CC DM 20220906 B - 20220816 CC MINS DRAFTDRAFT MINUTES RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING AUGUST 16, 2022 CALL TO ORDER: A Regular Meeting of the Rancho Palos Verdes City Council was called to order by Mayor Bradley at 6:03 P.M. at Fred Hesse Community Park, McTaggart Hall, 29301 Hawthorne Boulevard. This meeting took place remotely in accordance with Government Code section 54953(e) et seq. (AB 361) and Resolution 2021-59, adopted by the City Council on November 16, 2021. Members of the public could observe and participate using the zoom participation feature, and with options called out in the public participation form provided under separate cover with the agenda. Notice having been given with affidavit thereto on file. City Council roll call was answered as follows: PRESENT: Cruikshank, Ferraro, and Mayor Bradley ABSENT: Alegria* (excused, in Fireside Room); and Dyda* (excused, in Fireside Room) Also present were Ara Mihranian, City Manager; Karina Bañales, Deputy City Manager; Elena Gerli, Assistant City Attorney; Ramzi Awwad, Director of Public Works; and Teresa Takaoka, City Clerk. PUBLIC COMMENTS FOR CLOSED SESSION: None. CLOSED SESSION ITEM(S) ANNOUNCED: Assistant City Attorney Gerli announced the item to be discussed in Closed Session. 1. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION A closed session will be held, pursuant to Government Code § 54956.9(d)(4), because the City is considering whether to initiate litigation in one (1) case. At 6:04 P.M., the Council recessed to Closed Session. *At 6:04 P.M. Councilmember Alegria and Councilmember Dyda joined Closed Session in the Fireside Room. ROLL CALL: City Council roll call was answered as follows: PRESENT: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley ABSENT: None Also present were Ara Mihranian, City Manager; Karina Bañales, Deputy City Manager; Elena Gerli, Assistant City Attorney; Trang Nguyen, Director of Finance; Ken Rukavina, Director of Community Development; Cory Linder, Director of Recreation and Parks; Ramzi Awwad, Director of Public Works; Daniel Trautner, Deputy Director of Recreation and Parks; Jaehee Yoon, Senior Planner; Jesse Villalpando, Senior Administrative Analyst; Katie Lozano, Senior Administrative Analyst; and Teresa Takaoka, City Clerk. Also present was Captain Powers from the Lomita Sheriff Station. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Director of Public Works Awwad. CLOSED SESSION REPORT: Assistant City Attorney Gerli reported that the City Council met in Closed Session to discuss one item on the agenda because the City is considering whether to initiate litigation in one (1) case. This item was discussed, and no reportable action was taken. MAYOR’S ANNOUNCEMENTS: Mayor Bradley reported that the Metropolitan Water District announced today that residents will be asked to restrain from outside water use for a two-week period beginning September 6 through September 20 to make necessary repairs on a pipeline. RECYCLE AND EMERGENCY PERSONAL PREPAREDNESS KIT DRAWING: Mayor Bradley announced the Recycle Winners for the August 2, 2022, City Council meeting: Jon Davis and Anthony Todora. He indicated that all winners receive a check for $250 and urged everyone to participate in the City’s Recycling Program. He noted that in addition to winning the Recycler Drawing, the two individuals also won a Personal Emergency Preparedness Kit from the City valued at $40.00. The following member of the public addressed the City Council: Mickey Rodich. CITY MANAGER REPORT: City Manager Mihranian provided updates on the following: August 4 Sister City Second Anniversary Celebration with Sakura City, Japan; Basketball Open Gym every Sunday from August 7 through October 9 at Miraleste Intermediate School; LA Unified School District has returned to school starting Monday, August 15 and the Palos Verdes Peninsula Unified School District will return to school on Wednesday, August 24; the next events at the Civic Center will be Summer Concerts in the Park on August 27 with a country music cover band, Country Vision, and an 80’s cover band , PT and the Cruisers, on September 10; and City Hall will be closed on Monday, September 5 due to Labor Day. City Clerk Takaoka notified Mayor Bradley that there was one additional request to speak under Public Comments for Non-Agenda Items. The following member of the public addressed the City Council: Craig Cadwallader. CONSENT CALENDAR: City Clerk Takaoka reported