Have you checked the area comps? You could buy at least two and half of the most luxurious properties available here on the peninsula for that money, and triple the finished square footage. So I would deem this particular land development a certifiable boondoggle. And, am I mistaken, or don't a significant number of the City Council want a new City Hall? Who going to pay for that, and deplete our reserves? Please each of you, reconsider this over the top spending, and spend money as if it was coming out of your own pocket. I posted in Nextdoor, a community media, a statement titled "Coyote Attack" because on Wednesday May 19th our pet poodle was attacked and killed by a coyote. have received hundreds of emails not to mention the many responses on Nextdoor. This attack took place in our backyard. My granddaughter observed a coyote close to our backdoor. Layla, our pet poodle is gone, likely dead. We feel that our other dog in the yard was at risk of being killed or eaten because she was close to the coyote. We want to alert our neighbors about what has happen. We will not let this matter rest until our politicians bring to us a happy resolve." Dear Council members, Please suspend the trapping of the peafowl program for at least this year. All the birds have been trapped except for one in my neighborhood. I hear from so many people on the hill asking what has happened to all the peafowl. The peafowl were here long before any of the current residents. I would much rather see the coyotes being trapped as I cannot bear to read another heartbreaking story on Nextdoor.com about someone's pet being snatched away while their owners were not able to stop it. CAUTION: This email originated from outside of the City of Rancho Palos Verdes. Hello, I wanted to make my voice heard about concern over continuing of the trapping of the peacocks in PV. I feel you are taking away a beautiful piece of the Peninsula's history by trying to rid the hill of these gorgeous glorious birds! I was born and raised here and for all my time growing up here peacocks 9 were just naturally apart of the picturesque beauty of PV! These birds are dwindling in numbers. Please don't take them from where they belong and have always known as their home! Please! So much of the hill is getting squeezed out and becoming too overcrowded and opinionated now more than ever. From the peacocks, to the over population and out of control more daring coyotes and the wild barn cats . So much is trying to be changed, restrained and confined for all these new neighborhoods and the new money coming into this area. I realize some things are inevitable, but could we at least take the peacock trapping off the table to preserve at least some of Palos Verdes unique charm of years gone by. Please! Thank you so much! (g) Enforcement of contract provisions (non-estoppel). Consultant acknowledges and agrees that any actual or alleged failure on the part of the City to inform Consultant of non-compliance with any requirement imposes no additional obligations on the City nor does it waive any rights hereunder. (h) Requirements not limiting. Requirements of specific coverage features or limits contained in this section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the Consultant maintains higher limits than the minimums shown above, the City requires and shall be entitled to coverage for the higher limits maintained 012010006/719158.1 EQG DocuSign Envelope ID: AOAF8BA6-6510-4DC2-B2B6-19B104D51798 by the Consultant. Consultant agrees to ensure that its subconsultants, subcontractors, and any other party involved with the project who is brought onto or involved in the project by Consultant, provide the same minimum insurance coverage and endorsements required of Consultant. Consultant agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. Consultant agrees that upon request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to City for review. (n) Agency's right to revise specifications. The City reserves the right at any time during the term of the contract to change the amounts and types of insurance required by giving the Consultant ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the Consultant, the City and Consultant may renegotiate Consultant's compensation. ( o) Self-insured retentions. To the full extent permitted by law, Consultant agrees to indemnify, defend and hold harmless the City, its officers, employees and agents ("Indemnified Parties") against, and will hold and save them and each of them harmless from, any and all actions, either judicial, administrative, arbitration or regulatory claims, damages to persons or property, losses, costs, penalties, obligations, errors, omissions or liabilities whether actual or threatened (herein "claims or liabilities") that may be asserted or claimed by any person, firm or entity arising out of or in connection with the negligent performance of the work, operations or activities provided herein of Consultant, its officers, employees, agents, subcontractors, or invitees, or any individual or entity for which Consultant is legally liable ("indemnitors"), or arising from Consultant's or indemnitors' reckless or willful misconduct, or arising from Consultant's or indemnitors' negligent performance of or failure to perform any term, provision, covenant or condition of this Agreement, and in connection therewith: (a) Consultant will defend any action or actions filed in connection with any of said claims or liabilities and will pay all costs and expenses, including legal costs and attorneys' fees incurred in connection therewith; (b) Consultant will promptly pay any judgment rendered against the City, its officers, agents or employees for any such claims or liabilities arising out of or in connection with the negligent performance of or failure to perform such work, operations or activities of Consultant hereunder; and Consultant agrees to save and hold the City, its officers, agents, and employees harmless therefrom; (c) In the event the City, its officers, agents or employees is made a party to any action or proceeding filed or prosecuted against Consultant for such damages or other claims arising out of or in connection with the negligent performance of or failure to perform the work, operation or activities of Consultant hereunder, Consultant agrees to pay to the City, its officers, agents or employees, any and all costs and expenses incurred by the City, its officers, agents or employees in such action or proceeding, including but not limited to, legal costs and attorneys' fees. Consultant shall incorporate similar indemnity agreements with its subcontractors