AGENDA TITLE:
Consideration and possible action to approve the successor Memorandum of
Understanding (MOU) between the City of Rancho Palos Verdes and the Rancho Palos
Verdes Employees Association (RPVEA) for the period of July 1, 2022 through June 30,
2025.
RECOMMENDED COUNCIL ACTION:
(1) Adopt Resolution No. 2023-__, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO PALOS VERDES ACCEPTING, APPROVING AND
ADOPTING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE
CITY OF RANCHO PALOS VERDES AND THE RANCHO PALOS VERDES
EMPLOYEES ASSOCIATION FOR THE PERIOD OF JULY 1, 2022
THROUGH JUNE 30, 2025
FISCAL IMPACT: The budget allocated for the MOU is included as a portion of the
personnel budget of $13.6 million in the Fiscal Year 2023-24 draft budget. VR

BACKGROUND AND DISCUSSION:
Pursuant to the Meyers-Millais-Brown Act (MMBA) (Government Code sections 3500-
3511) and the City’s Employer-Employee Relations Resolution No. 2018-23, the City and
RPVEA met and conferred in good faith on April 4, April 18, May 5, May 24, June 2, and
June 9, 2022, regarding a successor RPVEA MOU. The parties’ labor representatives

successfully negotiated a Tentative Agreement on a successor RPVEA MOU covering
the period of July 1, 2022 through June 30, 2025 (RPVEA MOU 2022 -25), which was
ratified by the RPVEA membership on June 15, 2022 and signed by the labor
representatives that same day. The City Council accepted, approved, and adopted the
Tentative Agreement on June 21, 2022 by means of Resolution No. 2022-42 (Attachment
B).
The highlights of the Tentative Agreement for the successor RPVEA MOU 2022 -25
included the following:
• Three-year term (July 1, 2022 to June 30, 2025)
• Annual Cost-of-Living adjustment (COLA) on the first full pay period of July of each
year with a 0% floor and 3% ceiling, with a 3% COLA in year one
• A one-time non-PERSable lump sum retention bonus of 2% in year one for current
active employees
• Enhanced performance evaluation ratings in years 2 and 3 of the MOU term
• Increased standby pay from $100 per week to $200 per week for maintenance staff
• Increased City deferred compensation contribution, expanded to all tiers
(combined contributions are not to exceed IRS limits)
o Tier 1: Up to $45 match of employee contribution
o Tiers 2 and 3: Up to $100 match of employee contribution
• One additional floating holiday in lieu of Juneteenth as a holiday
• MOU update and cleanup language
Resolution No. 2022-42 directed the labor representatives of the City and RPVEA to
subsequently jointly prepare a written MOU in accordance with the Tentative Agreement
and present the same to the City Council at a future date for consideration and approval.
Soon after, the labor representatives of the City and RPVEA began working on cleanup
language prior to finalizing the successor RPVEA MOU 2022-25, including adopting MOU
provisions that were in conformance with changes in the law that became effective during
and after the Tentative Agreement was negotiated and approved by the parties. The
parties’ labor representatives met several times, and on May 10, 2023, the RPVEA labor
team approved the draft RPVEA MOU 2022-25.
In addition to the Tentative Agreement provisions noted above, the cleanup that was done
clarifies existing language to ensure the language accurately reflects the intent of the
parties. Additionally, some MOU sections were relocated to allow for ease of reading and
for content to be logically and seamlessly connected. No new language was introduced;
however, some language was required due to state legislation on sick and bereavement
leaves.
The highlights of the cleanup language include:
• Inclusion of the terms agreed upon in the Tentative Agreement
• Legislative language updates to bereavement leave and paid sick leave

• Clarification of dress code to include examples of appropriate and inappropriate
work attire
CONCLUSION:
Based on the above discussion, Staff recommends that the City Council adopt the
attached resolution approving the 2022-25 RPVEA MOU effective for three years
commencing on July 1, 2022 (Attachment A).
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative action is available for
the City Council’s consideration:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDESACCEPTING, APPROVING
AND ADOPTING THE MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF RANCHO
PALOS VERDES AND THE RANCHO PALOS VERDES
EMPLOYEES ASSOCIATION FOR THE PERIOD OF JULY
1, 2022 THROUGH JUNE 30, 2025
WHEREAS, the City Council of the City of Rancho Palos Verdes (“CITY”) adopted
Resolution 2020-25 on May 19, 2020, accepting, approving and adopting the Tentative
Agreement dated May 19, 2020, and the successor Memorandum of Understanding
between the CITY and the Rancho Palos Verdes Employees Association (“RPVEA”) for
the period of July 1, 2020 through June 30, 2021 (“RPVEA MOU 2020-21”); and
WHEREAS, the City Council of the CITY subsequently approved a First, Second
and Third Amendment to the RPVEA MOU 2020-21, the last of which extended the term
of the RPVEA MOU 2020-21 to June 30, 2022; and
WHEREAS, the CITY’s AND RPVEA’s labor representatives met and conferred
beginning in April, 3033 through June 2022 regarding a successor MOU, which resulted
in a Tentative Agreement for a successor RPVEA MOU covering the period July 1, 2022
through June 30, 2025 and which was accepted, approved and adopted by the City
Council on June 21, 2022 by means of Resolution No. 2022 -42 (Exhibit A); and
WHEREAS, Resolution No. 2022-42 directed the labor representatives of the CITY
and RPVEA to jointly prepare a written memorandum of unde rstanding in accordance
with the Tentative Agreement for a successor RPVEA MOU covering the period July 1,
2022 through June 30, 2025 and present same to the City Council at a future date for
consideration and approval; and
WHEREAS, the labor representatives of the CITY and RPVEA met and conferred
and jointly prepared and signed the successor RPVEA MOU 2022 -25 (Exhibit B) in
accordance with the Tentative Agreement for a successor RPVEA MOU covering the
period July 1, 2022 through June 30, 2025 and also addressed contract cleanup language
and new laws adopted since the Tentative Agreement was approved; and
WHEREAS, the City Council now desires to accept, approve and adopt the
successor RPVEA MOU 2022-25.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The recitals set forth above are true and correct and incorporated herein
by this reference.

Section 2: The successor RVPEA MOU 2022-25 attached hereto as Exhibit B is
accepted, approved, and adopted and shall replace any and all prior RPVEA MOUs and
amendments thereto.
Section 3: The City Clerk shall certify to the adoption of this Resolution and deem
it effective as of June 20, 2023, which shall supersede and replace Resolution No. 2022-
42.
