AMG and Associates Inc (Change Order 094)City of Rancho Palos Verdes Department of Public Works 30940 Hawthorne Blvd, Rancho Palos Verdes, CA 90275 (310)544-5252 CHANGE ORDER MEMORANDUM TO: RAMZI AWWAD, DIRECTOR OF PUBLIC WORKS FROM: ALAN BRAATVEDT, SUNBEAM CONSULTING DATE: March 19, 2024 SUBJECT: LADERA LINDA COMMUNITY PARK CONSTRUCTION CHANGE ORDER NUMBER: 94 (PCO 58) Description of Construction Change Order (1) In accordance with City’s response to RFI#33: modify the bio-basin on the middle tier to eliminate the need to remove two existing mature trees. (2) In accordance with City’s response to RFI#59: install additional connecting drainage from the switchbacks and tiered seating walls between middle and upper tiers. Justification Per the original contract drawings and specifications, bio-swales on each of the park’s 3-tiers were designed/sized to comply with the South Coast Regional Water Quality Control Board’s storm water runoff best management practices guidelines for Low Impact Development (LID). The bio-swales’ design specified the removal of two existing mature trees to accommodate the footprint of the middle tier bio-basin. The contractor issued RFI #33, which drew the City’s attention to consider preservation of the mature trees. The City’s response to RFI#33 resulted in the bio-basin being redesigned as two (2) separate basins with modifications to satisfy the above-described LID criteria, while preserving the existing trees. Drainage questions were subsequently raised by the Contractor during the construction of the switchbacks, resulting in the issuance of RFI#59. The City’s response to RFI#59 resulted in the issuance of new plans to address the drainage issues in that area and to pick up subsoil drainage behind the tiered seating and rerouted to the bio-basin. The additional design provisions also addressed necessary additional storm drain connections between the two middle tier bio-basins located at the mid-to-upper tier switchback ramp. The direction provided via the above-described City’s response to RFI nos. 33 and 59 resulted in changes to the original contract scope of work (plans), as well as a net of extra work (labor, equipment, and materials) to be performed that was not a part of the Contractor’s corresponding bid. Therefore, a change order needs to be issued to account for the changes to the contract drawings and the associated net-additional cost to construct the changes. However, the PCO was rejected by the City on the grounds that no credit was provided for the smaller bio-basin dictated by the City’s response to RFI#33. This led to initiating a Meet and Confer process between the Contractor, City, Architect and Construction Manager. The conclusion of that meet and confer process was that the additional cost for the storm drain modifications / additions were acceptable in merit, but the Contractor’s revised pricing was to include the deleted portions of the original contract-specified bio-swale. Sunbeam prepared a counter-offer for the expected cost savings associated with the bio-swale modifications, and with several rounds of negotiations, the following determinations were made: (1) There were no cost savings (credit) associated with the grading effort for 2 smaller bio-swales compared with the original for a single/larger bio-swale, which was verified through Sunbeam’s evaluation of time and materials (T&M) tickets. (2) There were no savings for the reduced vegetation planting in the 2 bio-swales, as the corresponding quantity of displaced plants were relocated to other areas of the park. (3) There was a savings for the export of dirt and the reduced area of the filter fabric and filtration media installed for the 2 smaller swales. Sunbeam’s calculated savings of $5,617.19 (credit). The Contractor issued revised PCO 58 (R1) in accordance with the above-described determinations. In summary, the cost of PCO 58-R1 is representative of Sunbeam’s verification of T&M records for extra work, as well as Sunbeam’s calculated counter- offer for the above credit (item 3). Therefore, SunBeam recommends that the City authorize the revised costs agreed with the Contractor. Schedule Analysis As this work is being authorized long after the authorized completion date for the overall project, a schedule analysis has not been performed by SunBeam for this scope of work. An analysis of the schedule impact of this work will be addressed for this work as part of a meet and confer process for overall completion of the project. This approach is consistent with the changes to the standard change order provisions as approved by the City Attorney. Materials The trench system bodies shall be manufactured from polyester polymer concrete with the minimum properties as follows: Compressive strength: 14,000 psi Flexural strength: 4,000 psi Water absorption 0.07% Frost proof YES Salt proof YES Dilute acid and alkali resistant YES The nominal clear opening shall be 4" (100mm) with overall width of 5.12" (130mm). Pre-cast units shall be manufactured with either an invert slope of 0.5% or with neutral invert and have a wall thickness of at least 0.50" (13mm). Each unit will feature a partial radius in the trench bottom and a male to female interconnecting end profile. Units shall have horizontal cast in anchoring keys on the outside wall to ensure maximum mechanical bond to the surrounding bedding material and pavement surface. The galvanized steel edge rail will be integrally cast in by the manufacturer to ensure maximum homogeneity between polymer concrete body and edge rail. Each edge rail shall be at least 3/32" (2.5mm) thick. Grates Grates shall be specified. See separate ACO Spec Info grate sheets for details. After removal of grates and ‘QuickLok’ bar there shall be uninterrupted access to the trench to aid maintenance. The LID surface area requirement was made up through increasing the elevation of the drainage grates and therefore the capacity of retained water/sf of pond. The total volume excavated for grading reduced by 17.3cy and the graded area by 1,320sf. If the dirt was exported at a cost of $85/cy and grading cost $5/sf, the value of the reduced scope of work = $8,070 $1,470.50 The combined surface area of the bioswales was reduced by 331 sf, which reduced the area of the media and planting by that amount. An estimated cost of that media and planting is $20 $10/sf = $6,620 $3,310 RFI #59 The costs for the additional drainage work remains unchanged. Conclusion: The total value of the reduction of scope of RFI #58 amounts to $14,690 $8,090 is $4,780.50, which amounts to $5,617.09 after mark-up. We therefore recommend a revised value of $17,597 $20,070.50 for this PCO.
