Exhibit A - Certificate of the Canvass of the Election Returns and Statement of Votes Cast (page B-1) ____________________________________________________________________ BACKGROUND AND DISCUSSION: At the conclusion of any given election , a canvas is conducted to account for every ballot cast and ensure that every valid vote cast is included in the election totals. On December 5, 2022, the Los Angeles County Registrar-Recorder will complete the Official Canvass of the November 8, 2022 General Municipal Election and will issue the Official Certificate of the Canvass of the Election Returns and Official Statement of Votes Cast. The results of that canvass will be set forth in Exhibit A (Attachment B) of the proposed resolution (Attachment A). 1 As of the writing of this report (November 29, 2022 @ 10:00 a.m.), the tally of votes are as follows: DAVID L. BRADLEY 25.23% 9,564 BARBARA FERRARO 22.02% 8,345 PAUL SEO 20.32% 7,702 STEPHEN PERESTAM 15.93% 6,039 KEVIN JAY YOURMAN 10.44% 3,958 MICHELE P. CARBONE 6.06% 2,297 CONCLUSION: Staff recommends that the City Council adopt the attached resolution reciting the facts of that election, thereby enabling those candidates who were elected at the November 8, 2022 General Municipal Election to assume office and begin their terms on the City Council effective December 6, 2022. 2 Resolution No. 2022-65 Declaring Election Results Page 1 of 3 RESOLUTION NO. 2022-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City Rancho Palos Verdes, California, on Tuesday, November 8, 2022, as required by law; and WHEREAS, pursuant to Resolution No. 2022-32 adopted on June 7, 2022, the election was consolidated with the Los Angeles County Local and Municipal Elections and the Los Angeles County Registrar-Recorder/County Clerk canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots cast in the precincts except vote-by-mail voter ballots was 15,049. That the whole number of vote-by-mail voter ballots cast in the City was 3,524, making a total of 18,573 ballots cast in the City. SECTION 2. That the names of persons voted for at the election for Member of the City Council are as follows: David Bradley Michelle P. The City Council does declare and determine that: David Bradley was elected as Member of the City Council for the full term of four (4) years; Barbara Ferraro was elected as Member of the City Council for the full term of four (4) years; and Paul Seo was elected as Member of the City Council for the full term o f four (4) years. SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the results of the election showing: 1. The whole number of ballots cast in the City; 2. The names of the persons voted for; 3. For what office each person was voted for; 4. The number of votes given at each precinct to each person and 5. The total number of votes given to each person. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. We, whose homes border the park and whose bedrooms back up onto Forrestal Drive, have equal concerns about our privacy and potential noise from visitors utilizing the walking path and lawn area. What kind of setback have you designed to help mitigate these concerns for Ladera Linda residents? While we are not asking for a 17-foot setback like the one along the ocean facing side of the lower field, we certainly hope that there will be an adequate setback on the Forrestal side of the park to address our concerns. On a more personal level, when you determined late in the planning and approval process to introduce the ADA entrance at the lower gate, it resulted in a widening of the overall gate. Obviously, there can be no shrubs or vines placed on that section of the fence where the gate is because the gate needs to be able to open and close. The result is that there will be a large section of fence/gate along the Forrestal side of the park which will allow visitors to look directly into my yard and home. There will also be no noise buffer in this area. The only way to provide me with more privacy and less noise is to provide a reasonable setback of the path from the Forrestal perimeter of the park. As always, I am available to council and staff if anyone would like to discuss these concerns. Approximately 25 SeaView homes on Dauntless Dr. and the cu-de-sacs are directly impacted by the Ladera Linda project. The stairs (125) leading up to LL are used regularly by a lot of residents for exercising including me and my elderly sister. I was among those who met with city staff last week to observe the southern side fencing & foliage both on- site and then from below on Dauntless Dr. We were most grateful for the opportunity to be heard as we presented an alternative to the staff's proposal for fencing and vegetation. The perimeter fence and foliage serve as an important barrier to maintain privacy, security, and property values for residents of Lad era Linda and Seaview. Mature shrubbery that exists on the hillside helps prevent erosion as well as providing privacy for homes below. The existing plants on the perimeter are drought tolerant so there is no need to remove them at additional cost to the city. Reseeding is unacceptable as it would take irrigation and a long time for plants to grow. We don't want to weaken the slope. Our meeting witn staff took place on the construction area and then we went down to Dauntless Dr. to view the hillside from the homes and street. Then we asked staff to climb the stairs to see the views of homes and the mature foliage along the existing fence and noted how it could be trimmed down and a lower fence in the same location would be preferred by residents. Staff explained that current blank spots along the rim will be