CC SR 20240319 01 - Landslide Remediation Project Update CITY COUNCIL MEETING DATE: 03/19/2024 AGENDA REPORT AGENDA HEADING: Regular Business AGENDA TITLE: Consideration and possible action to receive a report on the Portuguese Bend Landslide Complex. RECOMMENDED COUNCIL ACTION: (1) Receive and file an update on: a. Current conditions from the City Geologist on the Portuguese Bend Landslide Complex; b. Current trail conditions impacted by the Portuguese Bend Landslide Complex within the Palos Verdes Nature Preserve; c. Project activities responding to land movement within the Portuguese Bend Landslide Complex; d. Building inspections in the landslide area; e. Portuguese Bend Landslide Remediation Project and associated grants; f. The City’s request to the Governor to declare a State of Emergency for the Greater Portuguese Bend Landslide Complex; (2) Approve plans for emergency work in the Portuguese Bend Landslide consisting of installing two emergency hydraugers with arrays and associated work, and direct Staff to return with a construction contract for City Council consideration at the April 2, 2024 meeting; (3) Direct Staff to explore assisting the Abalone Cove Landslide Abatement District and the Klondike Canyon Landslide Abatement District with in-kind services and financial assistance in the form of a loan for landslide mitigation measures prepared by a licensed geotechnical engineering company and return to the April 2, 2024 meeting for the City Council’s consideration; and (4) Adopt Resolution No. 2024-___ thereby continuing the local emergency declaration by 60 days until May 18, 2024 as established by Resolution No. 2023 - 47 adopted on October 3, 2023; and extended by Resolution No. 2023 -56 adopted on November 14, 2023, Resolution No. 2023-61 adopted on December 19, 2023, and Resolution No. 2024-05 adopted on February 6, 2024. FISCAL IMPACT: If the recommended Council action items are approved, Staff will come back on April 2, 2024 to request for an additional appropriation of $8 million for the cost of hydraugers and $250,000 of estimated in-kind services and $3 of financial assistance. While Staff continues to explore other grant funding sources, the additional appropriation from the Capital Infrastructure Program (CIP) Fund will initiate the project immediately. The CIP’s estimated fund balance at the end of FY 2023-24 is $30.4 million with an unallocated amount of $25.4 million. February 20, 2024 City Council Staff Report BACKGROUND: On October 3, 2023, the City Council conducted a discussion regarding the conditions of the Greater Portuguese Bend Landslide Complex (Landslide Complex). After considering information presented that evening, including public testimony, the City Council unanimously adopted Resolution No. 2023-47 declaring the existence of a local emergency within the geographic boundaries of the Landslide Complex. (Attachment G) On November 14, 2023, December 19, 2023, and February 6, 2024, the City Council received updates on conditions in the Landslide Complex and activities underway by various entities to reduce landslide movement. The local emergency was extended at each of those meetings by 60 days. (Attachments H, I, and J) During the February 20, 2024 City Council meeting, in consideration of the unprecedented changes in the landslide and the threat to public health , safety, and property; the City Council directed Staff to complete the Final Environmental Impact Report (Final EIR) and final engineering for the Portuguese Bend Landslide Remediation Project (Project) based on the original concept design while continuing to study whether revisions could be made to the project footprint to reduce the environmental impact. (Attachment K) The City Council also authorized the Mayor to sign a letter to the Governor requesting his consideration to declare a State of Emergency by invoking his emergency powers to suspend or waive certain state requirements and to consider requesting the President 2 declare a Federal Emergency Disaster (as well as a follow up joint letter with co - signatures from other elected officials). DISCUSSION: Current Conditions in the Landslide Complex The Landslide Complex encompasses four historically active landslide areas: the Portuguese Bend Landslide (PBL), the Abalone Cove Landslide (ACL), the Klondike Canyon Landslide (KCL), and the Beach Club Landslide (BCL). However, it also includes areas outside of the historical boundaries of those known landslides, predominantly uphill from the Portuguese Bend and Abalone Cove landslides, within the Ancient Portuguese Bend Landslide Complex as mapped by various agencies (i.e., U.S. Geological Survey, California Geological Survey) and other researchers. Since the last update to the City Council on February 6, 2024, the City Geologist, Mike Phipps of Cotton, Shires, and Associates, Inc. conducted additional field mapping throughout the Landslide Complex; observed conditions at various site-specific locations impacting residential neighborhoods, public infrastructure, and where trails have been impacted; reviewed additional survey and rainfall data; and participated in the weekly Portuguese Bend Landslide Complex Working Group meetings. The City Geologist is reporting that movement continues to manifest at the ground surface in the form of landslide scarps, fissures, grabens/sinkholes, tensional cracking, shear zones, and thrust features. The ground movement features have continued to enl arge, expand, widen, or grow depending on the type of feature and location. Rainfall and accompanying infiltration and runoff into the Landslide Complex continue to adversely affect the landslide area. Upon review of ground movement survey data for separate monitoring surveys performed on the Wayfarers Chapel between November 28, 2023 and January 27, 2024; the City Geologist is reporting that movement velocities have accelerated on that property from December 2023 to January 2024 with total land movement of 0.20 to 1.41 feet over the two month period. This land movement is predominantly outside of the known western boundary of the Abalone Cove Landslide and appears to be reactivation of a portion of the mapped Ancient Portuguese Bend Landslide Complex. In summary, the City Geologist findings continue to be that a large portion of the Ancient Portuguese Bend Landslide Complex above the historically mapped PBL, ACL, and KCL boundaries is involved in significant active landslide movement that is impacting trails, roads, private property, and infrastructure. The current area of major landslide movement involves approximately 675 acres of land as shown in the updated map . (Attachment B) The City Geologist will be attending the March 19 meeting to provide the City Council and public with an updated report since the February 6 meeting. The City Council is being asked to receive and file an update on current conditions in the Landslide Complex. 