Abalone Cove Parking Issue Honorable Mayor and City Council Members: Please evaluate the adverse environmental impacts that will be imposed upon the environmentally sensitive Abalone Shoreline Park, including the tide pools and the Marine Protected Areas, if long-standing parking restrictions are lifted in the adjacent residential areas. When the large public parking area was planned and built within the bluff-top park the carrying capacity of the sensitive environment was evaluated. Unfortunately, that evaluation was excessively optimistic and understated the environmental impacts, especially the impacts on sea creatures in the tide pools. Over the last 20 years the tide pools have become impoverished, largely by heavy human traffic, though pollution and soil erosion likely have had some adverse impact. Visitors are loving the tide pools to death. Most of the park visitors trek down to the shore, rather than . using the blufftop park. Parking restrictions have in fact been in actual effect in the adjacent residential neighborhood for the 23 years I have been observing the park and the neighborhood. This is historical, environmental fact whether or not the old paperwork at City Hall is precisely in order. Abalone Cove park has in fact been protected from far heavier user traffic due to the actual parking restrictions that have been posted and enforced over the decades. Even with these historical, actual parking restrictions the tide pools still have suffered degradation. There are 81 residential parcels in the Abalone Cove Community plus adjacent multi-unit housing and several commercial parcels. If the existing parking restrictions are eliminated then the visitor burden on the shoreline and tide pools is likely to more than double. I respectfully urge that Government, including the Coastal Commission and the City of Rancho Palos Verdes, have statutory duties to protect the environmentally sensitive shoreline and tide pool areas. Adding major additional parking without mitigating foreseeable damage to these areas is inconsistent with those statutory duties. ' The tide pools already are degraded and higher levels of parking foreseeably will cause substantial, unmitigated, damage to these environmentally sensitive areas. LOWELL R. Hello, We would like to submit the following comments for the City's April 18, 2023, public hearing on Trump National Golf Club's compliance with its maintenance obligations relating to trails and open space (Case No. PLMH2023-0001 ). Comments: 1. We strongly request that the City require the Trump National Golf Club to re-open the Catalina Trail as soon as possible. We live right next to the golf course (on La Rotonda Drive) and greatly value access to these trails. We use them almost every day. We have been very disappointed that the Catalina Trail has been closed for over 2 years now and we have seen no plan to re-open that trail. The Catalina Trail is one of the most important trails in The Ocean Trails Reserve, as it is the only trail that connects the San Ramon Reserve to the rest of the Reserve. As long as the Catalina Trail remains closed, the Ocean Trails Reserve is broken into two separate spaces which greatly diminishes the value of the Reserve to the public. 2. We request that the Trump National Golf Club immediately allow public hiking access to the Hole #13 Golf Trail to connect the San Ramon Reserve to rest of the Ocean Trails Reserve. While the Trump Golf Club works on repairing the Catalina Trail bridge to re-open the Catalina Trail, they should immediately grant public access to the golf trail along Hole 13 of the Golf Course to connect access the San Ramon Reserve to rest of the Ocean Trails Reserve (see the Purple Dashed Line on the image below). This could be done immediately, with no trail construction as the golf trail along Hole 13 already connects the Lakeview Trail on the west with the eastern end of the Catalina Trail. Granting public access to hikers would allow the public to access the full Ocean Trails Preserve with little or no extra cost to the Golf Club . This can be done while still closing the bridge and the beach access trail on the Catalina Trail such that the hazardous sections of the trail will remain closed, while the public will be able to access the entire Reserve. There are multiple other sections of the Golf Course trails that are open to the public for hiking, so this would just be a simple extension of those existing areas. These private gates should not be allowed to remain. 2)The PBC submitted a request in 2018 for a trail from a private gate at the end of the PV Dr. So. culdesac into Lot D with access to the Trump trails. This was rejected as not being allowed. If such access were allowed, it would open up the entire Portuguese Bend Club, now a private gated community, to the general public according to the CA Coastal Commission. The PBC would lose their status as a private beach club community and the general public would be allowed free access accordingly. 