Pilot-program correspondence received since March 15, 2022 (page B-1) BACKGROUND: In early 2022, several parents in the vicinity of Fred Hesse Jr. Community Park contacted Staff to express concerns that they could not legally teach their young children to ride bicycles at City parks. Bicycles and other non-motorized wheeled vehicles are not permitted at City Parks per Rancho Palos Verdes Municipal Code (RPVMC) §12.16.080, unless expressly allowed. Specifically, this Code section states: 12.16.080 - Use of city parks, nature preserves and recreational facilities. B. No person shall ride or drive or otherwise introduce any bicycle or other similar unmotorized wheeled device within a city park, city - owned nature preserve or city -owned recreational facility except on trails or areas that are designated by the city for bicycle use and in 1 RANCHO PALOS VERDES areas where automobiles and other motorized vehicles expressly are allowed, unless expressly authorized in writing to do so by the city manager or the city manager's designee. At its March 15, 2022, meeting, the City Council considered a variety of options for allowing bicycles and other non-motorized wheeled vehicles at certain park sites (Attachment A). The options presented to the City Council on March 15 included the following: • Removing the prohibition on wheeled vehicles in all City parks • A pilot program to allow wheeled vehicles in designated areas of Hesse Park • Limited use at designated parks • Constructing a bicycle/scooter/skateboard path at certain park sites • Bike lessons/safety instruction at special events After discussing potential options, the City Council directed Staff to develop and implement a six-month pilot program to allow non-motorized wheeled vehicles including bikes, scooters, and skateboards at three designated park sites (Eastview, Lower Point Vicente, and Fred Hesse Jr. Community Park). This direction did not require a change to the RPVMC because the City Manager is specifically authorized to permit such designated use of bicycles and other unmotorized wheeled devices per §12.16.080 of the RPVMC as noted above. The City Council directed Staff to return after six months with an analysis of the trial period. The pilot program went into effect on April 15, 2022, at Eastview Park, Lower Point Vicente Park, and Fred Hesse Jr. Community Park. The pilot program was publicized to the public via park signs, listserv messages, the City’s website and social media. Informational signs were placed at the three park sites. Tonight, Staff is presenting the City Council with an assessment of the pilot program and seeking direction on whether to permanently allow the use of non-motorized wheeled devices at the three park sites. DISCUSSION: Public Feedback Public response to wheeled vehicles in parks and the pilot program has been mixed. To date, Staff received a total of 37 emails regarding this issue: 22 in favor of the program and 15 opposed. Of those emails, 22 were received since the pilot program was approved on March 15: 10 in favor of the program and 12 opposed (Attachment B). Emails in opposition were typically from residents using the path around the upper field at Hesse Park which is popular with joggers and walkers. Those opposed focused on the possibility of collisions between wheeled vehicle users and walkers, particularly children or seniors. One email noted an observed collision involving a bicycle and a toddler, who experienced a minor abrasion. 2 Those in favor focused on the recreational advantages of allowing bicycling and similar uses in parks, particularly regarding children being able to bike safely removed from traffic on City streets. Staff Observations Staff has made regular observations at the three park sites throughout the six-month trial period. Non-motorized wheeled use has been permitted at all exterior areas of th e sites, except for the Point Vicente Interpretive Center (PVIC) rear patio, where a sign is posted stating no bikes or wheeled vehicles are allowed in the area to minimize potential accidents in that section of the facility, which is often crowded. While incidents and complaints were received by email as noted above, Staff did not observe any incidents or confrontations between users of non-motorized wheeled vehicles and other park patrons. Staff at all three locations reported that overall use has been minimal during the trial period. Hesse Park Staff reported it received a few comments from patrons that were generally not in support of allowing bikes and other wheeled vehicles in the park because of the possibility of collisions with pedestrians. Staff encouraged them to submit their comments to the City by phone or email. Permanently Allowing Non-motorized Wheeled Devices at Certain Park Sites Based on the strong level of support for the program, the low number of incidents reported during the pilot program, and Staff’s observations, the City Council is being asked to consider permanently allowing bicycles and other non-motorized wheeled vehicles at Eastview Park, Lower Point Vicente Park, and Fred Hesse Jr. Community Park. If the City Council agrees, the RPVMC does not need to be amended because of the provision that authorized the City Manager to designate such use per §12.16.080 of the RPVMC. If approved, existing signs will be updated at the three locations to indicate that bicycles and other non-motorized wheeled vehicles are now allowed on a permanent basis. This change will be publicized via listserv messages, the City’s website, the City’s quarterly newsletter, and social media. Staff will continue to monitor and observe usage, record any accidents and incidents that may occur, and interact with the public to address any concerns. If incidents between users at these three park sites rise to a level of concern based on Staff observations or reports submitted to the City, Staff will come back to the City Council with proposed recommendations, including, but not limited to, reverting back to the prohibition at one or all three park sites. CONCLUSION: Staff recommends the City Council allow bicycles and other non-motorized wheeled vehicles at Eastview Park, Lower Point Vicente Park, and Fred Hesse Jr. Community Park on a permanent basis. ALTERNATIVES: In addition to the Staff recommendation, the following alternative actions are available for the City Council’s consideration: 3 1. Extend the six-month pilot program, with or without modifications. 