CC DM 20221101 B - 20221018 CC MINS DRAFTDRAFT MINUTES RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING OCTOBER 18, 2022 CALL TO ORDER: A Regular Meeting of the Rancho Palos Verdes City Council was called to order by Mayor Bradley at 7:04 P.M. at Fred Hesse Community Park, McTaggart Hall, 29301 Hawthorne Boulevard. This meeting took place remotely in accordance with Government Code section 54953(e) et seq. (AB 361) and Resolution 2021-59, adopted by the City Council on November 16, 2021. Members of the public could observe and participate using the zoom participation feature, and with options called out in the public participation form provided under separate cover with the agenda. Notice having been given with affidavit thereto on file. ROLL CALL: City Council roll call was answered as follows: PRESENT: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley ABSENT: None Also present were Ara Mihranian, City Manager; Karina Bañales, Deputy City Manager; Elena Gerli, Assistant City Attorney; Trang Nguyen, Director of Finance; Ken Rukavina, Director of Community Development; Ramzi Awwad, Director of Public Works; Lincoln Lo, Deputy Director of Public Works; Octavio Silva, Deputy Director of Community Development; Steven Giang, Associate Planner; Jesse Villalpando, Senior Administrative Analyst; Matt Waters, Senior Administrative Analyst; and Teresa Takaoka, City Clerk. Also present was Captain Powers from the Lomita Sheriff Station. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Cub Scouts Den 970 with a color guard flag ceremony. MAYOR’S ANNOUNCEMENTS: Mayor Bradley recognized the Peninsula High School students that were in attendance and thanked Cub Scouts Den 970 for leading the Pledge of Allegiance and color guard flag ceremony. RECYCLE AND EMERGENCY PERSONAL PREPAREDNESS KIT DRAWING: DRAFT City Council Regular Minutes October 18, 2022 Page 2 of 9 Mayor Bradley announced the Recycle Winners for the October 4, 2022 City Council meeting: Sabina Vaidyan and Kenneth Zenker. He indicated that all winners receive a check for $250 and urged everyone to participate in the City’s Recycling Program. He noted that in addition to winning the Recycler Drawing, the two individuals also won a Personal Emergency Preparedness Kit from the City valued at $40. CITY MANAGER REPORT: City Manager Mihranian provided updates on the following: Introduction of newly appointed Deputy Director of Public Works Lincoln Lo; Mixed-Use Overlay District community survey and virtual open house; the Great ShakeOut event on Thursday, October 20 at 10:20 a.m.; Red Cross Blood Drive at Fred Hesse Community Park on Friday, October 21; Harvest Festival at Civic Center on Saturday, October 22; Cox Communications open house at Fred Hesse Community Park on Wednesday, October 26; Prepared Peninsula Expo at Peninsula High School on Sunday, October 30; One - Day Early Voting at City Hall on Monday, October 31; Wish ed everyone a safe Halloween; and Happy 91st Birthday to Councilmember Dyda. Registers of Demands (Mata) 1) Adopted Resolution No. 2022-57, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. D. Consideration and possible action to continue implementing Assembly Bill No. 361 (AB 361) authorizing teleconferencing of meetings of legislative bodies for the month of October 2022. (Zweizig) 1) Adopted Resolution No. 2022-58, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, RE-RATIFYING THE PROCLAMATION OF A STATE OF EMERGENCY BY GOVERNOR NEWSOM ON MARCH 4, 2020 AND RE-AUTHORIZING REMOTE TELECONFERENCE MEETINGS OF THE LEGISLATIVE BODIES OF THE CITY OF RANCHO PALOS VERDES FOR THE PERIOD BEGINNING NOVEMBER 1, 2022 THROUGH NOVEMBER 30, 2022, PURSUANT TO THE RALPH M. BROWN ACT AND ASSEMBLY BILL NO. 361; and, 2) Authorized Staff to continue conducting, as warranted, City Council and Planning Commission public meetings using a combination in-person/virtual (hybrid) platform and continue conducting virtual-only meetings or a combination in-person/virtual (hybrid) platform, if warranted, for the City’s five Committees (Civic Center Advisory, Emergency Preparedness, Finance Advisory, Infrastructure Management