replanted. I was pleased with the meeting. Security, privacy, & views were subjects of discussion. Having read the current Staff Report which incorporates the residents' suggestions, I support the Alternative Staff Recommendations and ask that you approve them. Thank you for your service to RPV! We already have endured problems with people trespassing on our property, finding beer bottles and trash left by people using the stairs as a place to party. They also abuse the parking by parking numerous cars along the front of my home. We are only asking that we have our privacy and our neighborhood preserved. Since this project began, there seems to have ben a lack of communication from the City and I would hope that as residents you would open your ears and listen to our concerns. The current vegetation and fencing provides security and privacy and we would like to retain as much of the existing foliage as possible. Several mature trees have already been cut down as part of the park construction. We believe that there are plenty of viewing areas in front of the building as well as on the upper tier of the park to satisfy view seekers. We do not agree with Staff that a 42 inch fence will be enough of a deterrence to prevent accidents on the slope as well as security to limit access to the park. The staff report provided a recommendation to make various changes to the Ladera Linda Community Park plans. Table 1 below provides an order-of-magnitude cost estimate of the recommended plan revisions. Based on City Council action, Staff will further negotiate costs associated with any approved plan revisions to arrive at a firm cost. The estimated cost increase is partially driven by the addition of new items such as vines (with associated irrigation) to screen the retained existing chain link fence, a post-and-cable fence, and additional vegetation. However, the estimated cost may increase due to the modification of the existing fence to a lower height. Although the City will receive a credit for deletion of items previously included in the contract such as replacement fencing, removal of existing vegetation, and planting of new vegetation along the southern slope; the credit may be offset by the higher labor cost for the contractor to modify the existing fence and vegetation to 42" in height and plant new vegetation. This CITY OF RANCHO PALOS VERDES is because modifying the existing fence is more labor intensive than removing and replacing the old fence with a new one. Additionally, the new fence for the upper and middle tiers has already been fabricated, therefore, the City may incur a re-stocking fee. Ultimately, the contractor may replace the existing fence with a new one at a height of 42" inches; if it is more cost-effective to do so. Based on the progress of construction and the remaining contingency, Staff believes that any or all plan revisions can be accommodated within the remaining contingency. Therefore, at this time, Staff does not recommend a budget adjustment. Now those bushes have been removed, and everyone and anyone can stand at the fence and see directly into our backyard, master bedroom and even our Jacuzzi which we enjoy in the evening, although maybe seeing my naked purulent flesh will be the best deterrent for Looky Loos!!!!!!!!!!!!! Annoying as that is, it can be resolved. I have already been planting trees along my back fence and one day (hopefully before I snuff it) we will regain at least most of that privacy. My major concerns are as follows: a) If the fence is moved down the hill people will have access to the hillside, and that along with the loss of root structure through the bush removal will surely result in extensive erosion of the hill. Hopefully the proposed four foot fence and replanting of vegetation will help prevent that. b) The fence as it stands is no barrier for the dozens of broken beer bottles I clear out of the swale behind my property line a number of times a year. Reducing the height of that fence will surely just make that situation worse. Regarding this point I am still a little puzzled as to why the fence would spoil the view of the park goers as I have enjoyed that view thousands of times during my 20 year tenure when walking up there without feeling that the vista is somehow spoiled. c) How will the functions at Ladera Linda be policed? Will there be someone there to monitor the activities and make sure events are concluded on time and do not drag on late into the night? What time is the City proposing to have events shut down by? That must be addressed and cannot be left to ambiguous interpretation. D) With the increase in traffic volume are there plans for a signal at PV Dr South and Forrestal? There is one matter I want to bring to your attention, an existing gate in the existing Ladera Linda South Fence . Two pictures of this gate from below the fence are attached. Hopefully this is only a clarification related to the proposal you are voting on. A number of us neighbors in the vicinity of Helm Place have noticed that this gate as it currently exists creates problems. Some Ladera Linda visitors use it for purposes for which we are certain it is not intended. They use it to reach the slope below (above our homes) to dri nk beer and or hike on the hillside and storm water runoff channels. The results are debris such as beer cans, erosion of the slope, and deterioration of the drainage system (which was not designed for this purpose). Our request: we request that the gate either be eliminated in connection with the upcoming work on this fence or that a provision be made to keep the gate locked at all times except when City personnel need to access the slope.
