PC MINS 20240611 Approved 7/23/24 CITY OF RANCHO PALOS VERDES PLANNING COMMISSION MINUTES REGULAR MEETING DUNE 11, 2024 CALL TO ORDER A regular meeting of the Rancho Palos Verdes Planning Commission was called to order by Vice Chair Santarosa at 7:04 P.M. in accordance with the requirements of the Ralph M. Brown Act, Section 54950 et seq. of the Government Code. Remote participation by any Committee/Commission member shall be in accordance with Subdivisions (b)(3) or (f) of Government Code Section 54953. The meetings are held at Hesse Park, McTaggart Hall, 29301 Hawthorne Boulevard and/or via teleconference for staff/consultants/participants using the Zoom platform and broadcast live on the City's website at rpvca.gov/agendas and on PVPty channels Cox 35 and Frontier FiberOptic 39. Members of the public could observe and participate using the zoom participation feature and in person. PLEDGE OF ALLEGIANCE Pledge of Allegiance led by Commissioner Nulman. ROLL CALL Planning Commission roll call was answered as follows, Present: Brach, Nelson, Nulman, Perestam, Saadatnejadi, Santarosa and Chair Chura via Zoom. Absent: None Also, present were Director Forbes, Deputy Director Silva, City Attorney Fox, Senior Planner Seeraty, Associate Planner Nemeth and Senior Planner Alvarez via Zoom. THE COMMISSION VOTED TO APPROVE CHAIR CHURA'S REQUEST TO JOIN REMOTELY PURSUANT TO GOVERNMENT CODE 54953(F). CHAIR CHURA DISCLOSED THAT THERE WERE NO INDIVIDUALS IN THE ROOM FROM WHICH HE WAS PARTICIPATING. ALL VOTES FOR THE MEETING WERE TAKEN AS ROLL CALL VOTES. APPROVAL OF AGENDA Approved as presented. COMMUNICATION: City Council Items: None Staff: Director Forbes stated that at the June 18 meeting the City Council will vote and fill vacancies on all Committees and the Commission. Commission: Vice Chair Santarosa thanked all outgoing Planning Commissioners. COMMENTS FROM THE AUDIENCE (regarding non-agenda items): None CONSENT CALENDAR: 1. APPROVAL OF THE MAY 14, 2024 P.C. MINUTES (LG) COMMISSIONER BRACH MOVED SECONDED BY COMMISSIONER NESLON TO APPROVE THE CONSENT CALENDAR WITH VICE CHAIR SANTAROSA ABSTAINING. CONTINUED PUBLIC HEARINGS: 2. VIEW RESTORATION PERMIT— (CASE NO. PLVR2022-0010): N. Enrose Ave (RN) Associate Planner Nemeth presented the staff report requesting to restore the view from the viewing areas at 29642 N. Enrose Avenue, 29648 N. Enrose Avenue, and 29636 N. Enrose Avenue - Foliage property at 2138 Fairhill Drive. The Planning Commission asked clarifying questions of staff. Vice Chair Santarosa opened the public hearing. The following members of the public addressed the Planning Commission, Alicia MacGowan, Ryan MacGowan, Frank Albert and Tracey Wells. Vice Chair Santarosa closed the public hearing. Discussion ensued amongst the Planning Commission. FIRST MOTION: COMMISSIONER NELSON MOVED SECONDED BY COMMISSIONER SAADATNEJADI TO ADOPT STAFF RECOMMENDATIONS. THE MOTION FAILED ON A VOTE OF 3-4. The Commission continued discussions related to the view impact from various tree heights. SECOND