CC MINS 20220315 MINUTES RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING MARCH 15, 2022 CALL TO ORDER: A Regular Meeting of the Rancho Palos Verdes City Council was called to order by Mayor Bradley at 6:27 P.M. at Fred Hesse Community Park, McTaggart Hall, 29301 Hawthorne Boulevard. This meeting took place remotely in accordance with Government Code section 54953(e) et seq. (AB 361) and Resolution 2021-59, adopted by the City Council on November 16, 2021. Members of the public could observe and participate using the zoom participation feature, and with options called out in the public participation form provided under separate cover with the agenda. Notice having been given with affidavit thereto on file. City Council roll call was answered as follows: PRESENT: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley ABSENT: None Also present were Ara Mihranian, City Manager; Karina Banales, Deputy City Manager; William Wynder, City Attorney; and Teresa Takaoka, City Clerk. PUBLIC COMMENTS. FOR CLOSED SESSION: None. CLOSED SESSION ITEM(S) ANNOUNCED: City Attorney Wynder announced the item to be discussed in Closed Session. 1. CONFERENCE WITH REAL PROPERTY NEGOTIATORS A closed session will be held, pursuant to Government Code § 54956.8, to enable the City Council to consider the property acquisition currently under negotiations with York Point View Properties LLC., with whom City is to give direction to the City Manager and City Attorney, regarding that certain real property commonly known as the Lower Filiorum and Plumtree properties, parcels as noted below. The City Coupcil will provide direction on the terms of the property acquisition including price. Parcels: APN 7581023037, APN 7581023035, APN 7573003016, APN 7572012028, APN 7572012024, APN 7572012029 (6001 Palos Verdes Drive South) 2. CONFERENCE WITH LABOR NEGOTIATOR A closed session will be held, pursuant to Government Code § 54957.6, with the City Manager, Deputy City Manager, and City Attorney, acting as its negotiators, regarding labor negotiations with the Rancho Palos Verdes Employees' Association. REGULAR MEETING — OPEN SESSION CALL TO ORDER: A Regular meeting of the Rancho Palos Verdes City Council was called to order by Mayor Bradley at 7:41 P.M. at Fred Hesse Community Park, McTaggart Hall, 29301 Hawthorne Boulevard, notice having been given with affidavit thereto on file. ROLL CALL: City Council roll call was answered as follows: I PRESENT: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley ABSENT: None Also present were Ara Mihranian, City Manager; Karina Bahales, Deputy City Manager; William Wynder, City Attorney; Trang Nguyen, Director of Finance; Ken Rukavina, Director of Community Development; Cory Linder, Director of Recreation and Parks; Ramzi Awwad, Director of Public Works; Daniel Trautner, Deputy Director of Recreation and Parks; Lauren Ramezani, Senior Administrative Analyst; Matt Waters, Senior Administrative Analyst; Katie Lozano, Senior Administrative Analyst; and Teresa Takaoka, City Clerk. Also present was Captain James Powers, Lomita Station, Los Angeles County Sheriffs Department. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by City Attorney Wynder. CLOSED SESSION REPORT: City Attorney Wynder reported that the City Council met in Closed Session to discuss negotiations involving real property owned by York Point View Properties LLC., (Lower City Council Regular Minutes March 15, 2022 Page 2 of 10 Filiorum and Plum Tree Properties). Council, Staff, and the City Attorney's office reviewed in detail a deal point outline of terms and conditions. Questions were asked and answered, and City Council provided Staff and the City Attorney's office further direction to proceed with negotiations. Secondly, the City Council met in Closed Session to prepare for labor negotiations with the Rancho Palos Verdes Employees Association (RPVEA). Council received a status report on an ongoing Classification and Compensation Study that is being prepared to be shared with the RPVEA. There was a detailed discussion and questions were asked and answered, and further direction was given by the Council. MAYOR'S ANNOUNCEMENTS: Mayor Bradley announced that there was vandalism at the Hatano Farm property over the weekend. RECYCLE AND EMERGENCY PERSONAL PREPAREDNESS KIT DRAWING: Mayor Bradley announced the Recycle Winners for the March 1, 2022, City Council meeting: Diana M. Case and Larry Yuzuki. He indicated that all winners receive a check for $250 and urged everyone to participate in the City's Recycling Program. He noted that in addition to winning the Recycler Drawing, the two individuals also won a Personal Emergency Preparedness Kit from the City valued at $40.00. 