2. End the pilot program and prohibit the use of bicycles and other non-motorized wheeled vehicles in all City parks. 3. Hesse is my favorite walking area in Palos Verdes and I am there many times each week. It was with great relief that we welcomed the ban on bicycles in 1984 as it was often treacherous to walk there. To read in Thursday's newspapers that the City Council has decided to lift the ban on bicycles, scooters, skateboards "and the like," is completely mystifying. The park is extremely popular, not only with seniors but with younger folks who bring their small dogs to walk there daily. It is a very special place for those who are recovering from strokes and other ailments as we frequently see folks in walkers who are attended by a companion who is overseeing their walking. On many occasions, the park is so crowded that Anne finds it necessary to walk the Lower Hesse Park to avoid the huge crowds. To imagine bicycles, scooters, runaway skate boards and skates "and the like" on the trail there is inconceivable . Very often, even with the ban, I have encountered young people on their bikes or skateboards or scooters who have absolutely no thought about the danger they are presenting to those of us walking. They simply zoom on by or fall off or allow their out of control skateboard to do whatever it will do. When I have indicated that these items are not permitted at the park, I have not seen resistance from either parents or children as children have been very respectful and understood this was not the place for this activity. I am completely in favor of finding the right location for young people; however, the ban was put in place in 1984 for a reason . The population has vastly increased since 1984 and the park is immensely popular. Please revoke your decision to lift the ban. When they were developing plans to develop lower Hesse Park, one of the proposed ideas was a paved area/circle for young children to learn to ride bikes. That idea was not adopted unfortunately; that would have solved the problem being raised regarding the need to provide young children a flat place to ride. I frequently ride my bike along the beach bike path and I see how chaotic it is for all the groups using the bike path, especially in Hermosa Beach, where there is no separate walking paths . Walkers aren't happy and cyclists aren't happy. My 90 year old mom uses a walker and we occasionally walk at Hesse . I will be very concerned for her safety when they allow this . I think elderly walkers will have to walk at Hesse early in the morning, before young moms get there with their youngsters and bikes arrive, and certainly before kids arrive once they're done with their school day. Walking along the path at sunset could be chaotic. Keeping my fingers crossed that no one gets injured . Young children recover quickly from falls and other injuries, older folks don't . When I first learned of the new rule that allows bikes, scooters, roller skates, etc. I was actually happy since my kids are always looking to ride their bikes and scooters . That said yesterday, Easter Sunday, I witnessed two elderly people startled terribly by a kid riding a bike behind them and swerving around them on the narrow path around the Park. They did not fall to the ground but they stumbled and it could have been much worse . I understand and respect what got us here, in an ideal world it is wonderful to let the kids use the park for scooters and bikes but I am concern for the older people (and quite honestly even people who could be on the phone or listening to music). The paths are narrow, it is two way traffic and there are so many variable on how poorly this could go. Beyond people's health, as a local tax payer I am concerned if someone gets hurt that they will hold the City liable and this would impact what I pay for my taxes . I have never written to your office before but I wanted to reach out as this is a new rule and already seems to be dancing with danger. Dogs' leashes are allowed to be 6 feet in a five-foot walkway, meaning one dog walker will take up the walkway. People often walk together, and a couple will take up the entire walkway. "The City Council directed staff to explore a long-term solution on how to address safety for walkers and other users and to look at how neighboring cities address the issue of balancing safety at parks." If you want non motorized vehicles and pedestrians to interact safely, then you will need to widen the walkway and put a painted line in. I tried to report it but the doors were locked, lights off & no response when I knocked. I found a park employee fixing the water faucet & he said he'd call the Rangers. As a tax paying citizen & resident of RPV, I would appreciate the park getting cleaned up & mowed. Please rescind the new rule allowing bikes etc. before someone gets hurt. My son's leg was caught by the front wheel, causing an abrasion, lots of tears, and perhaps more lasting - a lost sense