and if it fails to do so Consultant shall be fully responsible to indemnify City hereunder therefore, and failure of City to monitor compliance with these provisions shall not be a waiver hereof. This indemnification includes claims or liabilities arising from any negligent or wrongful act, error or omission, or reckless or willful misconduct of Consultant in the performance of professional services hereunder. The provisions of this Section do not apply to claims or liabilities occurring as a result of City's sole negligence or willful acts or omissions, but, to the fullest extent permitted by law, shall apply to claims and liabilities resulting in part from City's negligence, except that design professionals' indemnity hereunder shall be limited to claims and liabilities arising out of the negligence, recklessness or willful misconduct of the design professional. ARTICLE 6. RECORDS, REPORTS, AND RELEASE OF INFORMATION 6.1 Records. Consultant shall keep, and require subcontractors to keep, such ledgers, books of accounts, invoices, vouchers, canceled checks, reports, studies or other documents relating to the disbursements charged to City and services performed hereunder (the "books and records"), as shall be necessary to perform the services required by this Agreement and enable the Contract Officer to evaluate the performance of such services. Any and all such documents shall be maintained in accordance with generally accepted accounting principles and shall be complete and detailed. The Contract Officer shall have full and free access to such books and records at all times during normal business hours of City, including the right to inspect, copy, audit and make records and transcripts from such records. Such records shall be maintained for a period of three (3) years following completion of the services hereunder, and the City shall have access to such records in the event any audit is required. In the event of dissolution of Consultant's business, custody of the books and records may be given to City, and access shall be provided by Consultant's successor in interest. Notwithstanding the above, the Consultant shall fully cooperate with the City in providing access to the books and records if a public records request is made and disclosure is required by law including but not limited to the California Public Records Act. 6.2 Reports. Consultant shall periodically prepare and submit to the Contract Officer such reports concerning the performance of the services required by this Agreement as the Contract Officer shall require. Consultant hereby acknowledges that the City is greatly concerned about the cost of work and services to be performed pursuant to this Agreement. For this reason, Consultant agrees that if Consultant becomes aware of any facts, circumstances, techniques, or events that may or will materially increase or decrease the cost of the work or services contemplated herein or, if Consultant is providing design services, the cost of the project being designed, Consultant shall promptly notify the Contract Officer of said fact, circumstance, technique or event and the estimated increased or decreased cost related thereto and, if Consultant is providing design services, the estimated increased or decreased cost estimate for the project being designed. 6.3 Ownership of Documents. All drawings, specifications, maps, designs, photographs, studies, surveys, data, notes, computer files, reports, records, documents and other materials (the "documents and materials") prepared by Consultant, its employees, subcontractors and agents in the performance of this Agreement shall be the property of City and shall be delivered to City upon request of the Contract Officer or upon the termination of this Agreement, and Consultant shall have no claim for further employment or additional compensation as a result of the exercise by City of its full rights of ownership use, reuse, or assignment of the documents and materials hereunder. Any use, reuse or assignment of such completed documents for other projects and/or use of 01203.0006/719158.l EQG DocuSign Envelope ID: A0AF8BA6-6510-4DC2-B2B6-19B104O51798 uncompleted documents without specific written authorization by the Consultant will be at the City's sole risk and without liability to Consultant, and Consultant's guarantee and warranties shall not extend to such use, reuse or assignment. Consultant may retain copies of such documents for its own use. Consultant shall have the right to use the concepts embodied therein. All subcontractors shall provide for assignment to City of any documents or materials prepared by them, and in the event Consultant fails to secure such assignment, Consultant shall indemnify City for all damages resulting therefrom. Moreover, Consultant with respect to any documents and materials that may qualify as "works made for hire" as defined in 17 U.S.C. § 101, such documents and materials are hereby deemed "works made for hire" for the City. 6.4 Confidentiality and Release of Information. (a) All information gained or work product produced by Consultant in performance of this Agreement shall be considered confidential, unless such information is in the public domain or already known to Consultant. Consultant shall not release or disclose any such information or work product to persons or entities other than City without prior written authorization from the Contract Officer. (b) Consultant, its officers, employees, agents or subcontractors, shall not, without prior written authorization from the Contract Officer or unless requested by the City Attorney, voluntarily provide documents, declarations, letters of support, testimony at depositions, response to interrogatories or other information concerning the work performed under this Agreement. Response to a subpoena or court order shall not be considered "voluntary" provided Consultant gives City notice of such court order or subpoena. (c) If Consultant, or any officer, employee, agent or subcontractor of Consultant, provides any information or work product in violation of this Agreement, then City shall have the right to reimbursement and indemnity from Consultant for any damages, costs and fees, including attorney's fees, caused by or incurred as a result of Consultant's conduct. ( d) Consultant shall promptly notify City should Consultant, its officers, employees, agents or subcontractors be served with any summons, complaint, subpoena, notice of deposition, request for documents, interrogatories, request for admissions or other discovery request, court order or subpoena from any party regarding this Agreement and the work performed