CC MINS 20250415 MINUTES REGULAR MEETING OF THE RANCHO PALOS VERDES CITY COUNCIL APRIL 15, 2025 CALL TO ORDER: A Regular Meeting of the Rancho Palos Verdes City Council for the purpose of a Closed Session was called to order by Mayor Bradley at 6:03 P.M. at Fred Hesse Jr. Community Park, McTaggart Hall, 29301 Hawthorne Boulevard. Members of the public could observe and participate using the Zoom participation feature and with options called out in the public participation form provided under a separate cover with the agenda. Notice having been given with affidavit thereto on file. City Council roll call was answered as follows: PRESENT: Lewis, Perestam, Seo, and Mayor Bradley ABSENT: Ferraro* (Excused in Fireside Room) Also present were Ara Mihranian, City Manager; William Wynder, City Attorney; Pam Lee, Labor Counsel; Catherine Jun, Deputy City Manager; Vina Ramos, Director of Finance; Vanessa Godinez, Human Resources and Risk Manager; Nathan Zweizig,Acting Deputy City Clerk (via zoom); and Teresa Takaoka, City Clerk. PUBLIC COMMENTS FOR CLOSED SESSION: None CLOSED SESSION ITEM(S) ANNOUNCED: 1. CONFERENCE WITH LABOR NEGOTIATOR A closed session will be held, pursuant to Government Code § 54957.6, with the City Manager, Deputy City Manager, Finance Director, Human Resources Manager, and Labor Attorney, acting as its negotiators, regarding labor negotiations with the Rancho Palos Verdes Employee Association (RPVEA). 2. CONFERENCE WITH LEGAL COUNSEL —ANTICIPATED LITIGATION A closed session will be held pursuant to Government Code § 54956.9(e) because the City is considering whether to initiate litigation in two cases. 3. CONFERENCE WITH LABOR NEGOTIATORS A closed session will be held, pursuant to Government Code § 54957.6, with the City Council, City Manager, and Finance Director, acting as the City's negotiators, regarding labor negotiations with Aleshire & Wynder, LLP, through William W. Wynder, City Attorney. At 6:04 P.M. the Council recessed to Closed Session. 111 *Councilmember Ferraro joined the Closed Session meeting in the Fireside Room at 6:04 P.M. RECONVENE TO REGULAR MEETING: At 7:07 P.M. the Closed Session was reconvened to the Regular meeting. REGULAR MEETING — OPEN SESSION CALL TO ORDER: A Regular meeting of the Rancho Palos Verdes City Council was called to order by Mayor Bradley at 7:07 P.M. at Fred Hesse Jr. Community Park, McTaggart Hall, 29301 Hawthorne Boulevard, notice having been given with affidavit thereto on file. City Council roll call was answered as follows: PRESENT: Ferraro, Lewis, Perestam, Seo, and Mayor Bradley ABSENT: None Also present were Ara Mihranian, City Manager; Catherine Jun, Deputy City Manager; William Wynder, City Attorney; Vina Ramos, Director of Finance; Ramzi Awwad, Director of Public Works; Brandy Forbes, Director of Community Development (via Zoom); Daniel Trautner, Director of Recreation and Parks, Amy Seeraty, Senior Planner; Vanessa Hevener, Project Manager (Environmental); Deanna Fraley, Principal Engineer; Nathan Zweizig, Acting Deputy City Clerk (via Zoom); and Teresa Takaoka, City Clerk. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Director of Recreation and Parks Daniel Trautner. CLOSED SESSION REPORT: City Attorney Wynder provided the closed session report and reported that only two of the three items were discussed in closed session due to the time allotted. City Attorney Wynder reported that for item 1 the City Council received a privileged and confidential briefing regarding ongoing labor negotiations with the Rancho Palos Verdes Employee Association and were given further negotiating direction. Additionally, the City Council engaged in labor negotiations with the law firm of Aleshire & Wynder, and City Council gave the Mayor direction to communicate and continue negotiations with the law firm. MAYOR'S ANNOUNCEMENTS Mayor Bradley shared that he participated in the City's 40th Annual Whale of a Day celebration at the Point Vicente Interpretive Center, and the event was enjoyed by all. RECYCLE AND EMERGENCY PERSONAL PREPAREDNESS KIT DRAWING: Mayor Bradley, by order of affirmation, approved the Recycle Winners for April 1, 2025, as Shirley Glitzon and Jeffrey Lulejian. The winners will each receive a check for $250 as well as a personal emergency preparedness kit from the City valued at $40. APPROVAL OF THE AGENDA: Mayor Pro Tem Seo moved, seconded by Councilmember Lewis, to approve the agenda as presented. Councilmember Ferraro moved, seconded by Mayor Pro Tem 'Seo, to approve the Consent Calendar with the exception of Item F. Approval of Minutes (Takaoka) Approved the Minutes of April 1, 2025 (Regular Meeting). B. Registers of Demands (Anguiano) Adopted Resolution No. 2025-21, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. C. Consideration and possible action regarding a claim against the City by Melody Lomboy. (Takaoka) Rejected the claim and directed Staff to notify the claimant, Melody Lomboy. D. Consideration to file a Notice of