3 Current Palos Verdes Nature Preserve Trail Conditions within the Landslide Complex Large parts of the Palos Verdes Nature Preserve (Preserve) are located within the Landslide Complex. Specifically, the Portuguese Bend Reserve, Abalone Cove Reserve, and parts of the Forrestal and Filiorum Reserves are located within the Landslide Complex. Many of these areas are seeing landslide -related damage including fissures, rockslides, sink holes, unstable trails, and significant erosion. Out of concern for public safety, and in consultation with the City Geologist, the City Manager has temporarily closed large areas of these Preserve consisting of approximately 8 miles of passive recreation trails. Staff continues to monitor these and other trails, and extensive repairs will likely be needed before these trails can be reopened for public use after the area has been stabilized. Since the last update to the City Council, land movement has continued in the Preserve; most notably in areas along Burma Road Trail and on Peppertree Trail, Landslide Scarp Trail, Garden Trail, and in the surrounding landscapes. Portions of Burma Road are no longer accessible by vehicle and are difficult to traverse on foot. These areas saw additional significant damage during the recent February/March 2024 storms, including elevation changes, large increases in erosion, and additional and expanded fissures. New developments have been observed in multiple locations in the Preserve, most notably on Garden Trail, Ishibashi Trail, Burma Road Trail, and in the Lay Reserve. These new developments tie in closely to the previously noted areas and show the expansion and connectivity of land movement throughout the Preserve. Infrastructure such as utility poles and water mains continue to be impacted in these areas. The photos below show recent conditions. The City has recently obtained drone footage of the Preserve and it will be posted on the City’s website in the near future. The purpose of the working group is to coordinate, develop and implement actions with participating members to minimize land movement and its impact on private property as well as public infrastructure. Although many of the measures are the responsibility of other parties, the City is proactively supporting and facilitating various measures. The working group is comprised of the following: • Abalone Cove and Klondike Canyon Landslide Abatement Districts (ACLAD and KCLAD) and their geologist; • California Water Service (Cal Water) • Southern California Gas Company (SoCalGas) • Southern California Edison (SCE) • Seaview Residential Association • Portuguese Bend Community Association • Portuguese Bend Beach Club Homeowners Association • Palos Verdes Peninsula Land Conservancy (PVPLC) • Los Angeles County Public Works Sanitary Sewer Maintenance (LACPW) • Los Angeles County Sanitation Districts (LACSD) • City of Rolling Hills • Rolling Hills Community Association • Area residents • Staff and consultant program manager, geologists, and civil engineers A summary of key recent activities is presented below: Fissure Filling: A combined effort including the Recreation and Parks Department, Public Works Department, ACLAD, and KCLAD continues to be underway to fill as many fissures as possible (especially in advance of forecasted rain), with geologists providing direction on priorities. Additionally, the PVPLC Volunteer Trail Crew is assisting with maintenance to repair fissures and erosion on trails to keep as many trails within the landslide area open as possible. Roadway Repairs: The City continues to inspect Palos Verdes Drive South (PVDS) and roadways in the Seaview Neighborhood on a regular basis. Repairs continue to be conducted as needed, particularly on PVDS. Staff, through consultants, performed a review of heavy vehicle restrictions on PVDS with respect to geotechnical impacts on the roadway, particularly at the area locally known as the “Ski Jump”. Because the impact of a vehicle on the road structure is dependent on the speed, the geotechnical engineering consultant’s review recommended certain speed limits based on vehicle classification. The review concluded that light vehicles should be restricted to a speed limit of 45 miles per hour, 8 heavy vehicles should be restricted to a speed limit of 35 miles per hour, and very heavy vehicles (three or more axles) should be prohibited. PVDS already has a speed limit of 35 miles per hour, therefore the speed limit restrictions are already in effect. Additionally, the use of PVDS as a haul route is prohibited, therefore, the heavy vehicle restriction is already in effect. Additional signage reinforcing this condition will be installed in the coming weeks. Overall signage on PVDS is also being reviewed, to include a traffic engineering and geometric conditions analysis. Signage modifications will be made, if recommended by the City’s traffic engineering consultants. Overall, it has become apparent that the “ski jump” is a separate lobe of the PBL that is breaking off. The ground on both sides of the rift/scarp at the ski jump is moving, with the east side dropping relatively faster than the