Brush Clearance Annual Notice FAQs
Residents of the Palos Verdes Peninsula have recently received a Defensible Space Annual Notice
(formerly known as the Brush Clearance Annual Notice) from the Los Angeles County Fire Department
(LACoFD). Some homeowners are receiving this notice for the first time due to updated mapping software.
Consequently, the Peninsula Cities received resident inquiries seeking clarification. In collaboration with
the (LACoFD), the four cities of the Palos Verdes Peninsula are providing this Brush Clearance Annual
Notice FAQ’s with additional information and clarification regarding the current requirements for brush
clearance.
Why Did I Receive this Notice?
−The Palos Verdes Peninsula is primarily located within a state-designated Very High Fire Hazard
Severity Zone (VHFHSZ).
−State law (California Public Resources Code 4291) requires single-family dwellings within the
VHFHSZ to maintain defensible space around these structures at all times.
−The LACoFD conducts defensible space inspections on residential single-family dwellings annually.
What is a Fire Hazard Severity Zone?
−CAL FIRE is required by law to map significant fire hazard areas based on fuels, terrain, local
weather, and other factors.
−These designations, known as Fire Hazard Severity Zones (FHSZ), mandate how people construct
buildings and protect property to reduce the risk of wildfires.
−The Palos Verdes Peninsula is almost entirely designated as a Very High Fire Hazard Severity Zone
(VHFHSZ).
Why is this the First Time I Am Receiving this Notice?
−The LACoFD has recently updated its mapping software using a geospatial database to create its
Defensible Space Inspection Program that is significantly more accurate.
−The updated mapping system has resulted in numerous new properties subject to the brush clearance
requirement for the very first time
When will My Property be Inspected?
−Your local fire station will begin inspections on June 1, 2023.
Is There a Fee for the Inspection?
−Yes, an inspection fee has always been assessed on properties subject to the required brush
clearanace. However, in December of 2021, the Board of Supervisors approved increasing the
inspection fee over the next 3 years at the following rate (2021 - $50.00, 2022 - $100.00, and 2023
-$151.00).
−The Fee will be assessed in November as part of your property tax bill.
How will I know if I passed the Brush Clearance Inspection?
− An Inspection Report identifying compliance or non-compliance will be left on your door.
Do I Have to be Home for the Brush Clearance Inspection?
− No, your local fire station will attempt to complete the inspection through only unlocked and open
access.
− If your gate is locked or your property inaccessible, a notice will be left at your day on who to call
to schedule an inspection appointment.
If found to be Non-Compliant, how much time will I have to make corrections?
− Owners have a minimum of 30 days to complete corrections.
Can I Call Someone if I Need Clarity on Requirements?
− Inquiries should be directed to the Brush Clearance Unit at (626) 969-2375.
What Is Assembly Bill 38 (AB 38)?
− Assembly Bill 38 (AB-38), commonly referred to as Real Estate Inspections, took effect on July 1,
2021. AB-38 requires that during escrow the seller of a property in the VHFHSZ submit
documentation of a compliant defensible space inspection prior to closing. Homes that received
their annual brush inspection within six months of closing can use that inspection, if compliant, to
satisfy this requirement
What Is Assembly Bill 3074 (AB 3074)?
− State Assembly Bill 3074 (AB-3074) establishes a new brush clearance zone called “Zone 0”,
which is a 5 foot Ember Resistant Zone that requires removal of all flammable materials within 5
feet of any structure.
− Zone 0 requirements will not be enforced until 2024, the LACoFD will be using this year’s
inspections to educate property owners on what they need to do to become compliant with next
year’s Zone 0 requirements.

BRUSH CLEARANCE REQUIREMENTS
It is a property owner’s responsibility to properly and timely clear vegetation around all structures. A fire
safe landscape creates a defensible space to help protect against approaching wildfires and flying embers
which could safe your home and personal belongings.
WHAT ARE YOUR RESPONSIBILITIES
− Establish a 5-foot Ember Resistant Zone around all structures. Eliminate all vegetation and
materials that could be ignited by embers from a wildfire. This is a new requirement imposed by
the State of California via AB 3074. Enforcement of this requireme nt will begin in 2024.
Informational only for 2023.
− In the VHFHSZ, a defensible space is considered 200 feet around all structures, based on the
following zones:
• Within the first 5 feet of any structure (Zone 0), removal of all vegetation;
• Within the next 50 feet of any structure, removal of flammable vegetation is required.
Native and ornamental vegetation known to be flammable, including but not limited , to
Acacia, Cedar, Cypress, Eucalyptus, Juniper, Pine, and Pampas Grass. Ornamental grasses
and ground cover should be maintained at no higher than 3 inches;
• Within the next 150 feet (or up to the property line), remaining vegetation is required to
be thinned
• Remaining vegetation for the next 150 feet (or up to property line) around any structure is
required to be cleared, trimmed, thinned, limbed up removing flammable vegetation and
dead wood;
• The total defensible space should measures a total of 200 feet from any structure (or up to
the property line);
• Specimen native trees and shrubs are permitted, provided they are spaced to not allow
transmission of fire to a structure; and,
• It is recommended that specimen shall be spaced a minimum of 15 feet or 3 times diameter
from other specimens, structures or surrounding native brush.
− Access road shall be maintained with a minimum of 10 feet of brush clearance on each side. Fire
access roads shall have an unobstructed vertical clearance to the sky. Trees overhanging fire access
road shall be maintained to provide adequate vertical clearance.
− Fire hydrants shall maintain clearance of 3 feet.
− All trees and shrubs shall be maintained free of deadwood and litter.
• Shrubs shall be trimmed up from the ground 1/3 of their height.
• Trees shall be trimmed up to a minimum of 6 feet or 1/3 their height up to 40 feet.