111 APPROVAL OF THE AGENDA: Councilmember Cruikshank moved, seconded by Councilmember Dyda, to approve the agenda with Item No. 2 to be removed from the agenda and placed on the agenda for April 5, 2022. CITY MANAGER REPORT: City Manager Mihranian provided updates on the following: Civic Center Tours taking place on March 17, 20, and 24, 2022, and Civic Center Master Plan Workshop taking City Council Regular Minutes March 15, 2022 Page 3 of 10 place on March 24, 2022 at Point Vicente Interpretive Center; Annual Budget Workshop on March 23, 2022; Emergency Preparedness Committee recruitment; Free Household Hazardous and Electronic Waste Drive-Thru Collection Event to be held on April 2, 2022; Entries for the Whale of a Day Bookmark Coloring Contest are due by March 25, 2022; and details on the Whale of a Day Event being held at Point Vicente Interpretive Center on Saturday, April 9, 2022. CONSENT CALENDAR: City Clerk Takaoka reported that there was one request to speak on Item E. Registers of Demands (Mata) 1) Adopted Resolution No. 2022-13, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. D. Consideration and possible action to continue implementing Assembly Bill No. 361 (AB 361) authorizing teleconferencing of meetings of legislative bodies for the month of March 2022. (Takaoka) 1) Adopted Resolution No. 2022-14, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, RE-RATIFYING THE PROCLAMATION OF A STATE OF EMERGENCY BY GOVERNOR NEWSOM ON MARCH 4, 2020, AND RE-AUTHORIZING REMOTE TELECONFERENCE MEETINGS OF THE LEGISLATIVE BODIES OF THE CITY OF RANCHO PALOS VERDES FOR THE PERIOD BEGINNING APRIL 1, 2022 THROUGH APRIL 30, 2022, PURSUANT TO THE RALPH M. BROWN ACT AND ASSEMBLY BILL NO. City Council Regular Minutes March 15, 2022 Page 4 of 10 361; and, 2) Authorized Staff to continue conducting, as warranted, City Council and Planning Commission public meetings using a combination in-person/virtual (hybrid) platform and continue conducting virtual-only meetings or a combination in- person/virtual (hybrid) platform, if warranted, for the City's five Committees (Civic Center Advisory, Emergency Preparedness, Finance Advisory, Infrastructure Management Advisory, Traffic Safety) subject to the Brown Act in accordance with the requirements of AB 361; and return with extension resolutions for the City Council's consideration every 30 days as the same may be warranted. E. Consideration and possible action to adopt Ordinance No. 658 repealing and replacing Chapter 8.20 (Solid Waste Collection and Disposal) of Title 8 (Health And Safety) of the Rancho Palos Verdes Municipal Code relating to solid waste. Consideration and possible action to authorize the City Clerk to file a Notice of Completion for the Caddington Area 9 ADA Access Improvements Project. (Lopez) 1) Accepted the project as complete; 2) Authorized the City Clerk to file a Notice of Completion for the project with the Los Angeles County Registrar-Recorder's Office; and if no claims are filed within 35 days after recordation, send a notice to the surety company to exonerate the Performance Bond; and, 3) Authorized the Director of Public Works to release the 5% construction retention payment to NR Development, Inc., 35 days after recordation of the Notice of Completion by the Los Angeles County Registrar-Recorder's Office, contingent upon no claims being filed on the project, and the contractor posting an acceptable warranty bond with the City. G. Consideration and possible action to approve Amendment No. 1 to the professional services agreement with Infinity Technologies for geographic information systems (GIS) support services. (Rukavina/Buchwald) 1) Authorized Amendment No. 1 to the professional services agreement with Infinity Technologies to extend the agreement from June 30, 2022, to August 30, 2022, and increase the agreement amount for GIS support services by $17,300 from $24,750 to $42,050, in a form approved by the City Attorney; and, 2) authorized the Mayor and City Clerk to execute the amendment. H. Consideration and possible action to submit the 2021 Annual General Plan Update Report on the implementation of the Rancho Palos Verdes General Plan to the appropriate state agencies. (Giang/Silva) Authorized Staff to forward the City's Annual General Plan Progress Report on the status of the implementation of the Rancho Palos Verdes General Plan during the 2021 calendar year to the Governor's Office of Planning and Research (OPR) and the California Department of Housing and Community Development (HCD). Councilmember Alegria moved, seconded by Mayor Pro Tem Ferraro, to approve staff recommendation as follows: Adopted Ordinance No. 658, AN ORDINANCE OF 111 THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, REPEALING AND REPLACING CHAPTER 8.20 (SOLID WASTE COLLECTION AND DISPOSAL) OF TITLE 8 (HEALTH AND SAFETY) OF THE RANCHO PALOS VERDES MUNICIPAL CODE RELATING TO SOLID WASTE HANDLING, ORGANIC WASTE DISPOSAL REDUCTION, AND EDIBLE FOOD RECOVERY. The motion passed on the following roll call vote: AYES: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley NOES: None PUBLIC HEARINGS: 1. Consideration and possible action to conduct a Proposition 218 public protest hearing regarding a residential solid waste and recycling rate increase and five-year rate adjustment formula associated with EDCO Disposal Corporation. (Ramezani) City Clerk Takaoka reported that late correspondence was distributed, notice of the public hearing was duly published, and there was one request to speak. Mayor Bradley declared the public protest hearing open. III City Council Regular Minutes March 15, 2022 Page 6 of 10 Director of Public Works Awwad introduced MSW Consultants President David Davis