MOTION: CHAIR CHURA MOVED SECONDED BY VICE CHAIR SANTAROSA TO ADOPT P.C. RESOLUTION 2024-18, CONDITIONALLY APPROVING A VIEW RESTORATION PERMIT (CASE NO. PLVR 2022-0010) REQUIRING THE FOLIAGE OWNER AT 2138 FAIRHILL DR. TO CROWN REDUCE ONE FICUS TREE 10 FEET FROM THE TOP OF THE TREE CROWN OR NO MORE THAN 40 FEET IN HEIGHT, WHICH IS THE SAME HEIGHT LEVEL ILLUSTRATED IN ATTACHMENT NO. 3A, WITH THE OPTION TO REMOVE Planning Commission Minutes June 11. 2024 Page 2 AND REPLACE IT, AS DESCRIBED IN CONDITION OF APPROVAL NO. 3, IN ORDER TO RESTORE THE APPLICANTS' VIEWS FROM 29642 N. ENROSE AVE., 29648 N. ENROSE AVE., AND 29636 N. ENROSE AVE. THE MOTION PASSED ON A VOTE OF 7-0. NEW PUBLIC HEARINGS: 3. CODE AMENDMENT FOR DEVELOPMENT APPLICATIONS AND SIGN CODE- (CASE NO. PLCA2024- 0005): Citywide (AS) Senior Planner Seeraty presented the staff report requesting to amend d §17.78.030 (Consideration of Multiple Applications) and amend §17.75.B.3 (Removal Without Compensation; Legal Nonconforming Signs) of Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code (Case Nos. PLCA2024-0006, and PLCA2024-0005, respectively). The Commission asked clarifying questions of Staff. CHAIR CHURA MOVED SECONDED BY COMMISSIONER NULMAN TO ADOPT P.C. RESOLUTION NO. 2024-19, RECOMMENDING TO THE CITY COUNCIL THAT IT AMEND §17.78.030 (CONSIDERATION OF MULTIPLE APPLICATIONS) OF CHAPTER 17.78 (MISCELLANEOUS) IN TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO PROHIBIT MULTIPLE SENATE BILL (SB) 330 PRELIMINARY APPLICATIONS AND/OR MULTIPLE APPLICATIONS FOR THE SAME ENTITLEMENT FOR MUTUALLY EXCLUSIVE PROJECTS ON THE SAME PROPERTY AT THE SAME TIME AND DETERMINE THE CODE AMENDMENT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUIREMENTS (CASE NO. PLCA2024-0006). THE MOTION PASSED ON A VOTE OF 7-0 WITH THE ADDED REVISION TO PLURALIZE "APPLICANT" TO "APPLICANT OR APPLICANTS". COMMISSIONER PERESTAM MOVED SECONDED BY COMMISSIONER NESLON TO ADOPT P.C. RESOLUTION NO. 2024-20, RECOMMENDING TO THE CITY COUNCIL THAT IT AMEND §17.75.140.B (LEGAL NONCONFORMING SIGNS) OF CHAPTER 17.75 (SIGN CODE) IN TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO ALLOW FOR THE REMODELING AND/OR RECONSTRUCTION OF EXISTING, LEGAL, NON-CONFORMING FREESTANDING MONUMENT AND DIRECTORY SIGNS AND DETERMINE THE CODE AMENDMENT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUIREMENTS (CASE NO. PLCA2024-0005). THE MOTION PASSED ON A VOTE OF 5-2 WITH THE ADDED CONDITION TO REQUIRE ANY REVISIONS TO LIGHTING TO COMPLY WITH THE SIGN ILLUMINATION SECTION. Deputy Director Silva presented the staff report giving an overview of the items in the proposed Planning Commissions Biannual Report. The Commission agreed to add the Subcommittee meetings to the report. COMMISSIONER NULMAN MOVED SECONDED BY COMMISSIONER NELSON TO ADOPT THE STAFF REPORT AND INCLUDE IN THE PLANNING COMMISSION'S BIANNUAL REPORT TO THE CITY COUNCIL AN ADDITION OF THE PLANNING COMMISSION ZONING CODE UPDATE SUBCOMMITTEE'S MEETINGS BETWEEN DECEMBER 2023 TO JUNE 2024.
