City salaries and benefits, divided by the number of full-time employees budgeted, that was in effect on the date of the last adjustment of the fees. Section 10. Any person paying a given fee who feels that any fee or charge determined and set is in excess of the percentage of costs reasonably borne by the City and to be recovered as set out in this Resolution, or has not been reviewed within the review schedule as set forth herein, may appeal in writing to the City Council. Section 11. The City Clerk shall certify to the. passage, approval, and adoption of this resolution, and shall cause this resolution and her certification to be entered in the Book of Resolutions of the City Council of the City.
