RECOMMENDED COUNCIL ACTION: (1) Approve the submittal of an application to the California State Department of Parks and Recreation for Proposition 68 Per Capita Grant funds for the construction of paths, walkways, landscaping, and park amenities associated with the Ladera Linda Park and Community Center Project; and, (2) Authorize Blais & Associates to prepare the grant application, on behalf of the City, for outdoor site improvements at Ladera Linda Park and Community Center at a cost not to exceed $3,800. Prop 68 Grant Forms (page D-1) 1 CITYOF RANCHO PALOS VERDES BACKGROUND AND DISCUSSION: Proposition 68 was approved by California voters on June 5, 2018. The proposition included funding for local park rehabilitation, creation, and improvement grants for local governments, including California cities and counties, on a per capita basis. The program is administered by the State Department of Parks and Recreation’s Office of Grants and Local Services (OGALS), and $185,000,000 in per capita funding is available. The City of Rancho Palos Verdes General Per Capita allocation is $177,952 and its Urban County Per Capita allocation is $26,012, for a total Prop. 68 allocation of $203,964. The proposed grant and resolution were reviewed by the City Council on December 1, 2020 (Attachment C). That evening, the City Council approved the resolution (Attachment A), which acted as a placeholder, reserving the funds for the City, pending the submission of a grant application. The deadline for submitting the grant application to OGALS is December 31, 2021. The grant-funded improvements need to be completed by December 31, 2023. The attached resolution approving the submittal of an application does not require any funds or the commitment to any future funding at this time. No funds would be required to be committed until the City formally accepts the grant. Projects not serving a “severely disadvantaged community” defined as one with a median household income less than 60% of the statewide average are subject to a 20% match. The City’s per capita grant, if approved by the state and the City Council, would therefore require a 20% City match ($40,792.80). The grant funds are proposed to be used to pay for a portion of the outdoor improvements associated with the Ladera Linda Community Center and Park Project, which is scheduled to begin construction by early 2022. Grant-funded amenities would include park benches, picnic tables, walking paths, and landscaping. Analysis of Grant Requirements On December 1, 2020, the City Council directed Staff to return with an analysis of the grant’s requirements for its review before giving direction to file a grant application. Staff worked with the City’s grant consultant, Blais & Associates, to identify and analyze the following requirements: Land Tenure: The purpose of the land tenure requirement is to verify that the grantee (City of Rancho Palos Verdes) has sufficient legal rights to the property to fulfill the terms of the contract. • Project amounts up to $100,000 require at least 20 years of land tenure at the site to be acquired or developed. • Project amounts greater than $100,000 require at least 30 years of land tenure at the site to be acquired or developed. 2 • The 20- or 30-year land tenure requirement begins on July 1, 2018. (Since the grant is for more than $100,000, 30 years of land tenure would be required.) • The grantee remains responsible for fulfillment of the terms of the contract, even if the grantee’s land tenure agreement changes within the contract performance period. Signage Requirements: All project signs must contain the following language displaying the current office holders: • California Governor • Natural Resources Secretary • California Department of Parks and Recreation Director Signs should include the names of current officials. The name of the director of the local agency or other governing body may be added. The sign may also include names (and/or logos) of other partners, organizations, individuals and elected representatives. Logo: All project signs must display the Parks and Water Bond Act logo. Deed Restriction: If the grantee owns the project land, a deed restriction must be recorded on the property’s title before OGALS will approve any grant payments. The City owns the Ladera Linda Park and Community Center property, so a deed restriction must be recorded. The deed restriction essentially limits the title to the property, safeguarding the property for purposes consistent with the grant (public recreation purposes) for the duration of the contract performance period. This deed restriction will remain in effect for a 30-year period from July 1, 2018 to June 30, June 30, 2048. This duration is less than many park-related grants which require an “in perpetuity” duration clause. Sufficient Funds: The grantee certifies that it will have sufficient funds to operate and maintain the project. Funding for the operation and maintenance of the grant project area as well as the entire Ladera Linda Park and Community Center will be included in future City budgets. Grant to Supplement Project Funding: The grant funding will supplement project funding, not supplant existing funding. Compliance with State Labor Laws: Compliance with state labor laws is required. The entire Ladera Linda Park and Community Center Project, including