AGENDA TITLE:
Consideration and possible action to authorize the City Clerk to file a Notice of Completion
for the Catch Basins Collector Screen Insert Project.
RECOMMENDED COUNCIL ACTION:
(1) Accept the project as complete;
(2) Authorize the City Clerk to file a Notice of Completion for the project with the Los
Angeles County Registrar-Recorder’s Office; and if no claims are files within 35
days after recordation, send a notice to the surety company to exonerate the
Performance Bond; and
(3) Authorize the Director of Public Works to release the 5% construction retention
payment to United Stormwater, Inc., 35 days after recordation of the Notice of
Completion by the Los Angeles County Registrar-Recorder’s Office, contingent
upon no claims being files on the project, and the contractor posting an acceptable
warrant bond with the City.
FISCAL IMPACT: The total project cost is $818,961.85.

BACKGROUND AND DISCUSSION:
In November 2017, the City of Rancho Palos Verdes and the State Water Resources
Control Board (State Board) executed a grant agreement, under which $600,000 was
awarded for the installation of approximately 1,368 connector pipe screens to reduce
storm water pollution by preventing trash from flowing into the Santa Monica Bay. This

award was based on a January 2016 application from the Cities of Rancho Palos Verdes
(RPV), Palos Verdes Estates (PVE), and Rolling Hills Estates (RHE), and subsequent
authorizations by PVE and RHE for RPV to act on their behalf to enter into and implement
the agreement with the State Board.
In June 2018, the cities of RPV, PVE, and RHE entered into a Memorandum of
Understanding (MOU). Each city agreed to collectively share and fully fund the local
match of the project and any additional costs of implementing the agreement in excess
of the grant funds. Local-share costs among the cities were based on the percentage of
catch basins for the project located in each city’s respective jurisdiction.
On October 2, 2018, RPV awarded contracts to United Storm Water for construction and
PSOMAS for construction management.
Of the originally anticipated 1,368 catch basins, connector pipe screens could only be
installed at 1,112 locations. The catch basins at 31 locations were too small for the
connector pipe screens to be installed, and the configuration of 225 locations do not allow
for the installation of collector pipe screens. As a result, the scope of work for United
Storm Water was reduced, and construction was completed in July 2020.

The City is being reimbursed up to $600,000 from the State Water Board, and
approximately 40% of the balance of expenditures through a MOU with the cities of Palos
Verdes Estates and Rolling Hills estates.

CONCLUSION:
The construction contractor, United Stormwater, Inc., has completed all work in
accordance with the specifications and construction contract. Therefore, Staff
recommends accepting the project as complete and filing a Notice of Completion with the
Los Angeles County Registrar-Recorder’s Office. If no claims are filed within 35 days after

recordation, the City will release the 5% retention, and upon the contractor posting an
acceptable warranty bond, notify the surety company to exonerate the Performance
Bond.
ALTERNATIVES:
In addition to Staff recommendation, the following alternative action are available for the
City Council’s consideration:
1. Direct Staff not to file the Notice of Completion for United Stormwater, Inc.
2. Take other action as deemed appropriate.
