CLERK 6. 1 CtTY CLERK I _,..=----·•-··. ·-·-·--_....J Ocean Front Estates HOA Request to City of RPV to Remove Acacia Bushes on City Lots 80-86 Presented by: Larry Carapellotti February 1, 2022 Introduction • The City (RPV) and the Ocean Front Estates HOA (HOA) do not agree on the responsibility for trimming/removal of the acacia bushes along PV Drive West adjacent to the OFE subdivision • There should be agreement that the highly flammable bushes be removed for fire and safety reasons -the City wants the HOA to pay 2 Background • During the development of OFE the City and the developer (Capital Pacific Homes/CPH) defined the responsibilities for maintenance of the open space lots #80-86 in a development agreement dated 1999 • In 2007 CPH transferred these lots to RPV and redefined the responsibilities: "maintenance of the revegetated habitat must transfer to the City" • The City was paid $750,000 to assume these responsibilities by CPH • The City assigned this task to the PVPLC 3 Background ( continued) • In subsequent years, the City has forced the OFE/HOA to trim the acacias at a cost exceeding $100,000 citing a "code violation" of the 1999 development agreement • Up until now the HOA complied assuming the city's position was correct -upon further review with council we were notified that this was a mistake • The City claimed numerous complaints of ocean view blockage -never providing any documentation 4 Position of OFE/HOA • 2007 agreement between City and CPH clearly transfers responsibility for Lots 80-86 to the City • OFE/HOA responsibility is limited to "perimeter ornamental landscaping and fencing" --any reasonable person would not consider acacias planted in a habitat area as "ornamental landscaping" • CPH planted acacias at the direction of and with approval by the City • According to original development agreement the acacias in question were planted in an area designated as a "fire break" -this should not have been allowed 5 OFE/HOA Responsibilities • Table from 2007 agreement between CPH and RPV City • OFE/HOA responsible for ornamental landscaping and fencing; not revegetated acacia habitat I Lot· Acres 80 14, 17 81 5.36 82 46.54 83 2.80 84 102 85 0.25 86 0.18 Exhibit 'F' Oceanfront Estates Open Space Lots Tract Map No. 46628 Use Maintenance Resoons!bi!lties ! City of Camarillo. 37 Cal. 3d 465 (1984), Developer shall have the right to develop the Project in phases in such order and at such times as Developer deems appropriate within the exercise of its subjective business judgment , so long as the Project is constructed as an integrated residential planned development as contemplated by the Development Plan. 11.3 Effect of Agreement on Land Use Reaulations. The rules. regulations and official policies governing permitted uses of the Property, the density and intensity of use of the Property, the max imum height and size of proposed buildings and the design, improvement and construction standards and speci- fications applicable to development of the Property are those rules, regulations and official policies tnat are included within the "Development Plan•. In connection with any approval which City is permitted or has the right to make under this Agreement relating to the Project, or other~ise under its rules, regulations and official policies, City shall exercise its discretion or take action in a reasonably expeditious manner which complies and is consistent with the Developmen t Plan and the standards, terms and conditions contained therein or in this Agreement. 11.4 Dedications and Monetary contribucion. In conjunction with processing this Project, conditions of approval and mitigation measures have been imposed which require Developer to preserve and enhance coastal sage scrub habitat ("habitat") on certain areas of the site which are to be dedicated to Lhe City. Initially, it is the Developer's responsibility, for a minimum period of five years, to ensure that the habitat is planted and established; after the first five years pass and the habitat i s established in accordance with the standards approved by the United States Fish and Wildlife Service, the City is to perform the long term maint enance of the habit::it. In addition, Developer shall offer for dedication to City the streets, approximately 71 acres of open space, and other public amenities that are to be constructed by Developer including, the bluff face, the wetlands area, the firebreaks, parking areas and automobile turnouts, bicycle lanes, trails , drainage facilities, a passive park, the coastal sa~s.crub. habitat, and the other open space areas depicted on ~151t ~o. All improvements which are to be dedicated to the C ty:--~ including, without limitation, the improvements referred to in this Section, shall be completed as prescribed in the Development, Plan. •-· A. Rancho Palos Verdes City Council Caltrans I applaud the proposed Western Avenue Bicycle and Pedestrian Improvement Project . Installing bicycle lanes and pedestrian improvements on Western Avenue between 25th Street in San Pedro to Carson Street is long overdue . Unfortunately, access to wonderful destinations along the coast are still not easily accessible. I would like to see bike lanes extended from 25th Street to West Paseo Del Mar, allowing safe bicyclist access White Point and Royal Palms Beach. Although Western is wide in this area, cars often speed here and are not alerted to the presence of cyclists. In addition, a ridable bike path should be built around the landslide (image below), connecting to West Paseo Del Mar, Point Fermin Park, the Korean Friendship Bell, Fort MacArthur Museum, the International Bird Rescue Center, as well as Cabrillo