California Department of Finance Price Factor and Population Information (page C-1) BACKGROUND: In coordination with the adoption of the annual budget, the City follows statewide guidelines to calculate the Gann appropriation limit. In November 1979, under Article XIIIB of the California Constitution (the Gann Spending Limitation Initiative), California governmental agencies are restricted as to the amount of annual appropriations from the proceeds of taxes. The appropriation limit establishes a ceiling on the amount of tax revenue the City can receive and appropriate for spending each year. The amount is 1 adjusted each year using inflationary and population growth statistics provided by the California Department of Finance. In addition to the guidelines, Section 1.5 of Article XIIIB of the California Constitution, the annual calculation of the appropriations limit, is subject to an agreed-upon procedures review in connection with the annual audit. DISCUSSION: Staff has completed the Gann limit calculation for the City for FY 2022-23. The adoption of the attached resolution (Attachment A) would establish the City’s FY 2022-23 appropriation limit at $36,291,352. The calculation of the limit is based upon the foregoing factors and the provisions of Article XIII B of the Constitution of the State of California. In addition, the calculation for the Appropriation Limit for FY 2022 -23 also comprises of corrections to the limits in FY 2020-21 for $32,431,834 and $33,984,996 for FY 2021-22 (Attachment A). The corrections increased the City’s appropriation limits by $1,130,425 and $1,184,561, respectively. As such, Staff seeks City Council acceptance to rescind Resolution Nos. 2020-35 and 2021-25 to correct the worksheet that contained formula errors which was used to adopt the appropriations limit. Though, it is important to note that the corrected limits had no fiscal impact as the proceeds of taxes for FY 2021-22 was $23,621,500, and $24,285,400 for FY 2022-23, which are well below the corrected limits. Staff has improved the calculation process to avoid the same error in the future. CONCLUSION: Based on the proposed budget of $28,333,280 for proceeds from taxes, the City is following the Gann limit, falling below 78% of the appropriation limit (Attachment B). ALTERNATIVES: In addition to the Staff recommendation, the following alternative actions are available for the City Council’s consideration: 1. Do not adopt the attached resolution and provide Staff with direction for consideration at a future meeting. 2. Take other action, as deemed appropriate. 2 RESOLUTION NO. 2022-__ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RESCINDING RESOLUTION NOS. 2020-35 AND 2021-25 AND ESTABLISHING THE FISCAL YEAR 2022-23 APPROPRIATION LIMIT FOR THE CITY OF RANCHO PALOS VERDES AT $36,291,352 WHEREAS, the City of Rancho Palos Verdes has established its Appropriation Limit of $36,291,352 (Thirty-Six Million Two Hundred Ninety-One Thousand Three Hundred Fifty-Two Dollars) for FY 2022-23; and, WHEREAS, by a letter, dated May 2022, the California Department of Finance has provided the following factors relevant to the calculation of the Appropriation Limit for FY 2022-23: California Per Capita Personal Income change: 7.55% (Seven Point Fifty-Five Percent) County of Los Angeles Population Adjustment: -0.71% (Negative Zero Point Seventy-One Percent) WHEREAS, the City’s Finance Staff has calculated the Appropriation Limit for FY 2022-23 based upon the foregoing factors and the provisions of Article XIII B of the Constitution of the State of California. In addition, the calculation for the Appropriation Limit for FY 2022-23 comprises of corrected limits in FY 2020-21 for $32,431,834 and FY 2021-22 of $33,984,996. The corrections increased the City’s appropriation limits by $1,130,425 and $1,184,561 respectively. The corrected limits had no fiscal impact as the adopted budget for operating revenues for FY 2021 -22 and FY 2022-23 were well below the corrected limits. The working papers supporting the calculation are maintained in the files of the Finance Department within the City. WHEREAS, the Appropriation Limit for the City of Rancho Palos Verdes establishes the ceiling for which proceeds from taxes can be appropriated during FY 2022-23. NOW BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES: Section 1: The Appropriation Limit of the City of Rancho Palos Verdes is of $36,291,352 (Thirty-Six Million Two Hundred Ninety-One Thousand Three Hundred Fifty- Two Dollars) for FY 2022-23. May 2022 Dear Fiscal Officer: Subject: Price Factor and Population Information Appropriations Limit California Revenue and Taxation Code section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments. Each local jurisdiction must use their percentage change in population factor for January 1, 20 22, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2022-23. Attachment A provides the change in California’s per capita personal income and an example for utilizing the price factor and population percentage change factor to calculate the 2022-23 appropriations limit. Attachment B provides the city and unincorporated county population percentage change. Attachment C provides the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations. Population Percent Change for Special Districts Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code section 2228 provides additional information regarding the appropriations limit. Article XIII B, section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. The code section and the California Constitution can be accessed at the following website Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits. Population Certification The population certification program applies only to cities and counties. California Revenue and Taxation Code section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller’s Office.
