BACKGROUND AND DISCUSSION:
The City of Rancho Palos Verdes (City) is a member of the California Joint Powers
Insurance Authority (Authority), which provides risk management services and handles
any liability claims received by the City. Under the current practice, claims presented to
the City Clerk are forwarded by the Authority to a third-party claims administrator, Carl
Warren and Company (Carl Warren) for adjusting.
Carl Warren’s staff reviews each claim on its merits and contacts the City with any
requested action pertaining to the disposition of the claim. The City Clerk and the City
Attorney review each claim when received and work closely with Carl Warren throughout
the claims process.

Claimant:
On December 13, 2024, the City received a claim for damages from Melody Lomboy. The
claim was referred to Carl Warren for review and investigation. The claimant states that
they should be eligible to receive the $10,000 grant that the City disbursed to impacted
residents in the Greater Portuguese Bend Complex area even though they closed escrow
on the sale of their home on September 27, 2024.
For some background, the Los Angeles County Board of Supervisors provided the City
with a $5 million grant to assist with landslide mitigation. On September 5, 2024, a Social
Program Agreement was transmitted to the City. On September 10, the agreement was
signed and the City received the funding on September 18. On October 1, the City
Council approved the disbursal guidelines for the County’s Social Program to impacted
residents. On October 3 the Grant program was open to the public to submit applications.
On October 4, the new owners of the claimants’ home submitted an application. After the
City determined that the new owner held the recorded grant deed signed by the claimant
on September 19, the City issued the $10,000 grant to the new/current owner on October
9.
Deposition:
Carl Warren has reviewed the claim and advised the City to reject it, based on the
supported chronology of events. Carl Warren recommends denying the claim for
damages.
