AGENDA TITLE:
Consideration and possible action to authorize submittal of application(s) for CalRecycle
grants.
RECOMMENDED COUNCIL ACTION:
1. Adopt Resolution No. 2023-__, authorizing the submittal of applications to the
Department of Resources Recycling and Recovery (CalRecycle) for all grants and
payment programs for which the City is eligible; authorizing and empowering the
Director of Public Works, or their designee, to execute all grant documents
necessary to secure grant funds and implement approved grant projects with
CalRecycle; and making these authorizations effective for five years from the date
of adoption.
FISCAL IMPACT: There are no direct costs associated with the adoption of the
resolution. However, the resolution would allow the City to apply for a non -competitive
grant estimated to be $89,000 to offset some costs associated with the implementation
of SB 1383. Currently, the adopted Fiscal Year 2023-24 budget includes $143,000 for
professional services to assist the City with implementing enforcement/inspections,
recordkeeping, and other associated program requirements.

BACKGROUND AND DISCUSSION:
To assist in complying with California’s Short-Lived Climate Pollutants Reduction Act (SB
1383), Staff is preparing to apply for a one-time, non-competitive local assistance grant
available through the California Department of Resources Recycling and Recovery

(CalRecycle). SB 1383 established a statewide effort to reduce emissions of short -lived
climate pollutants which set targets to reduce disposal of organic waste by 75 % by 2025
and recover at least 20% of currently disposed surplus food by 2025.
In April 2022, the City was awarded a CalRecycle grant in the amount $59,573 toward
compliance with SB 1383. This is the second round of one-time grant funding provided
by CalRecycle related to SB 1383 and is estimated to be $89,000. The grant will be used
to implement regulatory requirements associated with SB 1383, including conducting
enforcement/inspections, program evaluation/gap analysis and follow-through, complying
with procurement requirements, training, preparing necessary recordkeeping and
compliance forms and completing reports, grant management, providing assistance to
residents and businesses, conducting record keeping and compliance tracking, and
subscribing to recycling compliance software for documentation and tracking.
As part of the grant application process, CalRecycle requires a resolution (Attachment A)
adopted by the City Council authorizing the submittal of the grant application and
establishing the Public Works Director or designee as the executor of the grant. This
resolution, once in place, can also be used for any other CalRecycle grant applications
the City wishes to pursue over the next five years. The attached resolution for City Council
consideration is based on a resolution template provided by CalRecycle.
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative action is available for
the City Council’s consideration:
1. Do not adopt the authorizing resolution and forego funding from this non -
competitive grant. Such action will result in costs to implement new laws to be
borne by the City’s General Fund operating budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES, CALIFORNIA AUTHORIZING
SUBMITTAL OF APPLICATIONS FOR ALL CALRECYCLE
GRANTS AND PAYMENT PROGRAMS FOR WHICH THE CITY OF
RANCHO PALOS VERDES IS ELIGIBLE; AUTHORIZING AND
EMPOWERING THE DIRECTOR OF PUBLIC WORKS, OR THEIR
DESIGNEE, TO EXECUTE ALL GRANT DOCUMENTS
NECESSARY TO SECURE GRANT FUNDS AND IMPLEMENT
APPROVED GRANT PROJECTS WITH CALRECYCLE; AND
MAKING THESE AUTHORIZATIONS EFFECTIVE FOR FIVE
YEARS FROM THE DATE OF ADOPTION.
WHEREAS, Public Resources Code Section 48000 et seq. authorizes the
Department of Resources Recycling and Recovery (CalRecycle) to administer various
grant programs (in furtherance of the State of California’s efforts to reduce, recycle and
reuse solid waste generated in the state ) thereby preserving landfill capacity and
protecting public health and safety and the environment; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures governing the application, awarding, and management of the grants; and
WHEREAS, CalRecycle grant application procedures require, among other things,
an applicant’s governing body to declare by resolution certain authorizations related to
the administration of CalRecycle grants.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES THAT:
Section 1. The above recitals are true and correct and are incorporated herein
by reference.
Section 2. The City Council of the City of Rancho Palos Verdes authorizes the
submittal of applications to CalRecycle for all grants and payment programs for which the
City of Rancho Palos Verdes is eligible;
Section 3. The Director of Public Works, or their designee, is hereby authorized
and empowered to execute in the name of the City of Rancho Palos Verdes all grant
documents, including but not limited to, applications, agreements, amendments, and
requests for payment, necessary to secure grant funds and implement the approved grant
project; and
Section 4. These authorizations are effective for five years from the date of
adoption.
