Attachment A erroneously listed $89,280 (Eighty Six Thousand Two Hundred Eighty Dollars} as the total contract amount which includes the original contract plus the proposed amendment for added services. The correct amount is actually $86,600 (Eighty Six Thousand Six Hundred}. A corrected contract will be included as late correspondence. The staff report lists a different total of $89,280 which is also correct because it includes the additional max 10% allowed for reimbursable expenses related to the added services. Attachment A. Revised Attachment A Gensler Contract Amendment No. 1 AMENDMENT NO. 1 TO CITY OF RANCHO PALOS VERDES PROFESSIONAL SERVICES AGREEMENT FOR CIVIC CENTER PRE-DESIGN SERVICES This AMENDMENT to that certain "PROFESSIONAL SERVICES AGREEMENT FOR CIVIC CENTER PRE-DESIGN SERVICES" ("Amendment No. l ") by and between the CITY OF RANCHO PALOS VERDES, a municipal corporation ("City"), and GENSLER, a California corporation ("Consultant"), is effective as of November 15, 2022. RECITALS A. City and Consultant entered into that certain Agreement for Professional Services, dated February 15, 2022 ("Agreement"), whereby Consultant agreed to provide identified pre-design services, including preliminary/conceptual site planning, for the purpose of assessing overall Civil Center site constraints and capabilities (the "Services") for a Contract Sum of $59,800.00. The Agreement provided for a one (1) year term from and after the date of the Agreement. B. City and Consultant now desire to amend the Agreement to increase the Scope of Services, Exhibit "A," increase the total compensation, and adjust the Term of the Agreement. TERMS 1. Contract Changes. Such additional services shall include removal of sheriff,fire department, and parking structure program elements from this plan, but to be retained as an alternate option. Such additional services shall include addition of law enforcement and emergency/public safety components including, but not limited to, Sheriff drop-in office, multi-City Emergency Operations Center, maintenance yard, parking lot (evacuation area), and Park Ranger facilities into Public Safety Zone to address concerns raised by federal agencies. Such additional services shall include up to two (2) public presentations to City's Civic Center Advisory Committee in December 2022 and January 2023, or on an agreeable date." 2. Continuing Effect of Agreement. Except as amended by this Amendment, all provisions of the Agreement shall remain unchanged and in full force and effect. From and after the date of this Amendment, whenever the term "Agreement" appears in the Agreement, it shall mean the Agreement, as amended by this Amendment to the Agreement. 3. Affirmation of Agreement; Warranty Re Absence of Defaults. City and Consultant each ratify and reaffirm each and every one of the respective rights and obligations arising under the Agreement. Each party represents and warrants to the other that there have been no written or oral modifications to the Agreement other than as provided herein. Each party represents and warrants to the other that the Agreement is currently an effective, valid, and binding obligation. However, the approach suggested by the Palos Verdes Historical Society requires some careful consideration. Serious thought must be given to creating a museum complex that tells the rich history of the Palos Verdes Peninsula in a cohesive and logical manner, and, importantly, avoids exhibit duplication and repetitive storytelling. The staff report cites several reasons why a new building makes more sense than expanding the existing Point Vicente Interpretive Center. What is most compelling to me is that the existing museum is simply too small to accommodate more expanded exhibits, unless the Sunset Room is converted to this use, which would be a shame, as indoor meeting spaces are at a premium in our community. The Palos Verdes Historical Society is certainly presenting a tantalizing opportunity to expand the size and quality of the exhibits on public display. I was fortunate to tour the Society's Museum in 2007 before it was packed up and put into storage. Their collection contained a number of rare and remarkable items. It's a shame they've been largely hidden away all these years, especially the California Native American artifacts, the prehistoric fossils and the Vanderlip models. Unfortunately, the City wasn't able at the time to accommodate PVHS's stipulation for the entire collection be housed in a single facility and that all of the artifacts be kept on permanent display. It appears this may still be PVHS's desire. The conceptual floor plan included in the staff report closely mirrors the types of exhibits already contained in the existing PVIC museum. The only topics that don't appear to be duplicated between the two buildings are the history of the whaling industry and the migration of the Pacific gray whale. I'll be very interested to hear more about PVHS's proposal during the presentation on Tuesday night. There will of course be many other issues to be resolved, including the deed restrictions on the property, funding sources, ongoing operations, etc. Hopefully, these can all be sorted out. In the meantime, I suggest the City avoid the concept of having what appears to be two nearly identical museums on the property. City Council may instead want to ask PVHS and the PVIC Docents to collaborate on curating the artifacts and coming up with a plan to split the exhibits between the two buildings so that they tell distinct, yet connected, parts of our larger local history. For example, perhaps the two museums could each cover a different time period. Or, their exhibits could be divided by topic. No doubt there are a variety of approaches that would make sense. There is something else to consider. As stated in the staff report, in addition to the items currently on display at PVIC, there are several other notable historical collections on the Peninsula in search of a suitable place to be preserved and displayed. In addition to the