CC RES 2022-060 RESOLUTION NO. 2022-60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, APPLYING TRAFFIC AND PARKING PROVISIONS OF THE CALIFORNIA VEHICLE CODE TO CERTAIN PRIVATELY OWNED AND MAINTAINED ROADS WITHIN THE PORTUGUESE BEND COMMUNITY ASSOCIATION WHEREAS, on July 18, 2022, a Petition was submitted to the City of Rancho Palos Verdes requesting the City Council hold a public hearing to determine whether the interests of any residents along certain privately owned and maintained roads within the City of Rancho Palos Verdes and the motoring public would be best served by application of the provisions of the California Vehicle Code to such roads; and WHEREAS, such action was taken by a majority of the Board of Directors of a common interest development commonly known as the Portuguese Bend Community Association; and WHEREAS, a public hearing thereon was held by the City Council on November 1, 2022, upon 10 days prior written notice to all owners of such roads, pursuant to the provisions of Section 21107.7 of the California Vehicle Code. NOW, THEREFORE, the City Council of the City of Rancho Palos Verdes DOES HEREBY DECLARE, FIND, AND RESOLVE as follows: Section 1: The foregoing recitals are true and correct and are incorporated herein by reference. Section 2: The privately owned and maintained roads within the City of Rancho Palos Verdes as named in Exhibit "A" within the Portuguese Bend Community Association, attached hereto and incorporated herein by this reference, which are not generally held open for use of the public for vehicular travel but by reason of their proximity to or in connection with public highways, the interests of any residents residing along such roads, and the motoring public would be best served by application of the provisions of the California Vehicle Code. Section 3: The Vehicle Code shall apply to such roads, provided appropriate signs are erected by the private road owner at the entrances to such roads, of such size, shape, and color as to be readily legible during daylight hours from a distance of 100 feet, indicating the road is subject to the provisions of the California Vehicle Code. Section 4: The City Clerk shall certify to the passage, approval, and adoption of this resolution, and shall cause this resolution and its certification to be entered in the Book of Resolutions of the City Council of the City. The above list is intended to illustrate, in general terms, the locations of the PBCA private roads intended for general public use as opposed to driveways or dirt paths.
