RECOMMENDED COUNCIL ACTION: (1) Accept the Storm Drain Improvements at Peacock Ridge Road (CIP 8723) as complete; (2) Authorize the City Clerk to file a Notice of Completion for the project with the Los Angeles County Registrar-Recorder’s Office; and if no claims are filed within 35 days after recordation, send a notice to the surety company to exonerate the Performance Bond; and (3) Authorize the Director of Public Works to release the 5% construction retention payment to ASAD Holdings (dba Orangeblue General Contractors), 35 days after recordation of the Notice of Completion by the Los Angeles County Registrar - Recorder’s Office, contingent upon no claims being filed on the project, and the contractor posting an acceptable warrant bond with the City. FISCAL IMPACT: The final cost of the construction work was $227,941.12 (not including professional and technical services) and was completed within budget. Staff Report Awarding Construction Contract (page B-1) VR 1 BACKGROUND: Previously, the existing 12-inch storm drain situated within a cul-de-sac in the 5900 block of Peacock Ridge Road collected runoff from Peacock Ridge Road and channeled it downstream onto Scotmist Drive, south of Peacock Ridge Road. This segment of storm drain that connects Peacock Ridge Road to Scotmist Drive is approximately 150 linear feet. Based on an initial investigation by the City, the lower pipe segment was found to have collapsed and was no longer effectively managing runoff on Peacock Ridge Road, creating localized flooding conditions. To restore proper drainage to the area, the City Council approved a construction contract on September 17, 2024, in the amount of $224,000 for construction, inclusive of contingency, to Orangeblue General Contractors. The proposed Storm Drain Improvements at Peacock Ridge Road (Project) included the following elements: 1. Replace the damaged inlet and outlet structures located on Peacock Ridge Road and Scotmist Drive 2. Replace the interconnecting 150-linear feet of 12-inch storm drain 3. Replace adjacent damaged curb and gutter 4. Remove interfering vegetation DISCUSSION: Construction by Orangeblue General Contractors was completed in February 2025 in accordance with the plans and specifications and within budget for a total construction cost of $227,941.12. The contract includes a 12-month warranty period requiring the contractor to remedy any defective work. The project area will be monitored for the duration of the warranty period. During excavation to replace the damaged storm drain, it was discovered that the outlet structure had been constructed in a manner that encased adjacent utility infrastructure and required removal to complete the project. 2. During the demolition of the existing curb and gutter along Peacock Ridge, unsuitable subgrade soils were identified that required removal and haul-off, followed by the import of replacement soil that would achieve the contract-specified soil compaction standards necessary to support the new storm drain improvements. The additional labor and materials required to address the above differing site conditions were not accounted for in t e contract documents and t e contractor’s associated bid. Therefore, a change order was issued to account for the changes in the construction drawings and the additional cost for the contractor to complete the extra work. An additional appropriation in the amount of $3,941.12 was needed to account for the additional funding above the originally approved contingency to issue the change orde r. This additional appropriation is available in the project’s approved budget for Fiscal Year 2024-2025 as further detailed in Table 1 below. The filing of the Notice of Completion allows the City to close out its contract with Orangeblue General Contractors and release the associated retention within a reasonable timeframe relative to the date all construction contract work was completed, and the City took beneficial use of the facility. A financial summary of the project is shown in table 1 below. Table 1: Storm Drain Improvements at Peacock Ridge Road Financial Summary 3 CONCLUSION: The construction contractor, Orangeblue General Contractors, has completed all work in accordance with the plans, specifications, and construction contract. Therefore, Staff recommends accepting the project as complete and filing a Notice of Completion with the Los Angeles County Registrar-Recorder’s Office. If no claims are filed within 35 days after recordation, the City will release the 5% retention, and upon the contractor posting an acceptable warranty bond, notify the surety company to exonerate the Performance Bond. ALTERNATIVES: In addition to Staff recommendation, the following alternative action are available for the City Council’s consideration: 1. To restore proper drainage to the area, t he City Council approved the Storm Drain Improvements at Peacock Ridge Project as part of the FY 2024-25 CIP (Attachment D). On January 16, 2024, the City Council awarded a Professional Services Agreement (PSA) to BKF Engineers for the preparation of plans, specifications, and construction cost estimates to replace the storm drain (Attachment C). Since the early stages of design development, Staff have conducted outreach to residents living in close vicinity of the project, including the homeowners association of the Peacock Ridge Condominium complex. Staff will continue to provide regular project status updates to residents, including any necessary coordination during construction . DISCUSSION: On July 25, 2024, the City issued a Notice Inviting Bids on the PlanetBids platform for a cost to construct the Storm Drain Improvements at Peacock Ridge Project. Seven bids were received by the deadline of August 23, 2024, as shown in Table 1. The City evaluated the bid and found OrangeBlue to be a qualified firm. Table 2 shows a budget summary of the project. A draft of the Public Works Agreement (Contract) for the proposed work is currently being reviewed by the winning firm and will be made available as late correspondence (Attachment A). CONCLUSION: Staff recommends the City Council award a construction contract to OrangeBlue in the amount of $203,600, with a contingency of 10%, or $20,300, for a total amount of up to $224,000 to construct the Storm Drain Improvements at Peacock Ridge Project. ALTERNATIVES: In addition to Staff recommendation, the following alternative actions are available for the City Council’s consideration: 1. Do not award the contract and direct Staff to re-solicit construction bids. 2. Take other action, as deemed appropriate. B-3