Advisory, Traffic Safety) subject to the Brown Act in accordance with the requirements of AB 361; and return with extension resolutions for the City Council’s consideration every 30 days as the same may be warranted. E. Consideration and possible action to file a Notice of Completion for the Traffic Signal at Palos Verdes Drive South and Palos Verdes Drive East Project. (O’Neill) 1) Accepted the Traffic Signal at Palos Verdes Drive South and Palos Verdes Drive East Project as complete in accordance with the plans, specifications, construction contract approved by the City Council and Contract Officer’s approved changes; 2) Authorized the City Manager and City Clerk to file a Notice of Completion for the project with the Los Angeles County Registrar-Recorder’s Office, and if no claims are filed within 35 days after recordation, send a notice to the surety company to DRAFT City Council Regular Minutes October 18, 2022 Page 4 of 9 exonerate the Performance Bond; and, 3) Authorized the Director of Public Works to release the 5% construction retention, as part of a $26,375.30 payment to Crosstown Electrical & Data, Inc. marked “final payment”, 35 days after the recordation of the Notice of Completion by the Los Angeles County Registrar- Recorder’s Office, contingent upon no claims being filed on the project, and the contractor posting an acceptable warrant bond with the City. F. Consideration and possible action to install the Rattlesnake Trailhead Fence and Gate and the bollards at the Burma Road Trailhead Gate. (Awwad) 1) Approved the plans, specifications, and construction documents for the Rattlesnake Trailhead Fence and Gate Project; 2) Approved the plans, specifications, and construction documents for the installation of bollards at the Burma Road Trailhead gate; 3) Awarded a construction contract for the Rattlesnake Trailhead Fence and Gate Project to Coastal Iron Works Corp., in the amount of $83,550, with a contingency of 10% or $8,355, for a not-to-exceed amount of $91,905; 4) Awarded a construction contract for the installation of bollards at the Burma Road Trailhead Gate to Coastal Iron Works Corps., in the amount of $2,850, with a contingency of 10% or $285, for a not-to-exceed amount of $3,135; and, 5) Authorized the Mayor and City Clerk to execute the contracts in forms approved by the City Attorney. G. Consideration and possible action to authorize the purchase of a new City vehicle using AB 2766 funds. (Garrett) 1) Authorized a purchase contract with South Bay Toyota in an amount not -to- exceed $50,000 for the purchase of one 2022 Toyota RAV4 XLE FWD for the Community Development Department; 2) Authorized a not-to-exceed amount of $7,000 to purchase and install a roof-mounted light bar from the General Fund; and, 3) Approved an additional appropriation of $50,000 from the Air Quality Management District (AQMD) Fund. CONSENT CALENDAR ITEM(S) PULLED FOR PUBLIC COMMENT: None. PUBLIC HEARINGS: 1. Consideration and possible action to adopt code amendments adding Chapter 17.79 (City Projects) of Article VII (Development Application and Review); and amending Chapter 17.96 (Definitions) of Article VIII (Administration) of Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code designated the Planning Commission’s role as advisory to the City Council for City projects and associated updates for consistency with new code provisions (Case No. PLCA2022-0003). Councilmember Cruikshank moved, seconded by Mayor Pro Tem Ferraro, to approve staff recommendation as follows: Introduced Ordinance No. 666, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES ADDING CHAPTER 17.79 (CITY PROJECTS) OF ARTICLE VII (DEVELOPMENT APPLICATION AND REVIEW); AND AMENDING CHAPTER 17.96 (DEFINITIONS) OF ARTICLE VIII (ADMINISTRATION) OF TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE DESIGNATING THE PLANNING COMMISSION’S ROLE AS ADVISORY TO THE CITY COUNCIL FOR CITY PROJECTS INVOLVING DISCRETIONARY DEVELOPMENT APPLICATIONS AND ASSOCIATED UPDATES FOR CONSISTENCY WITH NEW CODE PROVISIONS. Consideration and possible action to receive an update on the six-month pilot program to allow bicycles and other