3)Also, discussions at that time with the Fire Department concluded with approval of a fire-resistent drought- tolerant plant palette for Lot D. The current system is working very well, it has reduced unsafe traffic maneuvers, lowered the noise, and enhanced the enjoyment for all of us residents walking in and out of our neighborhoods. I also believe that over time the system will become even more successful as visitors become more knowledgeable. It works, so why change it? Please don't return us to unsafe traffic congestion that we and you worked tirelessly to mitigate over the last years. In consideration of the current parking setup, I hope Council is not placing the cost of the system above resident and visitor safety. I remember a few of the Council members were concerned that the system was operating at a loss. Yes, this is important. However, as far as the numbers are concerned, I don't understand why the increased revenue generated by parking citations is not part of the equation. In truth, those parking tickets are probably generating more revenue for the city than the ParkMobil app. In conclusion, I support a parking system that requires reservations, without it I'm deeply worried th~t we will return to an unsafe "first come first serve" model. Lately I was informed that city is considering Demand Parking system due to frequent vacancies although the trend of usage is slowly going up. However, Del Cerro residents are afraid that the Demand parking system will bring back some of the past heavy traffic congestion and numerous dangerous U turns at the end of Crenshaw blvd, especially in weekend. ARTICLE V DEDICATION OF ASSETS The property of this corporation is irrevocably dedicated to charitable purposes and no part of the net income or assets of this corporation shall ever inure to the benefit of any director, officer, or member hereof or to the benefit of any private person. Upon the dissolution or winding up of this corporation, its assets remaining after payment, or provision for payment, of all of its debts and liabilities shall be distributed to a nonprofit fund, foundation or corporation designated by the board of directors of this corporation which is organized and operated exclusively for charitable purposes and which has established its tax exempt status under Section 501 ( c )(3) of the Code or the corresponding provision of any future United States internal revenue law. ARTICLE VI MEMBERS Section 1. Directors as Members. This corporation shall have no voting members within the meaning of the California Nonprofit Public Benefit Corporation Law. Any action that would otherwise require approval by a majority of all members or approval by the members shall require only approval of the board of directors, as authorized by Section 5310 of the California Nonprofit Public Benefit Corporation Law. Section 2. Meetings. There shall be no meetings of members as such. The persons constituting the board of directors may, at any given time and from time to time, act in their capacity as members pursuant to Section I of this Article VI, at meetings of the board of directors held as provided in Section 5 of Article VII of these Bylaws. 0 l203.0002/868557.2 2 ARTICLE VII DIRECTORS Section 1. Powers. (a) General Corporate Powers. Subject to the provisions of the California Nonprofit Public Benefit Corporation Law and any limitations in the Articles of Incorporation and these Bylaws, the business and affairs of this corporation shall be managed, and all corporate powers shall be exercised, by or under the direction of the board of directors; provided, however, that in order to preserve the nonprofit, exempt-from-income-tax status of this corporation, neither the board nor any member thereof shall do any act, or authorize or suffer the doing of any act by an officer or employee of this corporation, on behalf of the corporation, which is inconsistent with the Articles or these Bylaws or the nonprofit purpose of this corporation. Any such act or acts shall be null and void. (b) Specific Powers. Without prejudice to these general powers, and subject to the same limitations, the directors shall have the power to: (i) Appoint and remove, at the pleasure of the board, all officers, agents, and employees of this corporation; prescribe any powers and duties for them that are consistent with law, with the Articles of Incorporation, and with these Bylaws; and fix their compensation in a manner consistent with the Articles of Incorporation, and with these Bylaws. (ii) Change the principal office from one location to another within the City of Rancho Palos Verdes, California; and designate any place within Los Angeles County, California, for the holding of any meeting or meetings. (iii) Adopt, make, and use a corporate seal; and alter the form of the seal. (iv) Borrow money and incur indebtedness on behalf of this corporation and cause to be executed and delivered for this corporation's purposes and objectives, in the corporate name, promissory notes, bonds, debentures, deeds of trust, mortgages, pledges, hypothecations, and other evidences of debt and securities. (c) Limit on Dissolution. The Foundation may not be dissolved without the express authorization of the City Council of the City of Rancho Palos Verdes. Section 2. Board of Directors. The authorized number of directors of the board shall be five (5). The board of directors shall be composed of the following: (a) Five sitting members of the City of Rancho Palos Verdes City Council. 