CC SR 20211019 03 - Ladera Linda Permit Parking CITY COUNCIL MEETING DATE: 10/19/2021 AGENDA REPORT AGENDA HEADING: Regular Business AGENDA TITLE: Consideration and possible action to establish a Ladera Linda Residential Permit Parking Program on certain streets within the neighborhood. RECOMMENDED COUNCIL ACTION: (1) Adopt Resolution No. 2021-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, ESTABLISHING A LADERA LINDA RESIDENTIAL PERMIT PARKING PROGRAM ON CERTAIN STREETS WITHIN THE NEIGHBORHOOD. FISCAL IMPACT: The costs with establishing the residential permit parking program is approximately $2,000, which funds the production and installation of the permit parking signs and procures the parking decals. Funding for these costs is available in the Traffic Management Program of the Council-adopted FY 2021-22 budget. Proposed Sign Locations (page D-1) BACKGROUND AND DISCUSSION: In June 2021, a petition was received by the Public Works Department to establish a Residential Permit Parking Program (Permit Parking) on certain streets in the Ladera Linda neighborhood (Attachment B). 1 Rancho Palos Verdes Municipal Code (RPVMC) Chapter 10.20 states that an area that desires restricted or prohibited parking may apply to the City Council for the imposition of restrictions or prohibitions by submitting a petition demonstrating support for t he proposal, which is signed by at least 60% of the owners of the properties on the street(s) where the restriction will be imposed. The petition proposes Permit Parking to be in effect 24 hours per day and seven days per week on Pirate Drive, as well as parts of Sea Raven Drive and Phantom Drive. Staff verified that 60% of residents within the proposed area limits of the Permit Parking have signed the petition (Attachment C). Staff reviewed the petition and found that the requested Permit Parking is consistent with similar programs in other areas of the City. The Ladera Linda neighborhood is adjacent to the Preserve and the Ladera Linda Community Center and Park, and as with other neighborhoods next to the Preserve, spillover parking into the neighborhood is expected. This Permit Parking will act as a buffer for spillover parking and alleviate any parking shortages for residents of the neighborhood. Although not required by the RPVMC, in keeping with past practice, the Permit Parking petition was presented to the Traffic Safety Committee for a recommendation prior to a request for approval by the City Council. On September 27, 2021, the Traffic Safety Committee reviewed the proposed parking program and recommended approv al by the City Council. If approved by the City Council, the requested Permit Parking program will be administered by the Public Works Department. Residents may apply for permits , and re- usable guest passes. Enforcement of Permit Parking will require the installation of signs to alert the public of the restrictions. These signs are expected to be no large than two feet in length and two feet in width. The signs will be installed on existing traffic sign poles where possible. In some locations, new poles will need to be installed to accommodate the signs because there are currently no traffic sign poles (see Attachment D). In addition, the sidewalks on these streets vary from five to six feet wide, which provides adequate space to install sign poles without obstructing the sidewalk. Enforcement will be conducted by Recreation and Parks Department or the Los Angeles County Sheriff’s Department. CONCLUSION: Staff recommends establishing the requested Residential Permit Parking Program on certain streets within the Ladera Linda neighborhood. ALTERNATIVES: In addition to Staff recommendation, the following alternative action s are available for the City Council’s consideration: 2 1. Take other action, as deemed appropriate. 3 Resolution No. 2021-xxxx Page 1 of 11 01203.0006/744038.2 RESOLUTION NO. 2021- _ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, ESTABLISHING A LADERA LINDA RESIDENTIAL PERMIT PARKING PROGRAM ON CERTAIN STREETS WITHIN THE NEIGHBORHOOD. WHEREAS, Chapter 10.20 of the Rancho Palos Verdes Municipal Code RPVMC) authorizes the City Council to establish permit parking in areas in the City by resolution pursuant to the authority provided by California Vehicle Code Section 22507; and WHEREAS, the Ladera Linda Community Center and Park (Park) and the Forrestal Preserve a subarea of the Palos Verdes Nature Preserve (Preserve) is located just to the northwest of the Ladera Linda neighborhood, and patrons (non - residents) of the Park and Preserve have been observed parking their vehicles on the