who will present the staff report and PowerPoint Presentation and notified Council that EDCO Disposal representatives Steve South, CEO, and Mark Perumean, General Manager, were available for questions. MSW Consultants President David Davis presented a staff report and PowerPoint presentation. Council Members asked questions of the consultants and Staff. Mayor Bradley asked City Clerk Takaoka if EDCO customers received notice of the proposed rate adjustment and this protest hearing? City Clerk Takaoka responded yes, the City mailed notice to all customers subject to the potential EDCO rate adjustment on January 28, 2022. An affidavit of mailing is on file in the City Clerk's office. Mayor Bradley asked City Clerk Takaoka if there had been written protests filed with the Clerk and are there enough protests for a majority protest of any of the fees in question. City Clerk Takaoka responded prior to the commencement of this evening's meeting, the Clerk's office received twelve written protests. None of those protests have been validated. Even if all of them are valid, there are insufficient protests with respect to the water and sewer surcharge rates for them, pursuant to Proposition 218, to count as a majority protest from those customers subject to the rate adjustment. Mayor Bradley provided instructions for public comments and rules on how to file written protest and no written protest will be taken after the close of the protest hearing. The following member of the public addressed the City Council: Carol Mueller. Discussion ensued among Council Members, and questions were asked of Staff. Mayor Bradley declared the public hearing closed. Mayor Bradley asked City Clerk Takaoka if any additional written protests were received during the public hearing? City Clerk Takaoka responded that no additional written protests were received, and the tally remains at twelve; and there are still insufficient protests with respect to the rate adjustment for any of them to count as a majority protest of the EDCO rate adjustment. City Council Regular Minutes March 15, 2022 Page 7 of 10 Mayor Pro Tern Ferraro moved, seconded by Councilmember Alegria, to approve staff recommendation as follows: 1) Conducted the public protest hearing pursuant to Proposition 218, and after receiving public testimony as deemed acceptable, approved the rate increase and five-year adjustment formula associated with EDCO Disposal Corporation, as there is no majority protest; and, 2) Adopted Resolution No. 2022-15, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA TO CONSIDER AND APPROVE A RESIDENTIAL WASTE MANAGEMENT SERVICES RATE ADJUSTMENT ATTENDANT TO THE PASSAGE OF SENATE BILL 1383. The motion passed on the following roll call vote: AYES: Alegria, Cruikshank, Dyda, Ferraro, and Mayor Bradley NOES: None REGULAR BUSINESS: 2. Consideration and possible action to appoint one member to the Civic Center Advisory Committee. Consideration and possible action to review the current City policy prohibiting bicycle and other wheeled use in City parks. (Waters) City Clerk Takaoka noted that late correspondence was distributed, and there were four requests to speak. Director of Recreation and Parks Linder introduced Senior Administrative Analyst Matt Waters who presented a staff report and PowerPoint presentation. Discussion ensued among Council Members, and questions were asked of Staff and City Attorney Wynder. Councilmember Alegria moved, seconded by Councilmember Cruikshank, to: 1) Authorized a six-month pilot program allowing the use of bikes, skates, skateboards, and scooters at Hesse Park, Eastview Park and the Civic Center; 2) Council directed Staff to explore a long-term solution to safely accommodate both these users and walkers; 3) Assess the results of the pilot program, looking at how City Council Regular Minutes March 15,2022 Page 8 of 10 other cities achieve this balance; and, 4) Explore how to potentially accommodate this use at Grandview Park as a long term solution. Consideration and possible action to approve installing a temporary trailer to accommodate Open Space Management (OSM) Staff at the Civic Center. Mayor Pro Tem Ferraro moved, seconded by Councilmember Alegria, to approve staff recommendation as follows: 1) Approved a three-year contract with Willscot Mobile Mini in the amount of$60,525.39 (annually at $17,784) for rental of a temporary trailer to be placed at the Civic Center for OSM Staff, in a form approved by the City Attorney; and, 2) Authorized the Mayor and City Clerk to execute the contract. Consideration and possible action to approve the Engineering and Traffic Survey and establish certain speed limits on various City streets. Councilmember Alegria moved, seconded by Mayor Pro Tem Ferraro, to approve staff recommendation as follows: 1) Accepted the Engineering and Traffic Survey prepared and revised by the City's Consulting Traffic Engineer, Willdan Engineering, dated December 2021; and, 2) Adopted Resolution No. 2022-16, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING CERTAIN SPEED SURVEYS AND CONFIRMING THE APPROPRIATENESS OF CERTAIN SPEED LIMITS ON VARIOUS STREETS City Council Regular Minutes March 15, 2022 Page 9 of 10 WITHIN THE CITY.
