AGENDA TITLE:
Consideration and possible action to approve Amendment No. 2 to the Professional
Services Agreement with Geosyntec Consultants, Inc. to implement the Palos Verdes
Peninsula Coordinated Integrated Monitoring Program.
RECOMMENDED COUNCIL ACTION:
1) Approve Amendment No. 2 to the Professional Services Agreement (PSA) with
Geosyntec Consultants, Inc., to implement the Palos Verdes Peninsula
Coordinated Integrated Monitoring Program (CIMP) for stormwater quality
monitoring, reporting, and related services:
a. Retroactively increasing the PSA amount for Fiscal Year (FY) 2023-24 by
$58,242 to $422,516 for new compliance monitoring requirements;
b. Increasing the PSA amount by $914,169 for FY 2024-25 and FY 2025-26;
and
c. Extending the term by two years to June 30, 2026 with a new total of
$2,114,620 plus 15% contingency over a five-year period; and,
2) Authorize the Mayor and City Clerk to execute Amendment No. 2 to the PSA in a
form approved by the City Attorney.
FISCAL IMPACT: This cost of the services provided by Geosyntec Consultants, Inc.
under this PSA and amendments is shared among several
agencies within the Peninsula Watershed Management Group
including the three other Peninsula cities. Amendment No. 2
increases the cost of services to the City in FY 2023-24 by $13,210
which is already included in the approved FY 2023-24 budget.
Amendment No. 2 also increases the cost of services to the City in
FY 2024-25 by $269,033 and $237,734 in FY 2025-26. The cost
for FY 2024-25 is included in the proposed FY 2024-25 budget
under professional/technical services for Stormwater Quality
(General Fund and Measure W). VR

BACKGROUND:
The Los Angeles Regional Water Quality Board (Regional Board) regulates the discharge
of pollutants into watersheds through a permit called the Municipal Separate Storm Sewer
Permit (MS4 Permit). The MS4 Permit was adopted by the Regional Board on November
8, 2012.
With the adoption of the MS4 Permit, the City is required to comply with stormwater quality
regulations or face severe penalties, including fines. Compliance requirements include
watershed-based pollutant monitoring, illicit discharge prevention, treatment of
stormwater to reduce pollutants, record-keeping, and reporting. The City is complying
with the MS4 Permit requirements through the CIMP, which is a technical document that
lays out the requirements for monitoring, analysis, and reporting water quality data to the
Regional Board.
On April 15, 2016, the City Council approved a memorandum of understanding (MOU)
between the cities of Rancho Palos Verdes, Palos Verdes Estates, Rolling Hills, Rolling
Hills Estates, the County of Los Angeles, and the Los Angeles County Flood Control
District (collectively as the Palos Verdes Peninsula Watershed Management Group
(Peninsula WMG)) for the development and cost share implementation of the CIMP based
on relative land area. Since it has the largest land area, the City of Rancho Palos Verdes
serves as the chair of the Peninsula WMG and also serves as the monitoring services
contract administrator.

On August 7, 2018, City Council approved a PSA with Geosyntec Consultants, Inc.
(Geosyntec) for monitoring and reporting services required to comply with the MS4 Permit
requirements and approved Amendment No. 1 to the MOU to include additional weekly
shoreline monitoring for the Santa Monica Bay Beaches Bacteria Total Maximum Daily
Load (TMDL).
On September 11, 2021, the MS4 Permit was renewed which required the Peninsula
WMG to revise its CIMP to meet the new MS4 Permit requirements. On April 6, 2021,
City Council approved Amendment No. 2 to the Peninsula WMG CIMP MOU for the
development and cost share of implementation of the revised CIMP for a five-year term
(through Fiscal Year 2025-26) (Attachment D).
On June 1, 2021, the City entered into a PSA with Geosyntec for water quality monitoring,
testing, and reporting services in the amount of $969,68 with a three-year term ending on
May 31, 2024, and the option to extend the PSA for one additional year. Subsequently,
in June 2023, the City approved Amendment No. 1 to the PSA for additional services to
address changes to regulatory requirements, as these services were not included in the
original PSA. This increased the compensation by $172,526 for a new PSA total of up to
$1,142,209 plus 15% contingency.
The current amended PSA with Geosyntec expires on May 31, 2024 and services will
discontinue unless the PSA is again amended, or the City enters into a new PSA with
another vendor for these services.
DISCUSSION:
The PSA with Geosyntec needs to be increased by $58,242 for FY2023-24, of which the
City’s share is $13,210. This increase is due to the need to respond to more extensive
comments than anticipated from the Regional Board on the Peninsula CIMP Update and
to review Machado Lake Nutrient data to provide the Peninsula WMG justification to
contest alleged water quality violations. The request is being made retroactively because
there was a very short deadline to respond to the Regional Board in order to maintain the
ability to contest the alleged water quality violations; therefore, there was insufficient time
to proactively increase the PSA.
The current amended PSA with Geosyntec, which is set to expire on May 31, 2024,
includes an optional one-year extension. Because the Peninsula WMG CIMP MOU
expires in 2026, Staff determined that it would be more efficient to extend the term of the
PSA by two years to coincide with the expiration of the MOU. Therefore, Staff requested
a proposal from Geosyntec to provide CIMP implementation for Fiscal Years 2024-25 and
2025-26. The PSA’s new expiration date, if approved by the City Council, will be through
June 30, 2026 (as opposed to May 31, 2025) (Attachment A).
Geosyntec provided the attached proposal (Attachment B) for Fiscal Years 2024-25 and
2025-26 CIMP implementation in the amount of (FY 2024-25: $485,445 and FY 2025-26:
$428,724), increasing the total PSA compensation by up to $914,169, for a new total of