0 l 203.0002/868557.2 3 Section 3. Term, Removal, and Vacancy. (a) Term of Office. Directors shall be appointed for a term of two (2) years, except that the length of the terms of each of the initial five (5) directors shall be staggered, as follows: (i) Eric Algeria's term shall end on November 2024; (ii) John Cruikshank's term shall end on November 2024; (iii) David L. Bradley's term shall end on November 2026; (iv) Barbara Ferraro's term shall end on November 2026; and (v) Paul Seo's term shall end on November 2026. (b) Number of Terms. Directors may serve no more than two (2) consecutive terms of office and shall not be eligible to serve again until the expiration of at least six ( 6) months after the end of that person's last term of office .. ( c) Resignation. Any director may resign by giving written notice to the chair of the board or to the executive director or the secretary of the board. The resignation shall be effective when the notice is given unless it specifies a later time for the resignation to become effective. If a director's resignation is effective at a later time, the board may elect a successor to take office as of the date when the resignation becomes effective. (d) Removal. Directors of the board may be removed with or without cause. A director of the board, other than the councilperson, may only be removed from the board by a majority vote of the board. The councilperson may only be removed from the board by a majority vote of the City Council. ( e) Vacancies. Upon the expiration of their term, directors of the board shall retain their position on the board until their successor is appointed. Notwithstanding the previous sentence, if the councilperson on the board ceases to be a member of the Rancho Palos Verdes City Council for any reason, he or she shall automatically be removed from the board of directors, effective on the date that such person ceases to be a member of the City Council. Moreover, if a City resident board member ceases to be a City resident, or if a business representative ceases to represent a business located in the City of Rancho Palos Verdes, such person shall be automatically removed for the board of directors, effective on the date of the triggering event. Section 4. Leadership of the Board. (a) Chair of the Board. The chair of the board shall be the City's Mayor. The chair of the board shall preside at meetings of the board of directors and exercise and perform such other powers and duties as may be from time to time assigned to him/her by the board of directors or prescribed by the Bylaws. 01203.0002/868557 .2 4 (b) Vice Chair of the Board. The vice chair of the board shall be the City's Mayor Pro Tern. The vice chair shall have a term as vice chair of two (2) years , except that the vice chair's initial term as vice chair shall expire on June 30 , 2023. Section 5. Directors' Meetings. (a) Applicability of the Ralph M. Brown Act. All meetings of the board of directors of this corporation shall be subject to the provisions of the Ralph M . Brown Act (Government Code§§ 54950 et seq.). However, if any applicable provisions of these Bylaws are more stringent than those contained in the Brown Act, then the provisions in these Bylaws shall control. (b) Regular Meetings. The board of directors shall schedule regular meetings of the board of directors at such time and place as determined by the board of directors. Meetings of the board of directors shall be held in the City of Rancho Palos Verdes at Hesse Park in Mc Taggart Hall, unless otherwise determined by resolution of the board of directors or stated in the notice of meeting. ( c) Special Meetings. Special meetings of the board of directors may be called at any time by the chair of the board or by a majority of the authorized number of directors of the board. Notice of special meetings shall be given in accordance with Section 54956 of the Government Code , as may be amended from time to time. Any waiver of notice of a special meeting shall be filed with the corporate records and made a part of the minutes of the special meeting. ( d) Quorum. A quorum shall be present when a majority of the authorized number of directors are present, except to adjourn. A quorum must be present in order for the board of directors to conduct business. Every act or decision done or made by a majority of the directors present at a meeting duly held at which a quorum is present shall be regarded as the act of the board of directors , subject to the more stringent provisions of the California Nonprofit Public Benefit Corporation Law, including , without limitation, those provisions relating to (i) approval of contracts or transactions in which a director has a direct or indirect material financial interest, (ii) appointment of committees, and (iii) indemnification of directors. A meeting at which a quorum is initially present may continue to transact business , notwithstanding the withdrawal of directors, if any action taken is approved by at least a majority of the required quorum for that meeting . ( e) Adjournment. A maJonty of the directors present, whether or not constituting a quorum, may adjourn any meeting to another time and place. (f) Notice of Adjournment. Directors and members of committees shall receive no compensation of any kind for their services as directors or officers. However, directors