City of Rancho Palos Verdes Department of Public Works 30940 Hawthorne Blvd, Rancho Palos Verdes, CA 90275 (310)544-5252 CHANGE ORDER MEMORANDUM TO: RAMZI AWWAD, DIRECTOR OF PUBLIC WORKS FROM: ALAN BRAATVEDT, SUNBEAM CONSULTING DATE: March 15, 2024 SUBJECT: LADERA LINDA COMMUNITY PARK CONSTRUCTION CHANGE ORDER NUMBER: 93 (PCO 82) Description of Construction Change Order The Contractor shall hand dig portions of the cable fence post holes located on the south landscaping perimeter to complete the contract’s scope of cable fencing improvements. Justification Background: In early 2023, approximately a year after contract notice to proceed, the City’s decision to install additional cable fencing via change order was made. ASI #29 was issued to the Contractor on 3/7/2023 to formalize the City’s direction and provide details necessary to construct the additional cable fencing scope. In response, the Contractor submitted a cost proposal on 4/26/23. On 5/11/23, change order (CO) #27 was executed as the vehicle to perform the additional scope of work. CO #93 is associated with two compounded impacts to production associated with the means and methods originally priced and agreed to as part of executed CO #27: Impact #1: Over the course of the City’s decision to proceed with the work (via ASI #29 and CO #27) and the subsequent materials procurement process, the installation of the adjacent contract-specified landscape improvements had already progressed considerably (see attached ASI #29 impact exhibit). This created access constraints that prevented the remaining cable fence post holes from being excavated via means and methods priced in executed CO #27, which was based on using a machine-mounted auger with 2 laborers. Further, CO #27 did not include pricing for the additional hand-digging of cable fence post holes that was now necessary due to the above-described access constraints preventing the use of the machine-mounted auger. However, upon initial excavation for the fence post holes, a substantial quantity of rocks was encountered to an extent that slowed down production of excavating fence post holes. As a result, the auger drilling became a slower operation (approximately 33% longer duration than originally anticipated/priced by CO#27) and also required additional labor to manually remove rocks to allow for further drilling. In summary, the above compounded impacts resulted in (1) a slower production rate, and (2) the use of additional manual labor to complete the change order #27 scope of work. As such, a change order needs to be issued to account for the additional work (labor) and associated cost not accounted for in executed CO#27. Cost Analysis Contractor’s associated PCO #82 in the amount of $20,857,32 for the added labor was initially rejected, resulting in a notice of a claim, issued by the Contractor on 1/29/24. A Meet and Confer process was initiated shortly after between the Contractor, City, Architect and Construction Manager to reach a resolution. The conclusion of that meet and confer process was that the PCO merit was justified and a price would be negotiated. SunBeam Consulting was tasked with evaluating the costs of that component of the work, which was done by checking the Contractor’s labor records and comparing the bid schedule (“planned hours”) with the actual hours used and calculating the value of the difference. This resulted in a negotiated reduction from $20,857.32 to $15,295.33. See attached estimate that breaks down the negotiated amount. Sunbeam recommends issuing a change order reflective of the negotiated (and substantiated) amount of $15,295.33. Schedule Analysis As this change order is being authorized long after the authorized completion date for the overall project, a schedule analysis has not been performed by SunBeam for this scope of work. An analysis of the schedule impact of this work will be addressed for this work as part of a meet and confer process for overall completion of the project. This approach is consistent with the changes to the standard change order provisions as approved by the City Attorney. (AMG) disputes the rejection of this PCO and maintains that the PCO is valid and that the associated work is outside the approved scope of work. Bulletin ASI 029, Cable Rail Fence was issued to AMG on 3/7/2023 for review and pricing. The subcontractor’s proposal was based off the bulletin plans/details as well as factoring in site conditions. Due to the lengthy review and approval of PCO #047 by the City as well as the procurement process, the subcontractor had no choice but to deal with additional site obstacles directly affecting the fence installation. These obstacles included contract scope of work by other trades as the schedule progressed. (Irrigation, DG, Sod) In addition, the subcontractor came across unforeseen obstacles (rock) during the excavation process. The rocks ultimately caused delays resulting in an increase in field labor. According to the Contract, resolution of public works claims shall follow the provision of California Public Contract Code. Specifically, General Provisions item 33: 33 – RESOLUTION OF PUBLIC WORKS CLAIMS This contract is subject to the provisions of Article 1.5 (commencing at Section 20104) of Division 2, Part 3 of the California Public Contract Code regarding the resolution of public works claims of less than $375,000. Article 1.5 mandates certain procedures for the filing of claims and supporting documentation by the contractor, for the response to such claims by the contracting public agency, for a mandatory meet and confer conference upon the request of the contractor, for mandatory judicial arbitration upon the failure to resolve the dispute through mediation. This contract hereby incorporates the provisions of Article 1.5 as through fully set forth herein.
