Public Comments #1 -Exempting City's Equestrian Overlay Districts From SB9
Honorary Mayor and City Councilmembers:
As a resident in the Equestrian Overlay District (PVDE), I encourage your support of the
exemption of the 5 Equestrian Overlay Districts of RPV.
For years, us equestrians and other residents of the 'Q' Districts have advocated for the
protection of these large, horse-keeping properties, our trails and open space.
With an exemption to 5B9, equestrian overlay districts will forever
be protected and our community will continue to be defined as the semi-rural area
designed over fifty years ago to balance urban and equestrian living.

Mayor and City Council,
There are two areas of the new development code of concern:
1. The proposed language restricts the replacement of damaged structure to the location of the damaged
structures. There are areas in Portuguese Bend where fissures go through houses. These houses should
be allowed to move to a more stable location. The lots in PB are large enough for some movement to
comply with RPV setback requirements on portions of the lots that do not include active fissures. I
recommend that you keep the language in 17.32.030 that allows movement of the structure to a
more stable location.
2. Commercial agriculture should be allowed on the larger parcels in Portuguese Bend. 17.32.030
prohibits commercial agriculture larger than 1 acre. We should modify this to allow commercial
agriculture with limitations regarding landslide support restrictions.
Please have staff explain why they have changed the language to change the ordinance in these areas.

Subject: Prohibition on moving houses to safer location
Honorable Mayor and City Council. Please do not prohibit residents in the Portuguese Bend Landslide
Complex from moving their houses away from fissures to more stable land. The city has adequate set
back requirements and planning reviews to ensure that a new location would meet city requirements. I
have attached pictures of 3 houses that would benefit from being allowed to adjust their location. There
are many more examples in Portuguese Bend