west side. The elevation difference at this break is increasing rapidly and jeopardizing PVDS. It is possible that PVDS will need to be closed in the near future because it could become unsafe. Therefore, the City’s consultants are developing construction documents to regrade the road, which may require a temporary closure of PVDS. In the event PVDS has to be closed, staff is exploring if a detour route can be developed. PVDS typically accommodates 15,000 daily trips. The regrading is likely to be accomplished by building up the east side of the “ski jump” and even potentially cutting the west side. The City is exploring building up the east side using innovative materials such as geofoam blocks, which are synthetic lightweight blocks with similar compression strength as traditional fill materials. The design will be very closely coordinated with the Los Angeles County Sanitation Districts to carefully consider impacts on the sanitary sewer trunk lines. A construction plan is being developed and will be presented to the City Council for approval consideration on April 2, 2024. Water Distribution Pipes: In the Portuguese Bend Community Association neighborhood (PBCA), Cal Water started construction to bring certain water distribution pipes above ground. Work started on bringing a segment of watermain at Clovetree Place and near Cinnamon Lane above ground. Installing swing joints on existing above-ground water lines on PVDS south of Wayfarers Chapel has also started. These projects are expected to be complete by the end of March 2024. Cal Water is continuing planning work on several other projects including bringing the water main at Vanderlip Drive near Vanderlip Trail as well as between PVDS and Yacht Harbor Drive above ground, installing swing joints throughout Narcissa Drive, and replacing watermains in the Seaview neighborhood. (Attachment E) Sanitary Sewers: Inspection and repair of the underground sanitary sewers in the Seaview neighborhood is being regularly conducted by the Los Angeles County Public Works, who maintains and operates the system. Due to repeated sanitary sewer breaks in certain areas, the City is discussing possibly re-routing certain segments of the sewer to avoid the areas of greatest movement. 9 Utility Poles in Preserve: SCE is currently engaged in a project to remove 40 de-energized utility poles from the Portuguese Bend Reserve because the land movement has made ongoing maintenance of these poles untenable. The work is occurring in consultation with the City Geologist and includes the use of crews with all-terrain type vehicles as well as helicopters (when approved by the City Manager). The helicopter staging area is located adjacent to the Forrestal Reserve off Main Sail (Intrepid) Drive. The schedule is variable depending on field conditions and notification is provided to nearby HOAs whenever possible. Land Movement Surveying: Staff ordered a GPS land movement survey of select locations representative of the Landslide Complex in February 2024 to understand land movement rates in comparison to recent surveys (January 2024, December 2023, and October 2023). Due to ongoing rain and resultant ground conditions limiting access, the survey was conducted in early March 2024 and a report is being developed for public distribution, which is expected to occur in late March 2024. Initial raw data has been provided to the City Geologist for his early review. Staff continues to coordinate with the City Geologist and Land Surveyor to identify whether additional monitoring points are warranted in response to increased and expanded land movement. KCLAD Activities KCLAD now has a total of 4 operational wells which are pumping a total of approximately 225 gallons per minute at the time of publication of this report. A fifth well is currently being repaired and is expected to become a productive pumping well. The tarps installed to prevent water infiltration at the high priority Klondike Canyon Landslide boundary fissure continues to be maintained by City crews on a regular basis, especially in advance of forecasted storms. The City and KCLAD have been meeting with the Los Angeles County Flood Control District (LACFCD), which has jurisdiction over Klondike Canyon, to discuss surface drainage in Klondike Canyon to minimize recharging the water table thereby reducing landslide movement. LACFCD is peer reviewing drainage solutions proposed by KCLAD for Klondike Canyon to reduce surface water infiltration and resultant land movement. The City shared available information with LACFCD and will continue to coordinate with LACFCD to facilitate their peer review. ACLAD Activities Four City-funded dewatering wells south of PVDS that were recently installed are operational. Additionally, two ACLAD-funded wells north of PVDS have been installed, with power and drainage lines scheduled to be connected in March . ACLAD and the City have cleared vegetation to provide access to the Kelvin Canyon 10 Spring and are now assessing potential actions to prevent surface water from infiltrating into the ground and contributing to land movement by recharging the water table. The City and ACLAD have been meeting with LACFCD, which has jurisdiction over Altamira Canyon, to discuss Altamira Canyon as it relates to reducing landslide movement. LACFCD is peer reviewing the Altamira Canyon Drainage / Erosion Control project study report prepared by the City (through tis consultant Harris & Associates, Inc.). The City shared available information with LACFCD and will continue to coordinate with LACFCD to facilitate their peer review. The City Council is being asked to receive and file an update on activities in the Landslide Complex related to the emergency declaration. Building Inspection Update Building Division Staff have been proactively conducting windshield inspections of the residential neighborhoods (PBC, Seaview, and PBCA) within the landslide complex multiple times per week to monitor conditions particularly structures. Staff have also visited