Western Avenue in the northeast corner of the City, bordering the Cities of Lomita, Rolling Hills Estates and Los Angeles. The cemetery was first established in 1948 and, at the time, was located within an unincorporated area of Los Angeles County. The property became part of the City of Rancho Palos Verdes when the “Eastview” area was annexed in 1984. 1 01203.0005/1054401.1 On February 19, 1991, the City Council certified a Mitigated Negative Declaration and approved Conditional Use Permit (CUP) No. 155 for the Green Hills Memorial Park (Green Hills) Cemetery Master Plan, which called for the development of the cemetery site over the next 100 years. On April 24, 2007, the Planning Commission certified a Mitigated Negative Declaration and approved a Revision to CUP No. 155 (P.C. Resolution No. 2007 -33) revising the Green Hills Cemetery Master Plan for the development of the cemetery site over the next 30 to 50 years, including additional grading to accommodate future interments and the construction of mausoleum buildings. As part of this approval, Mitigation Measure No. AQ-14 of Resolution No. 2007-33 requires an annual compliance review to assess Green Hills’ compliance with the CUP’s Conditions of Approval. Conducting an annual compliance review provides an opportunity for the City Council to assess the effectiveness of the existing conditions based on current operations and the ability to add, delete, and modify conditions based on changed circumstances or unforeseen impacts that may not have been addressed as part of the previous approval. In 2014, the Planning Commission conducted the first annual review of the project, which was appealed and heard by the City Council. Section 17.60.50.D of the Rancho Palos Verdes Municipal Code (RPVMC) requires all subsequent annual reviews to be conducted by the same deciding body that took the final action. Accordingly, the City Council has conducted all subsequent annual compliance reviews, finding that Green Hills continues to operate in compliance with the Conditions of Approval and approving the following salient revisions to the Conditions of Approval for the project: • November 17, 2015 – Allowing the mausoleum in Area 11 (i.e., Pacific Terrace/Memorial Terrace) to remain in accordance with its 2007 approvals and permits • January 31, 2017 – Reorganizing the conditions by topic and development area, as well as to further clarify or enumerate the conditions • February 6, 2018 – Clarifying existing conditions, permitting a fence/wall along the north and south property lines, improving dust control measures in Area 6, and amending the hours of operations • January 21, 2020 – o Changed the Neighborhood Advisory Committee meeting frequency to at least once each calendar year but no more than four times per calendar year (Condition No.17) o Allowed a temporary sign to be hung from the primary identification sign up to six times a year (Condition No.18) o Allowed a traveling half-size replica of the Vietnam Veterans Memorial to be located on the property up to once per calendar year (Condition No. 20) • December 7, 2021 – Allowed burials on the roof of Inspiration Slope Mausoleum subject to specific conditions (Condition No. 6) • February 21, 2023 – Approved a Conditional Use Permit Revision and a Major Grading Permit to allow the construction of a 2,800-square-foot crematorium building with 193.4 cubic yards of associated grading to replace the cemetery’s 2 01203.0005/1054401.1 existing cremation facility; and amended Condition No. 12.c to reduce the total number of existing parking spaces in the Administrative Building parking lot from 95 to 93. No revisions to the Conditions of Approval were proposed as part of the 2018, 2020 and 2023 annual compliance reviews held in 2019, 2021, and 2024, respectively . The City Council received and filed reports at meetings on March 19, 2019, March 2, 2021, and February 20, 2024, finding that Green Hills was following the Conditions of Approval of its CUP. DISCUSSION: This report will discuss the 2024 Green Hills Memorial Park CUP Compliance Review. 2024 Annual Compliance Review of the Existing Conditions of Approval Over the past year, the City has been monitoring Green Hills’ compliance with the Conditions of Approval adopted in Resolution No. 2023-08 (Attachment A) by the City Council. The City’s compliance review is discussed in the following order: 1. Green Hills’ compliance with action items; and 2. Green Hills’ compliance with operational Conditions of Approval 1. Compliance with Action Items Below are salient conditions that require specific actions to be taken within a certain period, followed by Staff’s analysis. Conditions that have already been met and addressed in previous annual reviews are not included below. • Condition No. 2 – This condition outlines the review process for improvement requests allowed pursuant to the Conditions of Approval, including the proper decision-making body for certain applications, the public noticing process, and the appeal process. All improvement requests (listed