$2,114,620 plus 15% contingency. The costs for FY 2024-25 and FY 2025-26 are higher
than prior years due to new monitoring requirements for an additional list of pollutants
and associated reporting that have not been previously required to be sampled or
monitored. The proposed contract amount will be shared by all the agencies in the
Peninsula WMG with the City’s share being $506,767 (FY 2024-25: $269,033 and FY
2025-26: $237,734) based on the percentage of land area formula within the Peninsula
(Attachment C).
The Peninsula WMG reviewed the proposal by Geosyntec and determined that the cost
was fair and reasonable given the added new requirements outlined above. Additionally,
the Peninsula WMG is amenable to a two-year extension to the PSA so the expiration
aligns with the expiration of the current MOU.
ADDITIONAL INFORMATION:
On January 10, 2024, the City of Rancho Palos Verdes along with nine other agencies
(Los Angeles County Flood Control District, County of Los Angeles Carson, Lomita, Los
Angeles, Torrance, Rolling Hills, Rolling Hills Estates, and Palos Verdes Estates) were
issued notices by the Regional Board relating to violations of exceeding water quality
limits for pollutants in Machado Lake during the monitoring years of 2020 -2022. The
notices offered to settle violations with a penalty amount of $3,000 per violation per
monitoring site, for a total of $195,000 across all agencies. The City’s portion of this
amount is up to $47,322.
On February 9, 2024, the affected agencies submitted a letter requesting a time extension
to allow the agencies to review the alleged violations and file an appropriate response by
March 26, 2024.
On March 26, 2024, in coordination with the named agencies, the City of Rancho Palos
Verdes submitted letters contesting the violations on the basis that there was evidence
showing that the Regional Board may have erred in issuing the notices. To date, the
Regional Board has not provided a response to the letters contesting the violations.
The monitoring programs included in the Geosyntec PSA provide essential data to
determine if the City is in violation of any pollutant limits.
CONCLUSION:
The City Council is being asked to approve Amendment No. 2 to the PSA with Geosyntec
for the Peninsula CIMP implementation to retroactively increase the PSA amount by
$58,242 for FY 2023-24, of which the City’s share is $13,210; and increase the PSA
amount by $914,169 for FY 2024-25 and FY 2025-26, for a new total amount of
$2,114,620 (plus 15% contingency) of which the City’s share is $539,130; and increasing
the term of the PSA to June 30, 2026.
ALTERNATIVES:

In addition to the Staff recommendation, the following alternative actions are available for
the City Council’s consideration:
1. Do not approve Amendment No. 2 to the PSA with Geosyntec and direct
staff to return with an Amendment extending the term of the agreement by
one year only.
2. Do not approve Amendment No. 2 to the PSA with Geosyntec and direct
Staff to re-solicit proposals for those services. This alternative risks an
interruption in services due to the amount of time needed to obtain new
proposals.
3. Take other action, as deemed appropriate.