and officers may be reimbursed for expenses, as may be determined by resolution of the board to be just and reasonable. Section 7. Liabilities. No director now or hereafter shall be personally liable for any indebtedness or liability of this corporation, and any and all creditors of this corporation shall look only to the assets of the corporation for payment. ARTICLE VIII BOARD COMMITTEES Section 1. Board Committees. The board of directors may establish one or more board committees, each consisting of no more than two (2) directors, to serve at the pleasure of the board. The board may designate one (1) or more directors as alternate members of any board committee who may replace any absent member at any meeting of the board committee. The board of directors may also appoint any number of persons who are not directors to serve at the pleasure of the board on any board committee, and said persons shall have a vote in the recommendation of the committee of which they are a member. The board of directors may adopt rules for the government of any board committee not inconsistent with the provisions of these Bylaws. Section 2. Committee Member Selection. The chair of the board shall appoint committee members from the board, subject to confirmation by the board. Section 3. Restrictions on Board Committees. A board committee shall have the power to make advisory recommendations to the board of directors regarding the subject matter of its charge, but shall have no other power, and shall have no power to bind the board of directors or the corporation in any way or thing whatsoever. ARTICLE IX OFFICERS Section 1. Officers. The officers of this corporation shall be an executive director, a secretary, and a treasurer. Any number of offices may be held by the same person, except that neither the secretary nor the treasurer may serve concurrently as the executive director or chair of the board. Section 2. Executive Director. The executive director shall be the City Manager of the City of Rancho Palos Verdes. Subject to such supervisory powers, if any, as may be given by the board of directors to the chair of the board, and subject to the control of the board of directors, the executive director shall generally supervise, direct, and control the business and the officers of the corporation. The executive director shall be the chief executive officer of the corporation. The executive director may designate deputies to assist him/her, as needed, and may also designate deputies to assist the secretary and the treasurer, as needed. Section 3. Secretary. (b) Custody of Articles and Bylaws. The secretary shall keep or cause to be kept, at the principal office of the corporation, a copy of the Articles oflncorporation and Bylaws, as amended. (c) Notices, Seal, and Other Duties. The secretary shall give, or cause to be given, notice of all meetings of the board of directors, and of committees of the board, required by the Bylaws or by law to be given. The secretary shall keep the seal of the corporation, if any, in safe custody. The secretary shall have other powers and perform such other duties as may be prescribed by the board of directors or the Bylaws. Section 4. Treasurer. The treasurer shall be the Director of Finance for the City of Rancho Palos Verdes. The treasurer shall attend to the following: (a) Books of Account. The treasurer shall keep and maintain, or cause to be kept and maintained, adequate and correct books and records of accounts of the properties and business transactions of this corporation. The treasurer shall send or cause to be given to the directors such financial statements and reports as are required to be given by law, by these Bylaws, or by the board. The books of account shall be open to inspection by any director at all reasonable times. (b) Deposit and Disbursement of Money and Valuables. The treasurer shall (i) deposit or cause to be deposited all money and other valuables in the name and to the credit of this corporation with such depositories as may be designated by the board of directors, (ii) disburse the funds of this corporation as may be ordered by the board of directors, (iii) render to the executive director and directors, whenever they request it, an account of all transactions effected by the treasurer and of the financial condition of this corporation, and (iv) have such other powers and perform such other duties as may be prescribed by the board of directors or the Bylaws. ( c) Bond. If required by the board of directors, the treasurer shall give this corporation a bond in the amount and with the surety or sureties specified by the board of directors for faithful performance of the duties of such office and for restoration to this corporation of all its books, papers, vouchers, money, and other property of every kind in the possession or under control of the treasurer on such officer's death, resignation, retirement, or removal from office. ( d) Tax Filings. The treasurer shall prepare and file all necessary tax and financial documents on behalf of this corporation. Section 5. Resignation or Removal of Officers. Resignation or removal from the position of City Manager, City Clerk, or Director of Finance shall be deemed resignation or removal from the position of executive director, secretary, or treasurer, respectively. 