there under. City retains the right, but has no obligation, to represent Consultant or be present at any deposition, hearing or similar proceeding. Consultant agrees to cooperate fully with City and to provide City with the opportunity to review any response to discovery requests provided by Consultant. However, this right to review any such response does not imply or mean the right by City to control, direct, or rewrite said response. ARTICLE 7. ENFORCEMENT OF AGREEMENT AND TERMINATION 7.1 California Law. This Agreement shall be interpreted, construed and governed both as to validity and to performance of the parties in accordance with the laws of the State of California. Legal actions concerning any dispute, claim or matter arising out of or in relation to this Agreement shall be 01203.0006/719158.1 EQG DocuSign Envelope ID: AOAF8BA6-6510-4DC2-B2B6-19B104O51798 instituted in the Superior Court of the County of Los Angeles, State of California, or any other appropriate court in such county, and Consultant covenants and agrees to submit to the personal jurisdiction of such court in the event of such action. In the event of litigation in a U.S. District Court, venue shall lie exclusively in the Central District of California, in the County of Los Angeles, State of California. 7.2 Disputes; Default. In the event that Consultant is in default under the terms of this Agreement, the City shall not have any obligation or duty to continue compensating Consultant for any work performed after the date of default. Instead, the City may give notice to Consultant of the default and the reasons for the default. The notice shall include the timeframe in which Consultant may cure the default. This timeframe is fifteen (15) days, but may be extended, though not reduced, if circumstances warrant. During the period of time that Consultant is in default, the City shall hold all invoices and shall, when the default is cured, proceed with payment on the invoices. In the alternative, the City may, in its sole discretion, elect to pay some or all of the outstanding invoices during the period of default. If Consultant does not cure the default, the City may take necessary steps to terminate this Agreement under this Article. Any failure on the part of the City to give notice of the Consultant's default shall not be deemed to result in a waiver of the City's legal rights or any rights arising out of any provision of this Agreement. 7.3 Retention of Funds. Consultant hereby authorizes City to deduct from any amount payable to Consultant (whether or not arising out of this Agreement) (i) any amounts the payment of which may be in dispute hereunder or which are necessary to compensate City for any losses, costs, liabilities, or damages suffered by City, and (ii) all amounts for which City may be liable to third parties, by reason of Consultant's acts or omissions in performing or failing to perform Consultant's obligation under this Agreement. In the event that any claim is made by a third party, the amount or validity of which is disputed by Consultant, or any indebtedness shall exist which shall appear to be the basis for a claim of lien, City may withhold from any payment due, without liability for interest because of such withholding, an amount sufficient to cover such claim. The failure of City to exercise such right to deduct or to withhold shall not, however, affect the obligations of the Consultant to insure, indemnify, and protect City as elsewhere provided herein. 7.4 Waiver. Waiver by any party to this Agreement of any term, condition, or covenant of this Agreement shall not constitute a waiver of any other term, condition, or covenant. Waiver by any party of any breach of the provisions of this Agreement shall not constitute a waiver of any other provision or a waiver of any subsequent breach or violation of any provision of this Agreement. Acceptance by City of any work or services by Consultant shall not constitute a waiver of any of the provisions of this Agreement. No delay or omission in the exercise of any right or remedy by a non-defaulting party on any default shall impair such right or remedy or be construed as a waiver. Any waiver by either party of any default must be in writing and shall not be a waiver of any other default concerning the same or any other provision of this Agreement. 01203.0006/719158.l EQG DocuSign Envelope ID: A0AF8BA6-6510-4DC2-B2B6-19B104D51798 7.5 Rights and Remedies are Cumulative. Except with respect to rights and remedies expressly declared to be exclusive in this Agreement, the rights and remedies of the parties are cumulative and the exercise by either party of one or more of such rights or remedies shall not preclude the exercise by it, at the same or different times, of any other rights or remedies for the same default or any other default by the other party. 7.6 Legal Action. In addition to any other rights or remedies, either party may take legal action, in law or in equity, to cure, correct or remedy any default, to recover damages for any default, to compel specific performance of this Agreement, to obtain declaratory or injunctive relief, or to obtain any other remedy consistent with the purposes of this Agreement. Notwithstanding any contrary provision herein, Consultant shall file a statutory claim pursuant to Government Code Sections 905 et seq. and 910 et seq., in order to pursue a legal action under this Agreement. 7.7 Termination Prior to Expiration of Term. This Section shall govern any termination of this Contract except as specifically provided in the following Section for termination for cause. The City reserves the right to terminate this Contract at any time, with or without cause, upon thirty (30) days' written notice to Consultant, except that where termination is due to the fault of the Consultant, the period of notice may be such shorter time as may be determined by the Contract Officer. Upon receipt of any notice of termination, Consultant shall immediately cease all services hereunder except such as may be specifically approved by the Contract Officer. Consultant shall be entitled to compensation for all services rendered prior to the effective date of the notice of termination and for any services authorized by the Contract Officer thereafter in accordance with the Schedule of Compensation or such as may be approved by the Contract Officer, except as provided in Section 7.3. In the event of termination without cause pursuant to this Section, the City need not provide the Consultant with the opportunity to cure pursuant to Section 7.2. 