AMENDMENT NO. 2
TO AGREEMENT FOR PROFESSIONAL SERVICES
THIS AMENDMENT TO THE AGREEMENT FOR PROFESSIONAL SERVICES
(“Amendment No. 2”) by and between the CITY OF RANCHO PALOS VERDES, a municipal
corporation (“City”) and GEOSYNTEC CONSULTANTS, INC., a Florida corporation
(“Consultant”) is effective as of May 21, 2024.
RECITALS
A. City and Consultant entered into that certain Agreement for Professional Services
dated June 1, 2021 (“ Agreement”) whereby Consultant agreed to provide engineering consulting
services in conjunction with the Palos Verdes Peninsula Watershed Group Coordinated Integrated
Monitoring Program Implementation (CIMP), for an initial Term of 3 years, expiring May 31,
2024, for a Contract Sum of $969,683.
B. On June 20, 2023, City and Consultant entered into an Amendment to the
Agreement (“Amendment No. 1) to include additional monitoring and reporting activities required
in order for the City to remain compliant with the Regional MS4 Permit and state regulations
increasing compensation by $172,526 for a total Contract Sum of $1,142,209.
C. City and Consultant now desire to amend the Agreement (“Amendment No. 2”) to
extend the Term of the Agreement by two additional years, ending on June 30, 2026, and to
increase compensation by $972,411 for a new Contract Sum of $2,114,620.
TERMS
1. Contract Changes. The Agreement is amended as provided herein. Deleted text is
indicated in strikethrough and added text in bold italics.
a.Section 2.1, Contract Sum, is amended to read:
Subject to any limitations set forth in this Agreement, City agrees to pay Consultant
the amounts specified in the “ Schedule of Compensation” attached hereto as
Exhibit “C” and incorporated herein by this reference. The total compensation,
including reimbursement for actual expenses, shall not exceed $1,142,209 (One
Million One Hundred Forty Two Thousand Two Hundred Nine Dollars $2,114,620
(Two Million One Hundred Fourteen Thousand Six Hundred Twenty Dollars)
(the “Contract Sum”), unless additional compensation is approved pursuant to
Section 1.9.

2. Continuing Effect of Agreement. Except as amended by Amendment Nos. 1 and 2, all

mean the Agreement, as amended by Amendment Nos. 1 and 2.

ATTACHMENT #1 – PROPOSAL
SCOPE OF SERVICES
Geosyntec will perform the following services during the 2024-25 and 2025-26 Fiscal Year. All
tasks are assumed to be performed during both fiscal years unless stated otherwise.
A. PALOS VERDES PENINSULA (PVP) WATERSHED MANAGEMENT GROUP
(WMG) COORDINATED INTEGRATED MONITORING PROGRAM (CIMP)
IMPLEMENTATION.
Task. A-1 Project Management
• One Geosyntec staff will prepare for and virtually attend six WMG group meetings per
year.
• Prepare the applications for two City-specific encroachment permits per year(one for
Ranchos Palos Verdes and one for Palos Verdes Estates). No fee is assumed for either
permit.
• Prepare the application for one Los Angeles County access permit per year. The application
fee is assumed to cost approximately $2,000 annually.
• Coordinate wet weather rainfall tracking and mobilization with the client and
subconsultants. During the wet weather monitoring season, email correspondence
summarizing forecasts and the potential for wet weather event monitoring will be provided,
as necessary. Go/No-Go decisions for wet weather monitoring events will be included with
appropriate documentation.
• During dry weather, email correspondence identifying proposed monitoring dates will be
provided monthly.
• General project management, including internal and external coordination, client check-in
calls, invoicing, etc.
Task A-2. Receiving Water Monitoring
• Dry weather receiving water monitoring will occur three times in 2024/25 (June 2024
through June 2025) and two times in 2025/26 (July 2025 through June 2026) at Peninsula-
RW1, including once during the historically driest month of the year.

