RECOMMENDED COUNCIL ACTION: (1)Accept the construction contract with Ramco General Engineering Contractors for the Wildlife Corridor Encroachment Removal Project (Capital Improvement Program Project No. 8427) as complete; (2)Authorize the City Manager to sign and the City Clerk to file a Notice of Completion for the project with the Los Angeles County Registrar-Recorder’s Office; and if no claims are filed within 35 days after recordation, send a notice to the surety company to exonerate the Performance Bond; and, (3)Authorize the Contract Officer to release the 5% construction retention payment to RAMCO General Engineering Contractors Inc., 35 days after recordation of the Notice of Completion by the Los Angeles County Registrar-Recorder’s Office, contingent upon no claims being filed on the project, and the contractor posting an acceptable warranty bond with the City. FISCAL IMPACT: The total construction cost for the work completed by Ramco General Engineering Contractors Inc. was $288,018, which is $10,982 under the contract amount of $299,000, and also leaving an unspent contingency amount of $29,0000. The acquisition was funded largely through grants from the USFWS and Wildlife Conservation Board. The complete acquisition funding breakdown is as follows: •USFWS: $12,600,000 •WCB: $4,800,000 •Land Conservancy (private donations): $1,300,000 •City of Rancho Palos Verdes: $1,300,000 •LA County Regional Park and Open Space District: $1,000,000 The City enrolled this newly acquired property into the Palos Verdes Nature Preserve (Preserve) to provide a wildlife corridor between the core Preserve properties. However, after escrow closed, it came to the City’s attention that approximately ten private properties along Fruit Tree Road and Arrowroot Lane had minor encroachments from their backyards into the Wildlife Corridor property. Encroachments included fencing separating the private properties from the Wildlife Corridor. See Figure 1 below for a location map of the Wildlife Corridor property and the encroachments. Figure 1: Wildlife Corridor Properties and Parcels Containing Encroachments 2 Wildlife Corridor The grant agreements with the WCB and USFWS used to acquire the Wildlife Corridor require that the City resolve all encroachments onto the Wildlife Corridor property by September 2025. Resolution consists of removing the encroachments and installing new fencing along the correct property boundary line, formally known as the Wildlife Corridor Encroachment Removal Project (Project). The City Council approved the Project as part of the Fiscal Year 2024-25 budget (Attachment B). The City awarded a construction contract for the Project on May 20, 2025, in the amount of $299,000 with a contingency of $29,900, for a total Project cost of up to $328,900 to Ramco General Engineering Contractors Inc. (Ramco). The proposed Project included the following elements: 1.Removal of approximately 2,400 feet of encroaching and sub-standard chain-link and wooden fencing. 2.Removal of vegetation impeding installation of new fencing along the correct property boundaries. 3.Installation of approximately 2,570 feet of black polymer coated fencing along the correct property boundaries. DISCUSSION: RAMCO’s scope of work was completed in September 2025, in accordance with their contract and within budget, for a total construction cost of $288,018. The contract includes a 12-month warranty period requiring the contractor to remedy any defective work. The project area will be monitored for the duration of the warranty period. Although Staff are actively working to resolve this dispute in a timely manner, the associated timeline is uncertain. As a result, the work along the east and north boundaries of this property could not be scheduled and carried out in accordance with the construction contract with RAMCO. Accordingly, the relative scope of work was deleted from the construction contract with RAMCO via change order (Attachment C). After the property dispute is resolved, Staff plan to resume completing the Project’s balance of work (deleted via the above-mentioned change order) via separate means and by using the remaining unexpended balance of construction funds currently allocated to the Project. No additional budget allocation is anticipated to be necessary to complete the Project. The filing of the Notice of Completion (Attachment A) allows the City to close out its contract with RAMCO and release the associated retention within a reasonable timeframe relative to the date their construction contract obligations were met. CONCLUSION: The construction contractor, Ramco General Engineering Contractors Inc., has completed all work in accordance with the contract plans and specifications. Therefore, Staff recommend accepting the construction contract as complete and filing a Notice of Completion with the Los Angeles County Registrar-Recorder’s Office. ALTERNATIVES: In addition to Staff recommendation, the following alternative actions are available for the City Council’s consideration: 1.Direct Staff not to file the Notice of Completion for Wildlife Corridor Encroachment Removal Project construction contract with Ramco General Engineering Contractors Inc. until work is completed on the remaining encroachments associated with 6100 Arrowroot. 2.Take other action, as deemed appropriate. 5 Revised 05/2019  To be recorded with County Recorder within 15 days after completion.
