Specifically, Condition No. 7 of the Amended and Restated Declaration of Restrictions states the following: 1 RANCHO PALOS VERDES 7. Review and Monitoring For Compliance. The City and Owners [Trump National Golf Club] shall review the Owners' compliance with its Maintenance Obligations and compliance with the terms and conditions under this Declaration at least once every twelve (12) months based on a tracking system and protocols implemented by City for monitoring compliance. Owners shall implement and/or perform all reasonably practical recommendations or requirements of City following such annual review. Pursuant to this Condition, Community Development and Recreation and Parks (“City Staff”) worked together to create a maintenance spreadsheet. In early 2019, Staff, in collaboration with the Applicant’s staff, created a tracking system for trail and open space complaints and the Applicant’s responses. The resulting document was a maintenance matrix that was first presented to the City Council on February 4, 2020, and most recently on April 5, 2022 (Attachment D). This item was not presented to the City Council for review in 2021 due to a significant backlog of work and limited resources for both the City and the Applicant. City Staff continues to maintain the matrix (Attachment A) for presentation to the City Council on an annual basis. The purpose of this report is to conduct the 2022 annual review of the overall effectiveness of the Applicant’s compliance with maintenance obligations for the trails, open space, and public amenities, using the maintenance matrix developed pursuant to Condition No. 7. The focus of this review will be on the application of the maintenance matrix and a discussion of the most common and recurring maintenance issues. DISCUSSION: The Applicant is required to maintain, manage, improve, and enhance, to the City’s reasonable satisfaction, various portions of the Trump National Golf Course property, which includes the open space, various public amenities such as picnic tables and benches, and trails. Common and recurring maintenance issues include trail erosion, spur trails, vandalism, litter, and sign deterioration. The maintenance matrix is used to log the issues and provide a method by which Staff can track and objectively measure the completeness and timeliness of the Applicant’s compliance with their maintenance obligations. The maintenance issues are grouped by trail or open space area, with a color code (green for complete, black for confirmation of work pending, and red for not complete), which allows the user to quickly assess the status of reported issues. Typically, when a report of a trail issue is either identified by the City Staff or received from the public. City Staff logs the reported issue on the maintenance matrix and reports the concern directly to the Applicant. Additionally, to improve the data and locations of reported issues, photos and map coordinates may be included, which reduces confusion regarding the location or nature of the issues. Eventually, City Staff anticipates moving to the CityWorks automated platform in the fall, which is the system that the Public Works Department currently uses for maintenance requests. There are 224 items listed in the current maintenance matrix. Currently, approximately 96 items are complete (green); 90 issues were responded to by the Applicant but not 2 confirmed complete by Staff (black); and 38 items not complete (red). The large number of issues responded to but not confirmed (black) is a result of the Applicant providing maintenance updates in the days leading up to the preparation of this report , which precluded Staff from inspecting the work. To summarize, 83% of the current reported or observed issues have been addressed. Staff continues to work with the Applicant to review its progress and ensure completion of items that are still pending. City Staff believes the Applicant, despite the challenges of the past several years, continues to make significant progress to address and keep up with the ongoing maintenance of the trails, open space and amenities. Additionally, since the April 2022 City Council meeting, five informal meetings between City Staff and the Applicant have been completed in order stay up to date with the current status of the trails. Due of the large size of the Ocean Trails Reserve and the Trump National Golf Course, the frequent usage by the public, and most recently, large amount of rain th at the area has received, topics discussed at these meetings include trail erosion, spur trails, deterioration of signage, and vandalism and litter. These topics are further discussed below: Trail Erosion As a result of erosion, trails and amenities need continuous and recurring maintenance. While various large-scale trail construction repairs were completed in October and November 2021, during 2022, the Applicant worked on smaller projects including repairing trail washouts and adding new posts and cables along the sides of existing trails. Erosion and resultant slope failures also caused the closure of the Catalina Trail bridge and the Coastal Switchback Trail landslide. Staff is working with the Applicant on possible solutions to remedy these two significant trail issues. Thus far, City Staff has held one meeting with the City’s Geologist, the California Coastal Commission, the U.S. Fish and Wildlife Service and the California Department of Fish and Wildlife to discuss possible solutions. City