FISCAL IMPACT: The proposed draft revisions to the 2021-2029 Housing Element and the implementing documents, such as the resolutions and ordinance s amending the Housing Element, General Plan, Local Coastal Plan, and Zoning Code will be prepared in-house by City Staff. The revision to the Zoning Map would be prepared by the GIS mapping consultant as part of their existing contract. The City Council also adopted Resolution No. 2024-17 to forward to the California Coastal Commission the amendments to the Local Coastal Program (LCP) Coastal Specific Plan and zoning map related to the 6th Cycle Housing Element actions in the Coastal Zone, consistent with State Housing Law. Additionally, in order to protect the health, safety, and welfare of the residents of the City of Rancho Palos Verdes, on April 16, 2024, the City Council unanimously adopted Urgency Ordinance No. 678U approving zoning amendments inclusive of Zoning Map amendments and development standards for Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs), to immediately effectuate the Housing Element, including rezoning sufficient sites to accommodate the City’s Regional Housing Needs Allocation (RHNA) by adopting the implementation actions to effectuate the City’s Revised Final 2021-2029 Housing Element. The City Council also initiated code amendment proceedings related to amendments to Chapter 17.40 (Overlay Control Districts), Chapter 17.96 (Definitions), Chapter 17.76 (Miscellaneous Permits and Standards, Chapter 17.10 (Accessory Dwelling Unit and Junior Accessory Dwelling Unit Development Standards) and other code sections as applicable of Title 17 of the Rancho Palos Verdes Municipal Code (RPVMC) to adopt the zoning and code amendments that were adopted in Urgency Ordinance No. 678U by regular ordinance. On June 4, 2024, City Council adopted Urgency Ordinance No. 680U which amended Title 17 (Zoning) to effectuate the Revised Final 2021 -2029 Housing Element, incorporating non-substantive revisions that were recommended by HCD. The City Council also introduced Ordinance No. 681, which amended Title 17 (Zoning) of the RPVMC to effectuate the Revised Final 2021-2029 Housing Element by regular ordinance. 2 On June 18, 2024, as part of the second reading of Ordinance No. 681, at the request of then-Mayor Pro Tem Alegria and then-Councilmember Bradley (now Mayor Bradley), the City Council directed City Staff to come back at a future meeting date with an evaluation of properties that could be removed from the Housing Sites Inventory while still remaining in compliance with State Housing Laws. The City Council directed City Staff to assess the 0 Clipper Drive property (Site No. 16 of the Housing Sites Inventory), but not exclusively that site. This directive was in response to a statement made by HC D’s Analyst, Fidel Herrera that the City exceeded its RHNA. On September 3, 2024, City Council gave direction to City Staff to work with HCD to prepare removing Site Nos. 16, 18, and 19 from the Housing Sites Inventory of the Housing Element. The reason these sites were selected for possible removal is due to the minimal number of units they would produce, the types of units would be market rate and not serve lower income housing, and that with the removal of these, the City would still meet the RHNA requirements. DISCUSSION: The City Council’s direction included authorization for City Staff to submit the proposed draft revisions to the Housing Site Inventory to HCD through the formal review process to determine if the draft, as revised, would be in compliance with State Housing Laws. On August 29, 2024, City Staff confirmed with HCD Staff what the process would be for the City to consider removing any of the sites from the Housing Sites Inventory of the Housing Element. As was presented to the City Council at the September 3rd meeting, and as confirmed by HCD, the process was as follows: • Prepare a draft (not adopted) proposing to remove the site(s) as directed by City Council • Submit draft for review by HCD through the formal review process to determine if it complies with State Housing Laws • If HCD determines the draft to be in compliance, prepare necessary documents (environmental, resolutions, zoning amendments, etc.) • Hold appropriately noticed public hearing at Planning Commission for recommendation • Hold appropriately noticed public hearing at City Council for introduction of ordinances • City Council adopt resolutions and ordinances to effectuate revisions to the Housing Element HCD Staff confirmed that the City would need to follow this process so as not to jeopardize the certification status of the City’s adopted Housing Element. City Staff reviewed the full Housing Element to make the necessary draft revisions that reflect City Council’s direction. As required by State Housing Element Law, the Housing Element was posted on the City’s website and made available to interested parties 7 days before it was submitted to HCD. The draft revised Housing Element (Attachment B) was submitted for formal review by HCD on November 26, 2024. 3 On January 23, 2025, the Community Development Department received a letter from HCD (Attachment D) confirming that the City’s draft revisions to the 2021-2029 Housing Element (including the removal of Site Nos. 16, 18, 19 from the Housing Site Inventory) will continue to comply with State Housing Element Law once the amendments have been adopted, submitted and reviewed by HCD. The City Council is now being asked to review HCD’s formal review letter of the proposed draft revisions to the City Council-adopted 2021-2029 Housing Element to remove Site Nos. 16, 18, and 19 from the Housing Sites Inventory. If deemed acceptable, direct staff to initiate the public hearing proceedings to consider removing Site Nos. 16, 18, and 19 from the Housing Site Inventory and amending the General Plan, Zoning Code, and Zoning Map to effectuate those revisions at a future duly noticed public hearing. Due to the recommendation to adopt a resolution rescinding Resolution No. 2024-17 this item is being considered as a public hearing, and applicable noticing has been completed. Next Steps If the City Council initiates proceedings to adopt the draft revised 2021 -2029 Housing Element and amendments to effectuate document revisions, City