7.8 Termination for Default of Party. If termination is due to the failure of the other Party to fulfill its obligations under this Agreement: (a) City may, after compliance with the provisions of Section 7.2, take over the work and prosecute the same to completion by contract or otherwise, and the Consultant shall be liable to the extent that the total cost for completion of the services required hereunder exceeds the compensation herein stipulated (provided that the City shall use reasonable efforts to mitigate such damages), and City may withhold any payments to the Consultant for the purpose of set-off or partial payment of the amounts owed the City as previously stated. (b) Consultant may, after compliance with the provisions of Section 7.2, terminate the Agreement upon written notice to the City's Contract Officer. Consultant shall be entitled to payment for all work performed up to the date of termination. 01203.0006/719158. l EQG DocuSign Envelope ID: A0AF8BA6-6510-4DC2-B2B6-19B104D51798 7.9 Attorneys' Fees. If either party to this Agreement is required to initiate or defend or made a party to any action or proceeding in any way connected with this Agreement, the prevailing party in such action or proceeding, in addition to any other relief which may be granted, whether legal or equitable, shall be entitled to reasonable attorney's fees. Attorney's fees shall include attorney's fees on any appeal, and in addition a party entitled to attorney's fees shall be entitled to all other reasonable costs for investigating such action, taking depositions and discovery and all other necessary costs the court allows which are incurred in such litigation. All such fees shall be deemed to have accrued on commencement of such action and shall be enforceable whether or not such action is prosecuted to judgment. ARTICLE 8. CITY OFFICERS AND EMPLOYEES: NON-DISCRIMINATION 8.1 Non-liability of City Officers and Employees. No officer or employee of the City shall be personally liable to the Consultant, or any successor in interest, in the event of any default or breach by the City or for any amount which may become due to the Consultant or to its successor, or for breach of any obligation of the terms of this Agreement. 8.2 Conflict of Interest. Consultant covenants that neither it, nor any officer or principal of its firm, has or shall acquire any interest, directly or indirectly, which would conflict in any manner with the interests of City or which would in any way hinder Consultant's performance of services under this Agreement. Consultant further covenants that in the performance of this Agreement, no person having any such interest shall be employed by it as an officer, employee, agent or subcontractor without the express written consent of the Contract Officer. Consultant agrees to at all times avoid conflicts of interest or the appearance of any conflicts of interest with the interests of City in the performance of this Agreement. Should Consultant so employ such unauthorized aliens for the performance of work and/or services covered by this Agreement, and should any liability or sanctions be imposed against City for such use of unauthorized aliens, Consultant hereby agrees to and shall reimburse City for the cost of all such liabilities or sanctions imposed, together with any and all costs, including attorneys' fees, incurred by City. Please review our scope of work provided below to perform the required services for this Project, as well as the following revised fee estimate . Let us know if you have any questions or comments regarding this letter proposal. Project Understand i ng and KOA Approach Our proposed approach involves analyzing the existing conditions and collecting data; developing industry-proven traffic calming countermeasures to address the issues; and working with residents, citizens and the City's Traffic Safety Committee to ensure that these solutions are supported by the community at-large and fit the local context of Rancho Palos Verdes . In addition to conducting on-site field walks, measurements and observations, we will collect speed data and traffic volume counts as a baseline measure in order to justify our ideas and recommendations . Studies to incorporate into the Plan include collision analyses, sight distance studies, ball-bank analyses for curvature speed recommendations, and various "warrant" analyses to determine the appropriateness of certain traffic control devices and traffic calming elements. Ultimately, a set of traffic calming plans will be developed and vetted through multiple outreach meetings with local stakeholders and the Traffic Safety Committee (TSC) for final City Council approval. The traffic calming plans will be prepared for the following locations: • Hawthorne Boulevard between Palos Verdes Drive West and Verde Ridge Road • The Pacific View Neighborhood -Verde Ridge Road and Locklenna Lane • Hawthorne Boulevard at Ravenspur Drive (West/East) • Avenida Classica between Crest Road and Los Verdes Drive; • Fond Du Lac Road between Basswood Avenue and Littlebrow Road; and • La Rotonda Drive between Palos Verdes Drive South and its southwesterly terminus RANCHO PALOS VERDES -DEVELOPMENT OF SIX TRAFFIC CALMING PLANS City of Rancho Palos Verdes Page 1 MC13039 DocuSign Envelope ID: A0AF8BA6-6510-4DC2-B2B6-19B104D51798 2141 W . Speaking for the Pacific View Homeowners Association, we strongly support this study and earnestly request that you approve it. The issue of speeding on our streets, specifically Locklenna Lane and Verde Ridge Road, has been of great neighborhood concern for many years. We have raised it repeatedly with City Councils and staff. These streets are very wide and steeply downhill. Speeding is the natural result. This raises the obvious safety and quality of life issues. One of our periodic outreaches to City staff took place shortly after the arrival of our new, now Public Works Director, Mr. Awwad. He very courteously offered to meet with us to observe the streets. When he arrived, we didn't have to say a word. Based on his extensive previous experience with traffic calming issues, he immediately saw what was happening. We trotted our our list of suggested fixes, but Mr. Awwad said that we needed to do a professional study so that any suggested remedies would have professional credibility with the City Council. So that is at least a partial reason for this proposed study. Mr. Awwad has worked with us to provide interim solutions pending this definitive study. We appreciate it very much. It is very impressive to the neighbors to see that the City is working to address this long standing problem, and clearly reflects well on the image of the City. Again, we