of safety in our beloved park. An elderly woman stopped to confide in me that she herself was scared to walk around the park now, and had some choice words about it. Within this same span of two minutes, an older man fell to the ground, as he lost his balance when another skateboarder whizzed past him. I am normally very tolerant, and believe the parks are for everyone, but experiencing this concentrated train wreck prompted me to speak up. This trial is a mistake. I know only non-motorized mountain bikes are allowed in the Preserve and observed people one-bikes on the trails in Portuguese Nature Preserve last month. I yelled at one but it didn't do any good as he was wearing ear-pods and blew right past me. Even though there are signs posted people disregard them knowing they won't get caught as we only have so many Rangers to monitor this area. My other concern is there is an E-Bike store (Pedego) coming soon at the Peninsula Center across from Ulta. There should be a discussion with these people regarding no E-bikes or pedal assisted bikes are allowed in the PB Nature or San Ramon Preserves so we don't have user conflicts (equestrians) that closed down many of the trails we real mountain bikers used to ride in the preserve. I also hope that due to the amount of complaints regarding the irresponsible attitude of kids one-bikes showing total disregard for motor vehicle traffic, the management will take responsibility to educate E-bike buyers and encourage them to obey all traffic laws. Regarding the post mentioning a permit after the pilot program has expired; this is false. There are no plans for any permit (for a fee or free) of any kind associated with this pilot program. The second topic is bikes and electronic bikes (e-bikes) on public trails. Mountain bikes (non-motorized) are allowed on certain trails within the Preserve and they are allowed in the parks listed in the pilot program. However, the topic of e- bikes was discussed in depth by the City Council and decided that within the Palos Verdes Nature Preserve, no classification of e-bikes is permitted (Class 1, 2 or 3), which includes the trails in parks. There is signage in place at several trailheads which indicates no e-bikes are permitted. I hope this information helps and I will speak to our public information staff to see if another post clarifying the pilot program can be sent again. One youngster attempting to pass me on my walker, sped by too closely so that his bike handles injured my side and wrist. I called the park attendant who said there was nothing he could do. Everyone must be able to use the park's excellent facilities in safety, and common sense rules must be enforced. Since safe and courteous use by bikers and children on scooters cannot be enforced and are endangerment to others, then I would offer my objection to the continuance of their use at Hesse Park after the October permission deadline expires. BCKGROUND AND RATIONALE: Centuries ago as population density began to increse in towns and cities, it became obvious that traffic moving at differnt speeds should not be mingled in streets or roads. Pedestrians and horses would get into each others way, and at worst collide. Thus at public or enforced private expense sidewalks were installed to segregate the low and higher speed traffic. In our own times it was recogonized that there needed to be a three-way division of streets and roads to separate high speed (motor vehicles), low speed (pedestrians), and mid speed (bicycles). Hence the widespread carve out of bicycle lanes between the sidewalks and the road. I am a frequent visitor to Hesse Park and enjoy walking around the paved pathway. In the past several months I have witnessed and experienced the conflict between pedestrians (walkers, joggers) and bicycles ridden often recklessly by pre-teen children. The pavement is only about 5 feet wide which precludes marking off a bicycle lane. Since there is no practical way of enforcing a speed limit, simply ban the bicycles from the walkways. Together with our friends, we often go to the Park for our daily walks. The circular, leveled trail, makes it very easy for people to just stroll around multiple times. The walking path is narrow, just enough to accommodate two persons, side by side. We often see lots of people, old and young who take walks, and it's a great park for that.. If we are to have kids with bicycles, scooters or other non-motorized vehicles in such a narrow path, it would be such a hazard for the elderly and the young ones as well. There is simply not enough room to accommodate everyone. I would be very concerned for the elderly who use walkers or canes; they can be knocked down very easily by young children running around. Hi, My husband and I just moved to PV six weeks ago, and Hesse Community Park has quickly become a favorite with our two year old. We haven’t ever been at Hesse before wheeled things were allowed, so I’m not sure how much different it was, but as I saw a dad with his four year old learning to master his little scooter and just overjoyed at the process, I can’t help but think that that family’s Hesse park experience has been substantially improved by allowing kids their wheeled vehicles. Obviously I have a vested interest in it becoming more permanent since I’d love to be able to have Hesse park be where my daughter can become more comfortable on a bike or scooter too, when she’s ready next year. We’ve been easily a dozen times since the end of August, and every time there’s been a kid on a scooter or bicycle having a blast, and I’m sure it eases parents’ minds knowing they’re not going to get hit by a car backing out of their driveway or run off a sidewalk into traffic.