that late correspondence was received for Items G and H, and there was one request to speak on Item E. Councilmember Alegria moved, seconded by Councilmember Cruikshank, to approve the Consent Calendar with Item E to be considered immediately after Consent Calendar. Registers of Demands (Mata) 1) Adopted Resolution No. 2022-50, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID(Check run dated 7/22/22); and, 2) Adopted Resolution No. 2022-51, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID (Check run dated 8/5/22). D. Consideration and possible action to continue implementing Assembly Bill No. 361 (AB 361) authorizing teleconferencing of meetings of legislative bodies for the month of September 2022. (Zweizig) 1) Adopted Resolution No. 2022-52, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, RE-RATIFYING THE PROCLAMATION OF A STATE OF EMERGENCY BY GOVERNOR NEWSOM ON MARCH 4, 2020 AND RE-AUTHORIZING REMOTE TELECONFERENCE MEETINGS OF THE LEGISLATIVE BODIES OF THE CITY OF RANCHO PALOS VERDES FOR THE PERIOD BEGINNING SEPTEMBER 1, 2022 THROUGH SEPTEMBER 30, 2022, PURSUANT TO THE RALPH M. BROWN ACT AND ASSEMBLY BILL NO. 361; and, 2) Authorized Staff to continue conducting, as warranted, City Council and Planning Commission public meetings using a combination in-person/virtual (hybrid) platform and continue conducting virtual-only meetings or a combination in-person/virtual (hybrid) platform, if warranted, for the City’s five Committees (Civic Center Advisory, Emergency Preparedness, Finance Advisory, Infrastructure Management Advisory, Traffic Safety) subject to the Brown Act in accordance with the requirements of AB 361; and return with extension resolutions for the City Council’s consideration every 30 days as the same may be warranted. E. Consideration and possible action to adopt Ordinance No. 661 adding Chapter 8.22 (Single-use Foodware Accessories) of Title 8 (Health and Safety) of the Rancho Palos Verdes Municipal Code regulating the use of single-use foodware accessories. Consideration and possible action to adopt an ordinance prohibiting the unlawful possession of catalytic converters. (Bright) Adopted Ordinance No. 660, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES ADDING CHAPTER 9.36 (UNLAWFUL POSSESSION OF CATALYTIC CONVERTERS PROHIBITED) TO TITLE 9 (PUBLIC PEACE, MORALS, AND WELFARE) OF THE RANCHO PALOS VERDES MUNICIPAL CODE. G. Consideration and possible action to approve two professional services agreements for RPVtv for producing, programming, and editing services. (Bañales) 1) Awarded an agreement with Jeff Koven for filming, programming, and editing services not to exceed $120,000 for an approximately three-year term ending on June 30, 2025; 2) Awarded an agreement with Maria Serrao for on-air reporting and interviewing, producing, and editing services not to exceed $138,000 for an approximately three-year term ending on June 30, 2025; and, 3 Authorized the Mayor to execute the agreements in a form approved by the City Attorney, as amended. H. Consideration and possible action to approve a contract services agreement for the printing of the City’s quarterly newsletters and recreation inserts in Fiscal Year 2022-23. (Waters) 1) Awarded a professional services agreement with Marina Graphic Center for the production of the City’s quarterly newsletters and recreation inserts in FY 2022 -23 in an amount not to exceed $42,364 for a period of one year that may be extended by two additional one-year terms by the City Manager; and, 2) Authorized the Mayor to execute the agreement in a form approved by the City Attorney. I. Consideration and possible action to send a letter regarding the Acting State Auditor’s Report on the Regional Housing Needs Assessments. (Wynder) Authorized sending the attached letter, to be signed by all members of the City Council, to the Governor, Legislative Leaders, and the Director of the California Department of Community Development Regarding the Acting State Auditors Report No. 2021-125 on the Failures in the Recently Issued Regional Housing Needs Assessments by the Department of Housing and Community Development. CONSENT CALENDAR ITEM(S) PULLED FOR PUBLIC COMMENT: E. Consideration and possible action to adopt Ordinance No. 661 adding Chapter 8.22 (Single-use Foodware Accessories) of Title 8 (Health and Safety) of the Rancho Palos Verdes Municipal Code regulating the use of single-use foodware accessories. Mayor Pro Tem Ferraro moved, seconded by