Completion for the Point Vincente Interpretive Center Drainage Remediation project (CIP 8509). (Sunwoo) 1) Accepted the Point Vicente Interpretive Center Drainage Remediation project (CIP 8509) as complete; 2) Authorized the City Clerk to file a Notice of Completion for the project with the Los Angeles County Registrar-Recorder's Office; and if no claims are filed within 35 days after recordation, send a notice to the surety company to exonerate the Performance Bond; and, 3) Authorized the Director of Public Works to release the 5% construction retention payment to Estate Design & Construction, 35 days after recordation of the Notice of Completion by the Los Angeles County Registrar-Recorder's Office, contingent upon no claims being filed on the project, and the contractor posting an acceptable warrant bond with the City. E. Consideration of a Public Health Services Contract with the Los Angeles County Department of Public Health (Jun) 1)Approved the Public Health Service Contract with the Los Angeles County Department of Public Health (LADPH) to allow continued health services as codified by reference in Chapter 8.04 of the Rancho Palos Verdes Municipal Code; and, 2) Authorized the City Manager and City Clerk to execute the PSA in a form approved by the City Attorney. Consideration to continue the emergency justification for work and emergency contracting for the Greater Portuguese Bend-Ancient Altamira Landslide Emergency Project. (Copp) This item was removed for separate consideration. CONSENT CALENDAR ITEM(S) PULLED FOR PUBLIC COMMENT: F. Consideration to continue the emergency justification for work and emergency contracting for the Greater Portuguese Bend-Ancient Altamira Landslide Emergency Project. (Copp) City Clerk Takaoka reported that there was one request to speak. The following members of the public addressed the City Council: Eva Albuja (Via Zoom). Councilmember Ferraro moved, seconded by Mayor Pro Tem Seo, to approve Staff Recommendation as follows: 1) Reconfirmed, by a four-fifths vote, there is a need to continue the work on the Vertical Deep Dewatering Emergency Project declared by Council-adopted Resolution No. 2024-20 on May 7, 2024, finding an emergency exists requiring immediate action in the Greater Portuguese Bend-Ancient Altamira Landslide Complex to seek to mitigate the movement of the landslide; and, 2) Directed the City Clerk to confirm the same in the minutes of this City Council meeting, via Minute Order, 111 reflecting this action. Consideration to conduct the 2024 annual review of Trump National Golf Club's compliance with its maintenance obligations (Case No. PLMH2O25-0001). (Seeraty) City Clerk Takaoka reported that the notice of the public hearing was duly published, late correspondence was distributed and there were two requests to speak. Mayor Bradley declared the public hearing open. Amy Seeraty, Senior Planner presented a detailed staff report and PowerPoint presentation. Council Members asked questions of Staff. Mayor Bradley closed the public hearing Councilmember Lewis moved, seconded by Councilmember Ferraro, to approve staff recommendation as follows: Received and filed the 2024 Annual Review of Trump National Golf Club's compliance with its maintenance obligations relating to trails and open space pursuant to the 2018 City Council-approved Amended and Restated Declaration of Restrictions (Case No. PLMH2O25-0001). The motion passed on the following roll call vote: AYES: Ferraro, Lewis, Perestam, Seo and Mayor Bradley NOES: None REGULAR BUSINESS: 2. Consideration to review assessment rate options for the Citywide Landscaping and Lightning Maintenance District (LLMD) for Fiscal Year (FY) 2025-26.(Hevener) City Clerk Takaoka reported that there were no requests to speak. Director of Public Works, Ramzi Awwad introduced Project Manager, Vanessa Hevener who presented a detailed staff report and PowerPoint presentation and shared Principal / City Engineer, Deanna Fraley is available for questions. Project Manager, Vanessa Hevener introduced Harris and Associates consultant Chris Thomas who was available via Zoom for questions. Discussion ensued among Council Members and Staff and questions were asked of City Attorney Wynder and Harris and Associates consultant Chris Thomas on the retroactive date of the levy. Mayor Bradley moved, seconded by Mayor Pro Tern Seo, to approve Staff Recommendation as follows: 1) Received and filed the report on the Citywide Landscaping .and Lighting Maintenance (LLMD); 2) Directed Staff to initiate proceedings to set the FY 2025-26 LLMD levy at a rate of: $23.50 per parcel for single family residences, which was the rate at the time that Proposition 218 came into effect on July 1, 1997; and, 3) Based on the above, directed Staff to prepare an Engineer's Report for the LLMD for FY 2025-26 and return at a future date with the appropriate resolutions memorializing the Council's directive for future consideration at a duly noticed public hearing.