Staff is also coordinating a site visit to these two impacted trail sites, which will take place before this summer. Spur Trails One of the main issues that remains is the creation of spur trails, which are unauthorized new trails through existing habitat by hikers that must be removed. Since the last update to the City Council, the Applicant has continued to work on solutions to permanently close these unauthorized areas, including, but not limited to, installation of “Area Closed” signage, adding branches and planting cacti, as well as additional posts and cables to block off these areas. Deterioration of Signage Sign maintenance due to vandalism and exposure to the elements is another constant and recurring issue for the Applicant. In the time period tracked in the maintenance matrix, the Applicant has replaced a significant number of signs including trail name signs and other wayfinding and informational signage. Given that signs are critical for the identification of the trails, as well as advising the public of the Preserve and beach rules, 3 City Staff will continue working with the Applicant to reduce the current volume of the sign issues. Additionally, the Applicant is working on an updated version of the original signage plan for the development. The property was still named “Ocean Trails” at the time that the original signage plan was approved in October 1999, and there have been various name changes and new trails added to the signage plan since it was first created . Additionally, there have been some interim signage plans, such as a 2013 Interim Ani mal Signage Plan and the City Council-approved 2018 Amenities Plan that the Applicant is currently working to consolidate into one updated Signage Plan. Furthermore, the Open Space Management Staff has provided the Applicant with additional surplus signage , as well as direction regarding the correct type of posts to install. Additional updates will be provided as more information becomes available regarding signage proposals. Vandalism and Litter The Applicant has also informed City Staff regarding ongoing issues with vandalism in the public restroom near the La Rotonda Drive parking lot. The Applicant has placed security personnel by the restrooms to deter this activity; however, each act of vandalism requires the closure of the restrooms for deep cleaning. In an effort to further deter this type of activity, Park Rangers will continue to frequent the La Rotonda Drive parking lot and adjacent trails in this eastern section of the Reserve several times a week to watch for any vandalism in the area. Additionally, the Applicant sends an employee to walk all the trails every Friday for litter and graffiti detail. It is evident that the Applicant strives to keep up with the recurring maintenance issues, based on continually improving communication between the Applicant and City Staff, among other things. Staff will continue to work with the Applicant to facilitate and ensure that recurring maintenance of the trails, open space and amenities will be in compliance with their obligations under the Amended and Restated Declaration of Restrictions. ADDITIONAL INFORMATION: Infrastructure Management Advisory Committee (IMAC) Trails Subcommittee Open Space Management Staff (a division of the Recreation and Parks Department) has been in regular communication with the IMAC Trails Subcommittee regarding two closed trails in the Trump National Golf Course property. Specifically, the trails include the Coastal Switchback Trail, which is closed due to landslide movement, and the bridge closure due to erosion on the Catalina Trail. As previously noted, the trails cannot simply be repaired and likely may need to be rerouted through dedicated habitat and Preserve areas. However, the IMAC is aware that these repair projects will require coordination with various stakeholders and agencies, which will take some time. Public Correspondence On March 30, 2023, a public notice was mailed to all property owners within a 500-foot radius of the project site and published in the Palos Verdes Peninsula News. In response to the public notice, Staff received public correspondence (Attachment C) from two 4 residents of the adjacent neighborhood to the west of the project site, with one resident representing the Portuguese Bend Club community. The residents expressed concerns regarding the approved plantings for Lot D (City-owned lot), which were originally approved by the California Coastal Commission in 2019, and most recently updated in 2021. This lot is located at the western boundary of the Trump National Golf Club property, immediately to the east of the Portuguese Bend Club community. The residents expressed concerns that the plantings on Lot D were overgrown and have become a fire hazard. Furthermore, the residents stated that a fire protection plan should be drafted for Lot D, as the planted native foliage is thriving and is growing up to the shared property with adjacent residences. Based on Staff’s analysis, the planting plan for Lot D was approved in consultation with the City of Rancho Palos Verdes, the Bureau of Land Management, the California Coastal Commission, and the Los Angeles County Fire Department, and was originally labeled as a fire break area. Based on the approved design of the plan, Lot D was to include foliage to be planted in the proximity of shared property lines with several types of existing foliage along the shared property line fence or wall to be protected in place, and simply trimmed to be closer to the wall on a regular basis. CONCLUSION: Staff recommends the City Council Receive and file this annual review report regarding Trump National Golf Club’s compliance with its maintenance obligations relating to trails and open space pursuant to the 2018 City Council -approved Amended and Restated Declaration of Restrictions. ALTERNATIVES: In addition to the Staff recommendation, the following alternative actions are available for the City Council’s consideration: 1. Identify areas of concern regarding the Applicant’s compliance with the maintenance obligations and direct Staff to address these concerns at a future meeting. 