BACKGROUND:
The Amended and Restated Declaration of Restrictions for Trump National Golf Club,
which, among other things, requires an annual review of Trump National Golf Club’s
(“Applicant’s”) compliance with trail maintenance obligations (Attachment B). Specifically,
Condition No. 7 of the Amended and Restated Declaration of Restrictions states the
following:

7. Review and Monitoring For Compliance. The City and Owners [Trump National
Golf Club] shall review the Owners' compliance with its Maintenance Obligations
and compliance with the terms and conditions under this Declaration at least once
every twelve (12) months based on a tracking system and protocols implemented
by City for monitoring compliance. Owners shall implement and/or perform all
reasonably practical recommendations or requirements of City following such
annual review.
Pursuant to this Condition, Community Development and Recreation, Parks and Open
Space (RPOS) Staff worked together to create a maintenance spreadsheet. In early 2019,
Staff, in collaboration with the Applicant’s staff, created a tracking system for trail and
open space complaints and the Applicant’s responses. The resulting document was a
maintenance matrix that was first presented to the City Council on February 4, 2020.
RPOS Staff continues to maintain the matrix; the current matrix (as of March 25, 2022) is
attached (Attachment A) and represents a two-year reporting period, as this item was not
presented to the City Council for review in 2021 due to a significant backlog of work and
limited resources for both the City and the Applicant in 2021. However, moving forward,
the review of the Applicant’s required maintenance will be presented to the City Council
on an annual basis, as part of the required annual review.
The purpose of this report is to review the overall effectiveness of the Applicant’s
compliance with maintenance obligations for the trails, open space, and public amenities,
using the maintenance matrix developed pursuant to Condition No. 7, with a copy of the
current matrix as of March 25, 2022, attached (Attachment A). The focus of this review
will be on the application of the maintenance matrix and a discussion of the most common
and recurring maintenance issues.
DISCUSSION:
The Applicant is required to maintain, manage, improve, and enhance, to the City’s
reasonable satisfaction, various portions of the Trump National Golf Course property,
which includes the open space, various public amenities such as picnic tables and
benches, and trails. Common and recurring maintenance issues include trail erosion, spur
trails, vandalism, litter, and sign deterioration. The maintenance matrix is used to log the
issues and provide a method by which Staff can track and objectively measure the
completeness and timeliness of the Applicant’s compliance with their maintenance
obligations. The maintenance issues are grouped by trail or open space area, with a color
code (green for complete, black for confirmation of work pending, and red for not
complete), which allows the user to quickly assess the status of reported issues.
Typically, when a report of a trail issue is either identified by the RPOS Staff or received
from the public. RPOS Staff logs the reported issue on the afore-described maintenance
matrix and reports the concern directly to the Applicant. Additionally, to improve the data
and locations of reported issues, photos and map coordinates included, which reduces
confusion regarding the location or nature of the issues. Eventually, RPOS Staff
anticipates moving to the CityWorks automated platform in the fall, which is what the
Public Works Department currently uses for maintenance requests.

A review of the current maintenance matrix finds a total of 167 items listed. Currently,
approximately 40 items are complete (green); 113 issues were responded by the
Applicant but not confirmed complete by staff (black); and 14 items not complete (red).
The large number of issues responded to but not confirmed (black) is a result of the
Applicant providing an update to the maintenance matrix this last week, which precluded
staff from inspecting the work. To summarize, 92% of the current reported or observed
issues have been addressed. Staff continues to work with the applicant to review their
progress and ensure completion of items that are still pending.
Staff is of the opinion that the applicant, despite the challenges of the past two years,
continues to make significant progress to address and keep up with the ongoing
maintenance of the trails, open space and amenities. As noted above, an annual review
was not conducted in 2021, but moving forward Staff will commit the necessary resources
to ensure that the annual review will be conducted in accordance with Condition No. 7 of
the Amended and Restated Declaration of Restrictions.
There are various maintenance issues that are chronic and persistent, which as
previously noted include trail erosion, spur trails, vandalism, litter, and deterioration of
signs. This is in part due of the large size of the Ocean Trails Reserve and the Trump
National Golf Course, and the frequent usage by the public, including heavy use during
the pandemic.
As a result of erosion, trails and amenities need continuous and recurring maintenance.
For example, various large-scale trail construction repairs throughout the area were
required and completed in October and November 2021, which included the construction
of retaining walls, the rebuilding of broken stairs, installing new cables and posts, and
repairing drainage issues to mitigate future erosion. However, some issues still remain,
including the removal of spur trails, which are unauthorized new trails through existing
habitat by hikers. Staff will continue to work with the Applicant to determine solutions to
permanently close these unauthorized areas, including, but not limited to installation of
“Area Closed” signage.
Erosion and resultant slope failures also caused the closure of the Catalina Trail bridge
and the Coastal Switchback Trail landslide. Staff is working with the Applicant on possible
solutions to remedy these two significant trail issues. The solutions will involve working
with the City’s Geologist, as well as coordination of various government agencies,
including the California Coastal Commission, U.S. Fish and Wildlife Service and the
California Department of Fish and Wildlife, which will result in a lengthy repair timeline.
Sign maintenance due to vandalism and exposure to the elem ents is another constant
and recurring issue for the Applicant. In the time period tracked in the maintenance matrix,
the Applicant has replaced a significant number of signs including trail name signs and
other wayfinding and informational signage. Given that signs are critical for the
identification of the trails, as well as advising the public of the Preserve and beach rules,
Staff will continue working with the Applicant to reduce the current volume of the sign
issues.