commercial/institutional sites to evaluate the safety of the structures. After discussions held during site visits to Wayfarers Chapel, on February 15, 2024, the leadership of that facility chose to voluntarily close access to the site to address the shifting conditions. The Building Division has visited the Portuguese Bend Nursery School and determined that facility is safe to continue operations. To date, the City’s Building Official has red-tagged two homes in the Seaview neighborhood due to structural damage sustained as a result of land movement. No other structures have been yellow- or red-tagged within the landslide complex which limits and/or prohibits occupancy. It is the City’s obligation to ensure and protect public health and safety. Accordingly, site and building inspections will occur when warranted with voluntary compliance, unless an inspection warrant is deemed necessary. The City Council is being asked to receive and file an update on building inspections in the Landslide Complex. Portuguese Bend Landslide Remediation Project and Associated Grants On February 20, 2024, Staff presented the City Council with an update on the final engineering and final Environmental Impact Report (EIR) for the Portuguese Bend Landslide Remediation Project (Project), which consists of the following components: • Infill surface fractures (fissures) to prevent storm water runoff from easily becoming part of groundwater. • Install surface drainage systems, including natural swales, to convey storm water runoff to the ocean and prevent it from becoming part of the groundwater. • Install hydraugers to extract underground artesian water and reduce pressure to slow down landslide movement. In light of current conditions in the Landslide Complex, the City Council directed Staff to 11 expedite the final EIR and complete final engineering based on the original concept design rather than re-analyzing the project to determine if changes could be made to reduce environmental impact of the project. This approach does not preclude future changes to the design to reduce the environmental impact. The City’s EIR consultant, LSA has been working on completing the Final EIR while the City’s design consultant, Geo-Logic Associates (GLA), has been working on completing the final engineering. Based on the progress to date, Staff expects to present the final engineering documents and the Final EIR for the City Council’s consideration in May 2024. Upon certification of the Final EIR and approval of the final engineering documents, the permitting process will begin. Staff have already been holding meetings with some permit agencies, including the California Coastal Commission,the California Department of Fish and Wildlife, and U.S. Fish and Wildlife to alert them of the dire conditions being faced and request that they expedite permits. Meetings with other permit agencies such as the Regional Water Quality Control Board and the United States Army Corps of Engineers will be scheduled shortly. Based on early discussions with the various permit agencies and the State of Emergency proclaimed by the Governor, Staff expects the permitting process with these agencies to be significantly expedited. An estimate of the duration of permitting is still being developed. In January 2023, the City submitted an application to the Federal Emergency Management Agency’s (FEMA) Building Resilient Infrastructure and Communities (BRIC) FY22 cycle grant program to fund 70%, or $23 million, of the project’s estimated cost of approximately $33 million. The BRIC program requires the balance of the project cost to be funded through non-federal sources. The City’s BRIC grant was vetted, and subsequently submitted to FEMA by the California Governor’s Office of Emergency Services (CalOES), the administrators of the grant for California on behalf of FEMA. On August 28, 2023, FEMA announced the selection of 124 projects, from a total of 803 applications, for the BRIC National Competition, including the City’s project with $23 million being allocated, not obligated, for the City’s project . This means that the projects met the basic eligibility requirements and enter the next phase of the awards review process. This includes a programmatic review before making a final funding decision. The review process, including environmental, is expected to have a duration of two to three years, at which point funding would be obligated. The final step in the process leading up to construction is the solicitation of construction bids, which is expected to have a duration of up to three months including advertising of the project and execution of a construction contract. City Staff are meeting regularly with the CalOES and FEMA project team to ensure the review process is proceeding seamlessly and to identify any potential measures to expedite the process to allow remediation work to stabilize the landslide sooner than later. Additionally, on February 20, 2024, the office of Los Angeles County Supervisor Janice Hahn pledged $5 million towards the City’s landslide remediation. Separate from the BRIC grant, the City applied for a Legislative Pre -Disaster Mitigation 12 (LPDM) grant. The City was selected for a $2 million dollar LPDM grant through Senator Feinstein’s Office. Because the 30% funding match for the BRIC grant cannot be from other federal sources, the LPDM grant is being applied towards the Palos Verdes Drive South at Peppertree Drive Drainage Project. This project will rebuild the drainage system in the area to convey stormwater runoff to the ocean rather than allow it to infiltrate into the ground and contribute to land movement, as it currently does. The City Council is being asked to receive and file an update on the Portuguese Bend Landslide Remediation Project and associated grants. Emergency Measures for the Portuguese Bend Landslide Due to the alarming increase in the rate of land movement in the Landslide Complex, the City is developing plans to implement certain components of the Portuguese Bend Landslide