2. The Lot D planting is now complete and has grown up thick and deep. The residents of our Tract 16540 recently received their 2023 L.A. County Fire Department instructions on brush clearance requirements. Our residents will comply with these detailed instructions and create a safe fire landscape. However, this might not be possible if flamable vegetation within a home's brush clearance zone is on City property. For residents on the eastern edge of our Tract, the planting on Lot D is within the 50 foot "Zone 1 Lean, Clean and Green Zone" surrounding their homes. Therefore, these residents cannot clear their brush clearance Zone 1 of all flammable vegetation - some of that vegetation may be on the City's Lot D. Here is an extract of our emails back in May 2022. I wrote: 3. As you know, there was a fire last week near the bridge to the Club House, fortunately quickly extinguished, but the fire treat from the habitat shrubs to my tract is real. There is new landscaping adjoining my tract which might be dangerous if not maintained properly. I will be working with them on a specific location, as the approved fencing plan included only a general location and dimensions. I will also be working with them on a possible material change, to make the wall more aesthetically pleasing than the currently required “slumpstone”. This change, as well as others that have been requested and/or implemented, will be shown on an updated fencing plan that the Trump contractor is currently working on, and will be documented as a minor change to the existing conditions of approval for the project. These changes will include other revisions to the approved fencing plan, and will be either presented or provided to the City Council along with a few other (relatively) minor project changes, which include a change to the storm drain plan for Tract No. 50666. Staff is currently working on the prerequisites to the storm drain revisions, which include updates to the City’s NCCP and an addendum to the MND for the storm drain project. I hope I am not being too much of a pain in the neck here as you are probably pretty busy, but I am hopeful these points can be considered as part of the City’s compliance review. To: Amy Seeraty, RPV Planning Division, I am following up Kelvin Vanderlip's letter to you since I have been actively involved with the City and the Fire Department on the plantings for Lot D and the need to protect our homes from brush fires. Tract 16540 has major concerns with the plans (or lack thereof) for fire protection along our property line with the Trump Golf Course. We would like to see more detailed plans given that the area is newly planted and is growing very robustly. The plantings already exceed the Fire Department's recommended size and density for a safe fire protection zone. As time goes on towards the hot summer months it will be even more dense and risky for our homes. I have attached some pictures of the property line today showing our homes and the plantings coming up to our homes within 10 ft or less (first three slides in attached PowerPoint). Since our homeowners do not have access to Lot D any longer per City orders, they cannot do the maintenance themselves and Trump must do it. I have also attached the results of a meeting we had with the City (hosted by Ara Mihranian and So Kim), the Fire Department, the LA County Agricultural Commission and the Trump organization concerning this problem in January 2019 (same attachment below) during the planting planning phase for Lot D. I have never seen a detailed fire protection plan from that meeting following the Fire Department recommendations. I strongly recommend you have one developed ASAP as the area is growing very rapidly and the problem will be upon us soon. Trump staff have informally said they will create a park-like environment on Lot D. It is not clear what that means and so far nothing like a park has been created. They have not built the fire break zones like the Fire Department recommends. As you can see from the recent pictures (April 2023) and the original plans (Jan 2019) it is all very densely planted growing up to the fences with our homes (typically 10 feet or less from the houses themselves). Plant species have been selected to adhere to a low water/drought tolerant palette consistent with a native plant community. The irrigation system is fully automatic and connected to an existing mainline and controller. Planting areas are designed to minimize overwatering, or other similar conditions where water flows onto adjacent areas not part of the irrigated area, such as adjacent property, walks, roadways, or structures. The irrigation system has been divided into hydrozones, so that plants with similar water requirements have been valved together.
