AGENDA TITLE:
Consideration and possible action to file a Notice of Completion for the Residential
Street Rehabilitation Project Phase I and Phase II, Areas 3 and 4 PCC Improvements
and AC Repairs Project, Project Code #8834.
RECOMMENDED COUNCIL ACTION:
(1) Accept the project as complete;
(2) Authorize the City Clerk to file Notices of Completion for the project with the Los
Angeles County Registrar-Recorder’s Office; and if no claims are filed within 35
days after recordation, send a notice to the surety company to exonerate the
Performance Bond; and,
(3) Authorize the Deputy Director of Public Works to release the 5% construction
retention to Hardy & Harper, Inc., a California corporation, 35 days after
recordation of the Notice of Completion by the Los Angeles County Registrar-
Recorder’s Office, contingent upon no claims being filed on the project, and the
contractor posting an acceptable warranty bond with the City.
(4) Authorize the Deputy Director of Public Works to release the 5% construction
retention to American Asphalt South, Inc., a California corporation, 35 days after
recordation of the Notice of Completion by the Los Angeles County Registrar-
Recorder’s Office, contingent upon no claims being filed on the project, and the
contractor posting an acceptable warranty bond with the City.
FISCAL IMPACT: The total budget is $3,717,303.40, which includes the construction
budget of $2,780,435. The final construction cost of $2,778,998
was within the authorized construction budget.

BACKGROUND AND DISCUSSION:
The City has completed construction of the Residential Street Rehabilitation Project
Phase I, Areas 3 and 4 PCC Improvements and AC Repairs Project, Project Code
#8834. The construction work consisted of primarily street repaving, with some
replacement of sidewalk, curb ramps, driveway aprons, curb and gutter, and some
asphalt repairs. A portion of the project is within the City of Rolling Hills Estates (RHE).
The City entered into a Memorandum of Understanding (MOU) with RHE to complete
this area of the work. The MOU stated that RHE will pay for construction, inspection,
construction management, and community outreach services associated with work in
RHE. Construction activities were completed in June 2020. The final construction for
Phase II consisted of placing slurry seal and new pavement markings. Construction
activities were completed in July 2020.
The contract includes a 12-month warranty period requiring the contractor to remedy
any defective work. The project area will be monitored for the duration of the warranty
period.

CONCLUSION:
The construction contractors, Hardy & Harper, Inc. and American Asphalt South, Inc.,
have successfully completed all work in accordance with the specifications and
construction contract. Therefore, the work should be accepted as complete and a Notice
of Completion filed.
ALTERNATIVES:
In addition to the Staff recommendations, the following alternative action is available for
the City Council’s consideration:
1. Take other action, as deemed appropriate.
