PC MINS 20240423 Approved 5/14/24 CITY OF RANCHO PALOS VERDES PLANNING COMMISSION MINUTES REGULAR MEETING APRIL 23, 2024 CALL TO ORDER A regular meeting of the Rancho Palos Verdes Planning Commission was called to order by Chair Chura at 7.00 P.M. in accordance with the requirements of the Ralph M. Brown Act, Section 54950 et seq. of the Government Code. Remote participation by any Committee/Commission member shall be in accordance with Subdivisions (b)(3)or(f)of Government Code Section 54953.The meetings are held at Hesse Park, McTaggart Hall, 29301 Hawthorne Boulevard and/or via teleconference for staff/consultants/participants using the Zoom platform and broadcast live on the City's website at rpvca.gov/agendas and on PVPtv channels Cox 35 and Frontier FiberOptic 39. Members of the public could observe and participate using the zoom participation feature and in person. APPROVAL OF AGENDA Approved as amended moving item #4 before item #2. COMMUNICATION: City Council Items: Director Forbes informed the Planning Commission that the City Council adopted the revised 2021-2029 Housing Element and the implementation items. Staff: Director Forbes informed the Planning Commission of the Leadership Academy on April 24th that will be hosted by the Community Development Department. APPEAL OF A SITE PLAN REVIEW WITH NEIGHBORHOOD COMPATIBILITY AND MAJOR GRADING PERMIT- (CASE NO. PLHV2022-0001): 2838 Calle Aventura (RN) Associate Planner Nemeth presented the staff report, an appeal of the Director of Community Development's conditional approval of a Site Plan Review with Neighborhood Compatibility and Major Grading Permit to construct a 742 ft2 single-story addition to an existing single-story residence along with ancillary site improvements and 39 yd3 of after-the-fact grading. Chair Chura opened the public hearing. The following members of the public addressed the Planning Commission, Ruta Wroblicky the Appellant, Sid Khajavi the Applicant, Sali Borjkhani, Lauren Ramezani, David Brandt, Mike Stern, Ellen Multari, Trina Gagliano, Clara Duran Reed, James Reed, Sharon Moromisato, David Lin, Suzanne Seymour. The Planning Commission asked clarifying questions of the Applicant and the Appellant. Chair Chura closed the public hearing. Discussion ensued amongst Staff and the Planning Commission regarding project setbacks,size, and view concerns. VICE CHAIR SANTAROSA MOVED SECONDED BY COMMISSIONER NULMAN TO ADOPT P.C. RESOLUTION NO. 2024-11, THEREBY DENYING THE APPEAL AND UPHOLDING THE DIRECTOR'S CONDITIONAL APPROVAL OF A SITE PLAN REVIEW WITH NEIGHBORHOOD COMPATIBILITY, AND MAJOR GRADING PERMIT TO ALLOW THE CONSTRUCTION OF A 742 FT2 SINGLE-STORY ADDITION TO AN EXISTING 2,533 FT2 SINGLE-STORY RESIDENCE (GARAGE INCLUDED) RESULTING IN A NEW TOTAL STRUCTURE SIZE OF 3,275 FT2; ALONG WITH ANCILLARY SITE IMPROVEMENTS; AND AFTER- THE-FACT GRADING (39 YD3 OF CUT) AT 2838 CALLE AVENTURA (CASE NO. PLSR2020-0215):4105 Maritime Road (SG) Planning Commission Minutes April 23, 2024 Page 2 Deputy Director Silva requested a continuation for a proposed project consisting of a Major Grading Permit, Site Plan Review with Neighborhood Compatibility, Variance and Coastal Development Permit for the construction of a 3,064 ft2 addition to an existing single-story residence for a new total structure size of 4,840 ft2 (garage included); with ancillary site improvements along with 1,364 yd3 of associated grading. COMMISSIONER BRACH MOVED SECONDED BY COMMISSIONER NELSON TO CONTINUE THE PUBLIC HEARING TO A DATE UNCERTAIN TO ALLOW THE APPLICANT TO CONSIDER PROJECT MODIFICATIONS BASED ON PLANNING COMMISSION FEEDBACK PROVIDED AT THE MARCH 12, 2024 PLANNING COMMISSION MEETING. THE MOTION PASSED ON A VOTE OF 7-0. NEW PUBLIC, HEARINGS: 3. ANTENNA CODE AMENDMENT— (CASE NO. PLCA2022-0008): Citywide (AS) Senior Planner Seeraty presented the staff report recommending approval to the City Council for code amendments that include repealing Section 17.76.020 (Antennas) of Chapter 17.76 (Miscellaneous Permits and Standards) and replace with Chapter 17.73 (Wireless Telecommunication Facilities on Private Property), in Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code. The Planning Commission asked clarifying questions of Staff and City Attorney Lopez. Chair Chura opened the public hearing. COMMISSIONER NELSON MOVED SECONDED BY COMMISSIONER NULMAN TO ADOPT P.C. RESOLUTION NO. 2024-12, RECOMMENDING TO THE CITY COUNCIL THAT AN ORDINANCE BE ADOPTED TO REPEAL SECTION 17.76.020 (ANTENNAS) OF CHAPTER 17.76 (MISCELLANEOUS PERMITS AND STANDARDS) AND REPLACE WITH CHAPTER 17.73 (WIRELESS TELECOMMUNICATION FACILITIES ON PRIVATE PROPERTY), IN TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE (CASE NO. RESOLUTION NO. 2024-13; FINDING THAT THE PROJECTS AND PROGRAMS CONTAINED IN THE PROPOSED FY 2024-25 CAPITAL IMPROVEMENT PROGRAM ARE CONSISTENT WITH THE GOALS AND POLICIES OF THE RANCHO PALOS VERDES GENERAL PLAN.
