I sent a letter to the Planning Depart via US Mail that requested an approval from the City to trim two trees located at 5715 & 5721 Wild briar Drive on the park strip between the sidewalk and street to restore my view. It is my understanding that any tree located on a parkway is a City owned tree and therefor the City must give permission to trim such tree. This is a "new" view request separate from one I made in 2003 but somehow the Public Works Department seems to continue to cite from that much older request. Perhaps my wording in the letter confused the issue, I do not know we never spoke in person . The background is as follows. On or around December 3, 20211 sent a letter to the Public Works Department requesting permission to trim the two trees at 5715 & 5721 Wild briar Drive. In my request I stated clearly that I would be happy to pay for and execute the trimming, all I needed was a letter of permission to take to a professional tree service company. Shortly after I got a telephone call saying that the City of RPV would not give permission. I was shocked that I received a telephone call saying that my request was denied citing the safety of the trees. To me clearly this person had no idea about such matters but was only repeating something she heard. I had to wonder if it was a biased telephone call. As I am sure you are aware the first step in the View Laws is that the view seeker contact the foliage owner and make a simple request . My guess is that most times the owner would say yes, no problem as long as the viewer pays for the trimming and executes it. I decided I would need to make a formal request to the City for a view restoration and on March 14, 2022 sent the official paperwork with photos etc. to the Public Works Department. (see attached letter). The request was denied citing a 2003 view restoration request I made which was for a completely different portion of my view. Deciding to request a re -evaluation I sent another letter, requesting to speak in person and an on -site evaluation so that we could discuss what I believe to be a miss understanding of the initial reque st of December 3, 2021. A completely "new" and simple request. I asked for a reevaluation only to be denied again . At this time I am asking for a City Council review and ruling on the initial request for an approval to trim the trees on the parkway at 5715 and 5721 Wildbriar Drive. My case is as follows: 1.) From the beginning in December of 2021 this should have been a simple issue of a View Seeker asking a Foliage Owner permission to trim two trees as the View Restoration Law asks in step number one. A singular request. 2.) The above request should have never been linked to a 2003 request. Permit 165 (2003) was an evaluation of a large eucalyptus tree to the rear of the lot at 26202 Grayslake and trees on the properties of 5709 and 5715 Wildbriar Drive . It did not evaluate my entire view and I dispute it be used in this case . That 2003 request/ view restoration only involved a 90 degree portion of my more than 180 degree view frame. This is a separate City owned tree View Restoration case. 3.) Where in Prop M, View Ordinance does it say that a home owner may not have more than one view? There is language that says Primary View but it does allow for secondary and/or multiple views. The rooms I cited in this case (kitchen, family room, third bedroom and patio) are legitimate viewing areas according to the view ordinance. The View Ordinance does not have anything to do with one specific room. It does say in the Ordinance that a view may exist for 360 degrees. 4.) My home may have a street frontage address facing east -north east however a map will show that my lot is a rounded corner lot which begins in the east -north east runs through the north and that extends to the west thus I have a more than 180 degree view as slope and topography dictate. That view frame extends from Cities to the east, Los Angeles and other cities east through west and all the way to the pacific ocean, mountains and monuments such as the Hollywood sign and Griffith Observatory, to include the entire Santa Monica Bay, coastline , and specific features such as King Harbor, beaches, etc. 5.) However the View Ordinance has nothing to do with the direction an applicants home faces. Where in the ordinance does it say my view is limited to that very old 2003 evaluation? That old evaluation (Permit 165) does not include the more than 180 degree view from my home as the slope and topography dictate. 6.) By not following through on a request to trim City owned trees as rule number one states the City of RPV are conflicted with upholding the laws of the View Ordinance. Rancho Palos Verdes, CA 90275 Regarding tree trimming, parkway 5715 Wildbriar Dr. To whom it may concern, It is my understanding that any tree on a parkway, defined as the area between the sidewalk and street curb are the responsibility of the city works department. With that in mind I am asking for a tree trimming at 5715 Wildbriar Dr. and 5721 Wild briar Dr. (they are next to each other) to restore my view of King Harbor, Redondo Beach Pier, the Ocean and Coastline beyond up through Malibu. My home faces north-north east in the Grandview Estates neighborhood off of Montemalaga Drive and the trees are across the street from mine . I have spoken with the homeowners at those addresses and expressed my wishes for the trimming both in the past and present. In the past one of the homeowners had their tree trimmed but one homeowner refuses to have anything to do with trimming saying you (me) must ask the city for permission. At this time I do not want to file a formal request for View Restoration but just asking permission in form of a letter to have a Professional Trimming Service come and trim those two parkway trees and I pay for the work. It is very important for me to be involved with the instructions to the trimming Service because in the past I have had experiences where the Service trims a few lower branches without opening the requested view. Enclosed are photos . I'd welcome any feedback and discussion, I do not want a letter saying that the view I am entitled too is not affected or something to that nature. That would be unacceptable. The applicant is requesting that the view is from the dining room and rear yard. Staff has determined that the primary view of the city lights is taken from the viewing area of the living room. The living room occupies the east portion of the residence. The subject trees do not affect the view from the living room. The dining room and rear yard are located on the western portion of the lot. Staff conducted. the view analysis from these areas. The City's rules governing "viewing areas" has not changed since 2003. Likewise, there has been no change in the position where the city cannot trim trees that do not significantly impair , a view from a viewing area determined by the city. In this case, the city has determined, based on the previous case (CTRP No. 165), that the trees are not visible from the living room and therefore do not significantly impair the living room view. I neglected to mention that the vacant lot is on Clovetree Pl. I happened to take another look at the locations of the peafowl survey for the Portuguese Bend area and there were no sightings of any peafowl on Clovetree Pl.which makes me wonder what other areas were misrepresented. The