Beach and LA Harbor. Cyclists are currently allowed to push their bike on the Grassland Trail but the existing trail is narrow, making for disgruntled walkers . Often cyclists choose to ride anyway. A new or widened path would eliminate these issues. There are two possible routes. The easiest is to simply widen the Grassland Loop Trail about 6 feet using compacted decomposed granite (shown in yellow). The alternative is a new path (shown in red). Neither of these proposed paths would be expensive to build. The project includes upgrades of curb ramps to satisfy ADA standards. According to the presentation, Phase 1 of this project included 106 curb ramp locations, with 7 of those within Rancho Palos Verdes. Phase 2 includes 53 additional ramp locations, with 9 within Rancho Palos Verdes. I would like to point out that the curb ramps in Phase 1 were started in August 2021, when the existing curbs were demolished and most of the concrete hauled away. Then the ramps and sidewalks, generally 4 at each location, sat demolished, idle, and taped off until November 2021. In those intervening months the ramps at each intersection were a hazard to pedestrians (even those without a disability) and an impediment to traffic, especially to cars turning the corner at one of those locations. I would like the City Council to INSIST to Caltrans that Phase 2 upgrades of the ramps be completed more expeditiously than the 4 months it took to complete Phase 1. The demolition of the existing ramps should not be started until the funding and the labor necessary to both demolish the existing ramps and construct the new ramps is in place and confirmed. Then the ramps should be demolished and upgraded in one continuous project, not 2 projects separated by 3 months of inactivity with 4 dangerous, torn-up curbs at each intersection. Thank you. Western Ave is a very busy and congested major street with traffic at all hours. Adding a bike lane will only cause more traffic. I also feel it is a dangerous street for cyclist. Please do not take precious traffic lanes from Western. 1. Traffic is already heavy 2. New construction on Western has already impacted troff ic ... before hundreds of new homeowners have moved in. The Estates alone has 132 garage spaces.) 3. There are few bikers, possibly due to the difficult hills. 4. Current bike lanes, constructed on east-west streets go unused years after completion. 5. A private school has relocated to north San Pedro. I am told that right now access is closer to Gaffey but it would, also impact Western. I have lived in San Pedro for over twenty years, having moved after twenty years in RPV. Twenty years ago traffic was heavy along western but expectedly so. In the past years, traffic has increased from heavy to nerve-wracking. However. two housing developments have started advertising sales of hundreds of new homes with ingress and egress on Western, south of PVDrN. Without these home occupied troff ic is stop and go with multiple barely timed lights along the San Pedro Western strip. There are only two paths to south San Pedro: Western and Gaffey with Gaffey being the feeder from the 110 freeway. I have seen how the government answers biking issues. it takes away one lane of troff ic. On Capitol Drive one full driving lane was deleted in 1 1-/. favor of a bike lane with lots of extra space. At the same time an extra stop sign was added to delay (anticipate?) troff ic. Since that time (years ago) I have NEVER seen a bike using the new bike path and I drove that route every day, frequently several times. All that expense for nothing. On Westmont(? Sorry I'm not sure of the name-the Albertson-Home Depot street) another anomaly appeared. Big near-rectangle (actually the short side are angular/zig zagged) boxes appeared painted on the street. I personally asked multiple police officers what they were. Not only did none of them know they were there, when they went to look, they still had no idea what they were. Later, I was told by one biker I know, that there is a law that a driver may not open his/her auto door to extend into the rectangle, as a protection for (non-existant) bikers. If this is true, no other person I have met, including police, knows it. So city funds were spent years ago interfering with roads for no known reasons. Please do not take precious troff ic lanes from Western. Dear Mayor and Council Members, Our residential property is located within the Cal-Trans project middle segment of the proposed project. We purchased the property in 1976 and since that time we have maintained the property landscaping on the eastern slope. Unrestricted parking access on Western Ave. is essential to maintenance of the slope. Haul away trucks typically and freely park on the West side of Western for debris loading purposes. (In any event, temporary parking permits cost should not be considered, in my opinion) I'm not certain the report addresses my concerns. Maybe, I missed it. In any case, I am opposed to a bikeway lane on the western side of Western as well as the proposed right turn lane at Westmont and Delesonde on the East side of Western. That particular intersection is a nightmare given the short length design of the left turn lane at Delsonde. The addition of a right turn lane will cause further delay in traffic flow. Moreover, for your information ..... it has been my experience and observation that some drivers waiting to head East get so anxious to move they turn left on Western, head South .... quick turn into Smart and Final shopping entrance or U-turn on Western heading back to the same intersection then turning right onto Westmont toward their desired northbound destination.