deeply appreciate that our City is addressing this long standing problem. We earnestly request that you approve this item. Her acceptance is based on the representation that this is RPV's final cost assessment for its code enforcement action against Ms. DiSanto as described in RPV's Petition for Appointment of Receiver filed against her and the subsequent Abatement Warrant issued against her. The final cost assessment is based on the assumption that Ms. Disanto will correct all code violations serving as the basis for the petition and warrant, a small number of which remain outstanding. It is also based on the assumption that the replacement/repair of the stable will not trigger the need to change the setback requirements for it. In light of this, I will not appear at the June 1 City Council meeting at which the special assessment of $22,264.62 will be voted on by the council members. If I have misstated our understanding, please contact me at your earliest convenience to discuss your concerns. Thank you for your courtesy and cooperation in this matter. Sincerely, Kerry A. For over a month now I have identified several issues relating to the Ladera Linda Park and the Forrestal Reserve Trails. One of the major problems is the unauthorized trail cut from the upper parking lot of Ladera Linda Park to Forrestal by the stairs that leads down to the lower soccer field. This trail has been used by both hikers and soccer players. Recreation and Parks response was to put up signs and temporary plastic fencing which has not stopped the use of the trail. As of this morning, 9 am, the Park Range had already caught someone climbing over the fence. Frankly there needs to be a more substantial fence that cannot be just pushed down. The other problem is dogs off the leash and dog owners not picking up after their dogs. Before Recreation and Parks spends $20 million on a new park they need to solve today's problems. I guess you do not get your name on a plaque or enhance your resume for fixing a fence or figuring out how to stop the trails from becoming a dog toilet. Dear Mayor and City Council Members, I am not happy! You continue to approve a folly rather than a reasonable {cost and design) Neighborhood Park and Activity Building. You say you have listened to the concerns of the Local neighborhood. What have you heard? We wanted a building with compatibly to fit the area and possible future needs of the community. That would require only a limited number of rooms and minimal change in park grounds compared to your design. So is listening to us is accepting a building that: at 252' long is a mere 80' longer than the 172' West Wall of City Hall? at 252' is longer than the 196' wingspan of a 747-100 Intercontinental plane? You do realize that that plane could sit on the roof of the proposed design with little overhang of the nose and tail? at 252' is longer than the 229' length of the Parthenon in Athens? So listening is accepting a cost estimate of $16 million {estimates are already being increased) that equals $2,388 per square foot of the 6,700 square foot functional area of the building? This is the real number and I have seen too many ways staff presents numbers in attempts to deceive your voters. Long ago a City Council decided that the existing buildings needed replaced. You have agreed to a $16 million project for the replacement that has now morphed to cover much more than the compact, single story building they may have imagined. I reject the idea that they wanted something to attract outsiders to the area. So listening is agreeing to creation of a totally new park, that requires denuding the existing area of most vegetation, erasing much of the privacy of neighboring homes, and creating a gigantic eyesore in a barely accessible {compared to other city parks) former school site, drawing more uncontrollable crowds into a congested area, and championing the design as evidence of a Top Notch City Council submission to a Top Ten List of Los Angeles Area Tourist Attractions? So listening is accepting a minisculee parking area compared to existing public demand? 1 So listening is allowing a Recreation and Park management free rein that seems incapable of managing anything as simple as blocking an illegal shortcut path from the existing upper parking lot to Forrestal? Their failures in dealing with Del Cerro is and has been a fiscal and local neighborhood disaster (you could have been there yesterday afternoon to see the crowd of cars and people milling around). R&P continues to establish an empire with a growing army of staff, posts rules that are barely or never enforced, should never have been the RPV staff to manage the park design (it was Public Works responsibility), and are totally out of touch with local residents? So listening is proceeding without alleviating the dangerous traffic situation at Forrestal and PVDS? That is cart before the horse planning. You are planning to spend millions of unnecessary dollars at Ladera Linda that should more appropriately be spent at a new city hall, on a funded plan to effectively monitor the Portuguese Bend Slide before it becomes a disaster, or even spend a minimal amount (comparable to a potential $20 million) to define an approximate cost of a small and more economic Plan B that could at least give an option for your consideration (simply demo the existing buildings, place a single story 5000 square foot building on the same area, repave the parking lots and avoid all the $9 million park and grounds expense you have approved). I am more than disappointed with the actions of City Council and your willingness to avoid a hard decision to start over. You are wasting money and are approving something that has little community support. For some background, the City implemented a periodic humane peafowl trapping and relocation program in 2015 in response to complaints from residents about the growing peafowl population and associated impacts (noise , property damage, etc.). It is not the City's intent to eradicate the peafowl population, but to manage the population at levels 2 identified in 2000 and to educate the public on how to coexist with the birds. This is all in an effort to strike a balance between differing opinions in the City. Every year, the City Council receives a report on the past year's trapping program (if trapping was conducted), as well as a census report for the current year's peafowl population, to determine whether or not to resume trapping . Trapped peafowl are relocated off the Palos Verdes Peninsu la to homes that have been screened by the trapping vendor and reviewed by the City to ensure the