It is evident that the Applicant strives to keep up with the recurring maintenance issues.
Staff will continue to work with the Applicant to facilitate and ensure that recurring
maintenance of the trails, open space and amenities will be in compliance with their
obligations under the Amended and Restated Declaration of Restrictions.
ADDITIONAL INFORMATION:
IMAC Trails Subcommittee
RPOS Staff recently received an inquiry from the Infrastructure Management Advisory
Committee (IMAC) Trails Subcommittee regarding the reasoning for the current closure
of eight trails within the Preserve areas, two of them being the landslide on the Coastal
Switchback Trail and the bridge closure due to erosion on the Catalina Trail. Planning
Division and RPOS Staff will be scheduling a meeting with the IMAC trail subcommittee
soon to discuss the issues relating to the repair of these trails. As previously noted, the
trails cannot simply be repaired and likely may need to be rerouted through dedicated
habitat and Preserve areas.
Public Notice
On March 17, 2022, a public notice was mailed to all property owners within a 500-foot
radius of the project site and published in the Palos Verdes Peninsula News. Notice was
also provided to interested parties through the City listserv. In response to the public
notice, Staff received an email (Attachment C) from a resident who inquired about the
Applicant’s responsibility for trail maintenance and the length of time that the Catalina
Trail bridge and the Coastal Switchback Trail has been closed. Staff responded and
explained the current status and the complexity of these trail repairs, as described above.
Staff also received an inquiry from the public regarding the reason for the maintenance
review, and informed that person that it simply is a requirement of the 2018 Amended and
Restated Declaration of Restrictions, not in response to any specific complaints about the
trails.
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative actions are available for
the City Council’s consideration:
1. Identify areas of concern regarding the Applicant compliance with the
maintenance obligations and direct Staff to address these concerns at a
future meeting.
2. Take other action, as deemed appropriate.

Close spur trail City Staff has monitored trail use for enforcement purposes and secured the
area with vegetation, and installation of "Area Closed" signs. A trail camera
was installed on 11/3/2021, and TN notified, with signage installed in adjacent
locations to inform the public. As noted in the West Portal Trailhead, the
Notice sign was installed on 10/2021 (white / blue background with black text)
and then replaced with permanent signage (brown background with white
text) to be consistent with other regulatory signage.

Thank you for your email. You are correct that the Trump Organization is supposed to maintain the trails. However, the two closures you mention are rather
complicated to fix, and City Staff is working with the Trump Staff to find solutions. Erosion has made the bridge on the Catalina Trail unsafe, and then the nearby
landslide on the Coastal Switchback Trail made that trail impassible. We are in communication with the City geologist, as the landslide must be stabilized before
we can proceed with both repairs. Also, if the bridge and the switchback trail cannot be repaired, both trails would need to be rerouted, which would require
removal of dedicated habitat within the recorded nature preserve areas. To do this would require restoration of that habitat through the input and coordination with
various government agencies, including the Coastal Commission, the Federal Fish and Wildlife Service, and the California Department of Fish and Wildlife.

I am a frequent visitor to the ocean trails along the bluffs adjoining the Trump Golf Course. I plan to submit comments to the City Council public hearing on April 5.
For the past 1 1/2 years a pedestrian bridge on the ocean trail has been "temporarily closed". In addition a path down to the Ocean has been closed. This makes these trails very difficult to traverse
thus preventing the public from enjoying their spectacular views.
Wasn't this part of the agreement with V.H. Property Corp? That these trails and bridges be maintained and repaired? Will this be part of the City Council's review?
