CITYOF RANCHO PALOS VERDES
BACKGROUND:
The property owners at 20811 Lobrook Drive and 31054 Hawksmoor Drive recently hired
the same contractor for the remodeling and improvements of their single-family
residences, including paying and obtaining the necessary building permits. However, no
permits were obtained from the City for any of the improvements, and the property owners
were provided with permits that appeared to be issued by the City, but were not. The
property owners for both properties had assumed the permits containing the City logo
(Attachment C) were legitimate, and they had no intention of violating the California
Building Code and/or the Rancho Palos Verdes Municipal Code (RPVMC). The matter
came to light in fall 2021, when Code Enforcement Staff observed unpermitted
construction and roofing at 20811 Lobrook Drive, and Building Inspection Staff observed
unpermitted construction at 31054 Hawksmoor Drive.
Pursuant to RPVMC § 15.18.040, when work requiring a permit has been started prior to
obtaining a permit, the penalty is equal to triple the permit fees. In the case of the two
subject properties, permits had to be issued after-the-fact, thereby incurring the penalty.
As a result, the property owners suffered a significant financial loss. Each had to hire a
new contractor to obtain official building permits, which included after-the-fact penalties
in the amount of $26.071.46 for 28011 Lobrook Drive and $21,589.02 for 31054
Hawksmoor Drive.
The property owners have requested waivers of all after-the-fact penalties as they always
intended the improvements to be constructed in accordance with all City requirements
and rectified the matter as soon as it was brought to their attention.
Tonight, Staff is presenting their after-the-fact penalty fee waiver requests to the City
Council for consideration. Staff recommends the City Council approve the requests, as
the applicants have adequately demonstrated financial hardship.
DISCUSSION:
The Community Development Department is processing two unique cases where two
property owners have hired the same state-licensed contractor to perform a full remodel
of their homes. Each property owner relied on the contractor to obtain the required City
building permits and fulfill their permitting obligations to remodel their homes. Both
property owners were charged for obtaining applicable permits by the contractor,
including application and permit; however, the City has no records of any such permits
being applied for or issued. The property owners were provided with what appeared to be
fake permits that included the City logo and assumed the permits were legitimate.
The City issued stop-work orders upon discovering the unpermitted work, initiated Code
Enforcement cases, and mailed notices of violation to the property owners, as outlined in
the Case History (Attachment C). Through the course of correcting the violations, the

property owners retained the services of different contractors to apply for and obtain the
applicable legitimate building permits from the City. Because these permits were issued
“after-the-fact,” applicable penalties were charged, in the amount of three times the permit
fee, pursuant to RPVMC § 15.18.040.
Due to the unusual circumstances, both property owners have requested the after-the-
fact penalty fees be waived (Attachment A). Pursuant to RPVMC § 17.78.010(B)(3), the
City Council may grant a request to waive the penalties associated with a development
application if it finds that the “applicant has demonstrated a financial hardship, as
determined by the City Council, on a case-by-case basis.”
As described in the attachments, Mr. Sato, property owner of 28011 Lobrook Drive, states
that the additional cost of $26,071.46 for the after-the-fact penalty to obtain the building
permits is an unexpected financial hardship and an unforeseen expenditure and has also
provided evidence of the financial hardship. The total cost to obtain the building permits
for the project without penalties applied would have totaled $18,299.46; with penalties
applied the total cost is $44,370.92.
Ms. Streit, property owner of 31054 Hawksmoor Drive, also states that the additional cost
of $21,589.02 for the penalty to obtain after-the-fact building permits as required by the
RPVMC is an unexpected financial hardship and the unforeseen expenditure and has
also provided evidence of the financial hardship. The total cost to obtain the building
permits for the project without penalties applied would have totaled $14,665.66 ; with
penalties applied the total cost is $36,254.68.
Staff has reviewed the merits of both requests and believes that the applicants’ requests
for waivers of the penalties is warranted, not only based on financial hardship but also
based on the unique circumstances surrounding these cases.
The property owners have been advised of the City Council’s consideration of this request
at tonight’s meeting and have been provided with a copy of the staff report.
City Staff have developed a Scam Alert flyer (Attachment D) advising residents how to
verify a contractor license, both on a state and local level, how to verify permits are
legitimate, and how to read permits, as well as providing useful links on the City website.
This flyer has also been distributed via listserv, social media, and the City website by the
City’s public information officer.
Lastly, the contractor has been reported to the state Contractor’s License Board to initiate
a review of its alleged fraudulent activity.
CONCLUSION:
Staff therefore recommends the City Council approve the after-the-fact fee waiver request
as the applicants have adequately demonstrated the financial hardship.

