AGENDA TITLE:
Consideration and possible action to file a Notice of Completion for the Hawthorne
Boulevard Median Beautification Project.
RECOMMENDED COUNCIL ACTION:
(1) Accept the project as complete;
(2) Authorize the City Clerk to file a Notice of Completion for the project with the Los
Angeles County Registrar-Recorder’s Office; and if no claims are filed within 35
days after recordation, send a notice to the surety company to exonerate the
Performance Bond; and
(3) Authorize the Director of Public Works to release the remaining 2.5% construction
retention payment to Marina Landscape, Inc., 35 days after recordation of the
Notice of Completion by the Los Angeles County Registrar-Recorder’s Office,
contingent upon no claims being filed on the project and the contractor posting an
acceptable warranty bond with the City.
FISCAL IMPACT: The total project cost was $1,863,948, which is $251,218 under
budget.

BACKGROUND AND DISCUSSION:
A construction contract for the Hawthorne Boulevard Median Beautification Project was
awarded by the City Council on March 17, 2020, in the amount of $1,736,860.30, to
Marina Landscape, Inc.
The project consisted of removing the existing green asphalt in the median along
Hawthorne Boulevard, between Palos Verdes Drive West and Crest Road. The project
replaced the green asphalt with architectural landscaping features, including Palos
Verdes Stone at the ends of the medians, black beach cobble with a scattering of
boulders, and passive storm water runoff filtering systems (bio-swales). The bio-swales
are structures were designed to accept rainwater runoff from Hawthorne Boulevard and
provide natural filtration prior to the runoff entering the ocean. Some drought tolerant
plants have also been installed within the black beach cobble rock along with some low
growing trees. Through the installation of this project, the aesthetic appearance of
Hawthorne Boulevard has improved, and the project has been the subject of positive
feedback from several residents.
Construction for this project was performed in two phases. Construction of the median
improvements, planting and trees was completed in October 2020. The second phase of
the project included watering all vegetation (through a “tank on a truck”) and a
maintenance period of 12 months. The second phase of the project was completed in
October 2021. Following the first phase of this project, Staff reduced the 5% retention to
2.5% because all subcontractors had been paid for the work they performed on the
project.
To ensure the plants and trees become fully established, watering is required in
accordance with a watering schedule that was provided by the project designer. The plant
establishment is three years. The watering amount will be cut in half year-over-year during
the three-year plant establishment period. The first year of watering was completed by
the construction contractor in October 2021. Watering for the remaining two years of the
establishment period will be performed by the City’s landscaping contractor.
The watering schedule describes the amount of water needed monthly. Summer months
require the most water, spring and fall require about half the amount of water needed
during the summer, and the winter months require about a quarter of the water needed in
the summer. The watering amounts can vary depending on rainfall and weather
conditions. The average monthly cost to continue watering is estimated at $2,250. The
plant establishment period should be complete with the plants able to exist with minimal
supplemental water by November 2023, at which time the cost to water will be greatly
reduced.
The contract includes a 12-month warranty period requiring the contractor to remedy any
defective work. The project area will be monitored for the duration of the warranty period.

CONCLUSION:
The construction contractor, Marina Landscape, Inc., has completed all work in
accordance with the specifications and construction contract. Therefore, Staff
recommends accepting the project as complete and filing a Notice of Completion with the
Los Angeles County Registrar-Recorder’s Office. If no claims are filed within 35 days after
recordation, the City will release the remaining 2.5% retention, and upon the contractor
posting an acceptable warranty bond, Staff will notify the surety company to exonerate
the Performance Bond.
ALTERNATIVES:
In addition to Staff recommendation, the following alternative action are available for the
City Council’s consideration:
1. Identify issues to resolve and direct Staff not to file the Notice of Completion for
the Hawthorne Boulevard Beautification Project at this time.
2. Take other action, as deemed appropriate.