01203.0002/868557.2 7 Section 6. Vacancies in Office. A vacancy in any office because of death, resignation, removal, or any other cause shall be filled in the manner designated by the City of Rancho Palos Verdes. ARTICLEX INDEMNIFICATION OF DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS Section 1. Right oflndemnity. To the fullest extent permitted by law, this corporation shall indemnify any present or former director, officer, employee or other "agent" of the corporation, as that term is defined in Section 5238(a) of the California Corporations Code, against all expenses, judgments, fines, settlements and other amounts actually and reasonably incurred by them in connection with any "proceeding," as that term is used in that Section, and including an action by or in the right of the corporation, by reason of the fact that the person is or was a person described in that section. "Expenses," as used in this Section, shall have the same meaning as in Section 5238(a) of the California Corporations Code. Section 2. Approval of Indemnity. On written request to the board by any person seeking indemnification under Section 5238(b) or Section 5238(c) of the California Corporations Code, the board shall promptly determine under Section 523 8( e) of the California Corporations Code whether the applicable standard of conduct set forth in Section 5238(b) or Section 5238(c) has been met and, if so, the board shall authorize indemnification. If the board cannot authorize indemnification because the number of directors who are parties to the proceeding with respect to which indemnification is sought prevents the formation of a quorum of directors who are not parties to that proceeding, the indemnification may be authorized by the court in which such proceeding is or was pending, pursuant to Section 523 8( e) of the California Corporations Code. Section 3. Advancement of Expenses. To the fullest extent permitted by law, expenses incurred by a person seeking indemnification under Sections 5238(b) or 5238(c) of the California Corporations Code in defending any proceeding covered by those Sections shall be advanced by the corporation upon the request of such person and upon receipt by the corporation of an undertaking by or on behalf of that person that the advance will be repaid unless it is ultimately determined that the person is entitled to be indemnified by the corporation for those expenses. Every director shall have the absolute right at any reasonable time to inspect the corporation's books, records, documents of every kind, physical properties, and the records of each of its subsidiaries. Section 4. Annual Statement of Certain Transactions and Indemnifications. Section 3. Corporate Contracts and Instruments; How Executed. The board of directors, except as otherwise provided in these Bylaws, may authorize any officer or officers, agent or agents, to enter into any contract or execute any instrument in the name of and on behalf of this corporation, and this authority may be general or confined to specific instances; and, unless so authorized or ratified by the board of directors or within the agency power of an officer, no officer, agent or employee shall have any power or authority to bind this corporation by any contract or engagement or to pledge its credit or to render it liable for any purpose or for any amount. Section 4. Policies. The RPV Community Foundation shall be governed by the officially adopted policies of the City of Rancho Palos Verdes, except to the extent that such policies conflict with these Bylaws or California Nonprofit Public Benefit Corporation Law. In the event of any conflict, these Bylaws and California Nonprofit Public Benefit Corporation Law shall govern. Section 5. Parliamentary Procedure. The RPV Community Foundation shall conduct meetings in accordance with the parliamentary procedures of the City of Rancho Palos Verdes. ARTICLE XIII AMENDMENTS New Bylaws may be adopted or these Bylaws may be amended or repealed by approval of the board of directors. When the large public parking area was planned and built within the bluff-top park the carrying capacity of the sensitive environment was evaluated. Unfortunately, that evaluation was excessively optimistic and understated the environmental impacts, especially the impacts on sea creatures in the tide pools. Over the last 20 years the tide pools have become impoverished, largely by heavy human traffic, though pollution and soil erosion likely have had some adverse impact. Visitors are loving the tide pools to death. Most of the park visitors trek down to the shore, rather than . using the blufftop park. Parking restrictions have in fact been in actual effect in the adjacent residential neighborhood for the 23 years I have been observing the park and the neighborhood. This is historical, environmental fact whether or not the old paperwork at City Hall is precisely in order. Abalone Cove park has in fact been protected from far heavier user traffic due to the actual parking restrictions that have been posted and enforced over the decades. Even with these historical, actual parking restrictions the tide pools still have suffered degradation. There are 81 residential parcels in the Abalone Cove Community