the components in the grant application, is subject to compliance with state labor law requirements. Compliance with the City’s General Plan and Parks Master Plan: This requires that the project will be consistent with the City’s General Plan and Parks Master Plan. The entire Ladera Linda Park and Community Center Project has been reviewed and approved by the Planning Commission and City Council, and found to be consistent with the General 3 Plan and Parks Master Plan as documented in the findings for the Conditional Use Permit. The grant project components are consistent with both plans. Consideration of Diversity: This grant term requires all grant applicants, to the ext ent practicable, to consider a range of actions in connection to this project that are intended to increase diversity and outreach to diverse populations as detailed in the January 12, 2017 “Presidential Memorandum Promoting Diversity and Inclusion in Our National Parks, National Forests and Other Public Lands and Waters.” There was considerable discussion of this grant term at the December 1, 2020 City Council meeting. The key term is “consideration” of diversity. It is not a requirement to create a diversity program or perform outreach to diverse populations to receive this grant funding. Below is the full list of diversity-related measures to be considered. None of them are required to be implemented to receive grant fund ing. A. Conducting active outreach to diverse populations, particularly minority, low income, and disabled populations and tribal communities, to increase awareness within those communities and the public generally about specific programs and opportunities. B. Mentoring new environmental, outdoor recreation, and conservation leaders to increase diverse representation across these areas. C. Creating new partnerships with state, local, tribal, private, and nonprofit organizations to expand access for diverse populations. D. Identifying and implementing improvements to existing programs to increase visitation and access by diverse populations, particularly minority, low -income, and disabled populations and tribal communities. E. Expanding the use of multilingual and culturally appropriate materials in public communications and educational strategies, including through social media strategies, as appropriate, that target diverse populations. F. Developing or expanding coordinated efforts to promo te youth engagement and empowerment, including fostering new partnerships with diversity -serving and youth- serving organizations, urban areas, and programs. G. Identifying possible staff liaisons to diverse populations. California Environmental Quality Act (CEQA) Compliance: Requires submission of the form stating that the project is in compliance with CEQA. Providing Work Opportunities for Disadvantaged Communities: This requirement states that “to the extent practicable,” the project will provide “workforce education and training, contractor and job opportunities for disadvantaged communities.” Again, this element is only for the City’s consideration, not a requirement. Authorize Blais & Associates to Prepare the Grant Application Staff recommends the City Council authorize Blais & Associates to prepare the application and supporting documents to apply for this grant (Attachment D). The grant application requires the submission of the following items: 4 • Project description • Project scope and cost estimate • Acquisition requirements (not applicable as property is already owned ) • Funding source • Land tenure documentation • Subleases or agreement (not applicable) • Site plan • Green House Gasses Reduction worksheet • Project site map • Site photos • Deed restriction recordation (a deed restriction must be recorded on the title before OGALS will approve any grant payments. The restriction ensures the property is used for purposes consistent with the grant for a pre-determined period.) Any other additional requirements for this specific grant would be brought to the City Council if the City’s application were accepted, as well as a resolution accepting the grant. Due to the complex nature of the grant, Staff believes that Blais & Associates’ successful grant-writing skills will enhance the City’s chances of obtaining these grant funds in a timely manner. The proposed preparation cost is $3,780. This proposal, including the scope of work, is attached (Attachment B). The City’s contract with Blais & Associates includes a sub-budget for grant-writing services. ALTERNATIVES: In addition to the Staff recommendations, the following alternative action s are available for the City Council’s consideration: 1. Direct Staff not to proceed with the application. 2. At this time, the first public hearing with the Planning Commission on the Conditional Use Permit is tentatively scheduled for January. Once a decision is rendered by the Planning Commission, it will be presented to the City Council for consideration. The preparation of the construction drawings will proceed if directed by the City Council. The grant requires the City to certify that it has sufficient funding, that the project will be consistent with the City’s General Plan and Parks Master Plan, that grant funds will supplement, not supplant funding, and that the project will be in compliance with Stat e Labor Law requirements.