Councilmember Alegria, to approve staff recommendation as follows: Adopted Ordinance No. 661, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, ADDING CHAPTER 8.22 (SINGLE-USE FOODWARE ACCESSORIES) OF TITLE 8 (HEALTH AND SAFETY) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO REGULATE THE USE OF SINGLE-USE FOODWARE ACCESSORIES. The motion passed on the following roll call vote: AYES: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley NOES: None PUBLIC HEARINGS: 1. Consideration and possible action to amend Chapter 16.40 (Urban Lot Splits), Chapter 17.09 (Second Units and Two-Unit Developments in Single-Family Zones) and Chapter 17.96 (Definitions) of the Rancho Palos Verdes Municipal Code regarding urban lot splits and second units and two-unit developments in single-family residential zones (Case No. PLCA2022-0001). (Yoon) City Clerk Takaoka reported that the notice of the public hearing was duly published, no written protests were received, late correspondence was distributed, and there were no requests to speak. Mayor Bradley declared the public hearing open. Director of Community Development Rukavina introduced Senior Planner Jaehee Yoon who presented a staff report and PowerPoint presentation and notified Council that Aleshire and Wynder Attorney Brian Wright-Bushman was available for questions. Council Members asked questions of Staff. Mayor Bradley declared the public hearing closed. Discussion ensued among Council Members, City Manager Mihranian, Staff, Assistant City Attorney Gerli and Attorney Wright-Bushman. Mayor Bradley moved, seconded by Councilmember Alegria, to continue the Public Hearing to the September 20, 2022 to allow staff time to make changes to the draft ordinance as it pertains to a courtesy notice that includes HOAs, required DRAFT City Council Regular Minutes August 16, 2022 Page 7 of 9 Conditional Use Permit cited language, to include the word “driveway approaches” for clarification purposes and add “or encroachments”, and requiring 50% of the units to be affordable or provide affordable housing units within the City. Consideration and possible action receive a presentation from the California Department of Insurance. (Villalpando) City Clerk Takaoka noted that late correspondence was distributed, and there w as one request to speak. Senior Administrative Analyst Jesse Villalpando presented a staff report and introduced California Department of Insurance representative Zuleimy Delgadillo, Outreach Analyst, who presented a PowerPoint presentation. Council Members asked questions of California Department of Insurance representative Zuleimy Delgadillo. The following member of the public addressed the City Council: Larry Maizlish. Discussion ensued among Council Members. Councilmember Cruikshank moved, seconded by Mayor Pro Tem Ferraro, to approve staff recommendation as follows: Received and filed the presentation from the California Department of Insurance on the Safer from Wildfires program and on community concerns regarding fire insurance. Consideration and possible action to receive the Palos Verdes Peninsula Land Conservancy’s 2019-2021 Comprehensive Report and the 2021 Annual Report on its management activities for the Palos Verdes Nature Preserve. Director of Recreation and Parks Linder introduced Senior Administrative Analyst Katie Lozano who presented a staff report and PowerPoint presentation. Councilmember Alegria moved, seconded by Mayor Pro Tem Ferraro, to approve staff recommendation as follows: Received and filed the 2019-2021 Comprehensive Report and the 2021 Annual Report submitted by the Palos Verdes Peninsula Land Conservancy on its management activities for the Palos Verdes Nature Preserve. The motion passed on the following roll call vote: AYES: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley NOES: None 4. Consideration and possible action to receive a status report on the ParkMobile parking system along Crenshaw Boulevard south of Crest Road. Director of Recreation and Parks Linder provided a brief staff report and PowerPoint presentation and introduced Deputy Director of Recreation and Parks Daniel Trautner who presented an additional PowerPoint presentation. Council Members asked questions of Staff. Councilmember Alegria moved, seconded by Mayor Pro Tem Ferraro, to: Receive and file the six-month status report on the ParkMobile parking system; and, directed Staff to return on October 4, 2022 with options that utilize real-time parking reservations.