below) over the past year have been properly processed in accordance with this condition, and Green Hills is in compliance with this condition. Specifically, Green Hills submitted the following application in December 2024, with review and approval by the Director of Community Development in January 2025: ▪ Major Grading Permit (Case No. PLGR2024-0027) - In January 2025, an application was approved for a Major Grading Permit for a proposal to conduct 4,658 cubic yards of balanced grading (2,335 cubic yards of cut and 2,335 cubic yards of fill) to accommodate the installation of vaults in unimproved portions of the Sky Ridge Extension area in Area 4 of the Master Plan (Attachment E). • Condition No. 17 – This condition requires Green Hills to establish a Neighborhood Advisory Committee (NAC) to meet at least once each calendar 3 01203.0005/1054401.1 year, but no more than four times per calendar year, and provide reports to the City Council. The NAC was established in 2017, and prior to 2020, meetings occurred quarterly at City Hall, with the meeting summaries provided to the City Council through the City Manager’s Weekly Administrative Report. However, Condition No. 17 was modified in 2020, per City Council Resolution No. 2020 -03, to instead require at least one, but no more than four NAC meetings, per calendar year. Staff held one virtual NAC meeting in December 2024. The meeting summary is attached to this report (Attachment C) and the December 2024 meeting summary was included in the December 18, 2024 City Manager’s Weekly Administrative Report. The minutes of the meeting s including the December 2024 NAC meeting are also available on the City website. As one meeting was held during the 2024 calendar year, and because the meeting summary was provided to the City Council via the City Manager’s Weekly Administrative Report, Green Hills is in compliance with this condition. • Condition Nos. 24 and 25 – These conditions require Green Hills to submit permit documentation for the following: o Fuel storage from the South Coast Air Quality Management District and Los Angeles County Fire Prevention Bureau; o Chemical storage from the Los Angeles County Fire Department; Hazardous Maintenance Division Section and Fire Prevention Bureau; o Crematory operations from the South Coast Air Quality Management District; and o Current and valid permits and/or licenses from the State Cemetery and Funeral Bureau. On December 11, 2024, Green Hills submitted all the required permits (Attachment B), which were reviewed and accepted by Staff. Therefore, Green Hills is in compliance with Condition Nos. 24 and 25. In summary, based on the discussion above, Staff has determined that Green Hills is in compliance with the action item Conditions of Approval. 2. Compliance with Operational Conditions Below are the Conditions of Approval that regulate operations at Green Hills to minimize impacts to neighboring properties. The salient operational conditions include, but are not limited to, the following: • Condition No. 14 (Noise) - This condition requires that Green Hills conduct its activities on site to not create noise nuisances to neighboring properties and that no noise emanating from the property shall exceed 65 dBA at the common property lines abutting a Residential Zoning District. Green Hills has met this condition by continuing to implement various measures throughout the park, including prohibiting amplified music in areas adjacent to residences, limiting the length of time that the music plays, and having security patrol the perimeter 4 01203.0005/1054401.1 of the site to ensure that no music is played from visitors’ car radios or portable radios. At the December 2024 NAC meeting, an NAC member mentioned that the volume for a recent event on the Green Hills property was excessively loud and asked that Green Hills test the volume before the events in the future. Green Hills Staff stated that they are receptive to that request and that residents are welcome to call them directly with any future noise concerns. • Condition No. 16 (Security) – This condition requires that at least one security employee shall be on duty patrolling and monitoring activities on the property for the entirety of the cemetery operation hours. Green Hills has met this condition by providing the required level of security but has also retained additional security officers who patrol the site on Friday, Saturday, and Sunday, from 11 a.m. until the park closes, and are available on call when needed as well. Green Hills also stated that they have a live security person to a nswer their phone from 6:00 AM to 10:00 PM daily. • Condition No. 19 (Construction) – This condition requires that construction on the site be maintained in a neat and orderly manner, including storage of equipment and supplies, proper disposal of trash and debris, and that Green Hills staff are properly trained in accordance with California Division of Occupational Safety and Health (Cal/OSHA) rules. Additionally, Green Hills’ representatives have stated that