individuals adopting the peafowl have some avian experience and have adequate space for peafowl to roam freely. Under no circumstances will the trapped peafowl be euthanized or treated inhumanely. This month, I will have been a resident of Rancho Palos Verdes for 8 years. I wanted to write to implore that you once again pause the peafowl trapping. I live on Sunnyside Ridge Road, where a number of peafowl reside, so I can say that I've experienced the perceived noise, poop, etc. on a daily basis. However, I have also experienced their extreme beauty, their personalities, and their interactions with each other that add to the charm and uniqueness of this special area I'm proud to call home. Although not native to this peninsula, the peafowl have predated most of the residents on the hill. When we were buying our house, we needed to sign a disclosure rider saying we were aware of the peafowl, and we had no problems with them. I love seeing the mothers watch over their new chicks. A few months after I first moved here, someone had hit a peacock with their car, and he was sitting in the middle of the road with a bent tail. There was another peacock with him who would not leave his side. (He did move out of the road after a while and later he was gone; hopefully, he survived.) One can tell that the peafowl obviously interact well with each other and separating them would be cruel. On our street, the people most affected by the peafowl living on their properties have no problem with them being there. (In the past, I've spoken to them about this during our neighborhood socials.) Please continue to keep this area rurally distinctive and pause trapping for at least an additional year. Sincerely, Marcia Luce 310-831-2130 1 1. The email address of the County's "animal care" person I spoke with back in April is: pwebb@animalcare.lacounty.gov This is the person who said I could be cited or even incarcerated, for throwing rocks at any wildlife. Air propelled projectiles are what got the authorities to show up at my doorstep. The Staff Report for Council's consideration for Tuesday June 1 is recommending "continue pausing", "encouraging" public education and deterrent measures. The "census" is a waste of money as in, not at all accurate. Let me know if you want more details about that. Given that some people like destructive and irritating non-native wildlife and some people don't, I think that the City's peafowl trapping program is a great compromise. It took only two weeks to remove 18 peafowl from the garden next to my patio. Since then, my veggies still have to be wrapped in chicken wire but the 24/7 screaming is now only in the distance. I use a child's air pump BB gun to haze any newcomers when they try to roost in my big tree. Each year, a few of the next generation needs to be "educated" but mostly, the screech from opening my sliding screen door is enough to remind them that they are not welcome. 1 1. Raven, ground squirrel and cotton-tail rabbit populations continue to explode producing progressively more damage to other birds, slope integrity and plants, respectively. These particular squirrels appeared only between five and 10 years ago. Coyotes, rats and rattlesnakes appear to populate according to their food supply in an ongoing cycle. I have mentioned before that I see the coyotes coming closer to people's homes because that is where these tasty squirrels have taken up housekeeping. All that leaves is what "deterrent measures" may not be applied by the offended residents. Please let me know what our Mr. P. Webb, CA Fish and Wildlife and the City Codes can agree upon via an "education" piece for the public. That is in your budget, right? Thank you for any clarification you can provide .... S 310-377-8761 PS: Please cover all the "varmints" if there are differences in what may be done to keep them off of one's property. The Fish and Wildlife man said that it was reported that someone on my property was seen shooting crows. There are no crows around here. In a message dated 6/1/202111:23:29 AM Pacific Standard Time, listserv@civicplus.com writes: 2 Peafowl Census Report June 1 Tonight, June 1, the City Council will review the Peafowl Census Report, an annual count of peacocks and peahens in RPV neighborhoods. The City Council will also consider whether to continue to pause the City's humane trapping program in 2021 until a new census is conducted in 2022. The hybrid in-person/virtual meeting will take place at 7 p.m. in McTaggart Hall at Fred Hesse Jr. Community Park and via Zoom with a very limited number of in-person attendees and COVID-19 safety protocols in place. Virtual participation is highly encouraged. The meeting will be live-streamed on the City website and televised on RPVtv Cox 33/Frontier FiOS 38. A staff report for this topic is available on the City website. Please submit your comments to the City Council in advance of the meeting by emailing them to cc@rpvca.gov . If you would like to provide comments during the meeting or leave a pre-recorded voice message, please complete a form at rpvca.gov/participate . For some background, the City implemented a periodic humane peafowl trapping and relocation program in 2015 in response to complaints from residents about the growing peafowl population and associated impacts (noise, property damage, etc.). It is not the City's intent to eradicate the peafowl population, but to manage the population at levels 3 identified in 2000 and to educate the public on how to coexist with the birds. This is all in an effort to strike a balance between differing opinions in the City. Every year, the City Council receives a report on the past year's trapping program (if trapping was conducted), as well as a census report for the current year's peafowl population, to determine whether or not to resume trapping. Trapped peafowl are relocated off the Palos Verdes Peninsula to homes that have been screened by the trapping vendor and reviewed by the City to ensure the individuals adopting the peafowl have some avian experience and have adequate space for peafowl to roam freely. Under no circumstances will the trapped peafowl be euthanized or treated inhumanely. There are already few left on the hill. In my area in Los Verdes, I have exactly one full grown male, and a young male and a couple of females. These birds are one of the reasons I love this neighborhood. It makes us a charming place to live and brings up the property values. They have done no damage to my property. I got a new roof 8 years ago. When I had a leak a year ago and called a roofer out, he said it was due to a nail in the skylight, and the roof looked brand