extensive collections held by the Los Serenes de Point Vicente Docents and Yvetta William's Discovery Room, I understand the Vanderlip Family is also looking for a place to display furniture, artwork and other heirlooms that previously resided at Villa Narcissa. The extent to which these separate collections overlap with one another is striking. Shouldn't all of the available resources be figuratively put on the table and made part of the 1 conversation? Even if everything can't be displayed at once, it could be a wonderful opportunity for rotating or seasonal displays that will keep the museums fresh for returning visitors. One of the main reasons I chose to live in Rancho Palos Verdes, and specifically in my home within the Seaview community, was because of the natural peace and quiet. The nature preserve that surrounds the area made it seem more like a small town and warm community. When the Ladera Linda improvements were passed, I was thankful for the consideration of our little neighborhood. The buildings were pushed back from the property line, consideration was made to reduce the inevitable light pollution the new building would bring, and parking needs of the increased traffic were addressed. It was progress with some consideration. Moving the buildings back from the property line was especially considerate, as it protected our privacy. My property is on Helm Place, directly below the Community Center. It is my back yard. Removing the established trees that are currently on the down-ward ocean-side slope means that we lose what little privacy we have left. It will remove the natural sound barrier from the sport fields and community center. It will remove the established root systems that are holding the loose hillside intact. It will mean that everyone visiting the new community center will have direct access to my backyard, visually and physically (as a shorter fence will not stop anyone from taking a short cut across the hillside}, and the barrier that stops trash from blowing over the side will be reduced greatly. I have great concerns. Removing trees to open the view will increase foot traffic, noise, and trash. It will reduce privacy and peace. Especially the privacy-this will greatly impact property values in the area. It will remove the reason we all have paid a premium to live in this small-town, quiet neighborhood, making it seem much more commercial, resort-like, and potentially unkept. 1 5. As a resident of Seaview, I believe that the recommended action is detrimental to our community. I ask that the Council either reject this action or delay action on this item until there is input from the Seaview Community about our community priorities. As captured in the Staff report, we have visited the site in recent weeks and worked closely with Staff to try to minimize the impact of construction and future visitors on the surrounding neighborhoods. We strongly urge you to retain the existing fence and vegetation around the entire lower tier of the park, as it serves as an important visual and sound barrier to protect the privacy of surrounding residents. At the October 19, 2021 City Council meeting, you directed staff to maintain the existing foliage in the lower tier of the park until a view assessment from the new community center could be conducted. Staff have now concluded that the view of Catalina Island from the new building will not be obstructed, therefore the LLHOA board believes there should be no further removal of the perimeter fence and foliage. The perimeter fence and foliage around the lower tier of the park have been in place for decades and help to maintain this area as a quiet space for walking and playing without subjecting neighboring homes to added noise or curious visitors staring into their yards and windows. Staff's plan to replace the existing fence and foliage with coastal sage scrub and a new fence farther down the slope will be insufficient in preventing park visitors from staring into the yards and homes surrounding the park, or preventing noise from impacting our neighborhoods. The LLHOA Board recommends the following actions to protect the interests of residents in the surrounding neighborhoods: 1. Maintain the existing fence and foliage around the entire perimeter of the lower tier of Ladera Linda Community Park. 2. Add vining plants such as bougainvillea to the perimeter fence around the lower tier to improve the visual appearance and discourage park visitors from approaching the perimeter. 3. Add a half-height perimeter fence at the top of the slope on the ocean-facing side of the middle and upper tiers of the park as a safety precaution to prevent children, balls and trash from rolling down the slope. This is consistent with placement of City fences at the top of slopes in other nearby areas such as Forrestal Drive behind the gate and the perimeter of Founders Park. We are unaware of any complaints from park visitors about obstructed ocean views from this area of the park, considering views are available from higher tiers of the Ladera Linda Park, and other nearby areas such as Forrestal Drive and the Preserve. Furthermore, additional public parks for ocean viewing are available within a short walk across PV Drive at Marilyn Ryan Sunset Point Park and Vista Catalina Park, as well as other popular sunset viewing spots like Founders Park at Trump National. The LLHOA Board expects that the new park facilities and events are going to attract a significant increase in visitors to our neighborhood, along with noise, traffic and trash. We worked to have the ball courts and playgrounds moved away from the perimeter of the park and request that the Council uphold your commitment to maintain the lower tier closest to homes as a quiet corner for passive recreation. The perimeter fence and foliage serve as an important barrier to maintain privacy and property values for residents of Ladera Linda and Seaview. Also, given the destruction of trees and vegetation that has already taken place, the preservation of remaining