RECOMMENDED COUNCIL ACTION: (1) Accept the project as complete; (2) Authorize the City Clerk to file a Notice of Completion for the project with the Los Angeles County Registrar-Recorder’s Office; and if no claims are filed within 35 days after recordation, send a notice to the surety company to exonerate the Performance Bond; and (3) Authorize the Director of Public Works to release the 5% construction retention payment to NR Development, Inc., 35 days after recordation of the Notice of Completion by the Los Angeles County Registrar-Recorder’s Office, contingent upon no claims being filed on the project, and the contractor posting an acceptable warranty bond with the City. FISCAL IMPACT: The total project cost was $188,701.25, which is $2,212.75 under budget. April 20, 2021, Staff Report BACKGROUND AND DISCUSSION: A construction contract for the Caddington Area 9 ADA Access Improvements Project was awarded by the City Council on April 20, 2021, in the amount of $113,850 to NR Development, Inc. 1 The project installed Americans with Disabilities Act (ADA) compliant curb cut ramps at 11 locations within the Caddington Drive neighborhood, as shown in Figure 1 and Figure 2 below. Prior to completion of this project, raised curbs created a barrier that impeded access for the mobility impaired. The project was f unded from the City’s Community Development Block Grant (CDBG) allocation. Figure 1: Project Vicinity Map 2 Figure 2: Project Location Map Construction was completed on August 19, 2021. Staff subsequently requested a construction contract compliance file review from the Los Angeles County Development Authority (LACDA) for the CDBG funds. The purpose of the review was to determine if the City complied with federal, state, and local regulations that applied to this project and to ensure that the participating construction contractor complied with federal contract requirements. The City received a clearance letter from LACDA stating that the City and the contractor met all applicable regulations and contract requirements. The contract includes a 12-month warranty period requiring the contractor to remedy any defective work. The project area will be monitored for the duration of the warranty period. 3 A financial summary of the project is in the following table: 4 CONCLUSION: The construction contractor, NR Development Inc., has completed all work in accordance with the specifications and construction contract. Therefore, Staff recommends accepting the project as complete and filing a Notice of Completion with the Los Angeles County Registrar-Recorder’s Office. If no claims are filed within 35 days after recordation, the City will release the 5% retention, and upon the contractor posting an acceptable warranty bond, notify the surety company to exonerate the Performance Bond. ALTERNATIVES: In addition to Staff recommendation, the following alternative action s are available for the City Council’s consideration: 1. Identify concerns with the project and d irect Staff not to file the Notice of Completion for the Caddington Area 9 ADA Access Improvements Project. 2.
