CC MINS 20220802 MINUTES RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING AUGUST 2, 2022 CALL TO ORDER: A Regular Meeting of the Rancho Palos Verdes City Council was called to order by Mayor Bradley at 6:04 P.M. at Fred Hesse Community Park, McTaggart Hall, 29301 Hawthorne Boulevard. This meeting took place remotely in accordance with Government Code section 54953(e) et seq. (AB 361) and Resolution 2021-59, adopted by the City Council on November 16, 2021. Members of the public could observe and participate using the zoom participation feature, and with options called out in the public participation form provided under separate cover with the agenda. Notice having been given with affidavit thereto on file. City Council roll call was answered as follows: PRESENT: Cruikshank, Dyda, and Mayor Bradley ABSENT: Alegria (excused), Mayor Pro Tem Ferraro *(excused, in Fireside Room) Also present were Ara Mihranian, City Manager; Karina Banales, Deputy City Manager; William Wynder, City Attorney; Director of Community Development, Ken Rukavina, and Teresa Takaoka, City Clerk. PUBLIC COMMENTS FOR CLOSED SESSION: None. CLOSED SESSION ITEM(S) ANNOUNCED: City Attorney Wynder announced the items to be discussed in Closed Session. 1. CONFERENCE WITH LEGAL COUNSEL—ANTICIPATED LITIGATION A closed session will be held, pursuant to Government Code § 54956.9(d)(4), because the City is considering whether to initiate litigation in one (1) case. 2. CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION A closed session will be held, pursuant to Government Code § 54956.9(d)(1), to confer with legal counsel regarding pending litigation to which the City is a party. The title of such litigation is as follows: City of Rancho Palos Verdes v. CONFERENCE WITH LEGAL COUNSEL — EXISTING & ANTICIPATED LITIGATION A closed session will be held, pursuant to Government Code § 54956.9(d)(1) & (4), to confer with legal counsel regarding pending litigation & a request from the County of Los Angeles whether the City of Rancho Palos Verdes wishes to join in the same as a party defendant. The title of such litigation is as follows: Southern California Edison v. State Board of Equalization, Orange County Superior Court Case No. 30-2022-01258057. 4. CONFERENCE WITH LEGAL COUNSEL— EXISTING LITIGATION A closed session will be held, pursuant to Government Code § 54956.9(d)(1), to confer with legal counsel regarding pending litigation to which the City is a party. The title of such litigation is as follows: In Re National Prescription Opiate Litigation, United States District Court for the Northern District of Ohio, Eastern Division Case No. MDL-2804. City Council Regular Minutes August 2, 2022 Page 2 of 9 PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember Cruikshank CLOSED SESSION REPORT: City Attorney Wynder reported that the City Council met in Closed Session and considered litigation in one case; it was a privileged and confidential briefing. City Council directed Staff and City Attorney's office to draft'a letter to the Governor's office regarding issues on which the City is considering initiating litigation, and this item will be on the next agenda for consideration and signature by all five Council Members. The second item was a matter of litigation to which the City is a party. The City of Rancho Palos Verdes vs. Indian Peak Properties. City Attorney Wynder reported that the Los Angeles Superior Court ordered Indian Peak Properties to abate their public nuisance and remove their antenna farm from the residence. The property will be inspected by the City to confirm that in all particular details, the judgment of the Los Angeles County Superior Court has been fully satisfied. The third item, the City Attorney, provided a privileged and confidential briefing on the litigation involving Southern California Edison on the State Board of Equalization. The City Council directed the City to not at this point to join as a party, but to monitor the litigation and to periodically report back to the City Council on significant developments in the same. Lastly, on item four with respect to the National Prescription Opioids litigation settlement agreement, the City Council directed that the City Manager to not accept the first round of settlement distribution money for the first of fifteen years of such distributions. MAYOR'S ANNOUNCEMENTS: Mayor Bradley shared that this evening's meeting will be adjourned in memory of Jonathan Candela, a local resident who recently passed away. Mayor Bradley and Councilmember Cruikshank attended his funeral. Mr. Candela was a recent graduate of Palos Verdes Peninsula High School. RECYCLE AND EMERGENCY PERSONAL PREPAREDNESS KIT DRAWING: Mayor Bradley announced the Recycle Winners for the July 19, 2022, City Council meeting: Piyush Karia and Vincent DiLeva. He indicated that all winners receive a check for $250 and urged everyone to participate in the City's Recycling Program. He noted that in addition to winning the Recycler Drawing, the two individuals also won a Personal Emergency Preparedness Kit from the City valued at $40.00. D. Consideration and possible action to designate voting delegate alternates for the upcoming Cal Cities Annual Business Meeting. (Takaoka) Designated Mayor Bradley and City Manager Mihranian as the first and second voting delegate alternates for the Cal Cities Annual Business Meeting scheduled for September 9, 2022, in the event Councilmember Cruikshank, the voting alternate, is unable to attend. Consideration and possible action to adopt Ordinance No. 659 to amend Section 12.20.030 (Special Events Definitions) of Title 12 (Streets, Sidewalks and Public Places) of the Rancho Palos Verdes Municipal Code. (Waters) Adopted Ordinance No. 659, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, AMENDING SECTION 12.20.030 (DEFINITIONS) OF CHAPTER 12.20 (SPECIAL EVENT PERMITS) OF TITLE 12 (STREETS, SIDEWALKS AND PUBLIC PLACES) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO INCLUDE A DEFINITION STATING THAT PUBLIC PROPERTY SHALL MEAN AND INCLUDE ALL CITY OWNED OR CONTROLLED REAL PROPERTY, INCLUDING BUT NOT LIMITED TO STREETS AND SIDEWALKS, PARKS, THE PALOS VERDES NATURE PRESERVE, AND FACILITIES, AS WELL AS ANY EASEMENTS OVER PRIVATE PROPERTY FOR THE BENEFIT OF THE PUBLIC. (Bright) Authorized the Mayor to sign a letter to the California Public Utilities Commission (CPUC) Local Agency Technical Assistance (LATA) grant program in support of the South Bay Cities Council of Governments' (SBCCOG) application to help fund planning for the South Bay Fiber Network extension. G. Consideration and possible action to authorize the Mayor to sign a letter requiring accessory dwelling units (ADUs) be used for affordable housing. (Bright) Authorized the Mayor to sign a letter to state legislative leadership in support of legislation which would require ADUs be used for affordable housing. H. Consideration and possible action to approve Amendment No. 2 to the professional services agreement with Infinity Technologies for geographic information systems (GIS) support services. (Garrett) 1)Authorized Amendment No. 2 to the professional services agreement with Infinity Technologies to extend the term of the agreement for GIS support services from August 30, 2022 to June 30, 2023, and increase the contract sum by $65,000 from $42,050 to $107,050, in a form approved by the City Attorney; and, 2) Authorized the Mayor and City Clerk to execute the amendment. Consideration and possible action to receive a status update on the Forrestal Reserve Parking and Traffic Management Plan. Consideration and possible action to introduce an ordinance prohibiting the unlawful possession of catalytic converters.