City Council will also consider whether to resume or suspend the City's humane trapping program in 2023 until a new census is conducted in 2024. For some background, the City implemented a periodic humane peafowl trapping and relocation program in 2015 in response to complaints from residents about the growing peafowl population and associated impacts (noise, property damage, etc.). It is not the City's intent to eradicate the peafowl population, but to manage the population at levels 2 identified in 2000 and to educate the public on how to coexist with the birds. This is all in an effort to strike a balance between differing opinions in the City. Every year, the City Council receives a report on the past year's trapping program (if trapping was conducted), as well as a census report for the current year's peafowl population, to determine whether or not to resume trapping. Trapped peafowl are relocated off the Palos Verdes Peninsula to homes that have been screened by the trapping vendor and reviewed by the City to ensure the individuals adopting the peafowl have some avian experience and have adequate space for peafowl to roam freely. Under no circumstances will the trapped peafowl be euthanized or treated inhumanely. Hello, I'm in favor of continuing the peafowl removal program. I live on Headland Drive in RPV and on any given day I have six to eight peafowl in my backyard and at night roosting in nearby trees. It's almost impossible to sleep through through the night with the constant very loud squawking especially during mating season which is now. The peafowl dig up and destroy my potted and in ground plants and break roof tiles when they land on my roof not to mention the mess/droppings I clean up every day. They have become more fearless and bold in their actions as they become more comfortable being around people. Many neighbors on our street have reached out to me numerous times over the years to complain. The City has in the past actively pursued residents to allow the traps to be placed in their yard on the premise that: "If there is a balance, people will no longer be willing to place traps in their yards." However, all it takes is one complaining resident to allow the trapper to lure the birds of an entire neighborhood against the wishes of the majority of residents. I hear from so many people on the hill how they miss the birds. The numbers have decreased tremendously. In the Crestridge area, I have seen only one male bird left. It really saddens me because they are such beautiful birds and I find them easy to co-exist with. So many of the other areas where the birds have been trapped, have been decreased by large numbers. I would hate to see fewer birds in those areas. So many of the babies do not survive so I feel that is why there hasn't been any increases in the number of birds. I also hate to see $40,000.00 a year of my tax dollars continuing to be spent on trapping and removal. Thank you. I am writing to request that you vote to continue to suspend the trapping of peafowl in our community. The latest census report shows a decrease in peafowl population compared to last year, despite the pause in trapping for 2022, so there is no reason to resume the cruel practice of trapping. My children and I enjoy living around the peacocks -and I feel they are a great asset to our community. I am sad to have seen their numbers decline in recent years.The peafowl have been here long before most of us who live here and the majority of the community cohabitates peacefully with these beautiful creatures. They bring joy to many people and are a large part of what makes our community so special. Please consider the wishes of the majority of residents who wish not to disturb the peafowl over the complaints of a vocal few. If we resume trapping and relocating these animals we will soon lose them as part of our city altogether which I personally believe would be a devastating outcome. I appreciate that the city listened to the community and paused trapping last year. I ask that you continue to suspend trapping and allow our peafowl residents to live peacefully. Peafowl hearing With sadness, I only have one peacock that goes through my yard and sits on my deck. When I moved to Vanderlip Drive, I counted 48 in a large area on my property. The out of control coyote population has devastated the peacock's and most wildlife. Please protect the peafowls and don't mandate trapping. Many of those who pushed the city to start trapping have moved or died. Peacocks have been on the Peninsula for over 100 years. If population reduction is needed, please fund the collection of peahens' eggs. A council member suggested this at the first hearing years ago. Please consider this as a humane option. Don't rip apart family units. It is criminal to move the trapped birds to ranches separating them from the group they have been with for years. The new locations usually don't have tall trees for their safety at night. The food supply is not adequate. Thank you for your consideration. This majestic bird is believe to bring good luck, prosperity and protection to the home. Its vibrant feathers, which symbolize the "eyes" on the tail, are said to ward off negative energy and attract positive vibes. Couldn't we all use some "positive vibes". I see in the Mgr.'s. latest newsletter that EDCO wants another 6% for the coming year. I have asked for the overcharges I received in the past, but again, no one responds. The newsletter doesn't say who at City Hall is negotiating with EDCO re their request for a current 6% increase. I know last year it was Ferraro and Bradley, and they granted a huge increase (can't put my fingers on the exact amount, so what % was it)? After that big raise last year ... we have not seen any changes or improvements for the better. Also, I believe Lauren Ramezami (couldn't figure a 20% discount even using a calculator) is gone, so who replaced her? So to whoever is working on it currently, I note the contract reads that if EDCO passes up any rate increases, they cannot recoup in future. Note: In 2015, they wanted the part of RPV that they didn't have ... got it, then in 2016, they wanted the street sweeping contract, got it ... in both cases passed up rate increases. Not to, apparently, be so obvious, they waited until 2018 to recoup raises in amount of 7 .18%. So, after last year's big increase, why 6% more this year? Also, last year they broke a couple of my 35 gal. cans ... they replaced all three of them ... each contained a paper sticker "MADE IN MEXICO". Why did RPV give such generous raises/contract to a family that sends our tax dollar business to Mexico? Because they have a loyalty to their home country? If you weren't aware of same, you are now!!!!!! And many are currently waiting at the boarder to collect freebies. I have written before that a 35 gal. can is too big and expensive for us empty nesters. Re principle, I withheld any cans for p/u to see how long it took me to fill it last year ... answer was 4 months. Please ensure that this email gets to all five Council Members/City Mgr., et al. illegals get big breaks, how about the seniors who live here and paid into the system? I am hard pressed to figure out the purpose of our City Council. .. it appears that it is just a political steppingstone to getting a pensions and good healthcare plan on the backs of those of us who get neither.