foliage should be prioritized in this sensitive habitat adjacent to the Preserve. PVIC is NOT a good location for the museum for several reasons. First, the area where it wants to put the building has been predesignated for outside exhibits for PVIC. Second, it's my understanding that One of the deed restrictions is that the land is zoned for passive recreational use only. If so, wouldn't that also need to be addressed? Third, the PVHS is offering to pay for the construction of the building ( for which it DOES NOT currently have the funds) and then "give" the building to the City with the understanding that the PVHS will provide the exhibits. BUT! The City would then be responsible for the maintenance, insurance and staffing of the building -all of which are not inexpensive. Plus, it wants the present PVIC docents to be trained to give tours in the new environment. Oh! Where will the exhibits that are not used going to be stored and who will pay for that? As captured in the Staff report, we have visited the site in recent weeks and worked closely with Staff to try to minimize the impact of construction and future visitors on the surrounding neighborhoods. We strongly urge you to retain the existing fence and vegetation around the entire lower tier of the park, as it serves as an important visual and sound barrier to protect the privacy of surrounding residents. At the October 19, 2021 City Council meeting, you directed staff to maintain the existing foliage in the lower tier of the park until a view assessment from the new community center could be conducted. Staff have now concluded that the view of Catalina Island from the new building will not be obstructed, therefore the LLHOA board believes there should be no further removal of the perimeter fence and foliage. The perimeter fence and foliage around the lower tier of the park have been in place for decades and help to maintain this area as a quiet space for walking and playing without subjecting neighboring homes to added noise or curious visitors staring into their yards and windows. Staff's plan to replace the existing fence and foliage with coastal sage scrub and a new fence farther down the slope will be insufficient in preventing park visitors from staring into the yards and homes surrounding the park, or preventing noise from impacting our neighborhoods. The LLHOA Board recommends the following actions to protect the interests of residents in the surrounding neighborhoods: 1. Maintain the existing fence and foliage around the entire perimeter of the lower tier of Ladera Linda Community Park. 2. Add vining plants such as bougainvillea to the perimeter fence around the lower tier to improve the visual appearance and discourage park visitors from approaching the perimeter. 3. Add a half-height perimeter fence at the top of the slope on the ocean-facing side of the middle and upper tiers of the park as a safety precaution to prevent children, balls and trash from rolling down the slope. This is consistent with placement of City fences at the top of slopes in other nearby areas such as Forrestal Drive behind the gate and the perimeter of Founders Park. We are unaware of any complaints from park visitors about obstructed ocean views from this area of the park, considering views are available from higher tiers of the Ladera Linda Park, and other nearby areas such as Forrestal Drive and the Preserve. Furthermore, additional public parks for ocean viewing are available within a short walk across PV Drive at Marilyn Ryan Sunset Point Park and Vista Catalina Park, as well as other popular sunset viewing spots like Founders Park at Trump National. The LLHOA Board expects that the new park facilities and events are going to attract a significant increase in visitors to our neighborhood, along with noise, traffic and trash. We worked to have the ball courts and playgrounds moved away from the perimeter of the park and request that the Council uphold your commitment to maintain the lower tier closest to homes as a quiet corner for passive recreation. The perimeter fence and foliage serve as an important barrier to maintain privacy and property values for residents of Ladera Linda and Seaview. Vining plants like bougainvillea can be added to the existing fence to improve its appearance and discourage visitors from approaching the park perimeter. Unsupervised children are often on the hillsides while their parents are involved in soccer and not restricting their activities. Other times people have sat on the swales drinking alcohol (leaving litter). Since the area is secluded, access from the center into our properties is easily done without being seen and has resulted in burglaries. Every property on our street has installed security due to seclusion and ease of access from the park above. I raised my concerns at one of the community meetings because no fencing was shown on the plans. We need both the current fencing where located to deter intrusion as well as large native vegetation to buffer the views into our backyards and pools. The fencing will also ensure the safety of guests to the park so that they remain in the park on trails and designated play areas. We bought here because it is quiet and remote. We don't want to have forced interaction with users of the updated facility looking down at our family and friends enjoying our yard/pool while they are at Ladera Linda. Without the existing large barriers, people have will no limits to bad behavior. The original scope directed the project to create a view line from the community center. This has been achieved, per the public statement. There is no reason the expand the project and create additional view sites when many such sites currently exist nearby including Founder's Park and the Marilyn Ryan Park. This opinion has also been shared by the Ladera Linda residents who were able to visit the site. They recommended the fence and shrubbery remain as is, with the addition of some vining plants to cover what it appears the project believes to be unsightly fencing.