• Wet weather receiving water monitoring will occur three times per year during wet weather
conditions at Peninsula-RW1, including the first significant storm event of the water year
as defined by the 2024 Revised CIMP.
• Parameters identified in the 2024 Revised CIMP (including TMDL, 303d listed, and Los
Angeles MS4 Permit Attachment E, Table E-6) will be collected and analyzed during the
2024-25 dry and wet weather monitoring events. The full list of parameters in the Los
Angeles MS4 Permit Attachment E, Table E-6, will be collected and analyzed during the
first flush stormwater event and during the historically driest month of the year for
receiving water monitoring. Any parameters that exceed the minimum reporting limits
listed in Table E-6 or applicable water quality objectives will be monitored during all
subsequent receiving water and MS4 stormwater outfall events through the 2025-26 fiscal
year (see below).
Task A-3. Stormwater Outfall Monitoring
• MS4 stormwater outfall monitoring will occur three times per year during wet weather
conditions at Peninsula-SD1 and Peninsula-SD3, including targeting the first significant
rain event of the water year as defined by the 2024 Revised CIMP.
• Parameters will be collected and analyzed at each location according to the 2024 Revised
CIMP. Parameters found to exceed the minimum reporting limits listed in Table E-6 or
applicable water quality objectives at the corresponding receiving water locations will be
monitored during all subsequent events.
• It is assumed that no traffic control plan is required for Peninsula-SD1 and Peninsula-SD3.
Task A-4. TMDL Outfall Monitoring
• Wet weather TMDL monitoring will occur three times per year during wet weather
conditions at RHE City Hall, Valmonte, and Solano, including targeting the first significant
rain event of the water year as defined by the 2024 Revised CIMP.
• Dry weather TMDL monitoring will occur thirteen times in 2024/25 (June 2024 through
June 2025) and twelve times in 2025/26 (July 2025 through June 2026) during dry weather
conditions at RHE City Hall and Valmonte, including during the historically driest month
of the year as defined by the 2024 Revised CIMP.
• Parameters will be collected and analyzed at each location according to the 2024 Revised
CIMP.

• It is assumed that the 10 outfalls will be screened over 1 event and that above-ground source
investigations will be completed immediately following observation of significant flow.
• A draft and final outfall screening report will be completed that summarizes all
observations and significant flow designations.
• No NSW outfall screening or follow-up monitoring activities are assumed to be performed
by Geosyntec or subconsultants during the 2025-26 fiscal year.
Task A-6. Flow Monitoring and data management
• A remote flow meter will be installed for Peninsula-SD3 during the 2024-25 fiscal year.
• Flow meters will be regularly maintained, and the collected data will be downloaded.
• Flow data will be processed, managed, and packaged as part of the field monitoring report
and data deliverable and will be included in the Annual Monitoring Report.
Task A-7. Monitoring Records
• All monitoring data will be uploaded to the PVP CIMP database and will continue to be
managed allowing for comprehensive regulatory and historical data analysis.
• Noteworthy sampling event observations will be communicated via email and summarized
during WMG Meetings
• Internal data validation will be completed for each laboratory monitoring report.
Significant data validation findings will be communicated via email and summarized
during the WMG Meetings, and all findings will be included in the Annual Monitoring
Report.
• An Annual Monitoring Report will be completed and summarize all data requirements
stipulated in the 2024 Revised CIMP, including data leveraged from external programs.

regarding action items covered by the 2024 Revised CIMP, which may include but are not
limited to outfall maintenance coordination, illicit discharge detection and elimination

Task A-9. CIMP Modification per MS4 Permit
• This proposed scope is written under the assumption that the 2024 Revised CIMP will be
accepted and go into effect prior to or upon the initiation of this contract, and therefore, no
CIMP modifications will be necessary.
B. SANTA MONICA BAY BEACHES BACTERIA (SMBBB) TMDL MONITORING
Task B-1. Project Management
• Regular communication with the City on the status of scope, schedule, and budget.
• Coordination with the City, the Peninsula Watershed Management Group (WMG), and the
City's water quality consultant.
• Organization of Team coordination calls.
• Tracking expenditures related to the budget spent on a monthly basis throughout the Project
duration to confirm that the Project stays on schedule and budget and that potential
deviations are identified, communicated, and mitigated early.
Task B-2. Weekly Sampling and Analysis
• Weekly sampling at coordinated shoreline monitoring locations SMB 7-1, SMB 7-2,
SMB 7- 3, SMB 7-4, and SMB 7-5 for three fecal indicator bacteria (FIB) parameters -
total coliform density, fecal coliform density, and enterococcus density in compliance
with the SMBBB TMDL Coordinated Shoreline Monitoring Program (CSMP) and
consistent with the requirements of the SMBBB TMDL.