plus adjacent multi-unit housing and several commercial parcels. If the existing parking restrictions are eliminated then the visitor burden on the shoreline and tide pools is likely to more than double. I respectfully urge that Government, including the Coastal Commission and the City of Rancho Palos Verdes, have statutory duties to protect the environmentally sensitive shoreline and tide pool areas. Adding major additional parking without mitigating foreseeable damage to these areas is inconsistent with those statutory duties. Dear Mayor and City Council Members, The Del Cerro HOA appreciates the opportunity to provide the following comments in advance of the 18 April 2023 City Council meeting discussion concerning the ParkMobile system. The Del Cerro HOA has been working collaboratively with the RPV City Council and City Staff for many years to address the safety and traffic impacts along Crenshaw Boulevard, south of Crest Road, the Palos Verdes Nature Preserve's most popular and congested access point. Since implementation of the ParkMobile reservation system in August 2021, and visitor-friendly changes made in December 2021, there has been a notable improvement in safety, congestion, and noise pollution. Currently, as Staff has noted and as observed by the Del Cerro community, the number of visitors entering via the Burma Road and Rattlesnake trailheads has returned to pre-Pandemic levels. Thanks to ParkMobile's advance reservation system, and improved parking enforcement, our residents no longer experience the plethora of traffic and safety issues that plagued this area previously. This qualifies the current parking system as a huge success -the City has struck the right balance of Preserve visitor access and usage, maintaining safe conditions for residents and visitors alike, while at the same time managing impacts to RPV residents living along or traveling through the Crenshaw and Preserve corridor. Likewise, visitors can continue to enjoy the Preserve with their choice of paid parking or ample free parking nearby. Following the HOA's review of the Staff Report, we would like to make the following points for Council's consideration: 1. The ParkMobile advance reservation system is a success In addition to the benefits cited above, we believe there is growing awareness and acceptance of the ParkMobile system as visitors become familiar with the operation and advantage of using the system. While some may prefer not having to make a reservation one hour ahead, the system removes the uncertainty of being able to find a parking spot within the area during periods of heaviest use. In fact, approximately 25% of users that participated in the recent survey indicated they have used the ParkMobile system, find it easy to use, and plan to continue using it. Surely this will continue to grow as evidenced by the fact that February 2023 was the highest month EVER for paid reservations (on a per-day basis excluding rain closures), March 2023 exceeded the same period last year, and the first week of April was even higher still as it registered the most weekly reservations in well over a year. This demonstrated, growing acceptance of the system is also fueled by increasing awareness of the free parking nearby. 2. Preserve visitors are satisfied During the period that the survey was available to Preserve visitors, approximately 32,000 people visited the Preserve via the two trail heads on Crenshaw. Across these 32,000 visitors only 272 surveys were completed -less than 1%. Allowing for repeat visitors within the 32,000 total, the response rate still measures in the low single digits. Question 5 directly 1 asked visitors what they would like to see changed in the ParkMobile system. There were 241 separate items identified by the 204 visitor that answered this question. As noted in the Staff Report, of these 241 items only 85 requested the elimination of both the advance reservation requirement as well as the charging of any parking fee -which is effectively scrapping the system altogether. Excluding these responses, only 46 mentioned advance reservations as the feature they would like changed and only 34 said they would like the cost reduced. These results further demonstrate that visitors are increasingly comfortable with the system now while also learning there is free parking nearby. This is consistent with what is observed by the Del Cerro community and heard from visitors. 3. Weekend parking is near capacity The Del Cerro community observes that the reserved parking spaces in the zones closest to the trailheads are filled to capacity on the weekends with lesser utilization during the week. Not surprisingly, the further zones are much less used since they are adjacent or nearly adjacent to the free parking area. Council should be reminded that reservations alone do not reflect the level of parking area activity. An estimated 40% of parked cars do NOT have a valid reservation based on the City's published citation data. Further, we have observed for every parked car approximately four additional cars pull into the parking area before leaving soon thereafter -all contributing to the noted churn and congestion along Crenshaw. Similarly, parking spots in the free areas, along Crest Road and Crenshaw north of Crest, are utilized seven days a week and are typically at capacity on weekends. This all amounts to a tremendous amount of traffic congestion on weekends. 