employees complete Cal OSHA training, as well as continuing education, on a regular basis. Mitigation Measures AQ-1 through AQ-Condition No. 14 – These conditions include various measures to protect air quality, including but not limited to the regular watering down of stockpiled fill and unpaved construction areas, discontinuing earth moving during periods of high wind, and limiting the speed of on-site construction vehicles on unpaved roads. Staff received no complaints during the 2024 calendar year regarding dust, as any complaints were likely conveyed directly to Green Hills staff to address. However, a Rolling Hills Riviera HOA member mentioned at the 2024 NAC meeting concerns related to construction dust and noise. Green Hills staff indicated that they are addressing the reported concerns that are associated with construction via regular watering of areas. Staff has reminded Green Hills’ representatives in the past about these air quality related mitigation measures, and that they apply to both active grading operations, as well as stored soil. Staff received one anonymous complaint in October 2024 about hay blowing from the park into residential swimming pools. Staff reached out to Green Hills staff to remind them that for any future events with hay and/or hay bales, they must ensure they have barriers to prevent blowing of hay onto other properties. Staff has received minimal correspondence from adjacent neighbors since the last annual review. In general, operational complaints submitted to Staff have substantially reduced 5 01203.0005/1054401.1 over the past several years. Representatives of the abutting Peninsula Verde HOA (to the north) and Rolling Hills Riviera HOA (to the south), who have made complaints in the past, have indicated that the operational impacts have improved over the past coup le of years and that Green Hills has not only been responsive, but proactive in addressing operational concerns. Staff believes the number of concerns expressed to the City continues to decline because Green Hills has been preemptive in identifying and addressing potential impacts before they become a problem, including informing adjacent residents of upcoming large visitations and events. Therefore, Staff believes Green Hills is in compliance with its operational conditions under Conditional Use Permit No. 155 for 2024 and recommends receiving and filing this report. ADDITIONAL INFORMATION: City Council Members Residing within 500 Feet No City Council members reside within 500 feet of the project boundary limits. Public Notice and Correspondence On February 13, 2025, a 15-day public notice inviting public comments was provided to all property owners within a 700-foot radius of the site (expanded beyond the required 500-foot radius), affected HOAs, listserv subscribers, members of the NAC, and published in the Peninsula News. To date, Staff has received one email in response to the public notice, which is discussed below. In the event that any additional substantive public correspondence is received after the transmittal of this report, it will be provided to the City Council as late correspondence. On February 20, 2025, Staff received an email (Attachment D) from Mr. Roger Metzler, resident located at 1921 Avenida Feliciano. He expressed concerns about what appears to be dead foliage in the four eucalyptus trees that are located west of the administration building, shown on the site plan on the next page. CUP Condition No. 21 states, in part: “All existing and future landscaping shall be properly maintained in a healthy and trimmed manner at all times.” Accordingly, Staff reached out to Green Hills which stated that they utilize an arborist who trims their trees around the park on a rotating basis. However, in response to this neighbor’s concern, Green Hills has contacted their arborist and have already scheduled a tree trimming for the week of February 24th. Staff will provide an update the Council at the March 4th meeting regarding the status of this trimming. 6 01203.0005/1054401.1 Complaint about Water/Mud Leak On August 6, 2024, Code Enforcement Staff received a complaint about water and mud leaking onto the sidewalk from the retaining wall that runs along S. Western Avenue. Upon confirmation of the complaint, Staff sent a courtesy notice to Green Hills’ staff the same day. On August 14, 2024, Staff visited the site and confirmed that the mud and water had been cleaned, and so the complaint case was closed. May 2025 Installation of “The Moving Wall” In 2020, Green Hills staff requested a CUP revision to allow The Moving Wall, a traveling half-size replica of the Vietnam Veterans Memorial, to be installed on the property once every calendar year. Resolution No. 2020-03 was adopted by the City Council on January 21, 2020, and included the following conditions: f. The Moving Wall. (Traveling half-size replica of the Vietnam Veterans Memorial). The property owner shall be allowed to have The Moving Wall located on the property no more than 10 calendar days per calendar year, subject to the following: i. The Moving Wall shall be allowed to remain on display for no more than 10 days. ii. Security. The Moving Wall shall be monitored 24 -hours a day by security staff hired by the property owner. Any visitors wishing to visit the wall after the hours of operation detailed in Condition No. 20b shall be escorted on and off the property. iii. Plans. At least 60 days prior to the installation of The Moving Wall on the property, the property owner shall notify the Director of Community Development where The Moving Wall is proposed to be placed. iv. Lighting. Any temporary lighting proposed for The Moving Wall shall comply with Mitigation Measures A-1, A-2, and A-3 as detailed in Condition No. 22. 