In addition to Staff recommendation, the following alternative actions are available for the
City Council’s consideration:
1. Do not approve the penalty waiver requests in the amounts of $26,071.46 for
28011 Lobrook Drive and $21,589.02 for 31054 Hawksmoor Drive.
2. Take other action, as deemed appropriate.

ATTACHMENT B: CASE HISTORY
28011 Lobrook Dr.:
September 1, 2021: Code Enforcement staff observed unpermitted construction and
roofing taking place and subsequently opened case ID CPM2021-0087. On November 8,
2021, a notice of the violations was mailed to the property owner, Shane Sato. On
November 17, 2021, Mrs. Martinez, unknown contractor, contacted Code Enforcement
Officer Rudy Monroy, and advised she would schedule an appointment with the Building
and Safety staff for the building permits.
January 7, 2022: A final notice for the outstanding violation and issued a stop work notice
for the unpermitted home remodel was mailed to Mr. Santos.
January 12, 2022: Mr. Sato emailed Code Enforcement Officer, Gerri Whitten, confirming
receipt of the final notice of violation. Mr. Sato explained he was issued permits from his
contractor, DeVitis Homes, which contains the City’s logo and believed he had valid
permits. Upon review of the permits, it was determined the permits to be fraudulent. Mr.
Sato stated, “when we received your first Notice of Violation dated 11/8/21, we were
shocked to discover the permit violations you noted. It has been an extremely stressful
and depressing situation for us as we have come to find out that our contractor, Danial
DeVitis of DeVitis Homes, has not been getting the necessary permits/plans and that his
foreman was creating fake permits. We unfortunately trusted our contractor and foreman
to do everything that was needed for our remodel. To rectify the issue, the contractor
referred us to Evolution Design & Development, Inc. who we immediately engaged to
help.” Mr. Sato has provided the City copies of the fraudulent permits he received from
DeVitis homes. Since then, Mr. Sato has been working with the City be rectify the
violations.
January 17, 2022: Jeriff Martinez, Evolution Design Inc, applied for a residential remodel
permit (RES2022-00023) totaling $44,010.96, which included an A-T-F penalty fee in the
amount of $26,071.46.
31504 Hawksmoor Dr.:
November 1, 2021: David Rasor, Building Inspector, observed unpermitted construction
taking place. He spoke with a construction worker who provided him falsified building
permits (see attachments). Code Enforcement opened case ID# CBLD2021-0052.

January 17, 2021: A notice of violation and a copy of the Building Inspectors stop work
notice for the unpermitted home remodel was mailed to the property owner, Christina
Striet.
January 24, 2021: A licensed contractor, New Vision Roofing, pulled a re-roof permit and
paid penalty fees. Permit# RES2022-00021, which included an A-T-F penalty fee in the
amount of $800.
January 24, 2022: Jeriff Martinez, Evolution Design Inc, applied for a residential remodel
permit (RES2022-00042), which included an A-T-F penalty fee in the amount of
$20,789.02.

Contractor Scam Alert
The City of Rancho Palos Verdes has been made aware of homeowners falling
victim to contractor “scams” in which they were fraudulently billed fees for non-
existent or fake City building permits. The City would like to provide residents with
tips to protect themselves from such individuals.
Many homeowners don’t know what kind of work requires a permit, or what a
permit looks like. Below are steps you can take to verify the legitimacy of your
contractor and permits.
How can I verify that my contractor is state-licensed?
You can look up your contractor’s license with the California Contractors State
License Board at cslb.ca.gov or by calling 800-321-2752. Then, verify that your
contractor has a photo ID that matches the name on their license.

How can I verify that my contractor has a business license with the City of Rancho
Palos Verdes?
You can find a list of active business licenses on the City website at the following
link: https://www.rpvca.gov/677/Business-License-List
How do I know if my project needs a permit?
You can determine what kind of work requires a permit from the City at the
following link: https://www.rpvca.gov/1452/Do-I-Need-a-Permit
How can I tell if my permit is valid?
Valid permits will be listed in the City’s permit database. You can conduct a permit
search on the City website at the following link:
https://etrakit.rpvca.gov/eTRAKiT/Search/permit.aspx
Additionally, an authentic permit will have a valid permit ID or record number. Fake
and real examples are shown below.

Roofing permit numbers will always start with RERF followed by the current year
and the number in sequence.
Residential Remodel permit numbers will always start with RES followed by the
current year and the number in sequence.
Building permit numbers will always start with BLD followed by the current year
and the number in sequence.