4. Another near-miss just occurred On Saturday morning, April 1st, there was a single car accident on Crenshaw near the Burma Road trail head -the latest of several such accidents in recent years -where a speeding car flew over the curb and landed sideways nearly 30' away on top of a neighborhood landscaping boulder. It was amazing that on a beautiful weekend morning with many Preserve visitors out with their children and pets that there were no serious injuries or worse. This incident was a chilling reminder that there are still safety and congestion issues during weekend peak periods of usage, and any modification to increase vehicles in the area will exacerbate an already tenuous situation. 5. An on-demand parking model abandons benefits and brings back problems For the reasons cited above, the Del Cerro HOA recommends the reservation-based parking system be retained as it has proven to mitigate the dangerous levels of traffic churn associated with visitors looking for parking upon arrival. We strongly oppose moving to an on-demand model that will bring back traffic safety and congestion problems experienced previously. 2 6. Any potential changes must be limited to weekdays only If the Council would like to introduce changes to increase usage of the 39 ParkMobile parking spots, the focus needs to be limited to weekday periods when this parking area is much less utilized -with no changes that would encourage additional traffic during the already heavy weekend periods. We must note that any such changes would place an even higher premium on enforcement as users adapt to the new rules. In summary, the Del Cerro community has been pleased with the success of the ParkMobile system and grateful for the relief it has offered. The recent survey suggests the Preserve visitors are accepting of the system as only 272 of 32,000 visitors felt strongly enough to register their complaints and suggestions over a three-month window of opportunity. Within those 272 there was no overwhelming recommendation or consensus of opinion as evidenced by only 46 respondents identifying advance reservations as the one item they would like changed and likewise only 34 suggesting a lower price point. Finally, while the visitors' voices are important, City Council cannot forget there are over 700 RPV residents across the Del Cerro and nearby communities who must pass through the Preserve parking area to travel to and from their homes. Approximately two-thirds of Del Cerro residents bought their homes prior to establishment of the Preserve so there is no valid argument that nearby residents shouldn't complain since they "chose" to live by the Preserve. The voices of these RPV residents must also be considered. Visitors choose to come to the Preserve for recreation among many other recreation choices. They also have a choice to reserve a parking spot or park anytime for free. The nearby RPV residents do not have a choice other than to move from their long-time homes, neighborhood and friends-all features of RPV that drew residents to live here and stay here. Undoubtedly, there was a need to address the serious traffic concerns and dangers posed to safety along Crenshaw Boulevard, south of Crest Road, the Palos Verdes Nature Reserve's most prevalent and busy road. The introduction of the ParkMobile reservation system in August 2021 has been a significant factor in addressing the Del Cerro resident's concerns of safety, traffic congestion and noise pollution and quality of life for residents and visitors alike. We are conscious that there has been an increase in the number of visitors to the Palos Verdes Nature Preserve Trails to pre-pandemic levels and yet ParkMobile's advance reservation system combined with strict parking enforcement has been immensely effective in countering the safety issues yet still providing Preserve visitors with ample paid and free parking nearby. Further, we understand that the large uptake in ParkMobile paid reservations in February, March and early April 2023 is evidence of the growing acceptance of the new advance reservations system, and this is also at a time when we have experienced some of the worst weather conditions. The Survey conducted had a less than 1 per cent uptake, albeit 272 surveys were completed. The comments attributed to ParkMobile indicated the growing acceptance of the advanced reservation system with a minority of 31 % wishing to eliminate both the reservation system and the parking fee, which effectively means to scrap the ParkMobile system. The weekend parking is near capacity and a cause for concern. Notably, the free parking along Crest Road and Crenshaw north of Crest are utilized 7 days a week and are over-capacity at weekends. Safety concerns exist with tour buses and additional traffic causing dangers with U-turns a near-miss occurred on 1st April when a speeding car crashed on South Crenshaw near the Burma Trail knocking down signage and landing sideways after hitting a curb. In summary, we are strongly advocating that the on-demand ParkMobile advance reservation is retained as a proven means to mitigate traffic congestion with paid parking access.