new. And that is with peafowl occasionally walking on it. Their feces is much easier to clean than any other animal. You spray it off with a hose. They call each other at night, but to me, after all these years, it is a relaxing sound. Why allow new people to move into our neighborhood and the peafowl's neighborhood and try to change it. They can move elsewhere and leave it for people who love it up here. Please leave them ALONE and work on things that need to be worked on, including people spreading hatred of human beings! The last raccoon was in 2014, and years since a possum or skunk. But I have seen coyotes and I know they must eat. At this moment, I wish to thank the Mayor & City Council for trying so hard to keeping my view of hikers and their cars at a minimum. I worked in Pasadena & Arcadia area for many years. They live with & love their peafowl. They have a brochure realtors pass out to potential home buyers. Let's become more "animal" positive. Let us remember they kill rattlesnakes & are part of the beauty of our Peninsula .. Let's learn the deterrents like cayenne pepper or freshly ground black pepper, mothballs, they dislike dogs, water spraying or automatic sprinklers. Let's stop trapping, or threatening to start up again. Peafowl have been here on the Peninsula far longer than any of us. Yes, I'm a septuagenarian and love the Peninsula. I do not understand folks who buy near a horse trail or neighborhood where it "smells like horses" or folks that hate the peafowls cries. Let's require real estate folks to tell folks about things they may not have thought about. Sometimes I get annoyed when new neighbors move in & their children are screaming for hours while having fun (maybe I've just gotten old, or more likely it's that I'm jealous of their energy),but it's life and one learns to adapt. Why not put a few peafowl in our Portuguese Bend Preserve ........ wouldn't hurt for them to kill some rattlers plus, 1 1. I'm sure many hikers have never seen one unless on TV or in the zoo. I would love to hear their cries and view their beauty again ...... 17 years without is a long time, but I do remember so very fondly the 31 years of having peafowl and proud to tell my visitors that's not a baby crying, those are peafowl. People that live by airports must expect noise. People that live in the desert must expect heat. People in RPV must expect peafowl. They come with the neighborhood. What is next? I don't like horses, so should we get rid of all the horses? They poop on the ground and make noise. No, horses are part of the charm of the city and if people don't like them, they are free to move. The wild parrots we have in the neighborhood now make a lot of noise, but I love them and feel blessed to watch these beautiful birds circle our house. How blessed we all are to have these exotic birds in the neighborhood! Peafowl already have a hard life between the dogs, cars, and coyotes. What is the survival rate after the city traps these birds? If the city wants to continue to trap them, they should remove the peacock emblem from all the city trucks and logos, and websites. If the city choses to be hostile to peafowl, lets not be hypocrites. I encourage you to spend the city's money somewhere else that will make life better for the residents and not use the money to erase an important part of the city's identity and history. Mr Vanderlip would not be amused. I would tell you what street we live on, but I am afraid you would come and trap the beautiful peafowl family. Thank you for your time and consideration. I have known Ken for many years, and greatly admire him for all that he has done for the City of Rancho Palos Verdes. I first met him in 1973, when he was working diligently to incorporate this great city, and have followed his civic and volunteer career all these years. I have supported him in elections, and know his volunteer works at our church. I admire him as a wonderful family man, church member, and civic volunteer. His number of service hours and love of this city is unmatched! As a founding father who worked so diligently to incorporate RPV, I cannot imagine any other person who deserves the honor of having City Hall named in his honor more than Ken Dyda. Good afternoon, RPV council members, I heard the proposal to rename PVIC after Councilmember Dyda at the last meeting, and would like to humbly request that you reconsider renaming the park. While I understand your desire to honor a founding member of RPV and a loyal servant over the decades, I do not think renaming RPV's flagship park after Councilmember Dyda is appropriate. Point Vicente Interpretive Center has a long history in the community, is iconic, and known worldwide under its' current name. Those of us who have donated to it throughout the years fondly refer to it as PVIC. (I personally have donated five times -for a whale honoring the passing of two family members that lived up by Ryan Park, three bricks, two of which were for my family members that were married at PVIC, one honoring my son's birth, and most recently a plaque honoring my mother who loved Palos Verdes during her time raising me there where my first job was working for the original Discovery Room at Ladera Linda, and again when I lived there as an adult raising my own family who attended Portuguese Bend Nursery School and Lunada Bay Elementary School.). For the simple reason that KDIC is not a good acronym and that those of us have donated prodigiously through the years wish to continue to have fond associations with the name and the park, I ask you to reconsider. There are, in fact, many lovely alternatives that I believe would be more supported and less laughed at due to the unfortunate acronym, KDIC, renaming the park would create, including renaming the sunset room at PVIC for Councilmember Dyda or the park near his home after him. I can only imagine that Councilmember Dyda would not was his park to be laughed at when people pronounced the acronym for the park, and neither do I want that. No doubt staff could come up with an even more robust list, if asked. Thank you for your thoughtful reconsideration of this proposal before the council. I look forward to hearing that the council will find another wonderful place to honor Councilmember Dyda, as I do appreciate the history and viewpoint he brings to council meetings. As for the location, it should be extra special and something that would warm his heart. If Point Vicente is selected, then perhaps we could combine the history of the location which was named by Captain Vancouver when he mapped the West Coast and the modern facility that exists today. For