non-motorized wheeled vehicles in designated City parks. Director of Recreation and Parks Linder introduced Senior Administrative Analyst Waters, who presented a staff report and PowerPoint presentation. Council Members asked questions of Staff. The following member of the public addressed the City Council: Hoai Nguyen. Discussion ensued among Council Members. Councilmember Cruikshank moved, seconded by Mayor Bradley, to approve staff recommendations as follows: 1) Received the update on the six-month pilot program to allow bicycles and other non-motorized wheeled vehicles in designated City parks; 2) Approved permanently allowing the use of bicycles and other non- motorized wheeled vehicles at Hesse Park, Lower Point Vicente and Eastview Park; and, 3) Directed Staff to continue exploring for additional City sites to provide additional opportunities to allow the use of non-motorized wheeled devices and for staff to identify safer path options at Hesse Park. Without objection, it was so ordered by Mayor Bradley. The following member of the public addressed the City Council: Larry Maizlish. Council Members asked questions of Staff. Mayor Pro Tem Ferraro moved, seconded by Councilmember Alegria, to approve staff recommendation to: 1) Approve a Master Customer Agreement with Pano AI for Peninsula-wide wildfire detection camera services for a period of three years, with the option of annual extensions, in the amount of $140,000 per year and a tot al contract sum of $420,000; and, 2) Authorize the Mayor to execute the Master Customer Agreement in a form approved by the City Attorney. Discussion ensued among Council Members and Staff regarding the term of the agreement. Mayor Pro Tem Ferraro moved, seconded by Councilmember Alegria, to amend original motion as follows: 1) Approved a Master Customer Agreement with Pano AI for Peninsula-wide wildfire detection camera services for a period of five years, in the amount of $140,000 per year and a total contract sum of $700,000; and, 2) Authorized the Mayor to execute the Master Customer Agreement in a form approved by the City Attorney. Consideration and possible action to receive and file a status update from the City’s lobbyist. Councilmember Alegria moved, seconded by Mayor Pro Tem Ferraro, to approve staff recommendation as follows: 1) Received and filed a report from the City’s lobbyist, RPPG, of its lobbying efforts to date and an update on bills the City has taken a position on during the 2022 legislative session; and 2) directed staff to create a list of cities to form coalitions for each topic covered in the 2023 Legislative Platform and include searchable terms in the 2023 Legislative Platform. Consideration and possible action to adopt an urgency ordinance amending Chapter 17.10 (Accessory dwelling unit and junior accessory dwelling unit development standards) and Chapter 17.96 (Definitions) of Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code to update accessory dwelling and junior accessory dwelling unit provisions for compliance with state law. Councilmember Alegria moved, seconded by Mayor Pro Tem Ferraro, to approve staff recommendation as follows: 1) Adopted, by a fourth-fifth’s vote of the entire City Council, Urgency Ordinance No.668 U, “AN URGENCY ORDINANCE OF THE CITY OF RANCHO PALOS VERDES AMENDING CHAPTER 17.10 (ACCESSORY DWELLING UNIT AND JUNIOR ACCESSORY DWELLING UNIT DEVELOPMENT STANDARDS) AND CHAPTER 17.96 (DEFINITIONS) OF TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO UPDATE ACCESSORY DWELLING UNIT AND JUNIOR ACCESSORY DWELLING UNIT PROVISIONS INCLUDING, BUT NOT LIMITED TO, ARCHITECTURAL AND DEVELOPMENT DRAFT City Council Regular Minutes October 18, 2022 Page 9 of 9 STANDARDS (CASE NO. PLCA2022-0004)”, as amended; and, 2) Initiated the regular code amendment proceedings to amend Chapter 17.10 (Accessory dwelling unit and junior accessory dwelling unit development standards) and Chapter 17.96 (Definitions) of Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code to update accessory dwelling and junior accessory dwelling unit provisions, including, but not limited to, architectural and development standards.