Remediation Project discussed above as emergency stabilization measures. GLA recommends the immediate installation of Hydrauger A1 from the Portuguese Bend Landslide Remediation Project, to extract artesian water creating pressure and contributing to land movement, as the most beneficial immediately available action (see map below). However, because of the current rate of movement, GLA recommends relocating Hydrauger A1 to the turn-out area adjacent to the formerly known Gateway Park, adjacent to PVDS. This is because the area is stable, easily accessible from PVDS, and drainage lines can be efficiently directed to Klondike canyon where they continue into a pipe under PVDS. This new location is now referred to as Hydrauger E1 as shown in Exhibit 1 (see map below). In advance of this work, borings will need to be taken in vicinity of the hydrauger arrays to validate modelling calculations. (Attachment C) Additionally, GLA also recommends the immediate installation of Hydrauger A2 from the Portuguese Bend Landslide Remediation Project, or another array in very close proximity as shown in Exhibit 2, to help capture water that has infiltrated into the ground at the top of the Portuguese Bend Landslide. This hydrauger array is now referred to as Hydrauger E2 as shown in Exhibit 1. (Attachment C) CONTINUED ON THE NEXT PAGE 13 Exhibit 1: Conceptual Locations of Hydraugers E1 and E2 Attached are the project plans for the proposed emergency work (Attachment C). If approved this evening, Staff will bring the construction contract for the City Council’s consideration at its April 2, 2024 meeting. If the construction contract is approved, construction is anticipated to begin in May. The estimated cost to install Hydraugers E1 and E2 is a total of approximately $8 million. In considering funding options for the proposed emergency work, a criterion of the BRIC grant is that work cannot commence in the project boundary until final award of the grant because it could change the benefit-cost analysis (BCA), which is a fundamental criterion of the grant evaluation. Proposed Hydraugers E1 and E2 are proposed to extend into the project boundary to be most effective and could change the BCA. Therefore, the City has requested that FEMA allow the Portuguese Bend Landslide Remediation P roject boundaries to be re-drawn accordingly and the BCA to be re-calculated. On March 11, 2024, the City was notified that FEMA agreed to this request, which means that proceeding with implementation of Hydraugers E1 and E2 as emergency work does not eliminate the Portuguese Bend Landslide project from BRIC grant award eligibility. However, FEMA also notified the City that Hydraugers E1 and E2 are not eligible for funding through FEMA’s hazard mitigation assistance grant programs, including the BRIC grant. But that doesn’t preclude the emergency work from being funded through other assistance programs. Alternatively, the FEMA disaster recovery program is a potential avenue for receiving reimbursement for the costs of Hydraugers E1 and E2, which are estimated be in the range of a total cost around $8 million. On February 4, 2024, Los Angeles County and the Governor both proclaimed a State of 14 Emergency due to the early February 2024 atmospheric river. The early February 2024 storms may also become a federal disaster, in which case emergency stabilization measures may be eligible for funding. In light of this, the City collaborated with ACLAD and KCLAD to submit cost estimates for its Initial Damage Estimate (IDE) on our local response and recovery to the storms. The IDE was submitted to Los Angeles County Office of Emergency Management (LACOEM) for inclusion in the County’s Preliminary Damage Assessment (PDA) that was submitted to CalOES. Among other response and recovery costs, t he City’s IDE requested disaster recovery funds from CalOES and FEMA for Hydraugers E1 and E2 as well as the re-grading of PVDS, depending on which category is included in the federal disaster proclamation, if there is one. The City is also exploring amending the January-March 2023 winter storms reimbursement request to FEMA as part of the Governor’s State of Emergency and the President’s proclaimed Federal Disaster, in the event that the early February 2024 storms are not declared a federal disaster. The amendment would be on the basis that the damages were incurred as a result of the January-March 2023 winter storms, but that the extent of those damages and emergency measures did not become clearly known until after the initial damages were submitted by the City. Staff is exploring other funding reimbursement options such as the $5 million pledge by Los Angeles County Supervisor Janice Hahn or applying congressionally directed spending grants (if they do not conflict with FEMA requirements). The City Council is being asked to approve the plans for Hydraugers E1 and E2 this evening. Should the City Council approve the plans, Staff will obtain bids and present a construction contract to the City Council for approval consideration on April 2, 2024. While Staff continues to explore other grant funding sources, an additional appropriation of approximately $8 million from the Capital Infrastructure Program (CIP) Fund will also be requested on April 2, 2024 to initiate the project immediately. The CIP’s estimated unallocated fund balance at the end of FY 2023-24 is $25.4 million. Any grant sources received in the future will replenish the CIP Fund. ACLAD and KCLAD Assistance ACLAD and KCLAD, which are Geologic Hazard Abatement Districts (GHADs), were created with the authority and responsibility to address and mitigate land movement within their boundaries. These GHADs are governmental districts, independent of the City, formed for the prevention, mitigation, abatement, or control of a “geologic hazard”, which is defined as an actual or threatened landslide, land subsidence, soil erosion, earthquake, fault movement, or any other natural or unnatural movement of land or earth. The GHADS have the ability to