• Weekly bacteria sampling and laboratory analysis at these five sample locations will
be conducted per the approved Peninsula Coordinated Integrated Monitoring Plan and
SMBBB CSMP. Additional accelerated monitoring will be conducted by the
Geosyntec Team on subsequent days when triggered in response to exceedance of the
single-sample bacteria objectives, as described in the SMBBB CSMP.
• A total of five (5) accelerated monitoring events at up to five locations each per year
are included for the SMBBB TMDL Shoreline Monitoring.
Task B-3. Data Analysis and Reporting
• Import monitoring results into the project database and generate weekly and monthly
reports that provide information such as sample locations, monitoring results, and
indication of exceedances.
• Reports will be sent to the Peninsula WMG and other requested parties on a weekly
basis. Monthly summary reports will also be provided.
• Preparation and submittal of two semi-annual Excel data reports per year in the
California Environmental Data Exchange Network (CEDEN) format, consistent with
the Regional MS4 Permit requirements.

HILLS, AND ROLLING HILLS ESTATES
REGARDING THE ADMINISTRATION AND COST SHARING FOR IMPLEMENTING
THE COORDINATED INTEGRATED MONITORING PROGRAM (CIMP) FOR THE
PENINSULA CIMP AGENCIES
This Second Amendment to the Memorandum of Understanding is made and entered into as of June 15,
2021 between THE CITY OF RANCHO PALOS VERDES,a body corporate and politic,THE CITY OF ROLLING
HILLS ESTATES, a body corporate and politic,THE CITY OF ROLLING HILLS,a body corporate and politic,
THE CITY OF PALOS VERDES ESTATES,a body corporate and politic, LOS ANGELES COUNTY FLOOD
CONTROL DISTRICT(LACFCD),a body corporate and politic,and THE COUNTY OF LOS ANGELES
COUNTY),a political subdivision of the State of California Collectively,these entities shall be known
herein as"PARTIES"or individually as"PARTY"
WITNESSETH
WHEREAS, the PARTIES entered into a Memorandum of Understanding (MOU) on May 03, 2016 for the
administration and cost sharing for implementing the Coordinated Integrated Monitoring Program(CIMP)
for the Peninsula CIMP agencies, and
WHEREAS,the PARTIES amended the MOU on August 07, 2018 to include the cost of monitoring for the
Santa Monica Bay Beaches Bacteria TMDL to the Total Cost Allocations for implementing the CIMP, and
WHEREAS,the PARTIES have agreed to cooperatively share and fully fund the costs of implementing the
CIMP,as proposed in Table 1 of Exhibit A and Table 2 and Table 3 of Exhibit B, and
WHEREAS, the PARTIES agree that the total annual cost for implementing the CIMP, preparing CIMP
Annual Reports, and preparing any necessary revisions to the CIMP in compliance with the MS4 Permit
shall not exceed $588,345 45 which includes a ten percent (10%) contingency and a five percent (5%)
contract administration cost, and
WHEREAS, the PARTIS agree that the final cost allocations will be based on the actual cost for
implementing the CIMP, preparing CIMP Annual Reports, and preparing any necessary revisions to the
CIMP in compliance with the MS4 Permit, and
WHEREAS,the PARTIES agree to amend the MOU to include the updated cost of monitoring and data
reporting for the Peninsula CIMP agencies,and
WHEREAS,the PARTIES agree that each shall assume full and independent responsibility for ensuring its
own compliance with the MS4 Permit despite the collaborative approach of the MOU
NOW, THEREFORE, in consideration of the mutual benefits to be derived by the PARTIES, the
PARTIES agree as follows

Section 1 Recitals The recitals set forth above are true and correct and incorporated into this
Second Amendment to the MOU
Section 2 Purpose The purpose of this Second Amendment to the MOU is to cooperatively fund
the implementation and any required revisions of the CIMP and to coordinate the
payment and performance of the monitoring and reporting services
Section 3 Cooperation The PARTIES shall fully cooperate with one another to attain the purposes
of this Second Amendment to the MOU
Section 4 Voluntary This Second Amendment to the MOU is voluntarily entered into for the
implementation of the CIMP
Section 5 Term This Second Amendment to the MOU shall become effective on the last date of
execution by a PARTY(EFFECTIVE DATE),and shall remain in effect for five(5)years from
the EFFECTIVE DATE
IN WITNESS WHEREOF,the PARTIES hereto have caused this Second Amendment to the MOU to
be executed by their duly authorized representatives and affixed as of the date of signature of the PARTIES
