A RESOLUTION OF THE CITY COUNCIL OF CITY OF
RANCHO PALOS VERDES, CALIFORNIA,
ESTABLISHING PARKING RESTRICTION BETWEEN
THE HOURS OF 7:30 A.M. AND 3:30 P.M., ON SCHOOL
DAYS ONLY, ON A PORTION OF THE SOUTH SIDE OF
DIVERSEY DRIVE TO CREATE A STUDENT LOADING
ZONE AT SILVER SPUR ELEMENTARY SCHOOL
WHEREAS, the City of Rancho Palos Verdes is a general law City located in
the County of Los Angeles, State of California; and
WHEREAS, California Vehicle Code ("CVC") Section 22507(a) provides that
local authorities may, by ordinance or resolution, prohibit or restrict the stopping,
parking, or standing of vehicles on certain streets or highways, or portions thereof,
during all or certain hours of the day, and that, with the exception of alleys, the
ordinance or resolution shall not apply until signs or markings giving adequate notice
thereof have been placed; and
WHEREAS, Silver Spur Elementary School, located 'at 5500 Ironwood Street
in the City of Rancho Palos Verdes, has its main student access on Basswood
Avenue, with an additional pick-up and drop-off entrance on Diversey Drive 430 feet
west of the intersection with Basswood Avenue; and
WHEREAS, the City currently allows day-time and night-time street parking
along the south side of Diversey; and
WHEREAS, the City has recently experienced a number of complaints about
significant congestionand other public health, safety, and welfare issues related to
access to and from Silver Spur Elementary School, including limited access for
student pick-up and drop-off; and
WHEREAS, Silver Spur Elementary School hosts both summer school
programs as well as summer day camps for students between the months of June
and August and also seeks to provide the same traffic safety protections for students
attending summer programs as those attending school during the calendar school
year; and
WHEREAS, the City Council desires to prohibit parking along the south side
of Diversey Drive within 430 feet of the intersection of Basswood Avenue and
Diversey Drive during school hours from 7:30am-3:30pm on an annual basis in order
to prevent such impacts, mitigate traffic, and protect the public health, safety, and
welfare.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS
FOLLOWS:
Section 1. The foregoing recitals are true and correct, and are incorporated
herein by reference.
Section 2. The City Council hereby prohibits parking along the south side of
Diversey Drive for 430 feet west of the intersection with Basswood Avenue during
school hours, which are from 7:30am-3:30pm, Monday through Friday, excluding
school holidays.
Section 3. In accordance with Vehicle Code Section 22507, the parking
restrictions pursuant to Section 2 shall not apply until signs or markings giving
adequate notice of the restrictions have been placed. The City Manager, or his or her
designee, shall cause the placement of signs along Diversey Drive and Basswood
Avenue, from the designated drop off and pick up area on Diversey Drive 430 feet
west of the intersection, in such locations as necessary to give adequate notice of
the restrictions, as soon as practicable after the adoption of this ordinance.
Section 4. This resolution shall take effect immediately.
Section 5. If any section, subsection, subdivision, sentence, clause, phrase, or
portion of this resolution is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect the validity
of the remainder of this resolution. The City Council hereby declares that it would have
adopted this resolution, and each and every section, subsection, subdivision, sentence,
clause, phrase, or portion thereof, irrespective of the fact that any one or more sections,
subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared
invalid or unconstitutional.
Section 6. The City Clerk shall certify to the passage, approval, and adoption
of this resolution, and shall cause this resolution and its certification to be entered in
the Book of Resolutions of the City Council of the City.
Section 7. The adoption of this resolution does not constitute a "project" within
the meaning of Section 15378 of the California Environmental Quality Act (CEQA)
Guidelines, as the parking restrictions do not have the potential for resulting in either
a direct physical change to the environment, or a reasonable foreseeable indirect
physical-change in the environment. Therefore, this resolution is not subject to CEQA.