assess properties within their districts to fund their activities. To date, the City has been coordinating very closely with the GHADs on their various mitigation activities. Due to the severity of the emergency, Staff recommends that the City Council direct Staff to directly assist ACLAD and KCLAD by providing in-kind services such as geology, engineering, and project management; as well as financial assistance 15 in the form of no-interest loans or grants. KCLAD shared with Staff a proposed 5-step plan to significantly reduce movement in the Klondike Canyon landslide with a cost estimated by KCLAD to be $5.4 million (Attachment D). Staff recommends that the City Council direct Staff to explore how the City could provide financial assistance to KCLAD to implement this plan and return with details for the City Council’s approval consideration on April 2, 2024. Staff recommends that the financial assistance be conditioned upon the plan being endorsed by a licens ed geotechnical engineering company as assurance that the plan will achieve its intended goals. Staff is expecting a similar plan from ACLAD and recommends the same approach. Any financial assistance, at approximately $3 million in total, considered by the City would be funded from the estimated unallocated fund balance of $25.4 million in the CIP Fund. ACLAD and KCLAD are requesting reimbursement for as part of the disaster declarations noted earlier in this report. As political subdivisions of the State, the GHADs are eligible for such funding. Additionally, the GHADs are exploring County, State, and Fe deral funding assistance, including grants. Finally, it is important to note that KCLAD has indicated to Staff that they are investigating an increase in assessments of properties in the district to replenish their reserves. The City Council is being asked to direct Staff to return on April 2, 2024 with details of funding assistance to the GHADs, contingent upon their landslide mitigation plans being endorsed by a licensed geotechnical engineering company. State of Emergency Declaration On February 20, 2024, the City Council authorized the Mayor to request the Governor declare a State of Emergency by suspending and/or waiving certain state requirements for work to stabilize the Landslide Complex due to the immediate threat to public safety, and consider requesting the President declare a Federal Emergency Disaster. Such a declaration would allow the City to streamline or bypass permitting for measures to reduce land movement. The City submitted the request to the Governor, following the process of submitting the request to the LACOEM, who then submits the request to CalOES on behalf of the City. The City did not request financial assistance as part of the request to the Governor because such a request would take the Governor’s Office a significant amount of time to process and time is of the essence for the emergency work to commence immediately to stabilize the area due to the immediate threat to public safety. On February 23, 2024, City Staff met with the Director of CalOES, Nancy Ward; her staff; the Director of LACOEM, Kevin McGowan; and his staff, to discuss the City’s request. It was at this virtual meeting that the City was notified that the City’s request was covered under the February 4, 2024 State of Emergency proclaimed by the Governor for 8 counties, including Los Angeles County. City Staff was informed that state permitting requirements were relaxed and/or suspended, and would follow emergency orders f or work needed to stabilize the landslide. 16 At the February 20 meeting, the City Council also directed staff to have a joint letter signed by the City’s county, state and federal representatives supporting the City’s request for the Governor to declare a state of emergency and to request a federal disaster to be declared. While collecting signatures for the joint letter, the letter was no longer needed because a determination by the Governor was made. As previously reported, in response to the February 2024 storms, the city submitted an IDE to the LACOEM, detailing the financial impact on both the City as well as ACLAD and KCLAD. This submission is required to be considered for federal assistance related to the February 2024 storms via FEMA. While the approval process is ongoing, the City is diligently documenting preliminary expenses related to landslide stabilization efforts aimed at protecting life and property. It is anticipated that the Governor will seek a federal disaster declaration once the County's comprehensive preliminary damage assessment (PDA) surpasses the necessary threshold. Should a federal disaster be declared, FEMA offers two principal types of assistance following major disasters The first is Individual Assistance (IA) which supports directly impacted households and businesses through various means, including grants for temporary housing and emergency home repairs. The U.S. Small Business Administration also offers low-interest disaster loans to help individuals and businesses recover from the disaster. The second is Public Assistance (PA) which focuses on repairing or replacing damaged public facilities and infrastructure, with FEMA covering at least 75% of eligible costs and the remaining portion shared by state and local governments. The PA program aims to restore essential services and infrastructure to their pre-disaster condition. The City Council is being asked to receive and file this update report on the City’s request to the Governor to declare a State of Emergency for the Greater Portuguese Bend Landslide Complex Extension of the Local Emergency Declaration On October 3, 2023, the City Council adopted Resolution No. 2023-47 declaring a local emergency. The emergency declaration is deemed to continue to exist until its termination is proclaimed by the City Council in accordance with law. Government Code § 8630 requires the City Council to review of the need for continuing the local emergency at least once every 60 days until the City Council