PC MINS 20220628 Approved 7/12/2022 CITY OF RANCHO PALOS VERDES PLANNING COMMISSION MINUTES REGULAR MEETING JUNE 28, 2022 CALL TO ORDER A Regular meeting of the Rancho Palos Verdes Planning Commission was called to order by Chair Perestam at 7:08 P.M. in accordance with Government Code Section 54953(e)etseq. (AB 361)and Resolution 2022-21 adopted by the City Council on April 19,2022, and as renewed by subsequent resolution(s) thereafter. The regular meeting was conducted through a hybrid combination of in- person and/or all virtual attendance of the seven members of the Planning Commission and invited staff at Hesse Park, McTaggart Hall, 29301 Hawthorne Boulevard and via teleconference using the Zoom platform, broadcast live on the City's website at rpvca Dov/agendas and on PVPtv channels Cox 35 and Frontier Fiberoptic 39. Members of the public could observe and participate using the zoom participation feature, in person, and with options called out in the public participation form provided under separate cover with the agenda. Notice having been given with affidavit thereto on file. PUBLIC PARTICIPATION OPTIONS Deputy Director Silva provided options for public participation. PLEDGE OF ALLEGIANCE Deputy Director Silva led the Pledge of Allegiance. ROLL CALL Planning Commission roll call was answered as follows, Present: Chura, Nelson, Nulman, Saadatnejadi, and Chair Perestam Absent: Hamill and Santarosa Also, present Director Rukavina, Deputy Director/Planning Manager Silva, Senior Planner Yoon, and City Attorney Brian Wright-Bushman. APPROVAL OF AGENDA COMMISSIONER NELSON MOVED, SECONDED BY COMMISSIONER CHURA TO APPROVE THE AGENDA AS PRESENTED. COMMUNICATIONS City Council: Deputy Director Rukavina informed the Planning Commission that the Cities of Rancho Palos Verdes and Lakewood filed a legal challenge to SB 9, as a companion to a lawsuit against SB 9 that was filed recently by several Southern California charter cities. He also shared that the California Renters Legal Advocacy and Education Fund filed a lawsuit against the City Rancho Palos Verdes for the denial of a ministerial-level accessory dwelling unit. Staff: None Commission• None CONSENT CALENDAR: 1. APPROVAL OF THE JUNE 14, 2022 P.C. MINUTES COMMISSONER NELSON MOTIONED, SECONDED BY COMMISSIONER CHURA, TO APPROVE THE CONSENT CALENDAR AS AMENDED. CONTINUED PUBLIC HEARING: 2. CODE AMENDMENTS TO TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO AMEND SECTION 17.02.020 (SINGLE FAMILY RESIDENTIAL (RS)) DISTRICTS— USES AND DEVELOPMENT PERMITTED), ADD CHAPTER 17.09 (SECOND UNITS AND TWO-UNIT DEVELOPMENTS IN SINGLE-FAMILY ZONES), AND AMEND CHAPTER 17.96 (DEFINITIONS) THEREBY ESTABLISHING DEFINITIONS AND REGULATIONS FOR SECOND UNITS AND TWO-UNIT DEVELOPMENTS IN SINGLE-FAMILY RESIDENTIAL ZONES(Case No. PLCA2022-0001): Citywide (JY) Senior Planner Yoon presented the staff report with a request to consider recommending to the City Council the proposed code amendments to Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code to amend Section 17.02.020 (Single Family Residential (RS)) Districts— Uses and Development Permitted), add Chapter 17.09 (Second Units and Two-Unit Developments in Single-Family Zones) and amend Chapter 17.96 (Definitions)thereby establishing definitions and regulations for second unit and two-unit developments in single-family residential zones. Discussion ensured amongst the Planning Commission and Staff. Planning Commission Minutes June 28,2022 Page 2 Chair Perestam opened the public hearing. The Planning Commissioners asked clarifying questions of Staff and the City Attorney. COMMISSIONER NULMAN MOVED, SECONDED BY COMMISSIONER NELSON, TO RECOMMEND THE DRAFT ORDINANCE TO THE CITY COUNCIL WITH ALL STAFF RECOMMENDATIONS.