It was a pleasure speaking with you tonight. As a followup to the public comments regarding Item J (draŌing a leƩer in
response to Cal Fire’s Updated Fire Hazard Severity Zone Map), I wanted to send the comments I made as well as add
one addiƟonal: the re‐designaƟon from a low‐fire severity zone to a high‐fire severity zone will no doubt have a dramaƟc
effect on homeowners insurance rates throughout our city … I could see them easily doubling or tripling ‐ or more ‐ just
based on this one change. Let alone the idea that most homes will be sans vegetaƟon.

My family is an original owner of our home from 1958; the leƩer from county fire is as stated draconian, yet vague and
frankly dangerous.
My father worked with the builder, the county, and the fire department to stabilize the canyon behind our house, which
included planƟng pine trees among other vegetaƟon. These trees are now over a half century old. Over the years they
have grown and the roots have done their job; unlike the early days the hill no longer collapses, which I am told led to
problems with obstrucƟon of the storm drain at the end of the canyon in turn causing floods
In the 65 years we have been here, we were never rated a high fire danger area. Suddenly we are, with the potenƟal
requirement of removing all vegetaƟon in and around our homes. No vegetaƟon within five feet, and removal of trees
providing shade and oxygen… depending on the final interpretaƟon, it may mean the removal of almost every tree on
every lot ‐ including your own vegetaƟon right outside this building, which is clearly in violaƟon of the new rules.
These are not rural lots. They are city lots. In 65 years we have never had a fire in the canyon, nor anything close to a
brushfire in or around the Eastview area. To suddenly be designated a high fire risk area goes against common sense, will
cause the removal of longƟme trees and vegetaƟon, and the destrucƟon of habitat for numerous species of birds,
including hawks, eagles, and owls, who call these trees their homes.
I urge the city to help county fire to bring common sense and raƟonality back to our area. Thank you.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES, CALIFORNIA, PROCLAIMING
THE TERMINATION OF THE EXISTENCE OF A LOCAL
EMERGENCY ASSOCIATED WITH COVID-19 AND
THEREBY RESCINDING RESOLUTION NO. 2020-11.
WHEREAS, the Emergency Services Act, Government Code Section 8558(c)
authorize§. the proclamation of a local emergency when conditions of extreme peril to the
safety of persons and property within the territorial limits of a city exist; and
WHEREAS, pursuant to the California Emergency Services Act and Government
Code Section 8625, Governor Gavin Newson proclaimed a State of Emergency on March
4, 2020, due to the peril to persons and property -by-from the emergence of a novel
coronavirus (a disease now known as COVID-19) t++&-GG\4G-49--v+rus-ernerg.enee; and
WHEREAS, pursuant to Government Code Section 8630, such a local emergency
existed in the City of Rancho Palos Verdes in accordance with Resolution No. 2020-11
as adopted by the City Council on the 17th day of March 2020, as a result of respiratory
i II ness due to C OVI D-19a-oovet-Borona-v+rHs-(2H,ii-sease-+1ow-knewn-asGGVID--49-); and
WHEREAS, pursuant to Government Code Section 8625, proclaiming the
existence of conditions of disaster or of extreme peril to the safety of persons and property
within the state caused by conditions as described in Government Code § 8558,
Resolution No. 2021-72, was adopted by the City Council on December 21, 2021,, which
re-ratified the State of Emergency and re-authorized remote teleconferencing meetings;
and
WHEREAS, Government Code Section 8630 requires that the City Council
proclaim the termination of such local emergency at the earliest possible date that
conditions warrant; and
WHEREAS, Governor Gavin Newson, having found pursuant to Government Code
Section 8629 that the conditions of extreme peril to the safety of persons and property as
declared in the State of Emergency on March 4, 2020 no longer exist, has proclaimed
that the State of Emergency no longer exists; and
WHEREAS, the City Council has reviewed the need for continuing the local
emergency; and
WHEREAS, the City Council has determined that the situation resulting from
COVID-19-sakl:
conditions of extreme peril is now deemed to be within the control of the normal
protective services, personnel, equipment, and facilities of and within the City of Rancho
Palos Verdes.