determines the local emergency within the geographic boundaries of the Landslide Complex has been abated or mitigated to insignificance. At this time, the City Council is being asked to extend the local emergency declaration an additional 60 days through May 18, 2024, which does not require a public hearing. The state of emergency was continued by the City Council on Novembe r 14, 2023, pursuant to Resolution No. 2023-56, again on December 19, 2023, pursuant to Resolution No. 2023-61, and again on February 6, 2024, pursuant to Resolution No. 2024-05. If extended this evening, the Council would consider renewing the local emergency declaration again during the next landslide update on May 07, 2024. The City Council is being asked to adopt Resolution No. 2024 -__ thereby extending the 17 Declaration of Local Emergency by 60 days (Attachment A). ADDITIONAL INFORMATION: Coordination with the City of Rolling Hills The Flying Triangle Landslide (FTL) in the City of Rolling Hills is one of the five landslides that make up the greater Landslide Complex. The FTL is situated above the KCL and drains into Klondike Canyon. City officials from Rolling Hills are participating in the weekly Working Group Meetings and are coordinating with their team. Both cities are coordinating approaching the land movement wholistically. As more information becomes available from Rolling Hills, it will be conveyed to the City Council and at future Working Group meetings. It should be noted that City Staff have stressed to Rolling Hills officials the importance of addressing the FTL in terms of studying the current hydrological conditions of Klondike Canyon within the entire watershed and collectively developing remediation measures. Public Outreach The public was made aware of tonight’s agenda item through the City’s listserv, as well as an update at the March 13 Landslide Working Group meeting. Some public comments have already been received requesting the City Council’s support of KCLAD’s 5-step project and to support other landslide remediation efforts (Attachment F). Any additional comments received after publication of this staff report will be provided to the City Council as late correspondence. The public can submit comments via email to cc@rpvca.gov. CONCLUSION: Staff recommends that the City Council receive and file an update on landslide conditions and activities to mitigate landslide movement and adopt the attached rResolution continuing the local landslide emergency declaration by 60 days until May 18, 2024. Staff also recommends that the City Council approve concept plans for installation of two emergency stabilization hydrauger arrays with associated work, and return at the April 2, 2024 City Council meeting for approval consideration of a construction contract. Finally, Staff recommends that the City Council direct Staff to explore assisting the Abalone Cove Landslide Abatement District and the Klondike Canyon Landslide Abatement District with in-kind services and financial assistance in the form of a loan for landslide mitigation measures prepared by a licensed geotechnical engineering company and return to the April 2, 2024 meeting for the City Council’s consideration. ALTERNATIVES: In addition to Staff’s discussed option, the following alternative actions are available for the City Council’s consideration: 1. Take no action and simply receive and file this report. 2. Do not approve the plans, specifications, and construction documents for installation of two emergency hydraugers to stabilize the Portuguese Bend Landslide. 3. The Landslide Complex encompasses four historically active landslide areas: the Portuguese Bend Landslide (PBL), the Abalone Cove Landslide (ACL), the Klondike Canyon Landslide (KCL), and the Beach Club Landslide (BCL). However, it also includes areas outside of the historical boundaries of those known landslides, predominantly uphill from the Portuguese Bend and Abalone Cove landslides, within the Ancient Portuguese Bend Landslide Complex as mapped by various agencies (i.e., U.S. Geological Survey, California Geological Survey) and other researchers. Since our presentation to the City Council on February 6, 2023, we have conducted additional field mapping throughout the Landslide Complex, including areas within the Portuguese Bend, Filiorum and Abalone Cove Reserves, and made specific visits to Kelvin Canyon, properties along Vanderlip Road, and the Wayfarer’s Chapel property. We have also participated in the weekly Portuguese Bend Landslide Complex Working Group meetings, provided input to OSM staff related to non-native brush removal and habitat restoration projects, reviewed additional survey and rainfall data, and corresponded with Wayfarer’s Chapel’s geotechnical consultant. We have also responded to numerous interview requests from regional newspapers, radio stations, and both local and national television media outlets. Rainfall and the accompanying infiltration and runoff into the Landslide Complex continue to adversely affect the landslide area. The 2023-24 season rainfall total was 7.23 inches through January 31, 2024 (Rolling Hills Fire Station 56 ALERT gauge); however, 8.29 inches of rain fell over the following week, raising the season total to 15.52 inches through February 9, 2024. February’s total rainfall was 11.22 inches, the second wettest February in the 69-year history of this rain gauge (February 1998 being the wettest). The current season rainfall total is 19.73 inches, about 145% of the season average over the past 69 years. B-1 SC6163 2 Our previous update (CSA 1/29/24) noted that average land movement velocities within the Landslide Complex from October 10, 2023 to January 10, 2024 had accelerated by a factor of 3x to 4x compared to the previous 12-month (Oct 2022-Oct 2023) monitoring period. This movement continues to manifest at the ground surface in the form of landslide scarps, fissures, grabens/sinkholes, tensional cracking, shear zones and thrust features. The ground movement features have continued to