example, the Ken Dyda Park and Museum at Point Vicente. (To me, Interpretive Center is generic and museum would be new and broader in scope.) As far as the whale watching maps are concerned, the historic identification could stay and add to the importance of the park. Los Serenos could keep their name. We could honor one great explorer and one great modern day leader at the same time. It would be like Terranea is at Long Point. Just a thought. I am sure City Council will go over all the options and make a decision worthy of the man they wish to honor. TO THE RPV CITY COUNCIL. I understand that several venues are being considered to honor Mr. Ken Dyda for the contributions he has made to the city over the years. I have been a docent at Pt. Vicente since 1984 and was the first president of Los Serenos de Pt. Vicente. Throughout this time the Center has been close to my heart. Since the opening it has been named Point Vicente Interpretive Center, which has both a sense of place and purpose. This name is used in all the guide books and tourist information and feel it would be inappropriate to change that. Your reference documents state that there should be a well-defined connection between the contributions of the individual or community organization and the city facility, and that is not the case here. Mr. Dyda has been associated with the Historical Society but not with the Interpretive Center. I do hope you will find a more appropriate method to honor Mr. Dyda. Mayor-Pro-Tern-David-Bradley and City Council, I do not believe nor do I support re-naming the Point Vicente Interpretive Center in honor of Councilman Dyda. In all due respect to his civic accomplishments and contributions he does not meet any of the conditions listed in Agenda Item No. 10 (as you had mentioned), nor is there any well-defined connection to the Point Vicente Interpretive Center, including the Sunset Room or a Wall of Honor. Yes, he has been involved in many city activities, contributions and organizations, such as the RPV Historical Society, but NOT PVIC. With all the listed options mentioned it is more appropriate to consider the following recommendations regarding a tribute to Councilmember Dyda's contributions .. 1. City Hall and/or Upper Point Vicente/Civic Center. It would behoove to include this tribute and respect within the City's Civic Center Master Plan where the City would be able to locate a site on this 1 7-acre property that offers spectacular ocean views from multiple locations and includes the current City Hall complex. I believe and feel such recommendation would be "particularly appropriate given his contribution to the founding of Rancho Palos Verdes and his decades-long involvement in Citv Government, " as well as informative to the public especially on a ceremonial opening day. 2. Grandview Park: This 18-acre, open space park offers beautiful views and informal walking trails. It is located near Councilmember Dyda's long-time home. In summary, please consider these thoughts and the contributions of any nominee to a particular facility when the city wants to rename it in honor of that person. Please also consider to include this when implementing a formal policy or guidelines .. "The City of Rancho Palos Verdes has lacked a uniform policy to assist the City Council and to guide staff in the naming of City facilities, including parks and open space areas, buildings, streets and other public amenities. In addition, there have been no formal policies or guidelines for honoring City leaders, nor for memorializing persons whose loved ones simply want to provide a remembrance in the form of a bench or tree. " Respectfully Submitted, Vu;wie,'R~ Rancho Palos Verdes Enyssa Momoli From: Sent: To: Subject: Larry <larry@maizlish.com> Sunday, May 30, 2021 9:59 AM CC; CityClerk CC Meeting 6/1/21 -Item 10 Hi Council and Staff. Please see comments below regarding Agenda Item 10. Naming a City facility after a person who is still living is prohibited as per our City policy. I'm not a fan of making exceptions to policies of this type as it might set a precedent for the future and who knows what would happen 10 -20 years from now. A future City Council could say "well we've done that in the recent past, so lets make another exception to the policy.' That being said, if there was ever a worthwhile opportunity for us to make an exception to this naming policy, this would be it. Ken Dyda has been actively shaping and supporting the community and our city since I was a little kid here. Not meaning to date Councilman Dyda, I recall my family meeting with him when I was in my early schooling here in PV and the idea of city incorporation was being discussed. Ever since that time, he has been a very active person in developing, supporting, and maintaining the City of Rancho Palos Verdes. In this particular case, I would support making an exception to our remaining policy guidelines and naming a facility after Mr. Dyda. Out of the possible choices listed in the Staff report, I would support naming the PVIC after him. Instead of an individual room there, I would support the naming of the whole facility after him. No one in our current generation here in the City is more deserving of this than him. Let's move ahead on this, take advantage of this opportunity, and honor his decades of contributions to our city. Dear Council Members It has been brought to my attention that you are considering renaming the Point Vicente Interpretive Center. I think that this is a big mistake. When we received money to build the building, it was stated that the name must include "Interpretive Center", which the City agreed to. The name gives the location fo the Center. A persons name and Interpretive Center would be confusing as we are not interpreting them. You are running out of locations to name after outstanding community members. A while back, there was a suggestion to building a wall or series of pillars at the Center to be used to salute these outstanding community members. It was suggested that it be put across the parking lot from the entrance. It is a good idea, why not do that. You could honor many more people that way, now and into the future. It is a very special place and popular with the public. It took awhile for people to understand what we were, but now it is clear. I was the first Docent Coordinator and Curator at the Center and worked there for 32 years. I was hired in1983 by the City, a year before the Center opened. I retired in 2015. Please consider the above and leave the name alone. Sincerely, Diana Ryan McIntyre 732 Cloyden Rd. Palos Verdes Estates, CA 90274 mothermac@mac.com 1 \\J .