7 01203.0005/1054401.1 Green Hills Staff has indicated that they plan on installing The Moving Wall in May 2025, where it will be available for public visitation for no more than 10 calendar days. Additional updates regarding this proposed project will be provided as part of the City Manager’s Weekly Administrative Report once more information becomes available. ALTERNATIVES: In addition to the Staff recommendation, the following alternative actions are available for the City Council’s consideration: 1. Identify areas of concern regarding compliance with the Council-adopted Conditions of Approval and direct Staff to address these concerns at a future public hearing. 2. Direct Staff to revise the language and/or conditions based upon City Council discussion and public comment and either read into the record the revisions or continue this matter to a future public hearing. 3. Determine that Green Hills is not in compliance with the City Council -adopted Conditions of Approval and provide Staff and Green Hills with further direction. 4. Project & Construction Update/Questions and Comments Green Hills (GH) Staff mentioned that they recently submitted a grading permit application for the installation of lawn crypts in the Sky Ridge Extension area, which is along the northern property line. Senior Planner Seeraty interjected that the City will be mailing out the public notices this week. GH also stated that they are still working on the south side of the Arroyo Falls area. Regarding the Sky Ridge Extension area, Mr. Martin asked how much dirt they were going to be moving and how long that project would take. GH stated that it will be a balanced project (i.e., equal cut and equal fill), and that it would likely take approximately 3-4 weeks. GH staff also stated that a few trucks would be going into Area 6 with the excavated dirt. Mr. Reher then asked if there is anything planned for the next year that has not yet been applied for, and Mr. Resich stated that they are currently working on the plans for the northern portion of Inspiration Slope and may submit to the City for approval somewhere in mid-2025, and ideally would be heard by the City Council sometime in May or June 2025. Mr. Resich also stated that once they have the plans finalized, they will schedule another NAC meeting so all members can review the plans and provide feedback. C-1 Green Hills Neighborhood Advisory Committee Summary Report December 16, 2024 Page 2 of 3 Mr. Bynon mentioned that the “Moving Wall”, which is a traveling half-size replica of the Vietnam Veterans Memorial, will be visiting the property this year. Mr. Espolt mentioned that he completed the annual submittal of various documents to Staff, and that the information about the “Moving Wall” was included. Senior Planner Seeraty thanked him. Mr. Martin asked if GH has already constructed the proposed crematorium building and Mr. Resich stated that the crematorium building that was approved by the City Council in February 2023 (to house the crematorium that is currently existing in the Administration building) is still in the Building & Safety plan check process. Mr. Martin asked when the project was to start and the estimated length of construction and Mr. Resich stated that they hoped to start sometime within the first quarter of 2025, and that construction could take approximately 6-7 months. Mr. Martin stated that his main concerns are the dust and noise from the equipment bringing in dirt to Area 6 behind his house, and that they obey the appropriate hours of work. Mr. Bynon stated that GH did purchase a new water truck, which is kept primarily in Area 6, where the spoils from excavations are stored. He also stated that they will keep it on the north side of the property during the excavation for the Sky Ridge Extension project, and that they are watering down the Arroyo Falls area and the road along the south property line on weekends as well. Mr. Turner then presented some photos related to his concern about coyotes using the pathway between the north wall of GH and the chain link fence on the property owners’ side to access their backyards. He asked if GH could plug up the holes below and between the fences. There was a brief discussion about the uncertainty regarding whether the coyotes are coming from the GH property or the adjacent streets, and that the coyotes