enlarge, expand, widen, or grow depending on the type of feature and location. Preliminary GPS survey data prepared by McGee Surveying Consulting, covering the period January 10-March 12, 2024 were recently received in raw form (i.e., Excel spreadsheet) and have been preliminarily reviewed. The data generally indicate that land movement velocities within the Landslide Complex have accelerated an additional 1.3x to 2.2x compared to the movement velocities in the October 2023-January 2024 timeframe. The acceleration appears to be greatest in the Abalone Cove Landslide (2.2x) and areas upslope of it in the Ancient Portuguese Bend Landslide (2.1x). The lowest acceleration (1.3x) was for points in the Klondike Canyon Landslide. Ground movement survey data were also received and reviewed for separate monitoring surveys performed on the Wayfarer’s Chapel property between November 28, 2023 and January 27, 2024. These data indicate an acceleration of movement velocities on that property from the December 2023 to January 2024 readings and total land movement of 0.20 to 1.41 feet over the two-month monitoring period. This land movement is predominantly outside of the known western boundary of the Abalone Cove Landslide and appears to be reactivation of a portion of the mapped Ancient Portuguese Bend Landslide Complex. Road conditions on Palos Verdes Drive South (PVDS) continue to deteriorate in response to the accelerated land movement. The most severe area requiring immediate and significant remedial measures is the colloquially known “ski jump” at the west margin of the PBL. The ski jump area is impacted by differential movement between the Abalone Cove Landslide west of the ski jump and the Western Subslide of the PBL east of the ski jump. The Western Subslide of the PBL is moving about 1.9 times faster than the portion of the ACL that is overriding the Portuguese Point promontory. The road displacement is occurring at the side scarp of the Western Subslide of the PBL. GPS monitoring point PB-70 is located approximately 80 feet southeast of this side scarp within the landslide lobe and is a reasonable proxy for land movement that is affecting the ski jump area of PVDS. PB-70 has moved nearly 15 feet horizontally and 5.5 feet vertically since 2015, and in the past five months alone it has moved 6.03 feet horizontally and 0.47 feet vertically (downward). The landslide is too deep in this area to consider permanent structural solutions such as shear pins, soldier piles with tiebacks, etc. Because the elevation difference at this landslide boundary is increasing so rapidly, the need for regrading of the road in this area is apparent. We have discussed alternative approaches for this grading with the City’s staff and other consultant teams, including the use of Geofoam blocks or lightweight cellular concrete in lieu of compacted fill material (because it adds substantially less driving force to the landslide), use of geogrid or other geotextiles in the road subgrade (to reduce pavement deformation), and lowering of the grade on the west side of the ski jump (cut grading). These measures are temporary and may reduce the road deformation at the ski jump area; however, the need for continuing maintenance should be expected given the current rate of land movement. B-2 SC6163 3 In summary, our findings continue to be that a large portion of the Ancient Portuguese Bend Landslide Complex above the historically mapped PBL, ACL and KCL boundaries is involved in significant active landslide movement that is impacting trails, roads, private property and infrastructure. The current area of major landslide movement involves approximately 675 acres of land. Please see Figure 1, attached, for updated mapping of ground features and current limits of major landslide movement superimposed on a February 12, 2024 orthophoto of the area. This was not a mandate nor is the City penalizing residents for non-compliance. The intent, again, was to minimize ground saturation. The ground is saturated from all the rain we received, so I suggest taking a break from watering. You will save on your water bill and help prevent the ground from becoming overly saturated. Depending on the topography and size, some yards are not feasible to hand water. Allowing plants to die due to lack of water will also increase the fire risk in our area. In addition, much of the soil around here is adobe clay. That is similar to the conditions in the “soils” area of South Torrance. Since most of us have slab foundations, I thought that it was advisable to keep the soil evenly moist around our homes to limit the amount of cracks in our foundations and walls from the expansion and contraction of the soil. Dear City Manager Mihranian: My family owns the home at 130 Spindrift Drive, Rancho Palos Verdes, CA 90275. As I am sure you are aware, Klondike Canyon Geological Hazard Abatement District (KCGHAD) has A 5-STEP PLAN ready to be funded to save the 107 homes in the Klondike slide zone. KCGHAD is just waiting on the money needed to complete those projects. The longer we wait, the more houses we will lose. Please help us secure FEMA funding ASAP. These plans are not aspirational, or over engineered, they are well thought out by people with boots on the ground. They will work! My family has lived in this area for close to 70 years. My father was raised in RPV. My brother and I were raised here in RPV, and visited my grandparents at 130 Spindrift every day after school. My 95- year old grandmother now lives in this home. She will not leave for an assisted F-30 care community because this is where the memories she still has live. This area isn't just a pretty area or a nice drive, it is where people have put down roots. This area is where families have found each other, loved each other and have been there for each other. Please aid us in gaining access to any state, federal or other government funds to aid in protecting this beloved area and community. Thank you for your prompt attention to this important issue.
