AGENDA TITLE:
Consideration and possible action to ratify the payment to Built Rite Fence Company for
emergency fence replacement services.
RECOMMENDED COUNCIL ACTION:
1) Ratify the payment of $61,870 to Built Rite Fence Company for emergency fence
replacement services rendered between June 16, 2023 and June 28, 2023.
FISCAL IMPACT: Ratifying the payment made to Built Rite Fence Company, as noted
in the staff recommendation, will result in a total authorized
expenditure of $61,870 from the Fiscal Year 2022-23 budget. The
expenditure will be funded and accrued from various unspent
maintenance service accounts.

BACKGROUND AND DISCUSSION:
From February 22 to March 10, 2023, Southern California received back-to-back
rainstorms that intensely affected the City of Rancho Palos Verdes. The heavy and
consistent rainfall and wind caused extensive damage throughout the City, including to
the fencing around the tennis court located at the Ken Dyda Civic Center. The extent of

the damage was so significant that the court and surrounding area was closed to the
public due to safety concerns. The Recreation and Parks Department and Public Works
Department determined the fencing was not repairable and would need to be removed.
In an effort to safely reopen the court to the public as quickly as possible, on March 1,
2023, the Recreation and Parks Department reached out to several fencing construction
contractors requesting quotes for removal and replacement of the damaged fencing . Two
vendors responded to the Department’s request. Of the two vendors, Built Rite Fence
Company provided the lowest quote and most complete estimate of the work required.
Due to difficulty in finding potential vendors, negotiations with the selected vendor, and
lead time on materials once a vendor was secured, a contract was executed with the
vendor on June 13, 2023 and work commenced on June 15, 2023.
Staff was authorized to secure emergency services under Rancho Palos Verdes
Municipal Code Section 2.44.080:
Emergency purchases required due to natural disasters or other
unforeseen circumstances may be made by the purchasing agent if so
noted on the purchase order form. Any such purchase shall be reported to
the city council at the earliest opportunity, including supporting
documentation to demonstrate the emergency and to provide a detailed

Built Rite Fence Company completed removal and replacement of chain link fence, fence
posts, footings, and tennis screen to match the damaged fence. The new fence was
installed to specifications provided by Built Rite Fence Company and calculated for
expected wind loads at the Civic Center site.
After completion of the work, the City received an invoice for $61,870 from Built Rite
Fence Company. The invoice matched the approved quote provided by the vendor prior
to commencement of the work. The invoiced amount was lower than the other vendor’s
quote.
Pursuant to Rancho Palos Verdes Municipal Code Section 2.44.080, Staff is now
reporting the purchase and requesting that the City Council ratify a payment of $61,870
to be made on August 18, 2023 for the following services:
• Removal of 320 linear feet of 10' high chain link fence, fence post and footing, and
haul away.
• Furnish and installation of 320 linear feet of 10' high chain link fence with tennis
screen to match existing.
• Installation of 1 - 3' x 8' pedestrian gate.
• Installation of tennis court screen.

ADDITIONAL INFORMATION:
2023 Storm Damage Reimbursement
Staff is seeking reimbursement for these and other expenses related to the late 2023
February to March storms by working closely with the California Governor’s Office of
Emergency Services (CalOES) on the submittal of a reimbursement request to the
Federal Emergency Management Agency (FEMA). If approved, the costs incurred for
services provided by Built Rite Fence Company may be reimbursed.
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative actions are available for
the City Council's consideration:
1. Do not ratify the payment to Bult Rite Fence Company.
2. Take other action, as deemed appropriate.