Re: Portuguese Bend Landslide Remediation Project -Draft Environmental Impact Report
Dear Honorable Councilmembers:
This communication from the Board of Directors of the Portuguese Bend Club Homeowners Association
("PBC HOA") on behalf of the members of our community ("PBC Community") is in response to the
recently published Portuguese Bend Landslide Remediation Project -Draft Environmental Impact Report
(the "Draft EIR").
We very much appreciate the efforts of the City of RPV ("City") to mitigate the adverse effects of the
Portuguese Bend landslide complex on the members of the community and the finances of our city, and
in that spirit, we have historically supported the City's work in this regard.
We have followed closely the prior work done by the City regarding this project, in particular the NOP,
Initial Study and City workshop materials. We were frankly surprised and dismayed to see how far the
Draft EIR expanded the scope of the proposed project and its potential adverse impacts to our
community, which is located immediately adjacent to the proposed project.
We respectfully request that no decision with respect to this Draft EIR be made until City staff has had a
chance to meet with representatives of the PBC HOA to discuss and resolve our concerns and give us an
adequate opportunity respond to the material changes/additions to the scope of the proposed project.
Our primary concerns are described below:
Project Location/Boundaries
The project site in the NOP and all prior materials did not include any private property within our
community. Moreover, the PBC HOA was not informed, much less consulted, in the decision by City staff
to expand the recommended project location boundaries to include private· property within our
community.
The City does acknowledge in Sec. 3.4.3.3 of the Draft EIR that, ''Access to one project element
{Hydrauger Al} for construction and operation/maintenance will either occur via Yacht Harbor
Drive/Seawall Road, a private road within the Portuguese Bend Beach Club community, or internally
within the project site. An easement or access agreement will be necessary if the Yacht Harbor access is
to be used/ We appreciate the affirmative acknowledgement of our private property rights and the need
for our approval in order for the City access described in the Draft EIR. We do however request that the
City confirm that the "project site" referred to in the referenced Section does not include any private
property within the Portuguese Bend Club community

Construction and Maintenance Heavy Equipment Access
There was no mention in the NOP, Initial Study or prior City workshop materials of City construction and
maintenance heavy equipment having access through the Portuguese Bend Club community via our
private roads (Yacht Harbor Drive/Seawall Road) as described in of the Draft EIR. Again we were not
consulted and there was no discussion between us and City staff or consultants regarding the potential
use of our HOA constructed and maintained roads to service the proposed project.
The expanded project site as described in the Draft EIR includes a portion of Yacht Harbor Dr., which
does not appear to connect to Palos Verdes Drive South ("PV Drive"). A connection to PV Drive at the
location shown is not practical, as there is a substantial elevation difference between Yacht Harbor Dr.
and PV Drive and the path would occupy property of a private homeowner. Please clarify how the City
plans to access PV Drive from Yacht Harbor Dr. (PBC Gatehouse) for the potential uses described in the
Draft EIR. At a minimum we would need more detailed information about the construction and
maintenance traffic demands on our existing roadway infrastructure before we could responsibly
consider any request.
The Transportation Section of the Draft EIR (Sec. 4.13) level of service traffic analysis did not evaluate the
traffic impacts to the existing intersection connection of PV Drive and Yacht Harbor Dr. for construction
and maintenance traffic impacts. If this alternative is to be considered, we request that a specific traffic
analysis for this intersection be conducted.
Geotechnical/Engineering Peer Review
We request the opportunity to provide peer review comments from our geotechnical, civil and other
technical consultants and receive written responses and/or set up calls to discuss.
Infrastructure Locations Al and A6 Concerns
The Hydrauger locations Al and A6 are squarely in the viewshed of our PBC Community and depending
on how they are implemented, could have a substantial adverse impact on the views from the PBC
Community.
We are also concerned about the apparent location of Hydrauger A6 for a number of reasons: (i) the
apparent proximity to the beach, advisability of a wellhead, pump, electrical and backup gasoline
powered generator infrastructure so proximate to the surf zone; (ii) risks to marine and other wildlife;
and (iii) risks to human health.
We request that the details of these infrastructure improvements be discussed with the PBC Community.

Draft EIR
Dear City Council Members,
We appreciate that the City has reached out to engage with PVPLC and other organizations to
collaborate on the design of the project to mitigate the landslide.
The Land Conservancy has started communicating with City Staff on specific questions and
suggestions regarding the draft EIR which is a very complex discussion and well beyond the
scope of this letter.
At this point in time, we are still listening to the community, learning from the City staff and
consultants, and consolidating our observations. We will communicate a comprehensive letter on
habitat restoration issues that we believe would be advisable to address in the final EIR as soon
as we can.
We want to lend support for measured steps to slow the landslide as that objective would bring
many benefits. However, we still have many concerns and questions regarding some of the
preliminary designs included in the draft EIR about the feasibility of restoring habitat in the
swales and Flow Reduction Area or about the feasibility of mitigating biological, geologic and
aesthetic impacts to installing some of the hydraugers, particularly on the coast. We want to
further understand the report's findings of "less than significant impact" in all cases when relying
on mitigation measures as well as temporary versus permanent impacts calculated with
assumptions based on the feasibility of restored habitat. We will continue to communicate this
issue, other issues, and alternative solutions raised to us in the community to help the City ensure
that the final EIR will comprehensively address community concerns.