Staff anticipates presenting the draft revised 2021-2029 Housing Element to the Planning Commission on April 22, 2025, and subsequently the City Council on June 3, 2025. City Staff will also forward the adopted resolution to the California Coastal Commission once the resolution has been approved. Environmental Review These proposed amendments to the Housing Element would not trigger any of the circumstances in Public Resources Code, section 21166 and CEQA Guidelines, section 15162 that would require subsequent environmental review, as these amendments would result in less impacts to the environment. ADDITIONAL INFORMATION: Preliminary Application On November 22, 2024, a SB330 Preliminary Application was submitted for the property commonly referred to as 0 Clipper Road (APN: 7573 -006-024). Pursuant to Government Code Section 65941.1(d)(1) within 180 calendar days after submitting a preliminary application, no later than May 21, 2025, the applicant shall submit an application for a development project that includes all of the information required to process the development application consistent with the RPVMC and Government Code Sections 65940, 65941, and 65941.5. Failure to meet this deadline shall result in the expiration of the Preliminary Application. 4 Public Correspondence On February 20, 2025, a public notice was issued and published in the Palos Verdes Peninsula News providing notification of the City Council’s review and consideration of the subject item. Staff received three public comments (Attachment E), in support of removing Site Nos. 16, 18, and 19 from the Housing Sites Inventory and expressing concerns specifically regarding 0 Clipper Road and attaching prior correspondence for City Council review. Public comments submitted after publishing this staff report will be provided to the City Council as late correspondence at the March 18 meeting. CONCLUSION: The City Council is being asked to consider initiating proceedings to adopt the draft revised 2021-2029 Housing Element to remove Sites No. 16, 18, and 19 and to amend the General Plan, Zoning Code, and Zoning Map to effectuate those revisions; and to adopt the attached resolution to rescind Resolution No, 2024-17 by requesting the California Coastal Commission to consider amending the City’s LCP related to the 6th Cycle Housing Element ALTERNATIVES: In addition to the Staff’s recommendations, the following alternative actions are available for the City Council’s consideration: 1. Take no action and proceed to receive and file this report. The current 2021 -2029 Housing Element adopted on April 16, 2024, would remain in effect. 2. Take other action, as deemed appropriate. 5 Resolution No. 2025-__ Page 1 of 3 RESOLUTION NO. 2025- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, RESCINDING RANCHO PALOS VERDES CITY COUNCIL RESOLUTION NO. 2024-17, A REQUEST FOR CALIFORNIA COASTAL COMMISSION TO CONSIDER AMENDMENTS TO THE LOCAL COASTAL PROGRAM (LCP) COASTAL SPECIFIC PLAN AND ZONING MAP RELATED TO THE 6th CYCLE HOUSING ELEMENT. WHEREAS, the California Coastal Commission has certified the Local Coastal Plan (LCP) of the City of Rancho Palos Verdes; and WHEREAS, on April 16, 2024, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 2024-17, forwarding to the Coastal Commission the amendments to the Local Coastal Program (LCP) Coastal Specific Plan and Zoning Map related to the 6th Cycle Housing Element actions in the coastal zone, consistent with state law; and WHEREAS, since the adoption of Resolution No. 2024 -17, new information and considerations have emerged that necessitated a re-evaluation of the amendments proposed in the aforementioned resolution; and WHEREAS, the City Council has determined that it is in the best interest of the City of Rancho Palos Verdes and its residents to rescind Resolution No. 2024-17 and retract the request to the California Coastal Commission to consider a proposed revised draft to the City’s 2021-2029 Housing Element that would remove , from the City’s Coastal Zone, Site No. 16 of the Housing sites Inventory, where such proposed revisions would render amendments to the Local Coastal Program and associated planning and zoning documents unnecessary; and WHEREAS, Public Resources Code Section 30514 provides that any proposed amendments to a certified local coastal program shall be submitted to, and processed by, the California Coastal Commission in accordance with the applicable procedures and time limits specified in Sections 30512 and 30513; and WHEREAS, the City Council desires to ensure compliance with all applicable state laws and regulations while also considering the community's input and interests; and WHEREAS, the California Coastal Commission has not yet considered the amendments to the LCP forwarded via Resolution No. 2024 -17; A-1 Resolution No. 2025-__ Page 2 of 3 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Palos Verdes as follows: SECTION 1. The City Council hereby finds that the above recitals are true and correct and are incorporated herein by reference as if set forth in full. SECTION 2. Resolution No. 2024-17, adopted on April 16, 2024, is hereby rescinded in its entirety. The City Council hereby retracts its request for the California Coastal Commission to consider certification of the LCP Coastal Specific Plan amendments and related Zoning Map, in order for the City Council to consider removing Site No. 16 from the adopted 2021-2029 Housing Element and adopting such implementation measures that would leave the LCP Coastal Specific Plan and Zoning for Site No. 16 designated as it was as of April 15, 2024. SECTION 3. If within six months of the adoption of this resolution the City Council does not remove Site No. 16 from the adopted 2021-2029 Housing Element or does not implement such revision reverting the LCP Coastal Specific Plan and Zoning for Site No. 16 as it was as of April 15, 2024, the City Council will consider reinitiating the actions of Resolution No. 2024-17 at a duly noticed public hearing. SECTION 4. This resolution shall take effect immediately upon its adoption. SECTION 5. The City Council hereby submits this adopted resolution to the California Coastal Commission so they may remove from consideration the amendments to the LCP forwarded through Resolution 2024 -17.