streets within the Ladera Linda neighborhood; and WHEREAS, the Ladera Linda residents have submitted a signed petition requesting that the City Council establish a Ladera Linda Residential Permit Parking Program in accordance with Chapter 10.20 of the RPVMC, the petition bearing the signatures of at least 60% of the affected residents; and WHEREAS, the City Council finds that a Ladera Linda Residential Permit Parking Program is consistent with the goals of Resolution 2015-02 and Chapter 10.20 of the RPVMC by providing residents with parking relief; and WHEREAS, the City Council has determined that establishing the Ladera Linda Residential Permit Parking Program would not result in significant environmentaleffects because the program will not significantly alter existing conditions. Therefore, in accordance to the California Environmental Quality Act (CEQA), the City Council finds that establishment of the permit parking program is considered a Categorical Exemption from CEQA based on Section 15301(c) of Article 19, which states that operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographic features involving negligible or no expansion of uses beyond that existing at the timeof the lead agency's determination. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: A-1 Resolution No. 2021-xxxx Page 2 of 11 01203.0006/744038.2 Section 1. The City Council finds that the establishment of a permit parking area for certain streets within the Ladera Linda neighborhood 7 days a week, 24 hours a day, is necessary to provide parking on this street for the residents who live there that is caused by long term parking of nonresident vehicles on these streets. The City Council further finds the adverse impacts have resulted in deterioration of the residential quality and character of the Ladera Linda neighborhood to the detriment of its residents and their property values. For these reasons, the City Council finds that the establishment of a permit parking area for the streets listed in Section 2 of this Resolution is necessary to avoid the adverse impacts upon the adjacent residential area indicated above and to provide reasonably available and convenient parking for the benefit of the residents along these streets throughout the day and evening. The City Council further finds that creating a Ladera Linda Residential Permit Parking Program for these spaces is consistent with Resolution No. 2015-02, and also consistent with the purpose of Chapter 10.20 of the Rancho Palos Verdes Municipal Code. The City Council further finds the signed petition of at least 60% of the affected residents agreeing to the permit parking program, is complete and attached as Attachment 1, and incorporated by reference. Section 2. The Ladera Linda Residential Permit Parking Program is, by this resolution, hereby created. Based upon findings in Section 1, the following areas are designated for permit parking only as shown in Attachment 2: Pirate Drive (both sides from Forrestal Drive to Phantom Drive) Phantom Drive (both sides from Pirate Drive to Vigilance Drive) Sea Raven Drive (both sides from Pirate Drive to 32350 Sea Raven Drive) Section 3. Pursuant to Section 22507 of the Vehicle Code, the permit parking restrictions on the portions of the streets listed in Section 2 above, shall be as follows: A) Resident and guest parking (non-recreational) shall be by permit only. B) Ladera Linda resident and guest parking permits shall be issued to residents of Ladera Linda upon application to the City. C) Vehicles displaying valid resident and guest parking permits issued pursuant to the Ladera Linda Residential Permit Parking Program may park in the spaces described in Section 2 above, every day, 365 days a year. The Ladera Linda Residential Permit Parking Permit Program shallnot be effective until signs are erected that indicate the area to which the program applies. The Director of Public Works is hereby authorized to erect such signs. Vehicles that are parked without displaying the required permit may be towed pursuant to Vehicle Code Section 22651(n). Section 5. This Resolution shall take effect and be enforceable immediately upon placement of signs in accordance with Section 4 above. Section 6: Any challenge to this Resolution and the findings set forth therein, must be filed within the 90-day statute of limitations set forth in Code of Civil Procedure 1094.6 and RPVMC §17.86.100(B). Section 7: The City Clerk shall certify to the passage, approval, and adoption of this Resolution, and shall cause this Resolution and her certification to be entered in the Book of Resolutions of the City Council.