can jump high fences. Mr. Resich stated that they work with the City and Fish and Wildlife staff on abatement programs and will do their best to plug holes. Mr. Turner also asked about the locks on the fence gates and while Mr. Resich said they will be unlocked if their landscape staff are doing work in the areas between the adjacent properties’ chain link fences and the GH wall. Mr. Bynon said that they are not doing landscape maintenance at this time, and so he will check to ensure the gates are locked. There was a discussion between GH staff and the other NAC members regarding a few adjacent new neighbors completing some unauthorized trimming of the podocarpus trees that GH was required to plant on their property for screening purposes. It was agreed that GH staff will draft a reminder letter that the members of that HOA will provide to these neighbors. Mr. Turner then asked about a change in GH’s security company and stated that he does have the new number but asked about the hours when he can call. Mr. Resich stated that they have a live security person available to answer the phone from 6:00 AM to 10:00 PM. Mr. Bynon also stated that they are enforcing the no drinking and no smoking rules with no tolerance. Some addition discussion ensued about an adjacent church in Rollling Hills having some events with loud music, and Mr. Martin mentioned that the volume for a recent event on the GH property was excessively loud and asked that GH staff test the volume before the events in the future. Mr. Resich stated that they are receptive to that request. Mr. Martin asked if there will be any proposed changes in the report for the annual review which is tentatively scheduled for the March 4, 2025 City Council C-2 Green Hills Neighborhood Advisory Committee Summary Report December 16, 2024 Page 3 of 3 meeting and Mr. Bynon responded that there is not. Some additional discussion ensued about some beautification work occurring on S. Western Avenue, Cal Trans projects, some new bike lanes on Westmont Drive, and Los Angeles County zoning density changes. Regarding the NAC member’s frustration with the bike lanes, Director Forbes stated that she would convey this information to the Public Works staff who is interacting with Cal Trans staff. III. I have referenced the highlighted portion of the following condition in the Staff Report as it relates to your request/comment: 21. Landscaping and Irrigation. Landscaping and irrigation in all setbacks require review and approval by the Director prior to installation. -lrrigation systems shall be designed to provide adequate coverage with no over-spray, runoff, or excessive quantities of water output. Use of drip irrigation systems is required wherever possible. A low water use turf shall be used in all new lawn areas. Prior to installation, the Director shall review and approve the landscape and irrigation plan for the setback areas. All existing and future landscaping shall be properly maintained in a healthy and trimmed manner at all times. Also, I have noted in the report that I will provide a trimming update at the City Council meeting, since Green Hills stated they should be able to complete the trimming this week, but the staff report will be distributed tomorrow or Wednesday. Roger Metzler 1921 Avenida Feliciano metzler.roger@gmail.com D-3 Ms. Amy Seeraty, Senior Planner Community Development Department, Planning Division City of Rancho Palos Verdes Dear Amy, As part of the staff analysis of the annual compliance review for the Green Hills Memorial Park Master Plan (Case No. PLCU2025-0001), I would like the staff to consider a condition that Green Hills thin and prune the 4 eucalyptus trees on the north side, near the fork, of the road along their southern border. There is quite a bit of dry and dead foliage in these trees that presents a significant fire hazard during the dry season. There is heightened awareness of such danger after witnessing the damage caused by the recent Eaton and Pacific Palisades wildfires. Now would be a good time to consider mitigating the risks caused by this dry foliage. There are a couple of obvious dead limbs in one of the trees (3rd picture below) that should not be removed, as they are favorite perches of the local red-tailed hawks. I believe that the dead foliage in that tree can be safely removed without adverse effects on the hawks, but perhaps Green Hills should consult a naturalist to verify this before performing any work. The dense and dry foliage in the other 3 trees can likely be thinned to reduce the risk of fire and promote the health of the trees themselves, without adverse effects on the natural habitat. This has been happening for months. I sent a picture and note to Nick Resich at GH, but I did not hear back nor has there been a fix or clean up of the mud. I'm afraid someone may slip and fall due to this active leak. I suspect it's either a leak from their irrigation system or a failure in the drainage behind the wall, which should funnel the water lower into the ground rather than through the wall.
